Secret cables sent by US Ambassador, Michael Ranneberger, to Washington and now released by WikiLeaks allege Raila wanted to create confusion when he said he was suspending Ruto and Education Minister Sam Ongeri. It claims Raila wanted public debate to focus on the two, and not his family’s role in the scandal. Ranneberger also gives an unflattering assessment of the PM, whom he says is increasingly being perceived as "unable or unwilling to govern effectively and move forward the reform agenda". Behind the scenes One of the cables reveals the behind-the-scenes pushing and shoving that culminated in Raila ‘suspending’ the two ministers, over the affair. However, the US believed Raila took the action not only because he wanted to be seen as fighting corruption, but to divert attention from his family’s involvement in the maize scandal. The maize and education scandals came to light in January 2009. The following month, Kibaki suspended key officials in the Agriculture and Education ministries, a day before Raila announced he was sending the ministers home. "We have credible reports that members of Odinga’s family, presumably with his knowledge and/or involvement, were involved in the maize scandal. Thus, at the time he made his dramatic February 14 statements, Odinga was facing serious pressures on both the corruption and constitutional review issues," wrote Ranneberger. The cable at the beginning says the family of President Kibaki was also involved in the maize scandal. Ongeri’s ministry was being probed over the disappearance of millions of shillings meant for free education programme. The envoy continued: "It seems highly possible that Odinga made the announcement regarding Ongeri and Ruto knowing that it would cause a huge political and constitutional flap, and thusa divert focus on both the corruption and constitutional review issues. Alternatively, Odinga may have miscalculated that he could ‘roll’ Kibaki to go along with his actions because Kibaki would not want to be seen as supporting ministers tainted by corruption." The embassy attributed claims of corruption by the President’s and the Prime Minister’s families to "multiple sources". Two senior officials in the Prime Minister’s Office – PS, Mohamed Isahakia and Chief of Staff Caroli Omondi – resigned a day before Raila attempted to suspend the ministers. However, Kibaki immediately issued a statement revoking Raila’s action, saying the Prime Minister does not have any powers to suspend ministers. Raila issued another statement the following day, insisting the National Accord, which created the Coalition Government, gave him such powers. Pursuant to consultation But according to the cable, "the legal authorities are not completely clear. While Kibaki has the constitutional power to appoint ministers, the National Accord states that ministerial appointments and removals shall be made pursuant to consultation between the Coalition partners." The cable reveals the fierce competition between Raila and Kibaki, who both wanted to be seen as anti-corruption champions. This happened at a time of deep differences over the constitutional review and the scandals, which posed one of the most serious threats to the PNU-ODM partnership. "Kibaki, like Odinga, also wants to be seen as spearheading anti-corruption actions, so one-upsmanship is at play. Members of Kibaki’s family may be involved in these or other corruption scandals. Kibaki may have calculated that sacrificing senior-level personnel short of ministers would be enough to placate the public," says the cable, referring to the suspension of officers in the ministries. "At the same time, Kibaki is likely to have been urged by Uhuru Kenyatta not to take action against Ruto since the two are working closely together, possibly with a view toward the 2012 presidential election." On Raila’s leadership, the ambassador says there is increasing disillusionment in the ODM camp, although he says critics’ views that he is in a weakened position are "wishful thinking". Writes Ranneberger: "The ODM seems both directionless and less united than before." Openly hostile He wrote that Ruto "has been openly hostile to Odinga and is working closely with the Kibaki side, so Kibaki has an interest in protecting Ruto. The corruption within the Ministry of Education likely reaches very senior levels on Kibaki’s side." The cable also reveals Ranneberger’s concerns over delays to the constitution-making process, after Raila raised objections to contentious issues that had been agreed on in the Naivasha meetings. Raila was opposed to a presidential system of government as agreed upon by a parliamentary select committee, in which his party and interests were represented. It says on February 12, soon after the agreement was clinched, the US Embassy learnt that Raila had held a meeting with advisers on renegotiating provisions on the contentious issues. When Ranneberger called Raila, he confirmed this was the case, saying the PSC had exceeded its mandate. "How could Odinga walk away from the agreement when Odinga’s top people are in the PSC and participated in the meetings under instructions from Odinga?" the Ambassador asked. "Odinga had no response to this, but nevertheless insisted that key provisions must be reopened," continues the cable. Ranneberger warned that the differences were causing ethnic tension, which could give rise to violence. He says: "Ruto certainly sees that as an option. Odinga knows that he does not have the votes in Parliament to support his actions (given that Ruto can control at least 12 or so MPs), and, therefore, may be tempted to see fomenting public unrest as his only option."

Owuor The maize scandal was investigated by both the KACC and PriceWaterHouseCoopers'. KACC was so quick to clear everyone and it was only after the release of PwhC report, which incidentally was commissioned by the PM himself, that heads started rolling including those of senior officers at the OPM. That does not sound to me like someone who was trying to cover-up his family's involvement in the scam. There were numerous other names mentioned and some of those have already been cleared and resumed work. Remember Kibaki only suspended the PS's after Raila's own officers tendered their resignations. It was never the president's intention to suspend or sack anyone until the action by the PM. We all know why these stories have now come up. And from your perspective, you are making it sound as if it is illegal for a member of Odinga's family to trade or run a business in this country. I would be willing to listen to you if you could point out to me which of the private businesses that bought maize from NCPB were ever charged and convicted in court for doing anything illegal. Fidel Odinga, like his father and grandfather before him, is an astute businessman. He is within his rights to run a business and trade in all manner of things. I do not see anything corrupt or illegal in that. If he went to NCPB and he bought maize on the basis of willing buyer-willing seller arrangement, what is wrong with that? When all is said and done, what prevented William Ruto, the then Minister for Agriculture from stopping NCPB selling subsidized maize to private businessmen instead of producing cheap unga for the masses? The buck must stop somewhere and it can only be at the minister's doorstep. Let Bw Ruto also tell us under what circumstances an insurance company and a logistics company that he owns also got some maize to sell, and if it is not an outright violation of the law for a public officer to trade with the government while still serving in the same government. I still maintain, a story does not become true simply because Ranneberger said so. It does not become a fact because it has come from wikileaks. We have our own way of interrogating events and separating the truth from cheap political propaganda.

Phil Good admission that Fidel was involved in the maize scandal. I do not want to discuss this young man because his past of drug dealings and theft that had him kicked out of the USA is a matter of public knowledge. I dont expect him to have taken a 'saul paul' conversion just because his father is a PM. Diverting attention away from the public is a trick that politicians world over have used for centuries for their own selfish ends. When people suspect your popularity is slipping in the polls, you are losing local elections and a huge chunk of your MPs are against you, you quickly divert attention and claim your life is in danger from two Israeli Mossad hit-men!
The same leaks claim Kibaki's family was involved in the maize scam which could be true considering Mary Wambui's appetite for hard cash. But at least the Kibaki's know how to eat quietly without any sideshows or even blinking to try and divert attention no matter the amount of noise we make. The truth is that both sides of the coalition are deep in corruption right up to their eye balls.
Raila's other hypocrisy and distraction is constantly labelling Uhuru an alcoholic and a bhang smoker although he uses a coded language to say this. We are all grown ups, we know who he means when he stoops that low.
Raila should openly tell Kenyans if alcoholism has ever affected a member of his own family and if that person was admitted into a South African Rehab for months. I don't know whether Uhuru is an alcoholic but isn't alcoholism a disease for anyone to gloat about just for political mileage?
Uhuru himself has also been hammer and tongs against the PM calling him all sorts of childish names like Kimundu which means in Swahili Kimtu hiki.. among other matusis. Our siasa has sunk this low good people when we have millions living in abject poverty while our so called leaders pull mega scams.
Such is the hypocrisy our leaders live in and we have to call it out whenever we see it.

My theories based on "IFs" are only to challenge your partisan logic in the attempt to defend the "safi kama pamba" rhetoric. You are just about to loop this discussion back into a circle. If a Wikileaks disclosure that threatens to taint Raila has to be trashed on the bases that Raila has not been arraigned in court, what about all the offenses alleged against Moi, Kenyatta and others that have had the power to eat the "mkate"? Should Kenya apologize for defamation?

I think the current lame duck P.O.R.K has lots of skeletons in his closet, for which he actually did sign some papers, be it Ken Ren the factory that never was (as kiraitu would say) or Halal meat, or the massacre in Wagallah. These he has direct input. His buddies then pulled of AF scandal (that never was yet monies were being returned and Githongo urged to ngo srow), CID labs to mention just a few. And the most infamous of all was his stealing of the 2007 elections, and then having his buddies kill innocent Kenyans, who were only asking to be left alone and congregate and protest to as per their god given rights. Is there a more despicable human being? I doubt This is a man who we dont know exactly what happened to his OWN father, this is a man who publicly disowned his own girl, his wife and gave them as ransom to the mamlukis arturs. Is there NOT anything that is sacrosanct to him and his mafiya? I think he will go down as the worst of the P.O.R.Ks, even kipkorios was not this callous. At least he spared the Nation of shame, even if he looted it. He did not kill as many folks as this lame duck P.O.R.K from othaya. Its sad to see how desperate some fellows are, trying to protect their opinion poll president and as usual they drag the old tired song of mafiya this, mamluki, othayan etc like they have done in other gazillion threads in Jukwaaa just to try divert the heat from their 'prince' of impunity. While they attack this specific wikireport with all the e-arsenals they can lay their hands on, the other wiki reports that purports the sitting president was involved in sleaze are embraced as gospel truth.
Its sad that in the 21st century, some people can be this gullible. However, its a free world and those who cannot see the light even if its shone directly to their eyes are a lost cause. Owuor

The accuracy of wikileaks is a concern only when the defacto Mr. Opinion Poll President and his family is adversely mentioned in connection with sleaze and graft. Otherwise, wikileaks is as factual and dependable as any bank loan collateral.
