Posted Thursday, November 8 2012 at 23:17Civil activist Okoiti Omtatah was seriously injured after unknown assailants attacked him on Thursday night in Nairobi's central business area.
Mr Omtatah lost four incisors in the 9.20pm attack along Kenyatta avenue.
He was also stitched on the forehead and the back of his head, doctors at the Nairobi Outpatient Hospital told Nation.
“He arrived here about 9.40 pm bleeding profusely and in a semi-unconscious state. We had to stitch his head and do IV fluid resuscitation because he had lost a lot of blood,” a doctor at the facility who requested not to be named said.
Mr Omtatah said the assailants had called out his name before asking him whether he intends to drop a case he has filed touching on the procurement of the Biometric Voter Registration kits.
“When I told them that I will not stop the case they immediately attacked me,” he said, adding that nothing was stolen from him despite carrying valuables that included two phones and Sh10, 000 in his pockets.
He was attacked shortly after alighting from a bus on his way back to town from his office located in the Community Hill area.
He said he had stayed late in office to finalize on a case he intended to file in court next Monday against “illegal payment of MPs for 14 days as from January 1, 2008 to January 14, 2008.”
Last week, Mr Omtatah amended his case to directly include IEBC Chairman Isaak Hassan, CEO James Oswago and Finance Minister Njeru Githae as respondents.
“I will not stop the case because Kenyans are losing almost Sh10 billion in this fraud. I want this money to be recovered from his individuals,” Mr Omtatah said.
He said that he wants the government to make public details of the BVR procurement.

This attack is connected to the abortive multi-billion shilling BVR tender by the IEBC.
Okiya has unfortunately allowed himself to be used by some bidders who lost on this lucrative tender and I suspect the other groups are hitting back. Those who arranged and are making even more billions from the single sourced government-to-government deal (my @ss!).
Question is; How honest is Okiya in some of the cases he has been filling in court? Take even the case he had against Evans Kidero as CEO of Mumias Sugar. Since when did Okiya become a sugarcan farmer?

We know that Phil has been rooting for Kidero here in Jukwaa and if such a case by Omtatah would derail Kidero's run for governor it hurts Phil's campaign!

About an hour ago, I received an urgent call for help from a barely conscious Okiya Okoiti Omtatah as he was being rushed to the Nairobi Outpatient Hospital in Nairobi’s Central Business District after he was viciously attacked by a gang of unknown assailants on Nairobi city streets, a stone’s throw away from the Nairobi Central Police Station.
I have since arrived at the Nairobi Outpatient Hospital to find that he has suffered broken teeth and has a deep gash from a blow to his head, which is bleeding very heavily. We have worked with the doctors, who have administered First Aid, to have him urgently transferred to a full hospital facility for emergency treatment. We have managed to procure an AAR Health Services ambulance and are headed for Mater Hospital.
Mr Omtatah who has recently been very keenly following the unfolding developments concerning the Biometric Voter Registration Kits’ procurement process in Kenya and has began a court process on the same, was going about his business this evening when he was assailed and mercilessly beaten. The reason for this vicious attack is not clear at this stage.
At the moment he is in much pain, deeply in fear for his and his family’s lives and we are concentrating on re-assuring him and moving him to safety where he can get urgent and comprehensive medical attention.
Your generous support in efforts at getting him proper and urgent medical attention and pursuing justice for this heinous crime will be deeply appreciated.

It is astounding to me, that very few of us appreciate the security situation in this country, particularly in light of the high voltage topics we touch and ventilate on. In Omtatah's case not only is he pursuing details of the irregularities on BVR ranging in the billions of shillings but he has also had a lengthy feud with Kidero on the matter of Mumias land again in the hundreds of millions of shillings and a probable governor's seat of no less a county as Nairobi also in the mix. With no CCTV camera system in place, a bewildered and lethargic investigations unit of the police it is on the cards that the masters of impunity will beat you up, even put a bullet in your head and saunter away to board a matatu their work completed. We must not be naive`. And George let's not talk of fear, for it is the most potent weapon they want to use against you in the struggle. They want to put the fear of God in you. Do not register, accept nor proclaim it.

As I was telling those other folks on social media, the BVR deal is water under the bridge. It's too late for Omtatah to purport to be filing cases in court to try to stall this deal. It's over and done with. Perhaps he can sue for damages he and his friends have suffered as a result, I dont know. I also find it very suspect that a group of people can attack a well known individual as Omtatah right outside I&M building which is one of the safest and busiest locations in the Nairobi CBD. There are police patrols and countless private security guards including CCTV in this vicinity. This appears to be a story half told. On a more considerate note, I condemn in the strongest terms possible the attack on Okiya Omtatah and pray for his quick recovery.

I wanted to use an 'icon', but I found the yellow round head with the three massive teeth inappropriate!

The assault
Okiya Okoiti Omtatah was on Thursday evening at around 9 pm evening accosted as he made his way from work along Nairobi’s Kenyatta Avenue, by two men smartly dressed in suits. According to his account to me, before the attack, one of the men greeted Omtatah in Swahili and proceeded to ask him “Hiyo case ya BVR utatoa? (Will you withdraw the case you have filed in court on the Biometric Voter Registration Kits?). When Omtatah responded in the negative, the two men immediately violently set upon him with heavy blows using an unknown but blunt object to clobber his head. One strike to the back of his head threw him into a pool of water. His assailants then stopped and left. He managed to make an escape from the scene barely conscious. The assault left him with a big gash to his face that later required seven stitches to close and an even deeper gash close to the base of his skull that required ten stitches to stem the heavy bleeding. He also suffered broken front upper and lower teeth. When I later got to him in hospital he was totally wet and soaked through in his own blood.
The SOS call
I received a frantic call from Omtatah repeatedly saying “Wanataka kuniua!” (They want to kill me!). I instructed him to take a taxi to the nearest health facility while I made my way to him as quickly as I could. He later told me that a Samaritan taxi driver took him to the Nairobi Outpatient Hospital in Nairobi’s CBD. I arrived at the hospital and found the doctors working on very blood soaked Omtatah to stitch up the gashes to his head and to stop the life threatening bleeding. The bleeding on the back of his head was horrible. When the ambulance arrived we quickly shuttled the traumatised Omtatah to the Mater Hospital for more comprehensive medical attention. After much reassurance over his security we finally managed to calm him down and he fell into an exhausted but fitful sleep.
Current condition
He is currently recovering under dedicated round clock security at the hospital. Yesterday, the doctor attending informed me that the stitches on Omtatah’s head will have to be redone. It seems the first aid stitches were done in hurry and needed changing. Omtatah’s head is still very swollen and his upper lip is swollen and cut. He is suffering severe headaches which the doctor attributes to the heavy blows and is in a lot of pain generally. By the time I left hospital last night, Omtatah was holding on well and keeping up his spirits. I hope he will be discharged soon.
This reads like a movie script but it is the harsh reality of a society where our basic freedoms and safety are still under threat from the criminal elements enjoying power-that- be protection.
This is totally unacceptable and I invite all people of goodwill to condemn in the strongest terms possible the heinous, cowardly and seemingly politically-instigated attack upon Mr Omtatah. The attack on Omtatah was nothing but criminal, barbaric and savage. Such behaviour should have no space in the new Kenya inspired by our new Constitution, 2010. We must not give in to this kind of scare tactics and harassment but use it creatively to serve as a propelling force to our resolve to build a free State in our country.
Omtatah will be able to narrate his own account to you once he is back to good health. For now the family has requested restricted access for safety purposes and also to allow Omtatah time to rest.

There has been suggestions that Okiya Omtatah was attacked because of his lawsuit against the government and IEBC over the procurement of the BVR kits. And for purposes of clarity, are Okiya and Patel enjoying any business relationship, or these are just two patriotic Kenyans working together for the love of their motherland? Has any money exchanged hands between Okiya and Patel? If yes, what who paid who and for what services? What does Okiya know about Patel's relationships with staff at IEBC? What does Okiya know about AIDC's other business deals? Some things are better left unsaid.
