There seems to be a focus on the main (PEV) case. But Ruto could also get convicted on corruption-of-witness charges, and they too carry jail-time. Yebei was found to have been too compromised by the Defence to be a witness in the main case but that in fact ended up making him a "good" witness in the other case, and he seems to have been working on that. Both the OTP and the Defence are being coy but from different points and for different reasons; a certain "activist" has actually been more "forthcoming" as to what went on.
Barasa's case was settled, ages ago, in the kienyeji style: he is not going anywhere, to sing about whatever. Both Barasa and some Kenyan judges are set for life, as one might say. Comfortable tropical life. Case closed. Or so people thought. And then came Yebei.

Is Barasa not waiting on his appeal on the exradition order by Justice Mwongo? It is not always that Duale opens his mouth and I ignore him. He can be too mouthy and rough, but it still pays to listen to him. When the Yebei death was reported, Duale called a press conference in the presence of several Jubilee MPs and made the startling accusation that Suspect No.1 was Ken Wafula and Bensouda was the second one. Ken Wafula has been accused of many things related to PEV and the procurement of witnesses, and it is something he does not vigorously deny this fact. So when prosecution turned defence witness (and we have had very many of these in both the Ruto and Uhuru cases)dies, Khan makes the claim the man was his witness and he has provided a chronology of events to make his case. As for Wafula and Bensouda Yebei was witness interfering and bribing witnesses and yet suffers no fate as that of Barasa! We are headed for interesting times in the Ruto case and there will be people left with egg on face...but will it be Khan, the ICC or some character in Jukwaa?

Another family identify Yebei's body as matatu tout, Yusuf Hussein, from Kapsabet. CID have taken fingerprints of the body & are 60% (accurate) convinced that the prints match Hussein's in the national database. They require more tests to confirm 100%.

So, where is Meshack Yebei? Or should I ask, will his body ever be found? Whenever Team Ruto has "disaapeared" other witnesses, no bodies were found. So there must have been some surprise when "Yebei's" was found. Suggested sloppy work somewhere. Khan immediately demanded a DNA test.

In the cops defense from as early as the 9th of January they already doubted it was Yebei since the fingerprints didn't match. With the new developments, Yebei might actually be alive as per 'his' sms earlier which we all chose to ignore. Wherever he is, the saga has brought us some clarity to a number of issues:
1. That the ICC through its intermediaries engaged in major hanky panky with the so called witnesses. 2. That Ruto and Sang were framed. It has emerged that the witnesses testifying against Ruto were PNU politicians in the larger UG area and therefore known rivals of Ruto and co. There is thus no way they could have attended planning meetings and oathing ceremonies meant to prepare for attacks against their friends and allies in PNU. They only found their way to the ICC through inducements.
Even as the search for Yebei (a man who drove himself and his family to the hospital and excused himself to buy water and then vanished without a trace) continues, we now know some truths about ICC and how it operates.

Accusing Bensouda of murder is wrong on many fronts. We don't even know where Yebei is let alone if he is alive or dead. However, if harm has come upon him and the OTP can be proven to have ignored the plight of a "hostile witness" then there may be some blowback on that oversight. Confusing as the situation appears one thing does stand crystal clear. The difference in style of approach by the OTP & the defence. Where the OTP treats media reports as fact & sacrosanct, the defence requests proof of what is reported. Bensouda accepted the report that Yebei was dead at face value much as we laymen would. Karim Khan requested DNA proof that indeed Yebei is dead. This is why the OTP relies on media reports as evidence without taking the time to explore the backstory. We've seen it time and again. The OTP presented video "evidence" of Ruto egging on a massive crowd in the Kalenjin language. The defence took the time to have the very same video translated & proved that WSR was actually advising the crowd to coexist harmoniously with other ethnic groups. The day when the ICC's conduct of the Kenya Situation cases is written, it will most likely show that the OTP sat back on its laurels & relied on unproven third party reports to pursue its case while the defence meticulously took the time to do its homework and debunk the charges. Mwalimumkuu, this again is the problem with the OTP failing to do its job. Why for instance didn't their people on the ground take the time to know the backgrounds of the various witnesses and determine if they were really ODM or PNU moles? What exactly is Maria Camera's mandate here in Kenya & why is she and her colleagues earning top salaries doing zero legwork? We were told the ICC would make a lesson of Kenya; it seems the prosecution arm of the world's court is the one that's getting thoroughly schooled by Kenya...

Does Kamale know that? Absolutely not. Nothing to do with the OTP once the VWU got involved (especially if at the request of the defence). (a) Witness protection for the ICC is carried out by VWU, which is independent of the OTP. (b) The VWU protects both OTP and Defence witnesses; indeed, a quick glance at court records in the various cases will show that it currently protects a large number of Defence witnesses and their families. Even Uhuru managed to get a couple of his would-be witnesses into the program late last year! (c) According to the ICC Registrar: " While the ICC Registry had offered Mr Yebei security measures, including a safe residency in a new location, he returned to Eldoret where the incident reportedly took place."www.icc-cpi.int/en_menus/icc/press%20and%20media/press%20releases/Pages/pr1082.aspx If you can give some examples of the "again and again", I will be able to comment on them; at any rate, I am keen to hear of them. For now, let's stick to this one. I would not necessarily make the assumption you have made. Anyone who follows discussions---online, at ASP sessions, etc.---of how the OTP operates will be aware that it has been criticized for not responding to misleading reporting in the Kenyan papers. The leading papers have throughout twisted all sorts of things, even when publicly available court records showed otherwise, and the OTP let it slide, on the basis that "the records were clear". That has been considered to be poor strategy, because public support is important, but the general public simply goes by what is in the media and will not bother to go read what is on the website, or ask meaningful questions, or think ... So what sticks in their mind is what the Daily Nonsense and The Stunted feed them. Even now, there are people---I have talked to a few---who believe that the OTP could have killed Yebei! Keep in mind that this is Kenya where the juiciest rumour gets the most credence, and it is even better when someone can say "a big, important man like Duale said it; that is good enough for me". That the body in question has been found not be Yebei's has in fact led such believers to other conspiracy theories along similar lines. I think it was absolutely critical that the OTP issue a statement of the type it did and when it did---not just for the general public but also for current witnesses and would-be witnesses, in the Kenyan and other cases.

Yebei's body is Yusuf Hussein ?? Confusing! What told the first party that the body was Yebei's? I am surprised they already took finger prints and they cannot conclude on the possibility of the body being that of Yebei. Aren't finger prints enough to answer the question whether a body under exam could belong to some known individual. No one is saying that the body was too damaged for reliable finger print analysis. So the whole saga reads like a James Hadley Chase reenactment. It sounds like someone with the interest to keep secrets has lots of strings to pull.

So guys how about taking the conspiracy theory a little bit too far? But start with what we know:
1. Word gets out that an ICC witness is missing and is last reported in Uganda claiming to be safe with 'Bensouda' people 2. Family is worried and this becomes a media story only. 3. A body is found and it is claimed that the body belongs to Yebei. The body is mutilated and the family is called to identify the body 4. The family identifies the body as that of Yebei and claims it is theirs. 5. Immediately Khan writes a confidential letter to the DPP asking for confirmation via DNA that it is Yebei 6. For the first time he claims Yebai was his witness. 7. As if on cue, Activist Wafula claims that the guy was a prosecution witness with sour relations 8. URP MPs led by Duale step in and accuse Wafula of complicity which Wafula denies and threatens to sue. 9. The whole nation now knows that Yebei the ICC witness is dead!! 10.Bensouda issues statement disowning the guy and claiming that Yebei may have been committing crimes of bribing witnesses 11.Khan issues his statement actually revealing that an OTP witness had threatened Yebei hence asking for protection for Yebei 12.Then out of the blue CID who have been called to investigate the matter tell us the dead man is actually not Yebei but another man. 13. To clear the confusion, the police decide to take the No 5 route as proposed by Khan confirm it is Yebei by DNA. 14. DNA results will be known next week.
So far that is what is known in this Yebei saga.
In the second Khan statement, the lawyer was critical of Bensouda of ascribing crimes to a dead person and even suggested that OTP had made no efforts to charge Yebei for the crimes he was being accused of when he "was alive".
Wafula last night is all noise claiming a cover up that the dead person is indeed Yebei and the DNA results the police will provide will not prove so.
So here is the Kamale theory:
1. Yebei is NOT dead and is alive under protection by Khan. 2. The Yebei family are in on it - I have not seen that much mourning in the family. 3. The contradictions by the brother's stories about how he wants matter followed up shows the confusion caused by the ruse.
But why would the Ruto/Khan team do this?
Was it intended to get Wafula to speak as much as he has spoken lately? Is Wafula the same person that signed off emails to ICC as Abubaker as claimed by Duale and as per an email circulated on the net? How about Bensouda and the claims she made after 'confirming' that Yebei was dead?
Yebei was an insider in the procurement and coaching of witnesses and it is most likely that the threats he had received from an OTP witness was related to this. So killing Yebei at the tail end time of the prosecution case throws the OTP into a spin and gives Khan and team an advantage i.e. Yebei will tell the court how he was involved in recruitment and coaching of witnesses to lie and this could deal the prosecution case a big dent if he comes out as an honest witness. At the appropriate time, the dead man will be buried in Busia and Yebei will reappear....and then there will be faces blushing!

It's grim stuff, but there have been one or two jokes that ought to lighten up things. For example, Karim Khan actually asked the Kenyan Police to investigate something! Do they have the first idea of hwo to go about that? In fact, the QC has asked for a " timely and vigorous" investigation! What a funny man. Never mind ... Mr. Khan, so far is not impressed. And perhaps there have been some tiny omissions or sloppiness in what exactly the Kenyan media has been reporting. Mr. Khan, Q.C. states that. " I wrote a confidential letter to the Director of CID in Kenya requesting that certain investigations be conducted, relevant to the incident. I was dismayed and gravely concerned that this confidential communication found its way into the press. Who put the OTP "on notice"? He doesn't say, but it is apparent that it was not Mr.Khan, Q.C.: " The Defence has recently learned that the Prosecution was fully on notice, months before the alleged abduction and murder of Mr. Yebei, that he had been threatened with abduction by one of the Prosecution’s own witnesses." This is a man who is very worried about something. What? Who knows. Anyways, after raving and ranting away on all open fronts, Mr. Kahn, Q.C., has some excellent advice for everyone: " Everyone should refrain from unnecessary public speculation and inflammatory comments at this time". And there you have it.

So guys how about taking the conspiracy theory a little bit too far? But start with what we know: 1. Word gets out that an ICC witness is missing and is last reported in Uganda claiming to be safe with 'Bensouda' people 2. Family is worried and this becomes a media story only. 3. A body is found and it is claimed that the body belongs to Yebei. The body is mutilated and the family is called to identify the body 4. The family identifies the body as that of Yebei and claims it is theirs. 5. Immediately Khan writes a confidential letter to the DPP asking for confirmation via DNA that it is Yebei 6. For the first time he claims Yebai was his witness. 7. As if on cue, Activist Wafula claims that the guy was a prosecution witness with sour relations 8. URP MPs led by Duale step in and accuse Wafula of complicity which Wafula denies and threatens to sue. 9. The whole nation now knows that Yebei the ICC witness is dead!! 10.Bensouda issues statement disowning the guy and claiming that Yebei may have been committing crimes of bribing witnesses 11.Khan issues his statement actually revealing that an OTP witness had threatened Yebei hence asking for protection for Yebei 12.Then out of the blue CID who have been called to investigate the matter tell us the dead man is actually not Yebei but another man. 13. To clear the confusion, the police decide to take the No 5 route as proposed by Khan confirm it is Yebei by DNA. 14. DNA results will be known next week. So far that is what is known in this Yebei saga. In the second Khan statement, the lawyer was critical of Bensouda of ascribing crimes to a dead person and even suggested that OTP had made no efforts to charge Yebei for the crimes he was being accused of when he "was alive". Wafula last night is all noise claiming a cover up that the dead person is indeed Yebei and the DNA results the police will provide will not prove so. So here is the Kamale theory: 1. Yebei is NOT dead and is alive under protection by Khan. 2. The Yebei family are in on it - I have not seen that much mourning in the family. 3. The contradictions by the brother's stories about how he wants matter followed up shows the confusion caused by the ruse. But why would the Ruto/Khan team do this? Was it intended to get Wafula to speak as much as he has spoken lately? Is Wafula the same person that signed off emails to ICC as Abubaker as claimed by Duale and as per an email circulated on the net? How about Bensouda and the claims she made after 'confirming' that Yebei was dead? Yebei was an insider in the procurement and coaching of witnesses and it is most likely that the threats he had received from an OTP witness was related to this. So killing Yebei at the tail end time of the prosecution case throws the OTP into a spin and gives Khan and team an advantage i.e. Yebei will tell the court how he was involved in recruitment and coaching of witnesses to lie and this could deal the prosecution case a big dent if he comes out as an honest witness. At the appropriate time, the dead man will be buried in Busia and Yebei will reappear....and then there will be faces blushing! I want to bookmark this one. Its getting better than James Hadley. It's beuatiful. But something remains unexplored. If Khan keeps Yebei in protection, does Khan then know about the the other death that is getting mixed up with Yebei's? I was actually bought into the theory when I started typing this, then it downed on me that if Khan were to be in on Yebei's dissappearance then he would have a case to answer about the other fellow. Or shall we say it was all coincidental that another guy showed up dead while everyone (but Khan) was looking for Yebei?

...You see, to fake the death of Yebei, the evil genius had to arrange for a look-alike-body! How do you arrange for an identical body?.... Ha! I should have known BIL would not miss it. But I don't think Kamale should remove it from the board ... I bookmarked it, afterall. Furthermore, I highly doubt the mix up has anything to do wiith resemblance of the recovered body and the missing Yebei.

I want to bookmark this one. Its getting better than James Hadley. It's beuatiful. But something remains unexplored. If Khan keeps Yebei in protection, does Khan then know about the the other death that is getting mixed up with Yebei's? I was actually bought into the theory when I started typing this, then it downed on me that if Khan were to be in on Yebei's dissappearance then he would have a case to answer about the other fellow. Or shall we say it was all coincidental that another guy showed up dead while everyone (but Khan) was looking for Yebei? You will remember that when the death was 'announced' Karim was clear in his letter to the Kenyan authorities that DNA should be performed on the body to confirm it is actually Yebei's. Why did he not trust the simple recognition of the body by the Yebei family which now turns out was wrong? What may give this away is how the family was informed that the body had been found and they were sent to identify the same. It is also clear that the media was being cleverly informed of the story but because they were not paying attention and wanting to appear professional they went to Wafula for his comments helping in muddling the trail...!

Kamale, even though your premise 1 is plausible it remains a tricky one since if Yebei was in Khan's care by extension the state would know & would be party to the defence shenanigans. After all, the state ought to know if Yebei has indeed left the country. Jakaswanga, as to the dead body I think you're reading too much into who would've had to do what to whom. It's standard operating procedure (SOP) to invite a family looking for a missing loved one to identify any unidentified body that meets the general description of the person in the vicinity. The injuries the discovered body is reported to have had would've made facial recognition difficult if not impossible. To the Hussein family's credit they've identified unique features such as a missing toenail on the right foot and a chipped tooth. In addition to that the fingerprints are said to match Hussein's. Even if the Yebeis go to court I don't foresee the ruling going their way.
