On Monday, November 20, 2017 the Kenyan Supreme Court has decided to uphold Uhuru Kenyatta’s “victory” even though the October 26th contest was even more farcical than the initial election that they rejected. According to Reuters:"Kenya’s Supreme Court on Monday unanimously upheld the re-election of President Uhuru Kenyatta in last month’s repeat presidential vote, paving the way for him to be sworn in next week."

Chief Justice David Maraga said all six judges dismissed the two legal challenges to the vote, but the opposition NASA coalition insisted the government was illegitimate.
Given the blatant anomalies-the massive boycott; the low voter turnout; the violence before, during and after the exercise, one can only speculate as to what led Maraga and his colleagues to rule they way they did. Was there intimidation? Were the judges exhausted? One will not play the role of ajuoga, jujuman or sangoma. We cannot exclude the subtle geo-political pressure of Kenya’s international partners or even the regional heavy breathing from the African Union.
Whatever the case, NASA had seen the movie before it was screened. In our country we are now beyond the elections. Uhuru Kenyatta, William Ruto and their Jubilee team can breathe easy now and go through the rigmarole of being sworn in.
Like some of us said even before August 8th, the fascist regime has so much at stake. Jubilee has looted the country dry and their hands are bloodied with the stains of Chris Msando, Pendo and all those innocents their slaughtered. It is not clear whether Jubilee will now officially go ahead and recruit the Mungiki thugs and their tribal vigilantes to boost the state terror of the Kenya Police, the GSU, the Kwe Kwe squad and the Kenya Defence Forces.
What is patent is that for however long they last in power,Uhuru,Ruto and Jubilee will continue mutilating the 2010 Constitution they promised to defend.
What is also obvious to Kenyans and the entire world is that if Robert Mugabe, who had arguably better credentials to ascend to power because of his anti-colonial contributions is finally is on his way out, no amount of live bullets, tear gas, police equipment and vehicles will stop Kenyans from achieving their historic quest for freedom and independence- a struggle that dates back to Me Katilili, Waiyaki wa Hinga, Mwangeka, Mary Nyanjiru, Makhan Singh, Elijah Masinde, Muindi Mbingu, Pio da Gama Pinto, Jaramogi Oginga Odinga, Masinde Muliro, George Anyona, Marie Seroney, Martin Shikuku and yes, Raila Odinga and the underground stalwarts and heroes and sheroes of the Second Liberation.
As NASA realized, Kenya is now beyond the gimmicks of neo-colonial stolen elections. I am even arguing that we are beyond secession, economic boycotts and anti Gikuyu and anti-Kalenjin tribal resentments.
Rather, we are on a trajectory, a new page of a new chapter in Kenya’s ongoing political transformation.
Just like the Kenya Land and Freedom Army caused a national, regional and international stir when Kimathi,Muthoni, Bamuinge and their comrades launched their glorious Mau Mau War for National Independence, let this generation of Kenyans be remembered for what they are doing to take the cause of African freedom forward. Who remembers the Idi Amins, the Bokassas, the Abachas, the Eyademas, the Mubaraks and the Mobutus? Likewise, will Uhuru Kenyatta and William Ruto even rate a tiny footnote when the history of the world is written?
That is why I urge my young comrades in Kisumu and other parts of the country not to donate themselves to the Jubilee and Mungiki killers for slaughter.
Instead, we must all rally behind a call I support one hundred per cent, which is the struggle for the Third Liberation, as a prelude to a people-powered National Democratic Revolution.
