Senior Internal Security ministry officials used a secret account at National Bank of Kenya to siphon billions in taxpayers’ money from public coffers in the run-up to last year’s General Election, we can reveal.

The money disappeared into a slush fund whose purpose remains unknown.

A report on government spending for the year 2012 says auditors unearthed the existence of a secret account at National Bank where Sh2.8 billion was wired and spent on items marked as ‘confidential’.

It points an accusing figure at former accounting officers in the security docket at the Office of the President.

The parliamentary Public Accounts Committee (PAC) says in its audit report for the year ended June 2013 that former Head of Civil Service Francis Kimemia and the then PS for Internal Security Mutea Iringo were the accounting officers at the time.

PAC, which is chaired by Budalang’i MP Ababu Namwamba, reckons that both Mr Kimemia, the Secretary to the Cabinet, and Mr Iringo, the Defence PS, who have previously served in the Internal Security ministry in the same capacity should be held responsible for presiding over the scandal.

The NBK slush fund was masked as a general account and was used to withdraw huge sums of money whose expenditure is not documented, the PAC report, which was tabled in Parliament on Wednesday, says.

“To circumvent the established regulations, the ministry operates an account at National Bank of Kenya (NBK) that is parallel to the regular account at the Central Bank of Kenya (CBK),” the Ababu Namwamba-led committee says in the report, adding that the account, though referred to as Police Account (P.Com), is operated as a general account at Office of the President (OP).

“It seems customised to irregularly facilitate unlimited cash withdrawals beyond the set limits,” the committee says before concluding that the Sh2.85 billion expenditure “was so opaque and smacks of loss, wastage, misapplication and pilferage.”

The multi-billion-shilling scandal raises fresh integrity questions over the management of public resources at the Presidency which is directly in charge of the key security docket that has been under pressure with the continuing rise of terrorist activities in the country.

President Uhuru Kenyatta has personally admitted the existence of powerful cartels in government, including his office, who he accuses of working at the behest of shadowy investors to fleece the taxpayer.

The PAC report reckons that all the fraudulent dealings at the defunct Ministry of Internal Security and Provincial Administration were executed by one officer named Ben Kihia, a senior accountant at OP.

The report singles out 48 cash withdrawals from the secret account between July 2012 and March 2013 totalling Sh1.1 billion.

The 27-member committee noted that Mr Kihia had served in the position for almost a decade, and had resisted his transfer to the Ministry of Industrialisation and Enterprise Development.

“He recently refused to honour his transfer to Ministry of Industrialisation. Months after the notice of transfer, Mr Kihia continues to serve at OP, and no action has been taken,” says the report.

PAC has now directed the Ethics and Anti-Corruption Commission (EACC) to investigate the conduct of Mr Kihia and take appropriate action.

The voluminous PAC report paints a picture of a well-orchestrated plunder scheme at the Office of the President coordinated by Mr Kimemia and Mr Iringo where cash withdrawals of up to five times a day were made from the slush fund.

The OP operatives, for instance, withdrew a total of Sh130 million on February 26, 2013 — barely five days to the General Election.

“The committee expressed grave concern that indeed the so-called confidential expenditure involved huge cash withdrawals with neither explanation nor any logical rationale,” Mr Namwamba said.

The Internal Security ministry is in charge of the Police Service, Directorate of Criminal Investigation, Immigration, Government Printer and National Authority for Campaign against Alcohol and Drug Abuse (NACADA).

The report shows that the ministry also made irregular spending during the procurement of 300 residential units on Nairobi’s Kangundo Road for police officers.

PAC says that the ministry paid single-sourced East Gate Apartments Ltd to develop the houses at a cost of Sh1.3 billion.

MPs made a visit to the apartments and established that it lacked a title deed, houses’ plinth area was smaller than indicated, some units were sold to civilians, and that the construction smacked of poor workmanship.

“There is no evidence in form of title deeds that the land and 300 units purchased have been transferred to the ministry,” PAC says in the report.

Besides, the directors of East Gate Apartments Ltd could not be identified and the committee fears that it may have been backed by powerful OP operatives.

“There is need to lift the corporate veil to determine the real faces behind East Gate Apartments,” PAC says as it recommends EACC to investigate the matter further.

The Police secret account at NBK is the highlight of the PAC report which shows that the Kibaki government could not account for more than Sh60 billion spent by publicly funded bodies during its last year in office.

The Independent Electoral and Boundaries Commission (IEBC) tops the of big spenders who were unable to explain their runaway expenditure having failed to account for Sh35.1 billion it spent on BVR kits and the printing of ballot papers.

It is followed by Ministry of Medical Services which failed to account for (Sh13.2 billion), Roads (Sh6.3 billion), the Judiciary (Sh2 billion), State House (Sh105 million) and the Sh1.5 billion lost in ghost projects funded by Constituency Development Funds (CDF).

The report spotlight now turns on the accounting officers in the identified departments who were the PSs – meaning that Mr Kimemia and Mr Iringo have a tough job of shedding light on the NBK slush fund.

“The accounting officers and all officers involved must face the full force of the law for violating the letter and spirit of the constitution, statutes and regulations,” says PAC in its recommendations.

Article 226(5) of the constitution demands that accounting officers such as PSs, State House comptroller, IEBC chief executive and the Judiciary registrar bear direct personal liability for any public funds lost, wasted or misapplied under their watch.

“If the holder of a public office, including a political office, directs or approves the use of public funds contrary to the law, the person is liable for any loss arising from that use and shall make good the loss, whether the person remains the holder of the office or not,” the law says.

Revelations that public officers colluded to swindle taxpayers of billions of shillings comes a day after Kenya was ranked poorly at position 145 out of 174 countries with a score of 25 per cent in this year’s Corruption Perceptions Index.

“Poorly equipped schools, counterfeit medicine and elections decided by money are just some of the consequences of public sector corruption,” said José Ugaz, chairman of Transparency International.

“Bribes and backroom deals don’t just steal resources from the most vulnerable – they undermine justice and economic development, and destroy public trust in government and leaders.”

I am curious on an aside: do you think our benefactors, the Americans who contribute a lot to our security budget in addition to funding the ''andilas'' (derivative drugs) that keep many an aids-patient in life, do not know of these massive thefts?

I mean, why do the Yankees expend American taxpayer's money on a country which obviously can afford to keep her citizens in health if it were better run? why don't they help us up our game in the anti corruption fight? Really, it is not like every American is on Medicare or Obamacare or whatever they call it! (40 million Americans, mostly latinos and blacks are medically destitute, so why don't the Yankees take care of their home business first, and tell their Nairobi friends to eat less! that being the economic better sense for everybody?)

Jakaswanga, why are you assuming your BENEfactors always mean you well? If you want to study the efficacy of things like a "lost cause" disease like HIV/AIDS with ARV's, the more you dish out for free in human experiments the better. After all has anyone independently verified that what we are given are all really the same thing? Modern drugs are poisons. That's why we have a Poisons Board or some such outfit overseeing the distribution of medication.

A few weeks ago I read an old book from the late 1970's called "The Arms Bazaar: From Lebanon To Lockheed" by Anthony Sampson. It was all about the arms industry back in the day before the US banned their corporate entities from bribing client state officials or governments. In fact, back then they openly encouraged companies to go with the flow and do as the Romans in whichever target country they were supplying did. In short, bribes were the norm not the exception. In fact they were openly encouraged to make payouts by US embassies in whichever countries bribes were considered a part of conducting business.

Eventually when the scandal of the bribes for arms came to light more for the exorbitant amounts, governments from Europe (notably Holland) to Japan were rocked. The Japanese government actually collapsed. Kenya had a minor mention as corruption was not yet the order of the day (this was probably when 10% was acceptable, not the anglofleecing amounts that have become the order of the day currently).

What am I saying? If one can seal the deal today by agreeing to look the other way when knowing a client state can do better if its leaders fleeced it's population less, how would that help maintain the status quo? It's the same old racket with the rules of engagement tweeked to have the benefactor save face after giving the odd lecture every now & again should someone get caught out.

There being no honour among thieves, the case of the thieves who stole from the thieves would be, academically speaking, an interesting jurisprudential occasion brought before the Supreme Court whose high chairman, Willy Mutunga, is the titular head of another thieving racket, the JSC.

The former secretary to this high JSC body, Glady's Shollei, whose unmatchable efficiency oversaw the smooth swearing in of the Uhuruto complex into office, is, howbeit O God, just another of the cheats paying out bribes to have a happy ending with her contraband goods pilfered from Wanjiku.

2. REPORTED BRIBERY ALLEGATIONS IN RESPECT OF THE JUDICIARY INQUIRY

At a sitting of the Committee held on Tuesday, February 17th, 2014, the Committee Vice-Chair, Hon Cecily Mbarire tabled the February edition of the Nairobi Law Monthly (NLM), which had published allegations of bribery. The story, on page 17 of the magazine, reported that bribes linked to the former Judiciary Chief Registrar, Mrs. Gladys Boss Shollei, had been conveyed to some members of the Committee through “a vocal female MP from Eastern…known for corrupt dealings”. The last tranche of the bribe loot was reportedly Kshs 4 million collected by this member to be shared with others.

Hon Mbarire submitted that this inference pointed to her. She further claimed that she had reliable information that this story had been leaked by myself to Mr. Ahmednasir Abdullahi, the NLM publisher. After defending myself against this allegation, Hon Mbarire withdrew her accusation. But the serious bribery allegations published in the respected Nairobi Law Monthly remains on the Committee record.

Ah yes, it is a small incestuous pond, the same names keep on surfacing!
But let us see the genesis of the anger of Mr. Mutea Iringo, who is scaring speaker Linturi into camera hearings. Mutea Iringo is the guy at defence. That is the key security docket. And the president himself confessed: Therein, right under his nose at the OP, is the nucleus of rot.

If the President himself is powerless before these guys, who is Justin Linturi to face them?

MEMBERS of the Public Accounts Committee were reportedly paid millions in the presidential suite at Serena Hotel last August.
The committee is now being probed by the parliamentary Committee of Privileges for taking bribes to doctor reports.
“The issues you are witnessing in PAC are the result of protracted wars amongst members smarting over sharing of bribes," one MP told the Star yesterday. Two other MPs repeated his allegations.

Their names are known. The probe, to be done in secret now, is headed to be one of those cover-ups. How should honest Kenyans respond to this latest outrage.

"It is not strange in committees. However in PAC some members took more than they deserved and wanted us to endorse reports blindly,” the MP said.
He claimed that four PAC members met a top state officer at the Serena in August last year where they received Sh10 million to doctor a report on confidential government expenditure for 2012/2013.
Two other reports were also allegedly doctored on dates between April and December.
The official reportedly channeled the 'payments' through one MP who was supposed to ensure that it was shared between 'key' members of the committee.
However the 'facilitator' only paid them Sh1.5 million each and allegedly pocketed the rest.
The disgruntled MPs then allegedly spilled the beans to other committee members at a PAC retreat in Mombasa.

No honour among thieves!

Some MPs refused to sign the final report of the committee on government expenditure for the financial year 2012/2013 but it was eventually tabled in parliament on a majority vote.
The top official reportedly summoned the so-called 'influential' PAC members to influence them to doctor their investigations into the Auditor General's report that referred to the secret transfers of large amounts of money at the Office of the President.
During a lengthy meeting the official struck a deal with the MPs to save him. The MPs apparently promised to water down the investigations into 'confidential security accounts' in the Office of the President.
The AG's report identified the unaccounted for withdrawal of Sh8.3 billion in 2013 in the transition period between the Kibaki and Uhuru governments.

This figure is important. Because in the fall out following PAC members swindling themselves Mr. Iringo's facilitation , we now know how the figure in the final report was whitled to 2.8 bn.

Wanjiku's account still reads 5.5 billion deficit!
The suspended incorruptible chairman of PAC must adress this figure. And really, Mutea Iringo and his gang can not possible expect to embezzle 8.3 billion and have even an incompetent report written exonerating their names!
What kind of moron would write a moron report detailing proven cash withdrawals totalling even the ''corrected' (8.3bn-5.5bn) without specifying who and who signed the checks!?
Iringo was asking for too much –-to have his name totally expunged! When the security men were fronting him to sign those cheques what did he think? That they did not know such things come back to bite, even in a land of impunity, and thieves have honour!?

The money was allegedly withdrawn from accounts registered to the Commissioner of Police and the Office of the President. However the office of the Commissioner of Police no longer existed as it was replaced by an Inspector-General of Police in 2012.
The AG further revealed that Sh2.8 billion transferred from the Office of the President to the “police commissioner’s account” was not receipted and the withdrawal was not approved by the accounting officer.
The PAC eventually agreed to slash the total suspicious amount from Sh8.3 billion to Sh2.8 billion.

The ''set of facts'' that ''led to this agreement'' to slash the suspicious amount by ksh. 5.5 billion, will of course now be ''secret'' and classified! They will be tabled in camera!

Last week bribery allegations resulted in the Speaker of the National Assembly Justin Muturi suspending the committee's operations for three weeks. The committee is now being probed by the Privileges committee led by Kuresoi North MP Moses Cheboi.

Moses Cheboi is already gagged before he opens his mouth –-the hearings will be in camera. So, Moses Cheboi, if he agress to hiding the truth from Wanjiku, is just another plaster or bandage.
Let him know if he complicits, he will soak so much blood he will be dripping all over, revealing the secret they wish to hide.

Committee chairman Ababu Namwamba has denied receiving bribes but says he has a recording of some MPs admitting receiving bribes.
Yesterday Namwamba told the Star that he recorded a conversation between himself, two PAC members and CORD leader Raila Odinga to deal with claims of corruption in his committee.
The Budalang'i MP is due to appear before the Privileges committee this morning and will later address a press conference. He is likely to play the tape to the committee.
Namwamba showed the Star a letter he wrote to Muturi, the day before last week's attempt to sack him as PAC chairman, where he raised the failure to agree on three reports, the bribery allegations, and lack of respects among committee members.

Top officials on the spot over transfer of Sh8bn from State’s secret accounts

The Office of the President (OP) is in the spotlight over the suspicious transfer of Sh8.3 billion into and out of the government’s secret security accounts.

Large transactions happened during the 2013 transition period, raising audit concerns.

The Auditor-General’s report, released a month ago, flagged some of the cash movements.

A source with close knowledge of the workings of the OP said the large cash transfers were part of the reason President Kenyatta transferred senior officials and procurement staff.

The leaks point to serious behind-the-scenes infighting at the OP, whose top officials are powerful because of their proximity to the presidency, their control of large budgets and security responsibilities.

Joseph Kirubi, the former director of finance and administration at the President’s Office, was removed in March alongside more than 100 procurement staff after the President ordered their redeployment.

AMMOUNT 'SCANDALOUS'

On Monday, Defence Principal Secretary Mutea Iringo, who as permanent secretary at Internal during the transition was the accounting officer, pointed out that his transfer last Thursday had nothing to do with audit queries.

“Someone is trying to be malicious. My transfer has nothing to do with it. The mentioned amount is scandalous, it cannot be,” Mr Iringo said when contacted by the Nation.

His boss at the time, Mr Francis Kimemia, who was head of Public Service, was also demoted to the less glamorous job of Secretary to the Cabinet.

The big job went to former Treasury Permanent Secretary Joseph Kinyua, who also doubles as President Kenyatta’s Chief of Staff.

LARGE WITHDRAWALS

The Nation has seen copies of documents that show withdrawals of cash through accounts registered under the Commissioner of Police and Office of the President, long after the Office of the Commissioner of Police was scrapped and an Inspector-General of Police sworn in in December 2012.

The Auditor-General’s report questioned these withdrawals and another Sh2 billion that had not been accounted for.

“During the year under review, the ministry transferred a total amount of Sh8.3 billion to Kenya Police Service through contra-entries on cash book and Ministry headquarters recurrent bank account amounting to Sh1.4 billion and Sh6.9 billion respectively.

“On March 14, 2013 alone, Sh2 billion was transferred through account number 0-101-000-6530101 through voucher number 272 under the account name Police Commissioner which was closed in December 2012.”

PAYMENT VOUCHERS

The Sh2 billion was withdrawn only four days after the declaration of official presidential results by the Independent Electoral and Boundaries Commission.

The Auditor-General’s report states: “The transfer of Sh1,415,000,000 through contra entries was not supported by payment vouchers contrary to section 5.5.11 of the Government Financial Regulations and Procedures.”

The auditor further revealed that Sh2.8 billion out of the Sh8.3 billion transferred from OP to the said “police commissioner’s account” was not receipted and that a further examination of the Police account revealed the withdrawal was not approved by the accounting officer.

UNACCOUNTED FUNDS

In the audit report, the Ministry of Interior and Coordination of National Government, which took over some dockets previously under the Office of the President, is said to have attempted to prove the financial movement of Sh2.3 billion of the Sh2.8 billion under audit as unaccounted funds, claiming it was re-channelled to the ministry from the police headquarters.

But auditors were unconvinced.

The report states: “The ministry purports that cash amounting to Sh2.3 billion was transferred from Kenya Police headquarters back to the Ministry of Interior and Coordination of National Government.

“However, the justification and utilisation of the alleged security funds by a non-security agent has not been explained. Further, the explanation for the remaining Sh511,000,000 has not been factual.”

PROHIBITED REALLOCATION

The report states that the Ministry of Interior, then under Mr Iringo as PS, claimed that it transferred Sh400 million to the National Intelligence Service.

But the auditors rejected the explanation, arguing that the law prohibited reallocation of funds from one government entity to another.

Said Mr Iringo: “We gave all responses to the audit queries as raised by OAG (office of Auditor-General). Everything must have been explained to them. There is nothing we never explained.”

Further, the ministry’s claim that it paid Sh25 million to the Criminal Investigations Director on March 8 was also rejected after verification of cheque number 08619, through which the payment was made, was found to have originated from the ministry and not from the Kenya Police headquarters.

CASH PAYMENTS AT ELECTION TIME

Payment vouchers seen by the Nation revealed a sequence of payments, mostly in cash, around the time the country was engaged in elections.

The Inspector-General of Police was unavailable for comment while Mr Kirubi, who is now at the Ministry of Mining, did not respond to calls and several text messages.

The last Commissioner of Police, Mr Mathew Iteere, retired on December 24, 2012.

But OP officials continued to credit millions of shillings to the Commissioner of Police’s official account as late as June this year.

Normal practice at the security docket is to open an account into which a specific amount of money is put for use by the person in charge of the police to discharge his duties.

OPEN TO ABUSE

This confidential expenditure is normally not questioned, with the auditors saying it is open to abuse.

Intriguingly, Mr David Kimaiyo had taken over as Inspector-General of Police on December 21, 2012, and a new account was supposed to have been opened for him.

Four times, millions of shillings were also deposited in his account.

There are numerous examples that the Nation has seen of millions credited into the account of the Commissioner of Police, long after it ceased to exist, and the money then withdrawn by OP officials.

Beleaguered Public Accounts Committee Chairman Ababu Namwamba has accused Defence Principal Secretary Mutea Iringo of conspiring to have him kicked out of the committee because of investigations into how the Interior Ministry spent Sh2.9 billion from secret funds.

Mr. Speaker,

RE: INTEGRITY AND ETHICAL ISSUES IN THE PUBLIC ACCOUNTS COMMITTEE (PAC)

On Wednesday, 18th February, 2015, in your chambers, I briefed you at length on the happenings in the Public Accounts Committee (PAC), which have pretty much crippled operations of this key Committee. Among the measures you and I agreed on was that the Ethics and Anti-Corruption Commission (EACC) be invited to investigate allegations of impropriety attributed to some members of the Committee. You subsequently attended a meeting of the Committee that same day, where a section of the members vehemently opposed my motion to call in the EACC.

In view of the very loose, unhelpful and manifestly speculative dimension this matter has since taken, am obliged to put on record the gist of the issues discussed with you at the said 18th February meeting, together with further details that have since emerged.
From the outset, let me reiterate my already stated view that the issues here are weighty and deserve substantive attention; but the issues now unfortunately run the risk of being clouded by partisan politics and self-serving pontificating. The issues primarily revolve around three investigations by the Committee, namely:

1. Confidential Expenditure under the 2012/13 annual audited accounts of government;
2. Inquiry into diverse transactions by the Judiciary; and
3. Inquiry into procurement of five sets of electoral equipment by the IEBC in the run up to the 2013 General Elections.

Let me enumerate here four key issues emanating from these three investigations that have come to my knowledge, and which touch on both ethics and integrity of the Committee:

1. FAILED CONSPIRACY TO SAVE MR. MUTEA IRINGO ON KSHS 2.9 BILLION “CONFIDENTIAL” EXPENDITURE

I have reliably gathered that even as a majority of us in the Committee worked overtime to clear the 3-year backlog of audited accounts, some members of the Committee were apparently busy engaging persons under investigation with the motive of soliciting for and/or receiving favours to improperly influence findings of the Committee.
I have it on record that Defence PS, Mr. Mutea Iringo, met four members of the Committee at Silver Springs Hotel for this purpose. They were Hon Omondi Anyanga, Hon James Bett, Hon Abbas Ahmed and Hon Samuel Arama. At the meeting, it was agreed that Mr. Iringo would provide money and facilitate business opportunities at the Department of Defence (DoD).

At least Kshs 1.5 million is confirmed to have been collected in cash from Mr. Iringo by Hon Anyanga, who shared with the members named herein above, together with Hon Kareke Mbiuki and Hon Cecily Mbarire. I was to be strictly kept in the dark, because I am not “flexible”.

The assignment for these members was to ensure that anything adverse to Mr. Iringo would be expunged from the Committee’s final report.

This, however, was not (rofl)achieved. Mr. Iringo is reportedly upset that he paid for a service not rendered, a fact that has left the involved members quite shaken, and upset with me for firmly protecting the integrity of the report, which returned a damning verdict on the PSs in office when the questionable Kshs 2.9 billion expenditure was undertaken.

A recorded audio confession in my possession, and phone records of the named members, especially Hon Bett and Hon Anyanga, easily and unequivocally confirm the liaison between Mr. Iringo and the named members. The findings and recommendations in the final report tabled in the House in December, 2014 by myself on behalf of the Committee confirm that this scheme failed, to the chagrin of the plotters.

2. REPORTED BRIBERY ALLEGATIONS IN RESPECT OF THE JUDICIARY INQUIRY

At a sitting of the Committee held on Tuesday, February 17th, 2014, the Committee Vice-Chair, Hon Cecily Mbarire tabled the February edition of the Nairobi Law Monthly (NLM), which had published allegations of bribery. The story, on page 17 of the magazine, reported that bribes linked to the former Judiciary Chief Registrar, Mrs. Gladys Boss Shollei, had been conveyed to some members of the Committee through “a vocal female MP from Eastern…known for corrupt dealings”. The last tranche of the bribe loot was reportedly Kshs 4 million collected by this member to be shared with others.

Hon Mbarire submitted that this inference pointed to her. She further claimed that she had reliable information that this story had been leaked by myself to Mr. Ahmednasir Abdullahi, the NLM publisher. After defending myself against this allegation, Hon Mbarire withdrew her accusation. But the serious bribery allegations published in the respected Nairobi Law Monthly remains on the Committee record.
Curiously, my motion to invite the publisher of the Nairobi Law Monthly to shed more light on this matter before the Committee was strongly opposed by Hon Mbarire. Tellingly, in her opposition, Hon Mbarire was stridently supported by Hon Anyanga, Hon Abbas and Hon Bett.

How this initial allegation against Hon Mbarire swiftly mutated to a full-blown accusation of impropriety against myself was the masterstroke in the grand conspiracy to save Hon Mbarire from published allegations, by casually dropping false accusations against me in a cynical, careless unsubstantiated manner that grossly violated Standing Orders of the House.
This matter is alive and cannot be wished away. Whatever political games are played, we must get to the root of the matter.

3. ATTEMPT TO PROCURE IMPROPER FAVOURS FROM A SUBJECT OF INQUIRY IN HYDERABAD, INDIA

In December, 2014, I led a delegation of six (6) members of the Committee and two clerks to India on the final leg of our preliminary inquiry into the five IEBC transactions. The members, besides myself, were Hon John Sakwa Bunyasi, Hon Jessica Mbalu, Hon Kyengo Katatha Maweu, Hon Omondi Anyanga, Hon James Bett and Hon Gonzi Rai. Logistics for our stay in New Delhi were made by the Kenyan High Commission.
When we transferred to Hyderabad, we were received by officials of 4G Identity Solutions, the Indian firm at the heart of our inquiry. As leader of delegation, it came to me as a shattering shock when Hon Anyanga demanded that the delegation accepts favours from 4G Identity Solutions, specifically payment of hotel bills, meals and local travel. I flatly rejected this on ethical grounds, and got the hotel to cancel a bills payment arrangement they had already made with 4G. Apparently, this did not go down well.

Hon Omondi Anyanga was particularly upset with me, for rejecting what he described as the “common practice everywhere we travel”. Hon John Sakwa Bunyasi, other honest members of the delegation, 4G Identity Solutions, and TRIDENT Hotel, Hyderabad can all corroborate this information.
To be fair, the rest of the delegation accepted my verdict, except Hon Anyanga. He has never stopped hounding me over this incident. As recently as two days ago, Hon Anyanga told me this “rigid principles” is one of the reasons some members have a problem with me. Indeed this “rigid” narrative of Hon Anyanga is consistent with subsequent evidence that has emerged as this saga has unfolded.

In my recorded evidence in respect of the confidential expenditure, a member clearly says the bribery schemers could not involve me because I was too rigid and would not accept to play ball.

4. INTERFERENCE IN INVESTIGATIONS BY COMMITTEE CLERK, MR. GEORGE GEZEMBA

The full picture of the integrity crisis in PAC, and the National Assembly by extension, would not be complete without paying attention to the serious crisis in the committee clerking services. As PAC chair, I have on numerous occasions complained to the Director of Committee Services, Mrs. Florence Abonyo, over the conduct of one particularly notorious clerk, Mr. George Gezemba, who, quite unfortunately clerked PAC for about three years.

My complaints touched on Mr. Gezemba’s questionable integrity, poor work ethic, indolence, incompetence and disrespectful demeanour. After myriad complaints from myself and other members, I literally threw out Mr. Gezemba from a Committee retreat in Kisumu last December that was to discuss the draft report of the Judiciary inquiry. I duly briefed the Director of Committees, who finally withdrew Mr. Gezemba from PAC and replaced him with Mr. Mutunga.

Among the serious breaches of integrity and ethics by Mr. Gezemba include:
1. Disappearance of supporting documents submitted by auditors and witnesses. While concluding the report on Confidential Expenditure and Housing Units for police, some key documents tabled by lead Auditor, Mr. Esau Ndeda just vanished. We had to desperately fly Mr. Ndeda to Mombasa to fill in gaps. We also made frantic efforts to have the Director of Committee Services dispatch to us raw electronic recording of Committee proceedings in our desperation to salvage critical evidence that appeared to have been deliberately “lost” by Mr. Gezemba.

2. Mr. Gezemba also deliberately drafted the Judiciary report in a manner suspiciously intended to favour a key person under investigation. On three occasions, I personally led the Committee to see that his drafts were grossly at variance with evidence and testimonies rendered to the Committee. These mischievous yet dangerous games by Mr. Gezemba seriously compromised the pace of the key Judiciary inquiry, as two report writing retreats aborted because of doctored reports that I found unacceptable. These are among the key reasons why I insisted Mr. Gezemba be removed from the Committee.

PAC TAKEN HOSTAGE BY MULTIPLE INTERESTS AND FORCES

I submit that the crucial Public Accounts Committee (PAC) has been taken hostage by five distinct interests:

1. Independent Electoral and Boundaries Commission (IEBC)
:
This week PAC was scheduled to commence open hearings on procurement of 5 sets of equipment used in the 2013 general elections. Chairman Mr. Isaack Hassan was listed as the first witness to appear before the Committee, to testify based on a special audit report prepared for PAC by the Auditor General and reports of independent preliminary inquiries conducted by the Committee.

For some reasons, IEBC-linked interests are scared dead of having me in the chair as we commence this crucial process. They have hatched a plot to remove me and install a puppet chair that would cause them no “headache”. Their choice is Ijara MP, Hon Ahmed Abbas, and for obvious reasons. Majority Leader Aden Duale is reportedly at the heart of this conspiracy.

2. The Judiciary

The eruption of this saga was triggered by the Judiciary inquiry. Among the key Committee agenda for the week commencing February 16th, 2015 was to conclude the long-delayed report on expenditure impropriety in the Judiciary. With past games played by clerk George Gezemba in respect of draft reports, and the posturing of some members over this matter, it is certain that some very powerful forces are hell-bent on influencing the report in a particular direction. Those forces obviously do not trust I will play ball with them.

3. Office of the President (OP)

President Uhuru Kenyatta is on record for admitting that corruption is endemic in government, with its tentacles firmly anchored at OP. The PAC report on government’s 2012/13 accounts clearly demonstrates this, particularly through the Committee’s exposé on the so called “Confidential Expenditure”. The Lords of graft and impunity have been shaken to the bone marrow by this exposure, which is the first time ever. Their panic is further manifest in efforts to tie the hands of the Auditor General through the Audit Bill 2014, whose shamefully unconstitutional provisions like clause 40 are tailor made to protect their theft from ever again being audited and scrutinised by PAC.

This matter gets murkier by revelations that OP mandarins, through PS Mutea Iringo, bribed some members of the Committee to influence the PAC report. That their evil scheme failed has upset them. They have now brought pressure to bear on their marionettes in the Committee. Who in turn must remove me to demonstrate that they have dealt with the “obstacle”.

4. Jubilee and ODM/CORD political intrigues.

Internal ODM/CORD feuds and supremacy wars have somehow found a perfect point of confluence with Jubilee interests of killing oversight in the National Assembly. The result is a crippled PAC with irreparably damaged public image.

5. Systemic institutional weaknesses in the Kenya National Assembly

The conduct of clerk George Gezemba could be a microcosm of a deep-sited institutional crisis that has serious implications on integrity and ethical image of the National Assembly. It is also important to interrogate how PAC’s “Hustler” Jet Report, concluded and tabled in the House by myself on April 24th, 2014 has never been balloted by the House Business Committee for debate – a whole year since tabling. This is unprecedented. Majority Leader Hon Aden Duale has reportedly vowed that the “Hustler” Jet Report will never be debated, because it touched on his boss. I have complained countless times – on the floor of the House, to the Hon Speaker, to Hon Duale, and to the House Business Committee, to no avail. What kind of brinkmanship and impunity is this? What forces exactly control operations of the National Assembly? Who is this that can so casually and cynically decide to trash House rules and traditions with such abandon?

CONCLUSION

In conclusion, my submission is that I am a victim of the classical case of the vampire of corruption fighting back viciously. Indeed it’s quite ironical that it is me, the victim, the one known by members as inflexibly principled, that is in the dock. It feels like the trial of a lamb in the court of a pack of wolves with blood dripping from their murderous paws.
I am proud of my performance as PAC Chairman. In less than two years, under my stewardship, the Committee performed the unprecedented miracle of clearing a backlog of audited accounts going back five years. Besides five reports on audited accounts (our core mandate) tabled in a single calendar year (a first in the history of Parliament), we also successfully concluded the “Hustler’s Jet” inquiry. Curiously, though, the House leadership has stubbornly thwarted my efforts to have the “Hustler’s Jet” Report debated by the House, since I tabled it a year ago on April 24th, 2014. The Committee is also at a very advanced stage in the inquiry into the IEBC and Judiciary.
These impressive achievements have come against the difficult backdrop of political intrigues and selfish personal interests.

I implore you, Mr. Speaker, to use PAC as an example to tackle head-on the integrity and ethical issues enveloping the Kenya National Assembly. Am ready and willing to collaborate with the EACC and other agencies in this respect.

Post script: It should be pretty easy to track the trail of anyone compromised to influence the outcome of a committee investigation. An audit of the evidence and testimonies vis-a-vis the findings and recommendations should clearly show a disconnect.

This was well exemplified by the Westgate Report jointly prepared by the Defence and National Security Committees, which Honourable members threw out in outrage. In my case, the PAC Report on Confidential Expenditure (FY 2012/13) was fully adopted by the House on 4th March, 2015. So, who exactly is my accuser? What exactly have I been accused of? Who paid me? to influence what? And how exactly did I do it? None of these questions have been answered anywhere. Accordingly, under Standing Order 91, I am actually being tried for non-existent crimes. Political witch-hunts do not get worse than this.

Would, that before this crisis, you would have had the courage to seek audience with Mr. Ruto and Mr. Kenyatta, and thus report, what transpired when you sought their input into the anti corruption war, with the thing festering right in their offices.

Aden Duale is Ruto's dog, so no need wonder why he wont have the report debated. Over his dead body. But Uhuru Kenyatta, under oath to serve Kenya's interest, and you have nothing to report on confronting him, even when he came visiting in Budalangi!?

What can a sensible one say? if not to warn William Ruto Singh, that Aden Duale is a very good attack dog, but attack dogs can error deeply in their enthusiasm. If not controlled on a careful leash, they can in a mad rush to show off their defence capabilities shove their noses down the lair of a blackmamba's and get the death strike. I therefore caution my friend Ruto -whose Kalenjin warriors saved many a Luo from pitiless Mungiki blades back in the day-- to rein this dog in, for he can be barking from both sides of his ends.

Two sets of investigations --the auditor general and the PAC have looked into it. It remains irregular. PAC and the whole caucus of Mpigs polluting Parliament square are selling themselves for as low as 20K to stall completion of reports which would pave the way for prosecutions. And even for all their joint and concerted efforts from both sides of the divide, the Mpigs and their committees are not able to cover up the massive rot. It is just too much. Duale is mentally switched off.

There is this detail where the Parliamentary Agricultural committee has investigated a case for 1.5 years, only to come up with the recommendation that a new committee be formed. And you know the story of sitting allowances.

Aden Duale is out of his depth. He has lost the most formidable weapon of the human head, common sense. Common sense is the kind of thing which makes it possible to differentiate a woman from a man while one is walking the streets. When you loose that sense, you are not much use to yourself, let alone anyone else.

Just to give you two more tips of this horrendous iceberg – on May 23, 2011 a contract was awarded to build a workshop and a petrol station at State House, Nairobi. The contract cost was Sh105 million. The project, however, stalled in less than a month. It has never moved since. By June 2013, the contractor had been paid Sh88.8 million.

Elsewhere, the Government irregularly single-sourced buying of 300 residential units in 2012, for Sh1.3 billion. Only one vendor, a senior Government official, was invited to bid. The vendor also determined the value and price of the houses. Afterwards the Ministry of Lands also valued the houses. It confirmed the value as Sh1.3 billion.

But even if we assume this was indeed the correct value, we are disturbed that the area of the houses was exaggerated. It was overstated by 228 square metres. The net effect was that the taxpayer lost an extra Sh30.19 million, paid for non-existent space.

Nothing I bet. So a bit of my thinking goes like this. Logic would dictate the suspension of the official leaders of Parliamentary business. It is their watch, their responsibility.

1. Leader of Majority business must go.
2. The speaker of the national assembly must go.
3. Leader of Minority, oppositions in parliament, must go.
4. Rotten mpigs who have taken bribes must be expelled from parliament, and banned from political office, if not for life, then for at least a decade.

If that is comical, the alternative can of course be made more permanent. History has records of motivated patriots of the uniformed types who burst upon rotten parliaments and drenched it in the blood of Pigs.

All options open as American presidents say. And so is history too. History does not outrule any option. It is that cold-hearted.

Deputy President William Ruto Sunday hit out at the Ethics and Anti Corruption Commission and the Auditor General saying they must take their roles seriously and stop corruption.

The DP and Senators Kipchumba Murkomen and Kithure Kindiki absolved the Jubilee administration from failure to stop corruption blaming it on the two agencies.
Mr Ruto said these bodies have enough resources to execute their mandate and that the government has no business interfering with their work adding that EACC should deal with the current allegations of corruption in parliamentary committees.
“The constitution has given you powers to weed out corruption; take advantage of this to safeguard public resources threatened by this evil called corruption,” said Mr Ruto.
He was speaking at Chekalini Secondary School in Lugari Constituency where he led a fundraiser in aid of churches from the area.

“EACC, the auditor general and parliament must up their game to ensure we get rid of corruption,” he said.
The Deputy President said they expect the EACC to take their role seriously and end the game of corruption or else they exit the scene.

President Uhuru Kenyatta has ordered an audit of procurement and tender contracts awarded by all State corporations in the past two years.
This means that all contracts awarded since the 2013 General Election that ushered his party into power will be scrutinised. State House warned that it would kick out corrupt officers from the public service.
