Termination of the ICC case against H.E. President Uhuru Kenyatta is good for the country for a number of reasons that I have previously articulated as documented below in a series of articles published by the Star. Now that this chapter of our history is closed, we can focus on the next one and that’s all of us pulling together to make sure there’s continued peace and progress in the country. I recall just the other day having a conversation on an Emirates flight from Dubai to Nairobi with someone I met in Business Class on 27 February 2015 who happens to know me very well and I know of him very well even though we had not previously met in person.[An earlier version of the blog stated this happened on a KQ flight from Entebbe to Nairobi but that's an entirely different conversation with someone else following this one to be the subject of another blog for another day]. What impressed me most is he and his friends who were traveling together and I had a very engaging conversation but none of us cared to know what our tribe or political affiliation was even though by our physical outlook you can eliminate one belonging to this or that tribe (read: not African but Kenyan) but it’s how the conversation occurred and the new friendship that matters. This can be replicated regardless of tribe or ethnicity or circumstances for that matter and that’s what we all as Kenyans should strive for and that's being open minded and willing to accept and engage those we don't readily know for it may turn out it's someone like this friend had we proceeded without engaging each other, we would never have known we were on the same flight and literally neighbors across the aisle. Interestingly, this gentleman who I met on the Emirates flight knows very well and is known very well by one of my most vicious haters on these Internets (GW Bush word, not mine)--something we didn't even waste a second to discuss because it's not worth it as serious businessmen like this gentleman and adults for that matter know only morons and otherwise not fully mentally grown adults would engage in that kind of vile hatred and attacks of others for no reason--not even political motivation should ever have one stoop that low in expression of the level of vicious hatred and name calling yours truly has been subjected to but nonetheless forgives the tormentors. Now, if only we can all forgive and move our country forward that would be the greatest gift we can give our beloved country for the benefit of one and all, including those who will be there after we're all long gone. And now, a reminder of the reasons why dropping of the ICC cases against our president is good for the country: Bring ICC Cases Back Home The Truth About ICC Cases Why Uhuru Should Skip ICC Trials Pursuing ICC Cases Is Counter-Productive ICC Not Solution To Poll Violence Raila and Cord Should Support ICC Deferral Justice For Poll Violence Lies In Kenya Options Beyond Denial of ICC Deferral ICC Termination Not Impunity Why Kenya Is Determined To Stop ICC Cases President Uhuru Kenyatta's Case ICC Trial Can Now Begin Why President Uhuru Kenyatta's Case Won't Stand Termination is not vindication of those of us who have been maintaining this position from the very beginning of this [fill the blank with adjective that best suites your needs], it's an affirmation sometimes the right thing is hidden from others until it's very transparent and no longer opaque.

ICC Termination Not Impunity ......
Termination is not vindication of those of us who have been maintaining this position from the very beginning of this [fill the blank with adjective that best suites your needs], it's an affirmation sometimes the right thing is hidden from others until it's very transparent and no longer opaque.
According to this second approach, reconciliation is still about restoring or establishing good relations, but in a world where this is understood not as cohesion and harmony per se, but as lively disagreement and debate between mutually respectful, but potentially incompatible political outlooks. www.nation.co.ke/oped/Opinion/Reconciliation-requires-rebuilding-of-trust-and-respect/-/440808/2652752/-/mxa5b7/-/index.htmlAs for the transition, the document declares state sovereignty does not apply. It terms South Sudan “a juridical fiction,” not an “institutional reality” and that it is “a dictatorship of all armed groups.” It concludes: “Where state sovereignty is used to license mass murder, the Commission is of the view that state sovereignty must be temporarily subordinated to African sovereignty.” www.theeastafrican.co.ke/OpEd/comment/South-Sudan--The-radical-solution-no-one-wants-/-/434750/2653212/-/13upw60/-/index.html

Omwenga,
Sometimes you can be so irritating! Who wants to know whether you were flying Business of Economy class from Dubai?

Omwenga, Sometimes you can be so irritating! Who wants to know whether you were flying Business of Economy class from Dubai? Abdulmote, as a frequent flyer, the last time I flew Economy was more than 5 years ago and from my BD coming soon, it's hello First Class, goodbye Business Class. This good news has two different effects to people depending on their DNA: those with a positive outlook on life find it inspiring and want to do the same and might even ask me how to accomplish this and I'll be happy to share; the reaction from those with a negative outlook on life otherwise known as haters is exactly the same as yours in response to my earlier post. Now, to answer your question which is a rhetorical one, the reason I included that information is to point out that if businessmen on a flight can put on blinds to ethnicity, tribalism and political affiliation and forge a relationship, someone like you who I doubt has even ever been on a plane sitting in the front of a Matu being your highest level of transport comfort should do the same with those you come into contact with instead of beating the same path of tribalism and hate.

abdulmote is right, and you are advised to slink away (in whatever class) before you get a real caning.

abdulmote is right, and you are advised to slink away (in whatever class) before you get a real caning. Abdul, Otisho, I think this is unnecessarily harsh and high handed. Brother Omwenga is blessing us with his presence after quite a sojourn in planet silence, and all he meets is a close-fisted welcome! --let us toast him not roast him! Those who love blogging like Omwenga, Kamale and ... no no not yours truly but the lost :-XEinstein! will occasionally slip in one or two personal details!

I am certain as certain can be your wise counsel has fallen on deaf ears thanks to a 3-letter acronym in one case and who knows for what reason in the other other than the predictable ailment which yours truly already stated without any need to given it's obvious in both cases and indisputable for that matter. For me, I am always proud to say I love everyone, including those who wish me ill or otherwise hate me! Our Almighty God asks for nothing less in these circumstances and I am at peace to comply.

Jakaswanga: You should encourage your friend---that's you, Omwenga---to do at least two things: (1) Avoid making statements that only serve to confirm already quite legitimate impressions. What he must think of those who do boda-boda---some on the "carrier" of a bicycle!---or who simply hoof is left to the imagination. Twit.
(2) Stick to the standard advice that is given to certain types of wayward folks: "pick one story, and stick to it".
The original Great Inter-Ethnic/Tribal Friendship-Making took place on the 1-hr Nairobi-Entebbe flight. That's what I read. But a new day always brings forth new things. Some editing took place place, and when I looked the next day, I found that Our Hero had moved. Same story, new-and-improved flight number:
Please, no more versions. Your buddy is, again, encouraged to slither away or, at least, stay away from serious matters. Otherwise, he should not howl when the caning starts.

In terminating the Uhuru case, the judges mentioned the appeal by Bensouda on the matter of referring Kenya to the ASP as per article 87(1).
I keep wondering what the effect of the referral as there does not seem to be any prescribed penalty for a country referred to the ASP. Article 122(2)(f) only provide for consideration of questions relating to non-cooperation without mentioning penalties for guilty members. The impression I get is that the court referral takes the matter out of a judicial process to a political process which makes the matter of referral complete nonesense!
Any one knows how Kenya would be punished by the ASP?

It is a question of political will' the Iran and USA matter on respect and the title, see www.huffingtonpost.com/michael-brenner/iran-and-america-at-heave_b_6877638.html could translate to Kenya and West at Heaven's gate however we will locally always have the second school 'who do not believe in the legitimacy of his Presidency and therefore, they have and will attempt to malign, denigrate, disparage, and sabotage his undertakings to deny him a successful legacy' www.juancole.com/2015/03/lobbies-americas-interests.html

Omwenga, Let me spare you a few lines in response to your silly reaction on what I had stated in a single line above; first of all I want you to know that I personally don't do "hate". Hate is a behavior more familiar amongst ignorant people, or people who are not clear on the reasons of their dislike on a person or thing. Haters tend to be 'shallow' minds. Minds which do not understand what a word 'logic' or reasoning means. Well, I don't have to ask you what you think of me, lest your own arrogance leads your 'foot into your mouth' and I don't wish that for you . Secondly, I believe people who are quick to imagine others "hate" them for what they may possess at any given time, must be very 'poor minded' people. You see, not being a young man of your age, I would like to think that I have matured enough to be able to appreciate that material wealth does not necessarily improve one's mental well being or indeed, true status in life. To help you understand this; temporary possession or control of material wealth does not make you a better person than others; basically, you will still need to eat food and drink, sleep and shit! What you may end up munching into your stomach may not be excessively better that what an ordinary person may eat, nutrition wise or taste wise. As a wealthy person you may enjoy less or poor quality sleep on your mega shillings mattress or bed. Believe you me, I may be sleeping on a cardboard box on a pavement along Tomboya street, but the quality of my slumber could be a thousand times more soothing than you could ever imagine! Lastly I fear that your excrement won't be smelling any better than mine. In fact foul it may be as always, with the concern that some rich people may want someone else to wipe it for them, tissue, fingers and all! Disgraceful but that is the harsh reality of life. Now lets discuss about your writing as given under this thread; firstly, I want you to know that after attempting to read your piece, I stopped immediately I came across your offending line; your unwanted and irrelevant description of 'flight class', as if bragging about your wealth to those who may not have the same. Such is your perceivable arrogance against those who may not have been bestowed with the same, but only having driven in a Matatu or Bodaboda as you implied. Indeed, I do hop into a Matatu whenever I need to and I certainly do not look down upon those who may not have seen the inside of a Boeing or an Airbus. I do not own a Chauffeur driven limo or own a ten roomed mansion by the lakeside some where in Michigan, where Diplomats dine and wine during impromptu weekend parties. Indeed, I am not wealthy at all to afford donating tens of thousands of US Dollars to ODM and none of those powerful people in the corrupt Kenyan political sphere are my pals who sit with me in a Business class flight from Dubay! It does not make you a better person Omwengaaaa, even if that describes you! Lastly, I do not think that such irrelevant statements as yours regarding your wealth and possessions, do not necessarily inspire those who may not have. By all means, if you think that you may have learnt a good and legitimate trick of earning those mega bucks and you would like to share with some unlucky readers of Jukwaa, please do. But equally, many a wealthy Kenyans nowadays are also known to have acquired their mega bucks through grand theft and corrupt ways, and not every rich idiot can be inspiring to poor like us at all. P.S: This is a free advice for you; as a writer (and I don't care why someone may choose to publish what you write in the manner that you do), seriously pondering on nay feedback given by readers may be a good way of improving your writing skills. Unless of course, you already know it all and do not do those long winded lines, which can be extremely irritating to a college professor marking your 'fantastic' and brilliantly written essay. Now, if you really love us as you profess to do, just simply stop calling others silly names as you may and welcome back to Jukwaa, sincerely.

Abdulmote, In the not too recent past, I would have given you a line by line rebuttal of what you've attempted to say but having just celebrated yet another birthday over 50 this last week and in a way still am--and yes this was in beautiful land of grass though I partake of none aka Jamaica, let me just say I wish I could say I found something unpredictable and not conforming to your confined thinking as to who yours truly is and what he represents other than your last sentence to which I can say laughing you remind of what the indomitable and efficacious Indira Gandhi once said: "You cannot shake hands with a clenched fist!" So, yes, I love everyone but I see nothing but a clenched fist in your writing not only unable to open and shake hands but likely ready to swing and deliver a KO of which I say, is that really necessary and in the words of Rodney King, can't we all get along?

You always mean well, but I'm afraid your efforts are wasted in this one; Omwenga's record on Jukwaa will explain why.
