And compare Kivuitu four years earlier YUP and maybe he too will write letters to the ICC in support of the Ocampo 6 he was part of the engine of what happened after his fake announcement... why couldn't have just said no clear winner. and left the presidential elections to be repeated?

I remember in KICC in Dec 2007, Kivuitu was implored upon by members of international community as well as opposition to resign rather than be compelled to announce fraudulent presidential election results.
If he would have taken that option, Kivuitu would probably have saved Kenya post election violence and the country could perhaps have taken a difference direction.
But being the arrogant mzee that he is and also that he may have been already compromised by PNU and ODM-K, Kivuitu went to State House and personally delivered the certificate to Kibaki before witnessing a pre-arranged dusk swearing-in ceremony.
I have no sympathy for this man.

A case of too little to late. Mr Kivuitu had a chance to come clean when it really mattered but he went ahead and announced the shady results which resulted into PEV. Whatever he has to say right now deosnt make any difference.
