Sudan President fugitive Omar el Bashir is at Uhuru Park joining Kenyans in the celebration of promulgation of the constitution! Now we know why the government could not reveal the names of these president yesterday.
Omar Al-Bashir has two ICC arrest warrants and Kenya having ratified the ICC Statute has a duty to arrest this criminal on behalf of the ICC.
What an anticlimax for Kenya's biggest day. This is unbelievable.
Bashir is in good company at the VIP dias in Uhuru Park. There are at least 6 ICC suspects at that dias.
The International Criminal Court issued two arrest warrants against the Sudanese President: the first one in March 2009 for crimes against humanity and war crimes, the second one in July 2010 for the crime of genocide. His involvement in thousands of murders, acts of rape and torture, and the forced displacement of the population of Darfur, is in question.
This is the second time that El-Bashir is visiting countries that recognize ICC having been since the issuance of arrest warrants. He was in Chad a few weeks ago, but boycotted the if AU Conference in Kampala last month.
If it does not arrest bashir, Kenya is literally endorsing the evil acts of the Sudanese regime on the people of Sudan.
Kenya has an obligation according to the ICC Statute, and indeed all ICC recognizing countries are under the obligation to cooperate with the ICC, including by executing the arrest warrants issued by the Court.
Is this how Kenya's government plans to show Ocampo the middle finger when he eventually indicts kenyan ministers and other suspects in December?

Folks,
This is was a national embarrassment in probably the single most important day in the republic. Kenyans are celebrating a new dawn with with a brand new constitution and Kibaki and his chaps decide to ruin all that by inviting an indicted international fugitive as a distinguished guest. This is beyond shameful and the message is the big boys will still do whatever they want with impunity. We will see.
May be Bashir should have a welcome mat for the soon to be indicted Kenyan criminals. They can hide all they want in their caves. It is no secret that there has been a lot of pressure by Kibaki and his cohorts to ensure that whoever succeeds Kibaki will protect Uhuru. So far there is not much to save Ruto's behind but I am sure he may try to sell his "kalenjin" votes to whoever can guarantee that protection.
The bad news is that once you are indicted you are over with politically. Let them deal with Ocampo. Even Bashir is sneaking around like a thief in the middle of the night. He knows he is a dead man walking till the day he goes to his grave.

Having been an innocent bystander as Kenyans voted for the constitution and being a proud Kenyan today that saw in the news the jubilation of my fellow countrymen as they ushered in anew dawn for Kenya, I was not surprised that Bashir was on Kenya today.
I showed a colleage out here in Pretoria pictures of Bashir and the Nation report about the whining ICC and my comment was that perhaps if Bashir was to witness the healing and the jubilation in Kenya he may want to look at the weaknesses of his on regime and heal the problems of Darfur and asudan in general.
That is what is required rather than thinking that ICC is the solution for Sudan.

But Kamalet, does ICC then not have any value, or are you suggesting that such value is not to be found in the Sudan case? Needless to say, Kenya has the obligation to hand in the man even if it doubts the potential of the ICC to solve the issue. Kenya did not have to put itself in the position of explaining why it cannot arrest El Bashir. This is a problem created by choice ... Bashir did not need to be invited. Inviting him is showing ICC and the international community "the finger".

As expected with the dimwits at Foreign Affairs (with full State House complicty) - they had to spoil the party.
A front dias seat had to be reserved for H.E. Mr. IMPUNITY just when Kenya thought they'll bury the dirty old ways. Bashir had to be feted no matter the distractions and negative consequences it would invite to Kenya.
And the idiot Wetangula pronouces that 'We must honour our neighbours when they visit us'.
The truth is - Bashir did not invite himself into Kenya.
The ICC fugitive was invited by his corresponding head of state - Mwai Kibaki.
Mwai Kibaki has sent a message to Ocampo & the ICC.
This single act has yet again - opened a cleavage in our short-lived march towards national unity.
Kenyans who yearn for an end to impunity have been offended. Kenyans who lost loved ones during the PEV have been offended. Kenyans who love peace and value sanctity to life have been offended.
All for what? Protecting ethnic warlords who masterminded the slaughtering of innocent Kenyan women and children.
Doing so just at the time Kenyans are almost in euphoric celebration.
What an anti-climax.
Well, we saw it - and we Kenyans shall react, trust me.
On the diplomatic front - this story is just developing.
State Department @ Washington DC is abuzz with talk of the obvious disappointment.
Just like other governments, they knew upfront Kibaki was yet again going to disappoint.
Was there also a clear boycott by other neighbouring Presidents? - South Sudan's Salva Kiir & Tanzania's Jakaya Kikwete? They refused to dignify impunity by sharing a dias with a wanted fugitive.
I think whoever allowed Bashir's coming into Kenya (& leaving as a free man) will soon regret that decision.
From another perspective, this might be a blessing in disguise since that single act (Bashir's hosting) has now brought back Kenya into the visual acquity of the International Community.
What a good way to start the transition phase, with external eyes firmly focused on our internal nitty gritties?

Disaster. major disaster.
Sadly, guys, the entire EU diplomatic community this afternoon also boycotted Kibaki's luncheon at State House after being ambushed by fugitive Bashir at Uhuru Park. Several Mps also did the same. Only the EU Chair went there carrying a protest note as a matter of protocol.
Raila was present but openly rejected the idea of having to be the one to invite Museveni to pass a vote of thanks. Balala's inexperience and amateurish traits showed today as he was the one earmarked to ride in the same car and escort Bashir up to the VIP dias at Uhuru Park. He was so excited. President, Senator, Governor, MP, Balala? Not with these king of bluncer, never!
MPs, diplomats, Kenya Police, media, the public etc, just about everyone was ambushed by Bashir's presence at uhuru park. As we speak, Bashir is safely back at his fortress in Khartoum.
Salva Kirr was apparently present in Nairobi, actually since Wednesday, but opted to stay away from Uhuru Park. Besides the ICC agenda, the SPLM has serious issues to sort with Sudanese President and ruling party regarding the SS referendum due in January.
For the Kenyan government, it is a major diplomatic gaffe. A very serious one that has now needlessly made its way to the UN Security Council desk . I raises doubts about Kenya's commitment to deliver justice to victims of Kenyan's past injustices. To make matters worse, you have Wetangula's undiplomatic and uncouth mouth rolling. Gosh! Kenya is not Chad and if nyayo apologist Wetangula is the government's chief foreign affairs advisor, then it is obvious Kenya has no idea what it means to be anyone's neighbour or even be part of community of nations.
In the meantime, all EU diplomats who boycotted State luncheon were seen enjoying themselves with their spouses at the Prime Minister's cocktail at the Carnivore restaurant (closed for private function tonight). Fireworks blasted, and the real liberation heros occupying the high table. Forget about jailbirds like Pattni holding VIP cards.

job and phil,This was the dumbest move of the old status quo chaps. They screwed Kibaki up big time. I don't know if the old man gets it. He blew the moment and the significance of the day and now he has rotten eggs flying all over. If President Kibaki who had worked so hard for the new constitution doesn't learn from this, he probably will not learn from anything. Obvioulsy he (Kibaki) must have approved criminal and fugitive Bashir's invitation. All invitattions were from the head of state. What a freaking shame! I am stunned Kibaki and his crew did not invite another international fugitive Félicien Kabuga reported to be in Kenya to grace the occassion. There was one missing. This one: Those who did this Bashir blunder will bear the cross. It is going to be a heavy and dirty one. What a pity. They asked for it. They will have to bear it. Kibaki blew his day of glory, once again. What else is new? The nation will move on. We already have ICC wanted criminals in plenty in the country, so what difference does one more visiting State House make? Bring them one, bring them all. These guys goofed big time. The tragedy is that Kenya at large will pay a price for this nincompoop doing. This is a non washable blemish on a grand opportunity otherwise going very well to connect with the world. I suspect even Obama, a man who (along with his government) has already gotten some heat for being a little too friendly, will have to rethink his enthusiasm with the show of friendship. It will take a while to put this blame squarely on the people responsible for it. In the meantime Kenya will bear the unfortunate weight.
I feel for Balala. The man is too naive, and often, naivete of this kind, in my book, is found in good hearted people who overly trust "the friends". Here the man was used like a door mat by "the friends", plain and simple. When I saw Bashir trod in I did not even think the man would be Balala ... Instead I thought "what a look-alike?".

1) Rasputin as chief secretary has been a thorn in the flesh to every pro change force, including the Hon Prime Minister 2)The guy at TJRC - the ex Ambaassador. Why was he put there yet he has beacoup skeletons in his closet. He becomes the issue and derails the TJRC. 3) Look at how inept my hommie Wetangula has been at MoF, he has been consisitently absent during crises. Migingo happened and Wetangula has said or done nothing. Ifacr the lame duck mafiyan sent his police chief to meet with the ugandans. 4) jomo jnr has been an embarassment. He has has one "typo" after another, but the problem with his typos is that they cost money, hundreds of millions of shillings dissapearing into balck holes.
And then this diplomatic snafu.
I am glad the EU reps boycotted the lunch, and the Hon Prime Minister refused to be used like a door mat, the way Balala was.

This was supposed to be our own party, the mother of all parties for Kenyan people!!! And guess who comes to town to spoil the Kenyan and my one and only party in decades???!!! A one Mr. Bashir!!!!
But that is still okay.
Just imagine this, first a Mr Jomo Kenyatta spoils the party for the so called Kenyan first nation. But as if that was not enough, a mass murderer whom we had almost forgiven in the name of Mwai Kibaki comes rubbing the salt in the wound and thereby rubbishing my party of the year for the second and probably the last birth of the Kenyan nation!!!
Mr Bashir belongs to ICC, just like some of his Kenyan counterparts!!
