That Koigi Wamwere was detained by Moi is undisputed fact.Three judges of the Court of Appeal on March 6 awarded him Sh12 million as damages for past torture experience. That would seem to be reasonable compensation considering that he did not sue the person whose name was used to authorise his torture. The money after all comes from the tax payers.
However, Koigi has not seen the legal victory enough for him to sit and enjoy his award. He has now gone to the Supreme Court to appeal the finding of the Court of Appeal. If successful, Koigi may be awarded more money. Of course, his pleading does not mention that his interest is simply more money but he argues he wants an interpretation on whether there has been misuse of the law on detention, whether there are specified particulars of torture to detainees and whether what he went through was similar to others’ fate. He further wants to know from the court whether the past constitution was better in addressing acts of torture. In simpe language he is saying others got more, why is my compensation in the lower bracket.
It is not lost on some us that Koigi had committed fraud when he continued asking for disability allowance from the Norwegian authroities despite recuperating from injuries from his motor accident that broke one of his ribs and fractured his collar bone. They gave a scholarship to Columbia, but Koigi still benefited from Norwegian disbaility benefit even after relocating to Kenya. Maybe now that he has a windfall in form of his compensation, the man will do the decent thing and pay the Norwegians their money.
