Kibaki is the sworn-in, thus legal new president and office-holder. He may have acquired this office illegitimately (due to obviously rigged elections), but until an election petition is eventually heard and decided, or until he resigns (hopefully) and new elections are set up, he will remain the legal president.
Also, he has not invoked special powers under the Public Security Act, so he is not a dictator yet, either.

All TV and Radio Stations in Kenya have been shut down and now the Kenyan military have been let loose on an unarmed Kenyans. If that is not the "President" invoking special powers under the Public Security Act, then I do not understand you! Kenya is literally a police state Sir!!! You are of zero help to Kenyans at this time; you are better off sticking to your Germans and leaving Kenyan affairs to Kenyans, if you really happen to be German as they say!
