I share your desire for the appeal court to throw out that Warsame ruling. But that decision should and must come from the court .....which the point I have been making! No, that's not what I had in mind. As I see it, as far as vetting goes, the Vetting Board is at the same level as the Supreme Court, in that no "higher court" can interfere with its final decisions. So, in my view, they should simply ignore these side-shows and endelea na kazi, the way Kenyans expect them to. While waiting for any Appeal-Court decision, if that's the way it will go, the Board should continue with its work, and the first order of business should be to sort out Warsame.

Totally agree though I would rather choose activities for leaders than .. those accused of committing heinous crimes during the PEV like Uhuru & Co and never such individuals like Mudavdi who rumours have it that he his Uhuru"TNT" protégé paid for and delivered to central province.. robot voters in central will have a field day come 2013 elections.. yup! better activities who have fought for freedom of expression and human rights and Kenyans now enacted new Constitution then those accused or bought and paid for..

And his odd appointment of the other Mohamamed [Warsame], then with a difficult vetting date, to rule on the continuity of the vetting board. Mutunga's mental sharpness needs an upgrade and Now.I think a man is only as good as he performs, and therefore, knowing how clever PLO Lumumba actually is, and how dismal he was as the new Githong'o, I am hedging my bets on Dr. Willy Mutunga. This is getting to be more entertaining than I expected. Mutunga is busy shooting bullets into his own feet while his followers are busy gnashing their teeth and wailing that the bad guys are out to cripple him.
As for this guy Warsame, I fully understand him. Put yourself in his shoes. You are due to be sent to the gallows in 2 weeks. Late one night, someone hands you the hangman, bound hand and feet. Do you free him and cheerfully say "see you in a fortnight, buddy!"?
I think your problem is that you don't appreciate Advanced Thinking. Jukwaa manambas like you and I think inside the box. More advanced thinkers think outside the box. Guys like Mutunga are way beyond that. I don't know what they call it ... thinking with the box?

Jakaswanga,That is what happens when one is caught with their hands in the cookie jar, they stammer and try to weave very incorrigible stories with the hope that they can walk from trouble. That is exactly what Willy Mutunga and his cable of clueless civil society are doing. The fact is, they got this very wrong. Their plan was to help their friend Ibrahim at whatever cost, but it backfired very badly. But that is not even the point, the main issue here is, this event only helps to demonstrate that Mutunga and the masters he serves are trying to put together a judiciary that will serve their own interests and not that of the nation. That is why he has tried at every opportunity to control the vetting process. But the Kenyan people have been very vigilant and so will remain. If Willy had any morals, he would resign over this scandal. But I bet he loves the money and feeds of impunity like her disgraced deputy Nancy Baraza.

Whereas Ahmednassir and others benefiting from inside information could easily point to other factors or individuals as being the cause of the friction we are witnessing within the vetting process, they fail totally to explain how and why exactly the CJ got entangled in the drama in the manner that he did. Why for instance, did the CJ find it prudent to have judges who were yet to be vetted presiding over cases that challenged the mandate of the vetting board? Secondly, how did he allow a judge who had been found unsuitable to hold the office of a judge proceed with writing judgments for over two hundred cases long after he was dismissed by the board, the same cases that formed the basis for his dismissal? Could this be a classic case of incompetence? Or is it ignorance on the part of the CJ? 2. Since the vetting begun, only a handful of judges have been dismissed or rather found to be unsuitable to hold office. Their cases have been concluded and sealed, they will never come back to the bench even if the vetting was to be stopped today. On the other hand, however, majority of the old guard, including Justices Rawal, Koome etc, have retained their offices. This is where Ahmednassir's case falls flat on its face. Because, if it is a case of an empire that the so called powerful lawyers had built within the judiciary, they have almost everyone we had before remaining in there. They may have destabilized yes, but not to the level that would worry them that much. 3. The CJ is on record supporting the winding up of the vetting board and transferring its mandate and functions to the JSC, which he chairs and to which Ahmednassir is a member. Ironically, Ahmednassir is one of the people who vigorously fought this idea and eventually prevailed. How then, can he convince us that the CJ does not have a hidden agenda in all this process especially when you juxtapose his earlier arguments against the board and his recent actions? It is obvious therefore that, the biggest enemy of the vetting board is none other than the CJ himself and a few people within the JSC, whether they are working for the so called powerful lawyers, or other forces within and without the country's boarders, is something that will need to be investigate further.

Very uncoordinated thinking even in basics When I read his public response last week in a daily paper, then read LSK' s chair's legalese, I found Mutunga' s intellect the lesser. And now he has paid the public price of humiliation. Let this be his last show of mental laziness. We all mostly support the CJ and think he is capable of some good. But I am yet to meet a person who is possessed of an infinite amount of goodwill, and the CJ should be careful not to exhaust ours. He needs to act in ways that our small minds can understand: contrast Rao's simple comment that a person cannot simultaneously be both a player and a referee with the convoluted stories put forth by the CJ and some of his acolytes. One hopes that the first thing the new-and-improved lot will do is determine whether any court has the jurisdiction to interfere with the Vetting Board. The law seems quite clear on that one, which should bring the matter to a quick, neat ending, without numerous Mentions and Hearings.

Having watched the CJ on Cheche I can still comfortably say I think his heart is in the right place & he remains the right man for the job, even though he confirmed he remains a Marxist. Let's keep in mind he has less than 4 years to go before he attains the retirement age so his job is simply to get judicial reforms rolling. He has done relatively well so far. As he said, it will take 10 years for KE to get the judiciary we want. It is a work in progress & we as the general public also have to be part of the change (do not give bribes, expect favours from judges & magistrates, etc). His explanation for the Ibrahim interference was believable (he sent the letter granting him more time to Ibrahim, not to the vetting board). He believes the LSK may have obtained a copy & then circulated it to the board & the press. He in no way tried to influence the board directly.
Unfortunately he couldn't comment on quite a number of matters as they are still being heard in court but he did give the judiciaries SMS number as 3834. If your judge or magistrate is still of the old school that believes they can keep the public waiting all day in court without making an appearance, pop the CJ an SMS. He reads them all...

It has invited tenders from interested parties for the purchase of a fully furnished mansion that will be the CJ’s official residence. The tenders must be received by the end of this month and thereafter be opened at the Supreme Court. The government recently completed the construction of Sh400 million Vice-President’s residence, which now awaits occupation.
According to the specifications, the palatial mansion must have a minimum of five all-ensuite bedrooms, a car park capable of holding more than 20 cars and an open verandah that can accommodate at least 100 guests. The tenderers must also provide a house that has a detached servants’ quarter, a lobby, parlour, meeting room, bar counter, dining room, cloakroom, kitchen, laundryroom, study-cum-TV room, computer room and a swimming pool.
The common areas, in particular the parlour and family room, must have a fireplace.
The Judiciary invites tenders from interested and eligible parties willing to enter into a contract for the Purchase of a Fully Furnished Residential Property. The minimum plinth area required is approximately 13,500 square feet, with acreage of approximately 0.75-1.5 acres located within a radius of 8-12km from the Supreme Court Building located in Nairobi Central Business District and meeting other requirements further set out in the tender documents.

He opted for a cheaper buyout as opposed to a build (ofcourse buying an existing structure will be faster than building a new one which may not be done until after he has retired ;D ;D). Let's see how the tender process goes before we throw stones.

This is all fine until you realize its being bought by one of the poorest countries in the world. Where most of the tax payers live in mabati shacks and mud structures.
Surely would that not make someone ashamed to ask for something like this?
Its not like he is living in the streets at the moment. Plus am sure we are paying him a heck of a lot of money every month.

He gets paid 800k according to what he said. He currently lives in a flat where he is comfortable. The need for the mansion is to allow a CJ to "entertain" guests. As you can see the specs call for a very large verandah big enough to accommodate 100 cocktail party goers.

These people being provided large houses already have several such houses of their own. Perhaps this money would be put into better use upgrading the slums.

I live in my own "multi-bedroom" house acquired via a mortgage in a not too affluent area. If I was a public servant, I would be earning a hefty owner-occupier allowance! This is a man who is in office for only 2 years and wants to burn up a lot of money in a mansion. But out of curiosity, what are these parties that the CJ will be having in his house that need entertaining? How would he deal with the matter if one of the people being entertained ended up before him?? I am uncomfortable with this........
