Kalonzo Musyoka has become an embarrassment even to himself. He has foresaken PEV victims and is waiting like a Hyena to feed after Uhuru and Ruto are shipped out to the Hague. But thanks to folks like Mutula, you can fool some people sometimes but you cannot fool all the people all the time. See how not to run a political party, unless you are desperate to be toshwad! Mutula to Wiper: There’s no shortage of parties Posted by WAMBUI NDONGA on January 31, 2012
NAIROBI, Kenya, Jan 31 – Justice and Constitutional Affairs Minister Mutula Kilonzo has now dared the Wiper Democratic Movement to kick him out, saying that there is no shortage of political parties.
Kilonzo told Capital News on Tuesday that he would not go back on his stance calling for the resignation of Uhuru Kenyatta as Deputy Prime Minister nor support his presidential bid alongside that of Eldoret North MP William Ruto.
He maintained that he was prepared to defend his position adding that he would not be cowed into embracing principles that went against the spirit of the new Constitution disclosing that he had already been enticed by 21 political parties for his bold stand.
Read related story on his stand here.
“I’m working with a lot of people who know better but don’t speak out and when they speak out, they do it in their bedrooms; when they go out in rallies they say something totally different,†he argued.
“But there is no reason to call me names or pretend that they can grill me,†he added.
The Justice Minister also revealed that he had not been formally summoned by his party and was therefore not aware of any plans to take disciplinary action against him.
Kilonzo has in the recent past found himself in turbulent waters for going against the party’s position with party leader Kalonzo Musyoka who says he supports Kenyatta and Ruto’s bids for the presidency regardless of their cases at the International Criminal Court (ICC).
Read his stand on ICC indictment here.
“To be fair, I have not received any summons from the party or the coalition or anything to show that there are disciplinary processes against me but I want to dare them to do so,†stressed Kilonzo.
Kalonzo, Ruto, Kenyatta have already declared their intention to form an alliance through which to pursue their political ambitions for the next government.
Kilonzo however maintained that the country’s leaders had a bigger role to play in terms of safeguarding Kenyans’ interests and it would be wrong for political ambitions to cloud such judgments.
“I’m the minister who facilitated the new Constitution. The late Mboya (Tom) tried in 1969, Charles Njonjo tried, Kiraitu Muriungi tried and Martha Karua walked out on her own with those high Prada shoes,†he argued.
“But I came, I saw, I delivered; nobody is going to step in my way,†he quipped.
He also renewed his calls to Kenyatta to relinquish his post as Deputy Prime Minister.
Last week, Kenyatta and former Head of Civil Service Francis Muthaura stepped aside from their government posts in light of the ruling by the ICC. Kenyatta however maintains that he will not give up his post as Deputy Prime Minister unless Members of Parliament pass a vote of no confidence against him.
“Kenyatta is still sticking to his post as Deputy Prime Minister which I don’t understand because I expected him to voluntarily step down as it is a much more superior position. So I can’t pretend that everything that I recommended has happened,†he said.
The Justice Minister at the same time called on Kenyans to remain sober arguing that they needed to come to terms with the significance of the ruling by the ICC.
He noted that the decision by the court to confirm charges against Kenyatta, Ruto, Muthaura and journalist Joshua arap Sang was an indication that crimes against humanity were possibly committed on Kenyan soil and there was need to confront this reality.
“You may bury your head in the sand like my ostriches do and think that the storm will pass but international crime is here with us. The sooner we come to terms with it the better and my work is to make sure that you see that fine line,†he said.
He also revealed that his ministry had in collaboration with officials from the office of the Director of Public Prosecution set up a special taskforce that would revisit files made on post election violence, with a view of initiating prosecution against other perpetrators who are not targeted by the ICC.
Kilonzo added that time had come for Kenyans to confront the ghosts of the post election violence so as to offer reprieve to the victims.
“I see preachers in rallies praying for the accused but who will speak for the voiceless? Don’t the victims deserve prayers too? We must not forget the victims of the post election violence,†he urged.

Spot on! Mutula he has merely hit the nail on the head on reality that comes with the new constitution. If all Kenyans would be sober & wake up to the new law am sure we will on the right path to first world devoid of ethnicity, corruption & to say the least impunity. Unless a patient comes to terms with his illness & embarks on taking prescribed medicines, leaving in denial will only worsen the condition which eventually leads to painful demise.

He's wrong on the law (read Joblesscorner's thread on Uhuru Muthaura resignations) as we are currently operating between the old & new constitutions. Even an aspirant for the LSK chair, Eric Mutua, confirmed as much on Citizen's breakfast show. The law calls for a vote of no confidence in parliament, the Kimunya way.
However, kudos to him for upholding the spirit of the new constitution. We'll get there someday.

I'm beginning to think this whole fiasco was designed to portray the treacherous Kalonzo as really and truly, with all his heart, backing the Coalition of the Accused. It's was an opportunistic ploy to have Kalonzo publicly and consistently rebuke Mutula's utterances thereby earning himself a soft spot in the hearts of Uhuru and Ruto. Lakini things didn’t go according to plan. Mutula went too far… to the point that recommending his sacking from the Justice Ministry is the only way Kalonzo can prove his love to Uhuru and Ruto. You see, even after the failed shuttle diplomacy, they still call him a hyena… to his face. Iron gates are literally quickly shut to deny him access. When he cries, they see crocodile tears. Like he said, these actions really hurt his nimble feelings. They break his heart.
Seeing that he's unwanted from all quarters, Kalonzo must grow some hairs on his one marble. He has no choice but to stand up on his own, set up his own agenda and hold his own rallies. He should not wait to inherit Uhuru's and Ruto's supporters. He should get his own.

Folks there MAY be a more sinister angle to the "improved" patriotic Mutula. Is he really a reformer or a transformer (a reformer in disguise ). He makes all the right noises when it comes to the integrity of leaders but some other things he calls for are bizarre. For instance, one of his pet projects remains vocal support to amend the constitution especially on election dates. I heard him advocating the same yesterday & today Ahmednasir rubbished all of that. Why is Mutula so stuck on ALL subsequent elections, not just the contentious 2012 one due to transitional clauses in the constitutions, being held in the third week of December? As Ahmednasir put it (on Citizen today), if there is a clash with the budget or our EAC obligations, its up to the politicians to work around the new KE constitution as it is the supreme law. Provisions can be put in place to ensure funds are available for elections before the budget is read. Let's not forget Mutula was Moi's lawyer & remains so to date as far as I know. He may be Moi's Trojan horse sneaking in unnecessary amendments until the constitution becomes as trashed & unrecognizable as the Lancaster one. Let's not forget Gideon Moi et al do not have the kind of ICC baggage Uhuru has.

NOK, I see you took the bull by the horns & started a new thread. This Mutula fellow doesn't strike me as sincere when he goes on about the new constitution. For one thing, he's a lawyer (apologies to Sadik & Omwenga but I have a beef with lawyers). On top of that, he's Moi's lawyer! There's got to be more than meets the eye when this guy talks.

Hehehehehehehe. Uhuru is just getting too desperate and looking very convoluted. Even hanging on straws has limits. So here is Uhuru's job description: "The National Accord says the DPM is a member of the Cabinet and may perform any of the co-ordination responsibilities assigned to him by the PM as well as to deputise for him."Now here is Uhuru who never even once attended any meetings called by the PM to deal with cabinet issues. Uhuru saw himself as only answerable to Kibaki. Uhuru despised the office of the PM with passion and has never even once stood in for the PM in bunge. Now he is crawling back to the PM's office to be asigned duties. Some people just have no shame at all. Basically Uhuru is hanging to an office that only exists by name. It has no portfolio and the pitiful part is Uhuru now wants to be under the PM to give him some house cleaning issues to handle. Macharia Giatho put it best yesterday saying Uhuru is now between an IDP and a squatter. He is no man's land. How pathetic is that. Uhuru's game plan is to say well, if I can be a DPM then may be I can also be a president. Really? A president working from his car and in his garage. Mutula has made a very clear statement. He said anybody who thinks he can be at The Hague one day defending himself on charges of mass murder of Kenyans and the next day at State House is dreaming and it is a bad dream they need to get awake from. The sooner Uhuru wakes up from his hallucination the better for him. Nobody can and/or will run Kenya from the Hague. That is just a fact. Hanging on the useless DPM job makes no difference in that direction. The one thing with Mutula in this case is just how sober his reasoning is. Mutula is comfortable with what he is saying because he is absolutely right. Kina Uhuru can dance around the sides of his argument but there is no escaping the fact that Uhuru's situation has changed for the worse and he has no place in the Kenyan cabinet or any executive authority. If he had Uhuru would not have resigned from the ministry of finance.

first heard this through the grapevine and now am reading that .... A senior lawyer might soon find in a tricky situation if information touching on some unlawlerly activities he is alleged to have engaged in is made public. Some people known to be close to an influential State House operative are reportedly planning to lay the lawyer's illegal deals that they allege will explain the massive wealth the man has acquired over the last few years. It seems they want to use the dossier they have collected to hit back at the lawyer who has been quite vocal on issues to do with governance.www.the-star.co.ke/national/corridors-of-power/60450-corridors-of-power

I doubt that Mutula and Kalonzo have fallen out. The noise Mutula is making does benefit Kalonzo immensely. If Ruto and Uhuru do not run, Kalonzo the opportunist hopes to bag in more dreamland votes. Essentially Mutula has to continue making the noise, while Kalonzo and his Wiper party pretend to distance themselves from Mutula’s accusations. This political game is to attempt to exonerate the untrusted Kalonzo. Kalonzo who has always been seen as a Judas, hopes to gain the trust of the Hague due, in particular Uhuru (and the Kikuyu voters) by pretending that he does not support Mutula’s calls yet deep inside he does. Hii ni inside job. Realpolitik

SO Uhuru is daring Mutula to move a vote of no confidence on himself as DPM? Just because Mutula is talking sense, Uhuru does not like it.
What happened to all those censure motions they wanted that backfired?
How about pulling Kenya out of the Rome statute to save our as**s?
God forbid, that Uhuru should one day become the president of this country! What arrogance!

Mutula Kilonzo timing is perfect he is wrenching power out of the wiper party and investing it in himself this statement gives him away "I am the minister who facilitated the new Constitution. The late Mboya (Tom) tried in 1969, Charles Njonjo tried, Kiraitu Muriungi tried and Martha Karua walked out on her own with those high Prada shoes, he argued.
Is he not forgetting that those men and women dealt with conditions and circumstances that were different and very intolerant and that he is actually reaping where he did not sow? is he not being insincere by not recognising those who discovered the sea route to india where he now sails smoothly?
He was a personal advisor to Kenyas CEO for almost 24 years in the days when impunity was at its highest. I never heard him say anything that went against the grain..
While I see his current stand as sober, Mutula Kilonzo is a greater opportunist even more than Kalonzo...
But I came, I saw, I delivered; nobody is going to step in my way, he quipped. C'mon give us a break!

While I see his current stand as sober, Mutula Kilonzo is a greater opportunist even more than Kalonzo...But I came, I saw, I delivered; nobody is going to step in my way, he quipped. C'mon give us a break! Was it Deng Xiao-ping who said: it does not matter the colour of the cat, so long it catches the mice? Deng was in a tough spot, during his open door policy, criticised by the conservative wing of the CCP [Chinese Communist Party] as counter revolutionary. Now Mutula Kilonzo looks to be the only guy in cabinet, and parliament --solomonic Marende retired long ago after he supported the impunity of tax-dodging--- capable of voicing a sensible opinion. The tough sherrif ready to take on our Billy the Kids! Raila has withdrawn his head like a tortoise into the shell for tactical reasons, leaving mama Fidel to be foolish in public; baba Jimmy is his usual see no evil hear no evil much ado about nothing I am asleep don't wake me up; Nyong'o who sometimes would pen an opinion capable of reminding us of what he once was --as clever as the [ [now mentally late] professor Githu Muigai once was, has been gagged together with the rest of the Luo front who were about to publicly jump into Mutula's corner. The former, some say still current Moi lawyer, is the knight on whose shoulders the honour of parliament has come to rest! There are plans to expel him from his party, remove him from his ministry, demote him from the cabinet, and kill his political career! There are even rumours about sections from the KANYOTU files resurfacing! all to intimidate Mutula, man of the people! Is it thinkable he is going to challenge Kalonzo for the lead role in the wiper party ticket? making Kalonzo payukapayuka? If some people think Eugene Wamalwa is a potential presidential candidate, really Mutula Kilonzo must think, my foot, I will die before that one can pronounce 'constitution of the republic!' So Mutula's pitch is this: O fellow countrymen, of them all, I am the one you can trust with the implementation of the promulgated constitution, both in detail and in spirit! The cat is out the bag! NO UHURU NO ELECTIONS, NO RUTO NO ELECTIONS went the chant at the prayer cum peace rally in Eldoret! It is time for a tough sherrif to write and read the law, and kick butt. If it is Mutula, so be it! Aint no matter the colour of the damn cat, just that it catch the bloody mice!

I do not know exactly how fluid the man is but I do know that Mutula is rich enough to own a private zoo in his ranch; in this zoo he keeps among other animals a pride of real lions. Now that is stinking rich by any standards if you ask me... My last pets were a bunch of pegions which lived in wooden soda crates carefully stacked on the roof ;D Owing in excess of 300 million (wow!) in taxes means that the man has at least a billion shillings stashed somewhere... How he earned this colossal amount of money without owning any substantial business empire apart from his legal practice deserves a thread of it's own... And he is not the richest in Kenya...!

@ Okolowaka, I saw footage of his private zoo some time back complete with the lions. You know feeding those big cats requires a lot of $$$ because a grown lion needs 20kgs or so of meat DAILY. He owns several, amongst other wild animals. The amount of meat he has to buy his pets could feed a small village for years.
As for his source of income, even allowing for the possibility that he would present his key client, now citizen Moi, with a fee note that was just a percentage of transaction amounts, it means his client was doing roaring business that can only be described as Abacha-esque.
@ Akinyi, there's definitely a shortage of people with integrity at the august house. It's pretty much a den of thieves with a code of "honour" of their own that once breached, leads to one becoming a news item.
