DID UHURU KENYATTA KILL A POTENTIAL ICC WITNESS?There have been serious threats against potential witnesses of the ICC (Hague), but we now also know there has been murder too. Top suspects like Uhuru, Muthaura and Ruto, are reported to have been directing a serious campaign to intimidate potential witnesses.As Wikileaks cables now reveal, the November 2009 street-assassination of Mungiki spokesman Njuguna Gitau by reported undercover police officers on a busy Nairobi street, is directly linked to ICC’s witness protection subject. According to Wikileaks cables, Gitau may have been the lynchpin that channeled funding from Uhuru Kenyatta during the latter’s sponsoring of Mungiki retaliatory murders and violence during the post-election violence. With that murder went down one high-priority witness with a "smoking gun" testimony. Other witnesses must be guaranteed real protection if this ICC thing is to succeed. One of the dipolomatic dispatches from the US Embassy captures kenya's dilemma:Minister for Justice and Constitutional Affairs Mutula Kilonzo has publicly acknowledged receiving "bundles" of letters from post-election violence witnesses reporting intimidation, many of whom testified before the Waki Commission, and who have therefore already attracted unwelcome attention from post-election violence inciters and organizers.
While Kilonzo notes that threats will complicate any prosecution of post-election violence suspects, he continues to argue that he is powerless to protect them and accuses Attorney General Amos Wako, who is responsible for oversight of the witness protection program, of failing to fulfill his duties. (Note: Wako was recently subjected to 212f visa sanctions for his role in several high-level corruption cases, and does not appear to feel any sense of urgency with regard to his witness protection mandate.
Kilonzo's suggestion that he has no ability to realize implementation of the witness protection program is disingenuous at best. End note). The bold truth is that successful investigation and prosecution of (esp) Uhuru Kenyatta and Francis Muthaura by Ocampo (the ICC) requires the FULL COOPERATION of the Kenyan government - which will not happen precisely because the two are at the very apex and center of that government. The last few weeks have actually proved that Uhuru Kenyatta is in fact the de facto leader of Kenya under this lame-duck closing-moment of Kibaki's tenure. Uhuru is the behind-the-scene director of Kibaki's own political realignments. Uhuru makes the picks for crucial appointments announced by Kibaki. Uhuru has gained the support and endorsement of the Gikuyu elite, vigorously fearful of ceding power to political rivals (Uhuru's endorsement by the Gikuyu glitterati was publicly espoused by John Michuki).This de facto (and behind-the scene) leader of Kenya (Uhuru) has proved that his priority is to save himself from ICC prosecution. Using his vantage as Finance Minister, the now boldly-assertive and foul-tempered Uhuru Kenyatta, has been misallocating large amounts of Kenyan public resources in the singular bid to frustrate ICC prosecution of PEV. Part of Uhuru's directives have involved the FORCEFUL DISPATCH of Kalonzo Musyoka on the back-firing shuttle diplomacy mission across African capitals (like recently besieged Cairo and Tripoli) to mobilize anti-ICC sentiments and galvanize AU support for deferral of Kenya's case. Another of Uhuru's fingerprints was Kibaki's faux-pas in the nominations of the next Chief Justice, Attorney General, DPP and DoB.Uhuru's Tango with Ruto - in wrenching off Henry Kosgey and Sally Kosgei from mainstream ODM (using threats of prosecution for corruption) is another of his latest handiwork. ODM Ministers Charity Ngilu and Musalia Mudavadi are still being "processed" along similar lines.Does anyone now realize the unseen force that has been remotely feeding PLO Lumumba's in-tray at KACC? No wonder PLO's appointment was swiftly confirmed by Parliament.
Uhuru (helped by Ruto) have similarly been coordinating the publicly unpopular Parliamentary effort to effort to pull Kenya out of ICC. Their string of 'successes' bolstered by the parliamentary numbers of impunity footsoldiers has definitely emboldened them, and rejuvenated the perceived indomitability of their coordinated 2012 presidential bid. Back to their joint role in stone-walling ICC probe of PEV. Uhuru, Muthaura and Ruto are doing everything possible to kill Kenya's cooperation with ICC. They have certainly appreciated the reality that successful ICC prosecution requires some degree of cooperation with the local government. This is why Uhuru and Muthaura are clinging at the heart of government - to prevent cooperation. Crucial aspects of this cooperation involve WITNESS PROTECTION and ASSET FREEZING/PROPERTY SEIZURES. ICC does not have its own witness protection but relies on cooperation from member states.Keeping witnesses alive and safe will be the cornerstone of successful prosecution of the high-flying suspects like Uhuru, Ruto and Muthaura. Uhuru is Kenya’s Deputy Prime Minister and Minister for Finance. Francis Muthaura is the head of Kenya’s civil service (& also secretary to the cabinet). How could ICC receive cooperation regarding say - the freezing of assets of Muthaura - if the instructions to do so essentially have to pass through the same Muthaura? How could witnesses be guaranteed protection if everything regarding the witness protection program (funding, passing amendments to the Witness Protection Act 2010, etc) all revolve around Uhuru and Muthaura?Witnesses are being killed and intimidated. Besides Gitau’s murder, former AP Deputy Commandant Oki Kaunya has also received death threats prompting his exile – facilitated by foreign diplomats cooperating with ICC. Muthaura has singularly stone-walled the ICC-requested taking of statements from Security chiefs during the PEV. Uhuru and Ruto have mobilized parliamentary numbers to prevent the amendment of the Witness Protection Law to give it more independence, teeth and capacity. Uhuru is on full gear ready to hand-pick (on behalf of Kibaki), his own cousin Githu Muigai, to be Kenya’s next Attorney General, which would give him the bonus of having a first-hand account and details of witnesses enrolled in the witness protection program. The Witness Protection program is under the AG’s office. Does anyone in this world think any witness protection program carried out under Githu Muigai would be credible in guaranteeing safety to witnesses slated to testify against Githu’s own cousin (& de facto employer) Uhuru Kenyatta? Under Kenya’s current Witness Protection Act, the Witness Protection Unit is headed by an Uhuru-Kenyatta stooge called Alice Ondieki and the unit falls under the AG. Security is provided by the rotten and corrupt Kenya Police and AG has to directly give approval for anyone to enter the program. The program is also directly funded by Uhuru Kenyatta, through a line item in the budget of the Ministry of Justice. This program is too closely linked to Uhuru, Muthaura and the existing security forces. How can such a system protect a suspect set to testify against Uhuru Kenyatta or Francis Muthaura? The impunity merchants are slowly grabbing back Kenya away from the reform path. All systems are being set to work for their individual interests and protection, not for common good. They are derailing implementation of the new constitution and deliberately triggering instability. Their latest language is laced with tribal epithets and slurs aimed at stoking ethnic divisions. The ICC Prosecutor must be finding it quite FRUSTRATING and EXPENSIVE to successfully investigate and prosecute GOVERNMENT-INSIDER suspects in Kenya who have their hands in KENYA’S PUBLIC PURSE. Britain recently donated some paltry £200,000 ($311,945) to the ICC Registrar to specifically offer protection to witnesses of PEV slated to testify at the ICC. Truth is – it’s not enough. As Ocampo continues probing Kenya's PEV, preparing witnesses, and awaiting Pre-Trial Chamber II Judges decision on his request for summonses, the ICC Prosecutor must do one more thing - investigate who killed the potential ICC witness and former Mungiki spokesman, Njuguna Gitau.

It is clear why nominations to the Judiciary will continue being fiercely contentious. Uhuru wouldn't wish to be probed for Njuguna Gitau's assasination. Pressure is also being put by the elite backers of the "Forest Guard" and Mungiki who are afraid of an independent local tribunal that would probe such events as this one (below) splashed by the Wikileaks (with names to boot). No wonder an insider AG and pliant CJ are BADLY needed within certain circles led by Uhuru Kenyatta. No wonder the panic. It's all fear of real Justice. Job, Thanks for the above. This issue is very explosive and might even be the last nail in Uhurus political coffin. These are allegations which if proven can send Uhuru to the Hague for the rest of his life.
There is something else here. Its looks as if there is an effort on the part of Uhuru "not to die alone" hence is recent (mis)behavior in public. Even though G Njoroge of mungiki is gone, his followers are still around. Incase a credible local tribunal is instituted, Njoroges followers might come out en mass and pour their hearts out for they will feel having been used.
Uhuru on the other hand is telling the retired generals, who helped him kill people that he wont be going down alone hence his erratic behavior in public. He has completely panicked.
Remember that the principals have agreed on the issue advertising for the post of CJ but we have not yet heard anything as far as the AG is concerned. My opinion is that PANU is looking for a way of bulldozing Uhurus cousin Muigai (PhD) into the position of AG. RAO must watch out. Kenyans must watch out. ODM must not sleep. This is high octane politics.
All the bulldozing is to be done in the name of saving one Uhuru Kenyatta. Ruto does not feature in PANUs thoughts as far as the above is concerned, not for a moment, even though he might think so. The circumstances, however, might find him at the right place at the right time or vis-a-vis.

JobYour input on Forest guard is pretty scary. I see it as a well crafted plot by the mafioso to initiate artificial turmoil in the country in support of the Ocampo 2 (Uhuru and Muthaura). Forget Ruto! He is a tissue paper that will serve its purpose like lady Martha and then be flashed down the manholes. They will use this plan B as the excuse to seek the ICC deferrals, given that they have not been able to so far demonstrate solid reasons why they seek it. They will then argue their case about regional stability. But can that work for them? This could also mean mobilisation of forces in readiness to deal with a Raila presidency. This may sound far-fetched, but when you dig up the archives and come up with things like THESE , which to-date have not been renounced and no apologies offered too, the foggy picture begins to clear up.

When going through the oath one begins to understand peppered position that some of our leaders have taken.
I do not wish to deviate Job's post from its core object but can anyone see where Kibaki Tosha came from 2002?
Methinks the recordings in Time Magazine gives us a very clear insight.
Today you have very serious records of similar nature which Job has unleashed here. These are people preparing to deal with their political enemy the way they dealt with the british settlers!
But this time it is in defence of their anointed leader against ICC.
It is all in that oath.

Couple that with the fact that the same leaders go about forming the so called tribal alliance aka KKK. What do they expect the other folks to think? As PM put it up there, that quote by DR CM about the presidency being theirs is well in the mind of Kenyans and we wonder kwani sisi wengine tumeumbwa kivipi? When you see the likes of Muthaura and Michuki still clinging onto the corridors at whatever cost you start to wonder if Mugabe's and Gadaffi's DNA is replicated in these folks.Washindwe! This oath taking thing is serious business and its their preserve since the colonial days. Mungiki is a force that propagates such out dated yet dangerous cultures and yet the Govt of one Mwai Kibaki turns a blind eye. Kisha when they need them to do their dirty work, they unleash them only to turn around and kill them...so as to cover their dirty trracks. All this is now in the public domain and I dont know how it will end up. The ICC way is the only way to rid ourselves of these demons that haunt our psyche.

Being reasonably old and knowing what was happening then, these tea visits were not restricted to Gatundu. Secondly apart from perhaps Gatundu, they were open to anyone circumcised ( I recall my primary school teacher who was a Luhyia was allowed in) . Finally, people did not eat soil. They ate meat dipped in blood which still happens even today in various gikuyu ceremonies, and took oaths to defend the gikuyu from evil.....!
Now you all can go and get disgusted...but tell me a community that did not or does not have oaths!
