On July 29, 2011 - the World Bank (of which Kenya is a member) DEBARRED China Communications Construction Company (CCCC) Limited, and all its subsidiaries, for fraudulent practices in Philippines. The suspension runs to January 2017. CCCC is the designated successor entity to China Road and Bridge Corporation CRBC), which GoK has via Kenya Railways Corporation has awarded the multi-billion standard gauge railway project on single sourcing basis.
On January 18 2014 ( just three weeks ago), as Hon Alfred Keter was making noise over the SGR project, it was the turn of Kenya Ports Authority to award tender number KPA/062/2012-13/ID via "Restricted Tender" procurement method to none other than China Communications Construction Company. The contract amount is an eye-watering KES 18,992,419,922.40 billion for construction of the First Three Berths and Association Infrastructure of the Proposed Lamu Port at Manda Bay.
This multi-billion dollar contract signing at KPA was happening at about the same time that the CRBC file was stolen at the Registrar of Companies just before Parliament summoned PS Nduva in a sitting aimed at unmasking the faces behind the local incorporation of the CRBC. One wonders what happened to automation at Sheria House? On its part, KPA claims it received 6 bids, but it is unclear how a debarred company emerged the winner in a competitive bidding process that they opted to restrict to suppliers of their liking.
So even as controversy was raging over the SGR scam, World-bank debarred CRBC/CCCC was still getting public procurement deals under very opaquely dubious circumstances. No due diligence, no open tendering, no local incorporation file at the registrar of companies, the faceless Anglo Fleecing b*stards are back in full swing!
Coincidentally and quite interestingly, Ambassador Francis Muthaura was gazetted as Chairman of the LAPSSET Corridor Development Authority (which has a role in this deal) effective from January 10, 2014. Amb. Muthaura was Head of Civil Service and Secretary to the Cabinet when the Anglo-Leasing Scam was mooted. The same gazette notice that appointed Muthaura also appointed another TNA/Jubilee diehard Danson Mungatana as the chairman of Kenya Ports Authority, for an unusual short mandate of ten months only. It is unclear what the role of these two is in this deal, or in other projects, but clearly Jubilee government wants to ensure trusted hands oversee these deals.
So what was that about Uhuruto fighting corruption when the very individuals who forced Githongo into exile over Anglo Leasing are the same ones behind the Chinese drive of large infrastructural projects using internationally mega-fraud indicted companies? Jubilee fighting corruption is nothing more than an absurd fallacy.

World Bank officials are attached to V-2030 secretariat. These numerous Vision 2030 projects are co-ordinated by GoK inter-ministerial committee, and it is through the ministry of transport and infrastructure that KPA are the implementing agency for the Lamu ports. Kenya Railways is for the standard railway gauge. Ksh18bn is no small change by any standards. Besides, I am not questioning the amount. I am more onto the massively irregular procurement process that is very opaque, and ends up being awarded to a company with questionable past and unknown presence, one that has actually been blacklisted by the World Bank no less! And if you are abreast with news, you must have seen this story yesterday where Registrar of Companies Bernice Gachegu (feigning ignorance) told the National Assembly’s Public Investment Committee that there is a local company registered under the same name as that of China Road and Bridge Corporation, same controversial company that has been contracted for standard railway gauge and the berths at Manda Bay. Shocking to say the least. This is the file that is missing at her office, although we know the registrar's office was long automated. The sly registrar told PIC that the directors of the Kenya-owned company are Peter Maingi Gatere and Leonard Mwangi Ndung’u, most likely proxy directors for the same guys who were largely behind the still unresolved Anglo Leasing mega-scam of the Kibaki regime. (I can even mention to you the names of the power-brokers who have Uhuruto by the balls!) Their analysis is very relevant vis a vis your thread and is proof positive of what they're actually forecasting. ICC's decision on Kenyan president's case risks triggering violenceIHS Jane's Intelligence Weekly 05 February 2014 Key Points The International Criminal Court (ICC) ruling will determine whether President Kenyatta's case relating to his involvement in the 2007-08 post-election violence is delayed or dropped due to a lack of evidence. The case against Deputy President William Ruto is likely to continue. If Kenyatta's case is dropped but Ruto's case continues, the ethnic Kalenjin (Ruto's ethnic group) is likely to feel unfairly treated, resulting in an outbreak of violence against the Kikuyu (Kenyatta's ethnic group); this would be most likely in the Rift Valley, due to Kalenjin grievances over Kikuyu land ownership. The case against Kenyatta's co-accused, former head of the civil service Francis Muthaura, was dropped in March 2013 when it emerged that one of the key prosecution witnesses had lied during his testimony and accepted bribes. Anti-Ruto rebellionThe continuation of only Ruto's trial would also further erode his legitimacy as leader of the Kalenjin. Bomet county governor and council of governors chairman Isaac Ruto (also Kalenjin, with no family relation) has led criticism against the deputy president for interfering in county-level politics and hindering the ongoing devolution process. Governor Ruto is one of the most prominent members of the deputy president's United Republican Party (URP). Governor Ruto leads the influential Kipsigis ethnic sub-group, which makes up an estimated 60% of the Kalenjin, as opposed to Deputy President Ruto's Nandi sub-group. Other high-ranking and respected Kalenjin members of parliament (MPs) have declared support for Governor Ruto, notably Alfred Keter (Nandi) and Zackayo Cheruiyot (Kipsigis). Kipsigis MPs and officials have complained that they are under-represented in the ruling coalition, and as such, governor Ruto is likely to be able to secure a significant amount of support.There are two likely scenarios for how political alliances will reform due to Deputy President Ruto's increasingly weak position: Scenario one: Joseph Kutuny In order to maintain the coalition, President Kenyatta would seek to bypass Deputy President Ruto and engage directly with governor Ruto and the other dissenting Kalenjin MPs. Kenyatta has previously been able to influence governor Ruto. Scenario two: Feeling that it had been made a scapegoat by Kenyatta's party, the URP would probably move closer to the leading opposition party, the Orange Democratic Movement (ODM) led by Raila Odinga. The ODM would be unlikely to accept an alliance with Deputy President Ruto as he previously ran with Odinga in the 2007 election but then switched sides ahead of the 2013 poll. Governor Ruto would probably use an alliance with the ODM to position himself not just as leader of the URP, but also as a presidential challenger in 2017. The ODM is holding a leadership election on 28 February 2014, and has seen a number of key members defecting or withdrawing from the race - notably Franklin Bett and Kenneth Marande. Odinga is therefore likely to win the election, but with a much weaker mandate. Given Odinga's weakened position, the URP would be the leader of the alliance instead of in its previous position as a minority partner. This second scenario is also likely if President Kenyatta initially attempts to co-opt the members of the URP opposed to Deputy President Ruto but then seemingly reneges on concessions made towards devolution and for Kalenjin. The second scenario is therefore more likely than the first.A URP-ODM alliance poses a higher risk of inter-ethnic violence, particularly surrounding the 2017 election. This alliance would probably be formed on an anti-Kikuyu basis, as was the case in 2007-08. However, if members of the URP were to be implicated in the 2007-08 violence, this would be likely to mitigate the risk of escalation of violence, as they would seek to avoid prosecution. FORECASTIn the immediate aftermath of an ICC decision, the greatest risk is ethnically motivated violence between Kalenjin and Kikuyu. This is likely to be primarily Kalenjin targeting the Kikuyu and affiliated businesses in the Rift Valley, with severe risks of reprisal attacks. Violence is unlikely to spread beyond small-scale arson and panga (machete) attacks within the Rift Valley, as respected ethnic elders would probably call for calm before it escalates. However, companies in the Rift Valley will face a risk of collateral damage even if they are not directly targeted, and there is a risk of increasing crime if the security situation deteriorates. The agribusiness sector - particularly tea and maize farms - is likely to be the most severely disrupted given its prominence in the Rift Valley and the fact that it is Kalenjin-dominated and would therefore be exposed to risks of reprisal attacks. The changing alliances will also pose varying risks in terms of political violence in the three-year outlook. If Kenyatta successfully co-opts governor Ruto or other prominent Kalenjins, the risk of violence would be reduced. However, a union between the URP and ODM, with the potential of gaining support from other smaller opposition parties, would be formed on an anti-Kikuyu basis, and would increase the risk of a similar pattern of violence as seen in 2007-08. Notably, this would include violence in Rift Valley, Western, and Coast provinces, where Kikuyu are considered to have occupied land. However, political leaders are unlikely to take an active role in orchestrating violence, as was allegedly the case in 2007-08, which would curb risks of violence escalating to that same scale.Until the 2017 election, the shifting political alliances are likely to result in several new political leaders rising to prominence. Firms that were previously associated with Deputy President Ruto are likely to have to seek new political patrons in order to not be overlooked in competitive tendering. There is also an elevated risk of legislative stalling while political leaders focus on forming alliances. However, this is unlikely to result in a dramatic change from the current situation, given that the presidency has been preoccupied with derailing the ICC case. If the URP chose to ally with the ODM, it would probably seek to undermine Kenyatta's party by targeting the infrastructure sector, which is key to his election manifesto. ALSO, elsewher on Jukwaa, we are pondering the corruption allegations as they were long ago raised by young Alfred Keter. Some even asked why it was not the opposition raising the obvious! then we understood the SGR was launched in 2009, and supervisor and coordinator of cabinet activities in those days was ehmmm... do you happen to know who he was?! Otishotish, if you read my intro to the post then you probably noted that I followed Phil's instructions to keep things "relevant" to his thread. That said, if you insist on being anally retentive about matters, then other points of interest may have cropped up to you. For instance, did you note how Jane's assessment of the possibility of violence between the Kikuyu & Kalenjin taking place if Uhuru's case is dropped? Doesn't that sound a lot like the recent letter from NGO's based in Kenya calling themselves the "Friends of Bensouda" to the ICC imploring them not to drop the case as violence would erupt? The difference is where Jane's says it will be minimal, no doubt the NGO's painted the usual gloom, doom & Armageddon prophecies for KE. Also, did you note their scenario 2 indicating a possible alliance between ODM & URP, which they believe will is more likely to play out than scenario 1? There are enough forecasts in the piece for which all we have to do is sit & wait to see what happens on 28th February. Alas, look what you made me do. That said, if you insist on being anally retentive about matters, then other points of interest may have cropped up to you. For instance, did you note how Jane's assessment of the possibility of violence between the Kikuyu & Kalenjin taking place if Uhuru's case is dropped? Doesn't that sound a lot like the recent letter from NGO's based in Kenya calling themselves the "Friends of Bensouda" to the ICC imploring them not to drop the case as violence would erupt? The difference is where Jane's says it will be minimal, no doubt the NGO's painted the usual gloom, doom & Armageddon prophecies for KE. Also, did you note their scenario 2 indicating a possible alliance between ODM & URP, which they believe will is more likely to play out than scenario 1? Ideed, I wish our comrade adongo 23456... and our good daktari job were here with us once again. And of course I acknowledge mzee and prominent others who have somehow maintained a distance from Jukwaa. Nevertheless, DC is also ours even though some of us have grown cold in our posts contributions. Wakenya ni ndugu, if only we know how!
Having said that, I am glad that we have Jakaswanga with us in Jukwaa, and our OtishO, brother Kamale, b6k, rastafarian mank, Omundustrong, and all others who keep Jukwaa running and informing us who are somehow quiet!
Coming back to the topic in this thread, I am personally in pain seeing what is unfolding before my very eyes on matters and scale of corruption that is currently taking place. What makes me even more sad, is the fact that there is hardly anyone else whom we can begin to imagine will eliminate the vice. Kenyans are being levied from every direction, if just for the sake of lining the pockets of their elected representatives. The nation's wage bill is like a runaway train, with its county governors spending most of their time abroad, with their MCAs on tow, eti luring investments and seeking those life bonding loans and what have you.
A friend of mine once told me that he hates Kenya as a Kenyan! Well, I don't actually hate it, although I wish I could love it even more. I hate its politicians though. Alomst all of them MFokers! My only consolation is in knowing that one day they will all and individually taste the darkness of their tombs!

The Jubilee corruption is getting out of hand amidst suffering Kenyans being tested to the limits through increased taxation, dictatorial laws and a very insecure regime that we are told won the elections on round one.
