I have not slept properly since when I heard about this death. Kasuku – Lilian Mwikali Andree - was killed because she was seeking to reclaim her family’s property stolen from her. Previous, she lost her husband who originally owned the property. She subsequently acquired that nationality as her husband is German. With Kenyans allowed dual nationality, there is a little chance her German nationality may help much, now. I think German govt will be reluctant to help where the subject was also Kenyan. I fear her extended family, especially her husband’s, had clear motive to eliminate her – or even business associates, if she had some. We know Lilian told us ( from Oloo's emails) she had an ongoing court cases about her stolen her property from well-connected, foreigners in Malindi. People, Lilian is our sister who was murdered in our country in cold blood because she sought back her property. Now, we can sit here and write useless lines praying for her, OR take matters seriously to the attention of those people who can do something and seek the murderers. Please do not write your condolences in this thread – use Oloo’s thread’s for that purpose. This thread is meant for ACTIONS – and FEEDBACK – on what people are doing or have done to help so that we can co-ordinate our efforts. This is the time we as Kenyans come together and fight for our own when she most wanted our help. I will ask specific people especially those in Kenya to help. I equally urge you make public all what you unearth immediately to us Kenyans, so that we can rest assured that your office which is funded by us is on top of this matter.
As you know the Kenya Police is not that highly regarded and I think that this is the time for you as an organisation to redeem your credibility and show us all that you are worth our taxes.

In the other thread many of you asked Oloo "to do something" and he has since not come back to us.
In view of the fact that the deceased had approached him directly for some help and we know holds some of what could be crucial evidence I suggest we give him time to come back to us with further developments.
Not forgetting some key persons suspected to have participated in the actual murder of Ms Andree are already in police custody and the CID have asked the court for time to complete investigations, perhaps when the case opens in court we shall get to know more details on this and if there are more suspects.
I do not want to believe that Jukwaa Administrator Oloo would be that negligent and callous to let a case as sensitive as this go unpunished.

All to frequent, murder committed in Kenya are ignored after public attention moves on. I was not apportioning blame, nor accusing Oloo of negligence. Far from it, I was only trying to help and make sure people voice their concerns to the people in-charge.
By the way, I am very surprised by the response. I expected a positive attitude to the email campaign to the cited leaders including the police.
I think we as Kenyans simply talk but have no action. We are all running with one liners when the murder was made public, but when people are called to act by simply sending emails so that the investigation is kept alive, until a result is achieved, no one participate.

Maybe people have written emails in confidence to whom it may concerned e.t.c Jukwaa has I believe nearly 1000 members, some don't post here regularly but I would want to believe each member will act accordingly, you posted a plea for all members to call or forward emails to the relevant government bodies...don't give up on jukwaa members as yet Sadik..just my 2cent.

"Kasuku was likely a German citizen, not a Kenyan anymore. She gained German citizenship through marriage when Kenyan law did not allow double citizenship, so she lost her Kenyan citizenship. The murder of a German citizen is prosecuted in the German criminal code under universal law, no matter where in the world (forum criminis) the deed occurred. The prosecution office of Wiesbaden is the locally competent one." In light of the above comments by a friend of mine [who should know], we also have to bring pressure to bear on German authorities to act on behalf of a German citizen. To act on kasuku's behalf. Certainly for her children and other loved ones.

I personally wrote to all the presidential candidates and gave them the link to Oloo's article at KDP. So far, only Martha Karua has acknowledged my correspondence and confirmed that she will look into it, urging me to contact all leaders and not just female leadership only. I have replied to her and told her that this has been brought to the attention of all presidential candidates. I am now looking to see if any of them will raise this matter in parliament so as to demand action from the Ministers of Internal Security and also from the AG.

I must report that I have received very little cooperation from the police. The person I was told to contact always takes my calls but has so far not followed up on my offer to supply him with information in my possession that may assist with the investigation. Lillian's lawyers DOES NOT take my calls or respond to my text messages.
On a related note, I was contacted yesterday by one of Lillian's cousins after another family called them to inform them of my blog piece. I spoke at length with her today (Wednesday, November 21, 2012) and she told me that three family members were present at the autopsy. From what they were able to gather, Lillian suffered a lot before she died. One of her arms was broken. She was stabbed in the neck before being strangled, with her hands and feet bound. After death her body was stuffed in a plastic bag before being wrapped in the bed sheets she was sleeping under and on. According to this family member, it took the pathologist and his team a long time to unwrap and untie her body before they could conduct the autopsy.
Lillian's body was flown from Mombasa today to her Machakos home.
There is a fundraising meeting taking place today and possibly tomorrow at the Stadium Bar at the Nyayo Stadium.
She is being buried in Machakos on Saturday. I will be there.
I will be attending the fund-raising function which starts at 5:30 pm today. I have requested the family to provide a number where friends, well wishers of the late Lillian Mwikali Andree can send their contributions. This will be finalized when I met the family later this evening.

Onyango Oloo NairobiOloo the above statement is worrisome.. with your connections and contacts in Kenya ....why don't you just take your information to the Head of CID directly? why wait for your police contact? and why not try to get your story/ correspondence with Lilian before she died to the Press "Hold a press conference to shade light on the matter ( this can place you in the lime-light at the same time let the world know it can some what also protect you.. if you go public).. Not sure whether my views make sense... just my humble opinion..

I attended the last meeting of Nairobi Funeral Committee where there were updates on the program, logistics and other travel arrangements which was held at a pub/restaurant located at the Nyayo Stadium on Wednesday, November 21, 2012.
I must say that the family members HAVE BEEN FOLLOWING the Jukwaa discussions and are quite moved by the warm solidarity and support Jukwaa members have shown towards our departed colleague Kasuku. They asked me to convey their deep gratitude and appreciation for what you are doing. As part of that appreciation they have created a specific space in the programme for me to speak at the funeral on behalf of the Jukwaa community. I have managed arrangements to have a wreath from Jukwaa as part of those that will be placed on the grave.
I was given an opportunity to speak and I said that we are determined to stay the course to see that justice is done for Kasuku. They had earlier expressed a lot of fear (especially one of Kasuku's siblings) about what the killers of Kasuku were capable of. I was told that one of the reasons why lawyer Kilonzo is not returning my calls is due to SEVERAL threats conveyed directly to him including a face to face intimidation from the the Dutchman who is currently the "owner" of Sailfish Club. They asked me if I too was afraid and I told them no, pointing out that our most potent weapon at this stage is our whistles-whether virtual or literal. I explained to them that I had made sure that the story I wrote on Kasuku was distributed far and wide in blogosphere and social media circles; I mentioned how Phil had contacted all the Presidential candidates; a brother in law of Kasuku had seen THIS THREAD started by Sadik because he mentioned Sadik by name. At my urging they resolved to instruct one of their family lawyers ( a cousin to Kasuku) to convene a press conference where they would publicly demand justice for Kasuku. I had inquired for some direction from the family on how Jukwaa members could contribute towards the funeral costs and after some deliberations last night, they got back to me this morning informing me that since they had met their targets regarding the burial expenses, they would need Jukwaa's support in pursuing the legal matters regarding recovery of her property and so on. They intended to set up a specific bank account whose details they would share publicly with us at the appropriate time so that those who felt they could contribute to the kitty would do so.
Kasuku's death announcement was carried in the Daily Nation of 21st November, 2012. She will be buried on Saturday at her home in Mumbuni village on the outskirts of Machakos.

FRIDAY, NOVEMBER 23, 2012 - 00:00 -- BY ALPHONCE GARI Detectives have been given five more days to complete investigations into the death of a 52-year-old widow brutally killed at Sailfish Club in Malindi.
The police had earlier been given seven days to carry out the investigations and the case was set to be mentioned yesterday. Lilian Mwikali Andree was killed more than a week ago and her body dumped in a septic tank.
She had recently come back to the country from Germany to seek legal ownership of the Sh70 million Sailfish Club, left behind by her dead husband.
Malindi district criminal investigations officer John Ndung’u said they are looking for a key suspect who is in hiding. Speaking journalists on the phone, he said they have crucial leads that will lead to the arrest of the suspect believed to be part of the group which killed Mwikali.
A Dutch, Emericus Van Dewerf, the manager of the restaurant and other employees have been arrested. A postmortem was carried out in the presence of family members and police.
A pending court case was to be heard at the Malindi law courts on the day when Mwikali's body was found. Mwikali's lawyer told journalists that her phone was switched off on Saturday and efforts by one of his employees to enquire about her at the club were futile.
Before her death Mwikali had posted a mail in a website claiming a Kisumu lawyer was trying to steal her land. The report on Jukwaa social network reveals she was worried about her safety but wanted to pursue her legal property.
She claimed the lawyer tried to have her property auctioned in 1997. “At the time he got a court order, my property, a villa, stood alone as my manager had passed away and I was sick in Europe.
As he couldn’t get someone to officially auction the property, he found a willing buyer in two guys from Holand who bought it for peanuts,’’ she said in the post.
Mwikali said she stayed in Europe for 10 years to resolve estate disputes with her two step-sons which prevented her from applying for a letter of administration.

If after the 14 days, investigation is not complete meaning they cannot charge, they can go to court and ask for more time (specific time) and give reasons. As the press coverage shows the police has been give a further five days as they trace the killers who they think they know their whereabouts from leads they have. The Newspaper coverage seem to be mixing the criminal and the civil cases. The murder will be a civil case while the ongoing property possession is a civil matter.

Just on a point of information.
I see from the star-article linked by abdulmote, that a date has been set for the application of bail. My question is, in the case of suspects to a first degree murder like this one of Kasuku, is the right of bail still agreed within our constitution and laws.
I mean I know of legal practices where an accused murderer will not be granted bail, also on the premise that the nature of the crime means he is likely to abscond or disappear. [when one faces the death sentence or life sentence, he can take his chances during bail].
We do not reason like that in Kenya? Or is the bail application merely a formality which will be rejected anyways?
