PUBLICATION OF THE 290 CONSTITUENCIES OF KENYA BY THE INTERIM INDEPENDENT BOUNDARIES COMMISSION After the December 2007 General Election and the crisis that followed, the Kriegler Commission found that representation in Kenya was flawed and pointed to the need to correct the anomaly and give effect to the democratic principle of equality of the vote. Acting on these recommendations, Parliament created the Interim Independent Boundaries Review Commission and entrenched it in the Constitution to insulate it from political interference by any person or authority. The Interim Independent Boundaries Review Commission has held numerous consultations with Kenyans across the board on how they would like to participate in their own governance. It has also employed modern scientific methods in an effort to arrive at decisions that further the country’s journey towards becoming a fully functioning democracy. In undertaking its work, the Commission has been guided by the Constitution. The New Constitution promulgated on August 27, 2010 provides that Kenya shall have 290 constituencies. IIBRC is, therefore, required to create only 80 new constituencies while ensuring that none of the current 210 is lost. Further, the New Constitution does not permit the Commission to change the county boundaries. The new constituencies will be the electoral areas for the 2012 General Election. The democratic principle of the equality of the vote has been given effect by the provision requiring that in creating constituencies the number of inhabitants shall be as nearly as possible equal to the population quota. The population quota is arrived at by dividing the total population of the country with the number of constituencies. Recognising that the country has developed unevenly and also that the population distribution is uneven across the country, the Constitution provides that IIBRC can deviate from the population quota by 40 per cent – upwards in respect to cities and downwards in respect to sparsely populated areas. In all other areas, the deviation from the mean is 30 per cent on the basis of: i. Geographical features and urban centres. ii. Community of interest, historical, economic and cultural ties; and After extensive countrywide public hearings and consultations with all stakeholders at all levels of Kenyan society, the IIBRC together with its highly qualified technical secretariat analysed the recommendations received and obtained a distribution of the 80 new constituencies in accordance with the Constitution. For the first time in the history of Kenya, the number of constituencies in each region will be directly proportional to its population. Following internal democratic decision-making processes, in strict adherence to the constitution and on the advice of the Attorney General, the IIBRC forwarded to the Government Printer on November 15, 2010 the following list of new constituencies for publication. The Government Printer has identified this information as Gazette Supplement No.83, Legislative Supplement No.52, Legal Notice No.185. The following, therefore, is the list of the 290 constituencies of Kenya as determined by the Interim Independent Boundaries Review Commission. thanks phil for this. owing to circumstances beyond my control i did not present my views to the ligale commission nor did i make an attempt to caucus or lobby to the effect. and now that the legal notice no. 185 is out, i want to be a bit selfish,almost local to confine myself to siaya county where i have interest.
i am saddened that the ligale commission did not consider it fit to split alego usonga into alego and usonga as it has done with kasipul kabondo which is now two constituencies.bondo is also more than ripe for split into two. but again,as able andrew ligale---who should know better since this is his ken-- informs me, it was more than just size thing.

Excellent public relations from IIBRC. Since the constitution limits constituencies at 290, it would be foolhardy for any shenanigans trying to block these newly PUBLISHED constituencies.
Hebu let them try to take them back (away) from wananchi who have now read them. This list is now a matter of public knowledge. Word of mouth has spread about the new constituencies and people are already internalizing the change.
I also doubt whether parliament can even contemplate trying to amend the constitution - to increase even more constituencies at the behest of few disgruntled elements.
This move of trying to undermine a constitutionally created body (IIBRC), by blocking these reforms through the courts was ill advised.
It will backfire terribly, leaving these MPs looking greedy and isolated,... leaving another bad face for the Judiciary and the now distinctly notorious government printer.
Was the greed really necessary, after census statistics spoke for themselves?

This is the problem with Kenyan politics particularly when you are dealing with M.Ps. If I ever have a chance to get someone in parliament I would highly support my mother's goat. She has no name. But I am sure she can mix it up with the best of them. If it was earlier on I would go for "Osama" my mother's dog who was very fierce. I am sure he could bark with any of them all day. But Osama passed away so I am down to the goat. Something else could come up. I will update you on that.
The IIBRC fiasco is a classic example of how M.Ps can take a fairly reasonable process and make it ridiculous within minutes, forget days. First it was the Uhuru boys with Muthaura holding their hands. They thought they could sabotage the whole thing. Now they know they can't and they have negligible support in parliament. That is a lost cause. What else is new with Uhuru and his clumsy spanner boys, old and young.
Then the team that supported the IIBRC in parliament. carried the day overwhelmingly. The sabotage masters are on the ropes, they have no plan B. The IIBRC report is most likely to be gazetted next week one way or the other.
And here Isaac Ruto and Olago Aluoch make an attempt to abuse the support the process have from all parties have from all parties in the House by claiming they have authority to censure Saitoti, Muthaura and even the compromised Justice Gacheche. They don't have that mandate and with their reckless behaviour they are rolling back the gains the IIBRC support has achieved in parliament with the support of M.P's all across parties. Let's focus on what is good for the country.
If you want to have a political fight with Saitoti or Muthaura open your battlefield with them elsewhere. Did some people abuse and violate Kenyan institutions to sabotage the IIBRC report from being published and gazetted as requested and approved by the AG on. 15, 2010? YES. Have they succeeded in their evil plan to hold the country hostage and stall fundamental reforms under Agenda 4 of the National Dialogue and Accords? For the most part NO.
Equitable legislative representation and resource allocation were key pieces in the national reconciliation efforts. The IIBRC was established, vetted and charged with that responsibility of giving the country an equitable representative national assembly. For the most part they have done just that very diligently and according to the laws of the land as we speak.
And here is the nation's worry and headache. For apart of the GCG to make such draconian and blatant efforts to destroy the IIBRC constitutionally mandated report even without a clue as to what happens next, the nation has to be alert that there are some real folks running the affairs of the land who don't care what happens next. That is dangerous for our country.
The thing Kenyans want done is to allow the IIBRC to complete its work and to gazette the new constitutions before Nov. 27. That should be the focus, not these other useless political gimmicks.
Some of our M.Ps have gotten carried away with this step aside crap. Focus on what the issue is and let's fix it then you can go back to your step aside politics.
Justice Gicheru should stop playing games. Today he ran away from his office to avoid meeting the IIBRC lawyers who wanted to talk to him because he had made a dumb move to have the case mentioned on Monday Nov. 22, without stating what the purpose of the mention was. What the IIBRC need is for the Chief Justice to do what he did for those who challenged the publishing of the IIBRC report by appointing a judge to hear their case to to MENTION it? That is his job even when he is working with politicians he still has to do his job. So we need that done on Monday.
On Tuesday, the Parliamentary Committee on Justice and Judicial Affairs is holding a meeting with the Minister for Justice and Constitutional Affairs Mr. Mutula Kilonzo who has abused and differed with his assistant minister Cheptumo who answered questions in parliament and supported the IIBRC to the hilt, Kilonzo has also disagreed with the recommendations of the government's chief legal advisor, the AG who approved the gazetting of the IIBRC report. Needless to say, Kilonzo will face a firestorm in parliament if he was to insist on his demonization of the good the IIBRC has done. Let him try.
My advice to the Isaac Rutos and all those standing by the IIBRC report, is simple. Get a grip of the real issues. Focus on what is important. Come up with real solutions. Quit political games on the matter. Work with others and find an amicable solution. Bombastic politics rarely works in our country. Let's learn from that.

High Court Judge Jeanne Gachehe, who has already granted previous orders, issued new ones stopping the Interim Independent Boundaries Review Commission (IIBRC) from publicly declaring any report or recommendation. The MPs, drawn from central Kenya, moved to court on grounds that the Commission hastily and with disregard of criteria threatened to publish the new constituencies.
The group led by Mathira legislator Ephraim Maina said IIBRC did not have any powers to publish the new constituencies.
According to them, such powers lies with the successor of IIBRC, the yet to be formed Independent Electoral and Boundaries Commission.
The MPs have also accused the chairman, Andrew Ligale and two other commissioners of refusing to resign from office despite the fact that he is in the position illegally.
“Their continued participation in the Commission is infringing to the rights of Kenyans to a free and fair electoral system and process," they say.
The group appeared before Justice Jeanne Gacheche who granted them the orders. This becomes the second set of orders to be issued by the same judge even as MPs plot to censure her.
The group, like in the previous application by businessman John Kimanthi, accuse the Commission of failing to consult the public and other stakeholders.
They also accuse the team of using provisional census results. According to them the true census result is yet to be ascertained.
IIBRC considered the Kenyan population in reaching its recommendations to have additional 80 constituencies.
The MPs include: Johnston Muthama (Kangundo), William Kabogo (Juja), David Musila (Mwingi South), Peter Kenneth (Gatanga) and Njoroge Baiya (Githunguri).
Others are: Cecily Mbarire (Runyenjes) , Ferdinand Waititu (Embakasi), Simon Mbugua ( Kamukunji) and Nelson Gaichuhie (Subukia).

This is the part I like most about what Ephraim Maina and co had to tell the court.
“The demarcation undertaken by IIBRC has raised the political temperature so much that the muddled up and the total disregard of the social, cohesion and political recovery the Kenyan society is undergoing following the 2007 post election violence is at risk of being reversed,” they said.
Basically this is a threat that unless the whole world kneels down and accepts their parochial demands they will terrorize the country and reverse it to what happened in the PEV. What kind of nonsense is that? And they have this stupid judge who accepts that kind of blackmail against Kenyans.
I think Kenyans are getting fed up with this threats that whenever politicians do not get what they want they threaten to cause chaos. It may be time to tell them to just go ahead and cause the chaos and let's see how far they can go. The country doesn't belong to a few individuals.
And then we have Mohamed Affey of ODM K, asking President Kibaki and the Prime Minister to disband the IIBRC. The poor fool doesn't even know that neither the president nor the PM has any powers to disband the IIBRC. His head is still stuck in the Moi days and we wonder why the country is in such a mess!

Go to court and file the case in support of IIBRC's group who still have the mandate to print the listed constituencies
Lets all file and see who wins they must file their cases in support of IIBRC's list of constituencies as urgent on Monday and must be heard next week due to the seriousness of these issue as same want to derail the new constitution rules of law
