wow,this people are evil they know where to steal and cover their tracks behind the law they sneaked in,they make laws that fit their actions and we are still letting them stay in the office. merkejuYou know what even bothers me even more. Kibaki rejected the same clause because it had been rejected by parliament, then his own people smuggles it in at the government print shop and the same Kibaki signed the Act into law with the same clause he had allegedly rejected before. I mean does someone at least read the damn thing for him before he signs it or was his alleged rejection of the clause just a ploy. Strangely enough the same clause is being used by Kibaki's people to rope in people like Kamlesh Pattni to help give hotels for sale to fulfill M.o.U's Kibaki made with others. Stranger things have happened but this is just nuts. But our country should be grateful to Mr. Paul Mwangi for pointing out this total illegality in the Economic Crimes Act which renders the whole Act illegal as Sadik pointed out. Strangely nobody in parliament has picked up this "elephant in the house" to use Job's words. They better do so now. What a mess this whole thing is going to be. But it has to be done. adongo

I am not a lawyer but I think Paul Mwangi's argument is flawed. The case in court was never about Pattni refusing to transfer ownership of the hotel to the Bank, it was his company challenging the charge the CBK had on the property!!!!! Having dealt with properties that I own and charges to the same by banks when I borrow money, I can claim some knowledge of how these things work. I still await the day you will give us a reasoned statement in Jukwaa that was devoid of tribal idocy, that is civil and actually makes sense. Defending the indefensible is the game they play. Looking for scape goats is onother. Then they also play the ame of moral equivalency - you did it too so why single me out? Or they retreat to their tribalistic shells like jomo jnr did in Kipiri[ir the other day after the Min of Finance kameme or whatever the heck his name is, thought he would dodge the bullet by appealing to his fellow kinsmen and women to support him.
