More killings feared as Kibaki vows new Mungiki war

President Mwai Kibaki has vowed to crack down on the Mungiki sect even as torture and disappearances undermine ongoing government efforts of eradicating the sect.


The President is enraged by the killings of at least 10 people in his parliamentary constituency. The dead are believed to have been executed by Mungiki adherents, who are known for demanding protection fees from retail business, land owners and transport operators across Central Kenya, Nairobi and parts of the Rift Valley.

Since June 2007, at least 600 youths have been killed for alleged involvement with Mungiki. Scores of others have simply vanished after they were arrested.

Survivors and civil society accuse the Kenya Police for the deaths and disappearances, a claim the police Commissioner has denied several times. However, former internal security minister, John Michuki, was quoted last year saying that funerals of Mungiki youth would become a common occurrence.

Mungiki is an underground movement among the Kikuyu ethnic group, drawing its membership from youths in squatter settlements and urban slums. The group advocates a return to Kikuyu traditional customs saying that modernity has failed to ease human suffering.

Mungiki leader, Maina Njenga, is serving a jail sentence for drugs and weapons possession but the sect describes the charges as a fabrication meant to curtail its activities.

Njenga began Mungiki in the mid 1980s in the Rift Valley province. His movement grew in numbers in the 1990s following clashes inflicted on the Kikuyu by forces loyal to President Daniel arap Moi.

The 1990s were a period of rapid economic liberalization in Kenya coupled with globalization, resulting in massive unemployment coupled with the loss of societal values. Rising crime and crumbling state authority added to the difficulties.

Within the shanties of the Kikuyu homeland and the capital city Nairobi, Mungiki restored order and provided basic social services in exchange for protection fees by households and businesses. By the early 2000s, Mungiki membership was estimated at over 1 million.

Since then, the Kenyan government has worried over the motives of Mungiki and sees the sect as a threat. Sections of the government are convinced that Mungiki’s goal is to capture power through its political wing, the Kenya National Youth Alliance.

Mungiki is not a movement of angels either. Dozens of people have been killed by the sect for either exposing the group’s secrets or refusing to pay protection fees. Mungiki does not allow revocation of membership and recruitment procedures are rather nasty.

Whereas President Moi kept the group in check through negotiation, his successor President Mwai Kibaki has pursued a hardline stance. Ironically, Kibaki is also a Kikuyu whereas Moi was not.

Being a phenomenon of the underclass, Mungiki does not enjoy the complete loyalty of the Kikuyu. Majority of upper and middle class Kikuyu support Kibaki’s crackdown against Mungiki, leading many social commentators to draw similarities with the Mau Mau war of the 1950s. Like Mungiki, Mau Mau drew its membership from the poor whereas the educated Kikuyu working for the colonial government opposed it.


Incidentally, John Michuki, the man who predicted Mungiki funerals in 2007 worked as a colonial administrator in the 1950s where he was tough against Mau Mau. Its worth noting that Mungiki draws its inspiration from the Mau Mau rebellion.

The rest of Kenya’s ethnic groups fear Mungiki and support the government’s campaign despite the violations of human rights. With Mungiki’s membership being exclusively Kikuyu, the rest of Kenya’s tribes see the group as an ethnic militia championing Kikuyu interests.

Consequently, there has been little condemnation of the government from the rest of the population. However, this apathy may change as the Kenyan government spreads its tactics to other parts of Kenya.

Security operations in Mount Elgon and the Somali border have been marred by similar allegations of torture, death and disappearances. It may seem as though the Kenyan government is adopting tactics last seen in Latin America back in the 1970s.
Perhaps, Kenyan leaders and security chiefs should familiarize themselves with ongoing legal procedures in Latin America. More than 30 years after the era of leftist groups and right wing paramilitaries (usually backed by military governments), trials are currently underway for those responsible for the disappearances.

FORMER Cabinet minister Ignati us Ngenye Kariuki yesterday took issue with the Government and the Minister for Internal Security John Michuki over the recent extra judicial killings of suspected members of the proscribed Mungiki sect.

The former Kiharu legislator pointed out that in the recent past a worrying trend of gunning down of alleged Mungiki operatives has been observed in the country.

He accused minister Michuki, of issuing dictatorial orders to the police who were exterminating innocent people.

He said every Kenyan has a right to be accorded fair trial in court of law but not to be subjected to extra judicial punishment.

Kariuki made the remarks while addressing bout 400 community leaders who had gathered at his Murang'a town home. During the meeting, he accepted to contest for the Kiharu parliamentary seat, which he lost in 2002 to the incumbent James Kembi Gitura.

Kariuki, one of the top stock brokers and investment consultant in the country, said he was prevailed upon to run for the seat by Kiharu residents.

He claimed that police and provincial administration in Murang'a region were harassing local young men in the guise of flushing out Mungiki adherents. The former minister further claimed that about 30 young men were massacred in cold blood a few months ago by the police when they were allegedly found in a hideout taking oath to abide to the sect.

The incident occurred at Gikui village in Iyego location, Kangema Constituency. Five school children were among those killed in the ill-fated Mungiki oathing ceremony.

Speaking to the' leaders, he claimed that the current political leadership had failed to champion the rights and interests of the residents. A member of the Constituency Development Fund (CDF) committee Edwin Matiba called for the auditing of the kitty.

He alleged that the fund was used in a suspicious way and that the area Member of Parliament Kembi Gitura had protected those embezzling the public fund.

At the same time, Kariuki observed that senior politicians from Mount Kenya region had failed to effectively campaign for the re-election of President Mwai Kibaki.

He said the leaders most of them in the Government have so far displayed arrogance which has thwarted efforts and plans to roll out campaign strategies for Kibaki re-election. He said proper plans should be put in place to manage Kibaki's campaign machinery without further infighting.

Human rights campaigners in Kenya have accused police of carrying out hundreds of extrajudicial executions during an operation against the Mungiki criminal sect.


The Kenya National Commission on Human Rights (KNHCR), an independent body set up by an act of Parliament, says it has evidence that almost 500 suspects were shot and their bodies dumped during the past five months. Researchers have spent three months collecting the data from mortuaries as relatives came forward claiming that their loved ones had disappeared.

A police spokesman dismissed the allegations as nothing more than "rumors." However, Maina Kiai, director of the KNHCR, said police had yet to explain how hundreds of bodies had been delivered by police vehicle to mortuaries, yet the force had denied any involvement in the deaths. "Killing about 500 people without due process is a crime against humanity," Kiai told reporters in Nairobi as he presented his organization's report on the killings. "We want police to tell us how those 500 people ended up in the mortuary between June and October. The burden of proof lies with the police."

His report said the deaths were clinical killings. "Almost all the cadavers bear classic execution signs of a bullet behind the head exiting through the forehead," it said. The Mungiki (meaning multitude in the Kikuyu language) draw their inspiration from the Mau Mau guerrillas who rose against British colonial rule in the 1950s. They began in the 1980s as a quasi-religious movement to rid Kenya of cultural imperialism and return the country to its African traditions. Followers were believed to face Mount Kenya to pray and many grew their hair into dreadlocks.

But in recent years, analysts say, it has fragmented into a network of distinct organizations. Some are little more than gangster outfits — running protection rackets in the slums and collecting "taxes" from buses — while others have political programs or continue as a shadowy religious order. They are bound together by a secret oath often taken under duress. One former adherent said it was designed to humiliate the recruit and ensure his silence. "You are forced to eat some meat — you don't know what, maybe it is human meat — and all the time they are beating you," he said.

In recent years, the Mungiki have retreated into their slum strongholds of Nairobi. But they hit the headlines in April with a string of beheadings as they tussled for control of lucrative bus routes by executing drivers and conductors who refused to pay protection money. Analysts speculated that the Mungiki were also flexing their muscles ahead of elections due next month. Brutal police crackdowns began in June after officers were shot dead in a slum as they investigated Mungiki violence. Young men shaved off their dreadlocks or fled the city for fear of being caught up in the arrests.

Thirty people died in shootouts with police in the Mathare slum in Nairobi during a two-day operation in early June that was later condemned by Amnesty International. In all, officers said they had rounded up 4,000 suspects. Kiai said he now had evidence that 454 bodies had been abandoned in Nairobi's mortuaries. Others, he said, were found in towns further afield or simply dumped in forests. Eric Kiraithe, spokesman for Kenya Police, denied the allegations. He claimed many of the bodies were victims of traffic accidents or gang warfare. "Who was there to say the victims were shot from behind and the bullets exited in front? These are reports aimed at maligning the force and individuals," he said.

FIRST ICC CASE MAKE AFRICAN LEADERS FACE THE MUSIC

Kinshasa/Nairobi - Confirming the charges against a suspected Congolese war criminal in the International Criminal Court's (ICC) first case could call into question a culture of impunity in Africa, making the continent's leaders think twice before they commit any atrocities.

The ICC confirmed charges on Monday that Congolese rebel leader Thomas Lubanga Dyilo used child soldiers in the north-eastern Ituri region of war-torn Democratic Republic of Congo (DRC).

This decision paved the way for the court's first case since its creation in 2001, the outcome of which will set a major precedent for international law.

'Many African leaders are aware of what the ICC might be capable of now. It will deter some leaders from engaging in horrendous acts,' said Wafula Okumu, head of the African security analysis programme at the South Africa-based Institute for Security Studies.

As it stands, some of the continent's most violent rulers have been granted asylum by neighbouring African countries, far away from any form of prosecution. Former Ethiopian dictator Mengistu Haile Mariam, who was tried in absentia for war crimes committed during his reign, lives sheltered in Zimbabwe.

Senegal granted asylum to Chad's repressive former leader Hissene Habre and the African Union summit this week is expected to come to a decision about his legal fate.

Already, former Liberian leader Charles Taylor, who was sheltered by Nigeria's government, is to be tried by a hybrid court for atrocities he committed in his country and neighbouring Sierra Leone.

'The long arm of international law caught up with him. He will face the music of international law,' Okumu said.

But despite the precedent this first case is to set, the ICC's relationship with Africa is likely to remain bumpy.

Cultural differences in Africa have shown that international justice is not necessarily what all Africans want.

In Uganda, victims of Joseph Kony's brutal 20-year insurgency have called for peace before justice. The ICC has indicted the elusive rebel leader, but many Ugandans have said this means nothing to them.

Meanwhile, in the Lubanga case, activists have been pushing for tougher charges.

'The charges need to be broadened. Why has he not been charged with murder?' asked Anneke Van Woudenberg, senior Africa researcher for Human Rights Watch. The charges against Lubanga have centred around his recruitment of child soldiers.

What is more, African leaders are hesitant to put themselves at risk of international prosecution and may seek to deal with breaches of international law in a regional setting, Okumu said.

'Leaders fear this might set a precedent. If African leaders are tried outside the continent, some leaders fear it might open a Pandora's box. They want to solve problems in Africa,' he said.

The best alternative is to allow for an international criminal court of justice to do its work,' said Okumu.

Kibaki knew that and that is why Martha Karua was on BBC saying that US was jealous of Kibaki's relationship with China( note that i mentioned kibaki not Kenya relationship- because Kenya has it's owners that is the people of kenya) Bush already signed off Kibaki for Prosecution in 2008- lets not try to cover that up like you are trying to on here..
Kibaki stopped being an asset to Bush and that means he is on his own..
