TOP KENYAN LAWYERS AS HANDLERS IN LOOTED PUBLIC CASH, THE BUBBLE MUST BURST!
They are money launderers.
There is a ditch our constitutional infrastructure has landed in. We mill around the wreckage of our country. The quagmire must be recognised. Only thereafter can it be adequately addressed.
There have been mutilations, dilutions, deliberate delegitimation of the most important instruments as were intended in the new constitution, wherefore the reform process envisaged therein has become a sham. Yet the political class in a make-believe play acting, fool themselves all is steady as she goes.
CHAPTER SIX AND INDEPENDENT BODIES CAPTURED
One of the most important instruments (of the new constitution) which has been diffused and rendered null and void is of course the infamous INTEGRITY CHAPTER. Too, many of the so-called independent bodies once can think of --Independent Police Authority (IPOA), Salaries and remunerations commission (SRC), Ethics and anti corruption commission (EACC), The Judicial Service Commission (JSC), The independent electoral and boundaries commission (EABC), all parliamentary commissions----- have all become appendages of abetting corruption. They have been captured by Kartels (to think of the narrative of state capture which, in South Africa under the degenerated Jacob Zuma, gave us the acronym ZUPTA.)
The comedy which is the Kenyan constitutional system as fashioned by the looters, hit a new low a few weeks ago with two proposals. One was by the council of governors, the other by the Legislators popularly referred to as Mpigs. The governors proposed to be, like the president, excluded from ARRESTS for whatever misdemeanour. This for the period they are in office. Howbeit a reading of the Auditor General's reports on county finances would suggest most if not all of them should be behind bars, charged with ---he he he KPLC blues--- economic crimes!
On their part, the Mpigs sought to bar THEIR arrests on Fridays or weekends, coz one can't apply for bail then! And has to wait in the cells until Monday noon!
These two examples underscore yes, a COLONIAL mentality of EXCEPTIONALISM for the ruling class. There were two sets of law in the colonial system. One for whites, another for blacks. At one point it was impossible for a whiteman to be charged, live alone convicted of murdering a Kenyan native black. Blacks were animals whose killings for whatever purpose by whites could not be judicially defined as taking of human life!
You know, a bit like a white cop who kills a Blackman in the USA is kind of never guilty of whatever charge! (LAW$ORDER, no matter black lives!)
Colonial law was a free ticket to rebellion by the natives! So is a meaningless post-colonial reform process.
The most important thing to record in Kenya then, is that post 2010, that is the promulgation, the political class have torn, mutilated and bent the document to defend their interests and, most importantly, render the new dispensation incapable of furnishing retribution on corruption. Corruption is primitive accumulation, the privatisation of the collective social surplus by use of the state. It is a nation-killing parasitism, and parasites and their facilitators need must be fumigated. But this defanging of the new constitution, this corruption of all her progressive tenets, is how we explain that, today, corruption is talked of as having exceeded even the Arap Moi barbarism and economic darkness. It is atavism.
And by thunder the KANU Arap Moi regime was a stone-age, pre-civilisation order of power.
Now that we have historically positioned the current constitutional infrastructure and its legal side-kicks (colonised by parasites), it is time to face one of the most sensitive bastions of any order. -The self-declared holiness of the legal, formal, renaissance pillars.
One such 'enlightenment' pillar is the legendary ''one is assumed innocent until proven guilty.'
That is fair and square, not withstanding the reality of ---in Kenya--- state-orchestrated extra-judicial killings by the likes of the ATPU, the Heszy's of wherever, or the usual robber-hunter killer squads of the special units like the QueKwe of yonder. (The new kid on the block Kinoti recently disassembled the toolkit only to reassemble it, meaner and leaner I should think, presumable so that they no longer be of wont to moonlight as private executioners for a fee!)
DANGEROUS DOUBLE STANDARD
Remember therefore, this double-standard we have refused to face in Kenya, which means should the QueKwe now turn on the barons who imported poisonous sugar and hunt them down with death intent like they do the coastal youth suspected of Al-Shabaab links, a hullabaloo from their rich lawyers will, however justified, sound like much ado about lost income. Not the principle. The principle of all innocence before guilt.

It is important to think these things through. But today, the beef I wanted to argue is non of the above. I want to go for the so-called ATTORNEY'S PRIVILEGE.
THESE public-money laundering LAWYERS ARE no better than PIMPS. They are plain HANDLERS IN STOLEN PROPERTY!
You know renaissance has really fortified the relationship between a lawyer and his/her client. And when that client is propertied, moneyed, socially powerful, strange things happen at law.
Exceptionalism.
But then, this is capitalism. Even if it is still the primitive variant, it is of the kind.
Consider a PIMP. It is illegal to live off the proceeds of prostitution. A pimp is a universal nasty parasite, even if (usually) he protects the prostitute from the excesses of the street.
Good. This has been internalised beyond dispute. A pimp is a moral degenerate everywhere.
Consider the clause HANDLING STOLEN PROPERTY. Every Tom Otieno, Dick Kamau, and Harry Simiyu who handles stolen property is guilty of a felony. Actually felonies if you split the clauses. Public money is public property.
Now consider the NYS heists, both one and two.
We will excuse those who can not add up figures. They wouldn't know whether money was stolen or not. But those with an elementary understanding of numbers, enough to decode financial audits, will not be nonplussed with shouts of where is the proof!?

The lawyers of Ben Gethi (money has since been recovered from him
--or he donated it back to the taxpayer out of his good heart?) who handled his NYS windfall so to speak, like the 27M HongKong shopping spree, are they not nothing but handlers in stolen property!?
But they have professional immunity. Exempted from being called what they are, parasitic scum. O! The privileged attorney-to-client relationship!
O yeah they do enjoy a medieval privilege, these wheelers and dealers in contraband cash, but for how long when Wanjiku is being dismembered by parasites on top!?
I want to plant a bomb under this posh and lucrative arrangement. It is a scam, and they are scum all round.
When my country is loosing an excess of 30% GDP to a corrupt elite supported by corrupt smart lawyers, I want to permit myself the word crisis and arise to the crack mental state of dealing with a crisis. Kenyan exceptionalism! Thus with cold eye, steady hand, ruthless heart, do I slowly turn the tip of the dagger and rest it at the belly of these lawyers. They must be deblooded, them ticks grown fat on Wanjiku's blood.
There is a story in Luo culture about a child who swallowed an all important bead and had to be disembowelled to recover the bead. For sure it was a nasty business. I now put forth this cultural argument. 1. The fabled 30% of the GDP lost to corruption is facilitated by these pro-colonial lawyers and their corrupt selves. They have swallowed the import and of the 2010 reform constitution, integrity and all. They must be disembowelled to recover the thrust, the bead, the content of eg integrity as a national good.
Handlers of stolen public goodies to go down with the looters themselves. Not as accessories nor collateral damage, but a main course. It is an awakening, not by a kick to the ribs of the smart corruption lawyers, but by a dagger through their bowels.

I LOVE THE CHILDISH INNOCENCE OF KENYAN ADULTS! 1. RAT-ATAT-TAT! I think corruption softens a ruling class too much. Too, it saps the critical and professional faculties of the facilitating, auxiliary and technical class. THE LAW SOCIETY OF KENYA? YOU MEAN IT THINKS IT IS CLEANER THAN THE MPIG-HOUSE?
Two issues from the mouth of their president, Allen Gichuhi.
1. They, LSK, fear the current demolition craze could result in malicious destruction and deprivation of private property. 2. They, LSK, fear Natural justice could have been breached in the demolition of private properties on the so-called riparian lands. 3. The statutes are not clear on what, or where riparian is! Govt should clarify first! (see citizen video of the 30m rule!)
The above letter is meant as a priority delivery! The fraternity of learned friends are fuming! --But I do not remember the LSK ever fuming on the breach of any justice ----natural or man-made, jungle or urban, divine or earthly----- when the victim is PUBLIC PROPERTY! From the Eurobond saga, to the NYS's, to the latest outrageous KRA heist, to the POISONOUS SUGAR, .... the breaches too many to list .... the LSK excelled by its play at possum!
Neither have they, LSK, ever shown temper at anybody over the 'dissappeared' NDUNG'U LAND REPORT!
In other words, the LSK is an organisation dedicated in service to private property. Whether that property is generated by loot, theft or whatever criminal genesis, is beyond their statutory scope at the LSK. That is good, law is a class thing. LAW AND JUSTICE, NOT YET TOGETHER The pitfalls thereof, and liberation. When the likes of Nelson Rohilala Mandela were facing death or life-time incarceration, it was to other concepts, HIGHER CONCEPTS of justice, they appealed in their HISTORY WILL ABSOLVE ME mitigation. This means they remained convinced their 'treasonable actions' were rightful', but in a way beyond the scope of the (Apartheid or Battista) judicial system which were, no doubt, duly constituted and conforming, formally at least, to the jurisprudence or legal order of that de-facto state (or regime). Hmmm Higher concepts I said! Which means an existent (legal order) regime jurisprudence may have nothing to do with real justice for the majority of a people under its yoke. This would make The Law a permanent ass without respite, perpetually in conflict with the subjects, except for a small elite. This was always the case within the colonial situation, and in its successor neo-colonial states. Actually Black Kenya's experience of colonial laws, say LAND LAWS, up to and including the laws on vagrancy, easily tell the tale of how UNJUST jurisprudence can be enacted by state operation. A state is legitimate in its own right, by virtue of its organised violence and capacity to contain opposition. In that sense, all states are legitimate, they are power, real organised power, imposing core wills of a select group. Rarely the majority. Back in them unjust days, that was when the word Uhuru came to the fore as a rallying call, with organisations like the Land Freedom Army taking to millitance. Land! O yee! Then of course one throws the word LIBERATION in the mix. But when one throws the word liberation in the mix, what happens to the defenders and beneficiaries of the status quo!? O yes, they jump out of their skin; the law and order fanatics, journeymen and kartelist profiteers, top bureaucrats ---(recruited from classes pathologically ever obedient to any hierarchy), and tenderpreneurial racketeers totally morally illiterate, they all scare to death. So too do all money-for-a-song politicians and their intellectual sycophants become nervous and threatened existentially. The whole bureaucratic order (political state tenderpreneurial complex) is thrown into ideological confusion and there is a call for a strong man to steady the ship. And if a strong man is already in power, there is a call for a more draconian crack down on dissidence: (right there is Professor A.G Githu Muigai calling for Amollo Tinga's execution should he swear himself in. Yeah, even simple, open-air carnivals of KALONGOLONGO chants become treason! that is how confused and scared parasites think!) So let me not waste any more time. Lets ride. Against this rotten judiciary and legal fraternity which, in its delusion, thinks itself better than the down-to-earth corrupt police force. The Judiciary got a chance to reform itself under Wily Mutunga, it squandered the chance. And set themselves up for a bust. Yes, you heard that right. But before the Big Burst of their Bubble, comes the intra class fall out. This latter battle you heard announced when Uhuru Kenyatta and William Ruto, having been rigged-in and declared winners by one wing of the Law School creeps, woke up the next morning to find another wing kicking the stool from under their windy butts. They promised to fix the Judiciary. Of course no one has yet sworn to fix the broken electoral process. Which is to say, fix the real economy. For law and order is merely a summary of existent social relations, which are conditions of the functional rate of the productive equation. And so (next) THIRD LIBERATION ON FOOTNOTE: On a report of the traffic intersection where the logic of mobility is defied by the criminal monstrosity once known as the Taj Mall, now a stumpy remnant as AirGate Mall, a Standard Journalist quipped that VESTED INTERESTS were to blame for the preference of a medieval solution to a futuristic problem, over modern engineering. So, if that is the score of current vested interests, what they, really!? Are vested interests, so-called, busy killing the future of Kenya? Did vested interests kill the promise within the 2010 constitution? Are vested interests responsible for the cycle of electoral irregularities, aka rigging!? So, what are these vested interests? But in mundane stuff like economics, verily miracles are possible, like the wirtschaftswunder, verily by the effort of man alone. So doctorates galore in economics, in fact, conveyor belt mode! No kidding! But, even for Anglo-Saxon curriculum in economics, it remains quite an extra-ordinary class of Ivy leaguers who, freshly producing crude, yet unlike Iran and Venezuela under a dollar sanctions regime, freely put their people and economy under the strains of shark-rate taxation on fuel! That kind of oddity needs a rational explanation. So, it is not that these guys --Rotich, Thugge and Njoroge--- are intrinsically mediocre, it is that they are mercenary. For their thirty pieces of silver, they'll be glad to see Kenya dead. But themselves super rich in a golden parachute. I want to get to lawyers and the judiciary, but I want to make sure it is understood I am not PARTICULARLY picking on them. It is just their turn to be knocked off their high tower of pretence, since they are the only remaining pretenders in town! I like being nice to lawyers, so I particularly run hard disclaimers. NB: Remember we teachers were reduced to committing suicide during the long strike when we couldn't even buy the daily sukuma-wiki on credit. So tough can Uhuruto be! Our bubble was long burst. Then came the turn of doctors and other health workers. Now we have Cubans! So tough can Uhuruto be. Kenyan Bankers we all know, just like International bankers who, had Obama not been predisposed to benefice his campaign funders, would have been executed for a global economic crime in 2008. Obama soft on bankers have Uhuruto been here too. Policemen we saw speak of their Mpesa merry-go-rounds where the average transaction was x20 their salaries. Good for them. Tenderpreneurs we have seen importing mercury-laced sugar, no need saying more on their rotten souls. So the rest of Ivy-League Blue-chipped Kenya are pretty much reduced to size. Except the lawyers! Judges and the whole lot of scumbag ants populating the catacombes of Kenyan Justice! Nothing personal thus! In fact I remember writing a disclaimer on OGOLLA&MUJEERA advocates when they were tasked with exporting 27M to HongKong to buy business suits for one, Ben Gethi, who was a major beneficiary of the Waiguru-Kabura NYS cash haul. I said then it was a story which told itself, and like a soap of many juicy strands, would lead us far, far and wide as we followed the money trail. TAJ MALL COMES DOWN, WHY NOW?
What forces have conspired to force the demolition of Airgate Mall, formerly the Taj Mall? This is a tens-of-million building, and was primed to making even more profit, ksh. 3bn lost in 5 years, if we cite the owner, Rameshchandra Govind Gorasia. This profitability projection was high enough to bribe KURA (and the rest of the cast) to redesign a landmark road junction and city roundabout.
So what has forced the gravy train off the rails!? Why now the pull-down after years of meandering backs and forth? (this goes for Atul-Nakumatt-Shah's Ukay Mall Westlands and the South Gate Mall of Manotti)
Something surely did force the issue. It must be quite a force, or, likely, a merger of forces which forced the owners of Kenya, high on impunity, to concede this blow to --tactically-- deflect an even deadlier one coming their way. Another mitigating factor could be as dark as the black bandit bourgeoisie calling their brahim counterparts of Asian Origins to order. That is an intra-bandit-class squabble adopting a mask of colour, caste faultlines. Using a wave of popular resentment, hiding behind the Handshake, the black bandits smell enough political cover to march on the localised Asian bandits.

To entrench Kalenjin crony capitalism, DT Arap Moi used anti-Gema feelings generated by Jomo Kenyatta's Kiambu-mafia plutocracy to reel back the Mount Kenya hold on the state he inherited. Fuata Nyayo as the smokescreen as daggers worked unresting. So always watch out for the struggle for existence, dominance and rising factions.
WHAT DO THE FUTURES FORETELL?
The demolition of this mall is a dangerous symptom to impunity. It clears the path to go for all those who were involved in the plot. THE POWER STRUGGLE NABS A SCUMBAG, PROFESSOR OJIENDAThere are some mental notes I like to make when something happens. And then wait for the power struggle to heighten. Such power struggles are always a staple in state politics. When they heighten, factional feuds are compelled to draw blood hither and thither. There's one at the JSC now, as a subset of the big one, come 2022. Vultures who like to strip corpses could soon have a field day, a season of plenty! On the mental notes I always featured Tom Ojienda was Kidero's consigliere, first at the cookie jar known as Mumias Sweets, thereafter wherever, eg Nairobi county. I pondered if the professor at law was an immoral high-end gold-digger. Nothing to do with Kenya really, just a cultural, Luo pivot frown. And don't I frown deep on that score! I noticed when he adopted a scandalous precedent. He went for what I call ODILI-like INJUNCTIONS. --That was a farcical case in Nigeria -- see Footnote--- where a Judge made a ruling which barred ALL Nigerian courts from ever prosecuting a corruption super star. It was called a permanent or perpetual injunction. Minimally it would be valid for at least one thousand years, Oga rappers joked. Nigeria is not eternal you know. (I hasten to add there was a precedent in Nigeria. Under Obasanjo and Awolowo there was a permanent injuction, decree, on questioning the legality of the further subdvision of Nigeria into whatever the number of states the then current head of state pronounced!) Fella Kuti wrote a scorching song about the episodes! OJIENDA THE NIGERIANOjienda for instance barred --it is not only in Nigeria where Judges can be bought---- anybody from quoting the KPMG audit reports of Kidero's time at Mumias. Dr. Bonny Khalwale was intimidated into shutting up for instance, he famously hid in a toilet as Kidero-sponsored goons bayed for his life; so did the whole host of Luhya Mpigs fold up, from their pretentious act of having the interests of Mumias sugar at heart. One never knows whether their names were mentioned adversely in the forensic audit reports. Eh!? Conservatory orders they say here!? not 'gag'? The mess in court was revealing, between two JSC and LSK stalwarts. For truly truly I say unto you, Ojienda and Ahmednasir have been paragons of the Kenyan castle in the air, the JSC! it is a small world, the same faces at every looting station, both lawyers as Mumias sugar addicts. A scumbag's fiesta, all in the public record! Only Dr. Miguna Miguna burst Ojienda's bubble. Running for Nairobi governorship, participating in a joint, live debate, the burly 'Canadian' looked at the incumbent Evans Kidero with a seething contempt which reflected something deep and widespread amongst the Kenyan peopls at large. He told Kidero to his face, he was Cartel looter who reduced Mumias to a carcass and was doing the same to Nairobi. And then, take me to court, I will read the forensic KPMG reports to you! Conservatory orders my foot! Kidero shrunk like a dick past ejaculation. I imagine along with the Judge who issued the conservator orders on the said Mumias KPMG audit. I noticed senior counsel Ojienda didn't come to re-inflate his patron and baron, by suing Miguna on his behalf. Neither could Kidero do a live Shebesh on him, topped-up Canadian! (eventually the elite could only deal with Miguna's mind by sending him to sleep before deporting him. The Canadian madhafaka got mental calibre too heavy for the lilliputian heads in Nairobi Kenya.)But that day of the debate told myself: wait for the intra-elite power struggle to escalate, Kidero and Ojienda will be re-visited. It is on the cards. (Just like the Marble Arch Hotel!) That is the way it works. There is a stalemate at the top, the active factions therein develop memories, incriminating memories. One can be sure the WESTON HOTEL LAND THEFT will come up somewhere as the 2022 succession battle heats up a notch more, but the NDUNG'U REPORT wont!) Anyway, let this Ojienda too be Professor Swazuri's lawyer at the NLC mess, in addition to being a member of the JSC. NB: On a sad note, I trembled some when this Ojienda filed injunctions to prevent the probe into the accounts of Dr. Susan Mboya Kidero. That is a Luo pivot post. Susan is Rusinga Mboya's daughter. She had become roped in as a Cartel handmaid. There is a certain historical horror to that. Not that Dr. Sister Susan would know what I am talking about. Added to that --that domestic horror from her Faustian bargain, we saw one of Kidero's boys, her son so to speak, arrested for selling laced fuel. --eh! The men women marry! Truly love is blind! But that is for the cultural takes! And I tell you culture is cold-blooded enough to abandon God if God ceases to bring rain. That is what dam engineering is about. God's monopoly of the rainfall blackmail on crops nullified. Anyway, there is a creeping escalation in the intra elite back and forth in Nairobi. Then do greed-ridden Scumbags like Ojienda become sitting ducks in the shooting war at the top! It was easy for DPP Haji to call his bluff, the way the same (that time accompanied by DCI Kinoti) called to call DCJ Mwilu's bluff. I encourage others to notice too, that Judge Warsame, an occupant of one of the high-sort- after seats at the JSC, is the assassin who was chosen by Dr. Wily Mutunga to kill off the RAO VETTING BOARD. He did at the first opportunity. This was a successful operation by the Kartel to push back the reform process. Wittingly or unwittingly, Dr. Wily Mutunga carried their water. What a scumbag! My thinking is Warsame's corruption is of a sort whose bluff is more difficult to call, since all factions of the predatory elite need a morally corrupted judiciary. Having proved his usefulness, he is not expected to go rogue all of a sudden. Should he, then pressure is best exerted behind the scene to bend him more, or back as need be. The JSC turf wars are actually a side show. It is a skirmish for one of the commanding hills in a large battlefield. The above reminded me of a view by Ronald C Slye, who was at the TJRC where Tom Ojienda was a commissioner. The whiteman thought it doubly odd, troubling and unpalatable that Ojienda had not revealed he was Mumias's chief lawyer at the time when the Commission was listening to a wide range of complaints from the Mumias sugar factory. Sly thought, and correctly I conclude, that Ojienda was in deep conflict of interest and showed a callous disregard for ethics. But neither the JSC then, nor the LSK then, offered an official opinion! -The pack defend their own to a hilt. That is why Mutunga allowed Warsame to kill the vetting board. But is this defence pact, the omerta of a mafia!? yes, I am afraid so. THE PACK TO THE RESCUE, DCJ MWILU etcThat is the professorial logic at the JSC, and the likes of David Maraga, a kind of new Mutunga like Kahara a new Githu, are listening to that nonsense! Innocent until proved guilty!? Huh!? --we know it does not work like that here. There are jobs we talk integrity, and something about Ceasar's wife: She mustn't have pants soiled by whatever spoils from another man's loin. The honourable thing to do is HaraKiri. In this case resignation.
