It is quite unfortunate for a whole Prime Minister of the Republic of Kenya to have said what the newspapers attribute to him on my illegal suspension.
Kenyans expect the PM to respect and uphold the rule of law and the Constitution.
The PM is not law unto himself. He is but a mere mortal like Miguna Miguna. His rights under the Constitution are not more or less than mine.
Like him, I have a right to due process of law. I have a right to be informed of the allegations ahead of time - if there any - against me and to be accorded an opportunity to respond. No one can be condemned unheard.
I am entitled to both adequate and proper notice and a defence or response. Everyone in this country has a fundamental right not to be subjected to arbitrary and whimsical action not founded on law.
The PM must explain to the country when he gave me a "show cause" letter with detailed particulars of the allegations he claims are being investigated.
He must also explain, under what law he suspended me without pay.
Further, the PM must explain to the country who the investigating agency is and what it is investigating.
What "normal government procedure" was followed? Under which law? Has the PM now become an investigator? Under what law or provision of the Constitution?
The PM must explain which law or provision of the Constitution gives him the power to leak the so-called suspension letter more than 24 hours before it is delivered to me.
As the PM's adviser for coalition affairs, I worked for the Executive arm of government. Jakoyo Midiwo and his incompetent fellow Luo MPs work on the legislative side. How then does Jakoyo and the other MPs become my supervisors and decide when and how I lose my job? Or is Jakoyo speaking as the PM's counsin?
I am a government employee; not that of the larger Odinga family or the party ODM. Therefore, I must be accorded all my legal rights. I am not going to beg for my rights.
The PM must start respecting institutions, procedures, laws and the Constitution. He must also respect every Kenyan; small or big. He is NOT above the law.
I am ready and prepared to answer any fabricated allegations they might have concocted. But I will only do so WITHIN the law and as prescribed by the Constitution.
I do not fear anyone. I am not going to allow anyone to bully me. God, the truth and the Constitution are my shields!
The new Constitution is very clear on the rights of individuals and employees. No one is permitted to treat the Constitution as a mere piece of paper. Miguna Miguna will certainly not allow it! I am not going to succumb to threats and intimidation from clueless goons!"
Thanks.

...incompetent Luo MPs... ? Surely there must be people who care about Miguna and can talk him out of this journey he has set himself. There is absolutely no reason why Miguna must be on this crusade to burn each and every remaining bridge...his bravado and belief that God and the constitution are his defenders will only take further into the hole he did not stop digging! It should have been absolutely clear to him that Raila fired him and moved on and will perhaps not be involved in this altercation any further. Someone should seriously help this man!

NOBODY IN KENYA IS ABOVE THE LAW! why should Kenyans vote in individuals that are clearly saying point blank to the country that they are ABOVE THE LAW! " 2007-2008 repeat in offing, it only happened because some of the individuals believed that they were above the law! look at the bloodshed it caused!!!! Miguna must stand firm even if it means burning bridges with those that want to misuse the law, and think they are above the law! THE YES MAN SYNDROME IS FOR YESTER-YEARS.. let those who support the NEW CONSTITUTION man-up and be counted!

This Miguna suspension issue has made ma vacation very unpleasant .Honourable Jukwaa members we will not accept intimidation and frustration from few fools at the Prime Ministers office to frustrate our very own son who has worked his socks off to defend the Honourable Raila Odinga from PNU thugs n goons since the Grand Coalition Goverment was formed.Miguna has our unflinching support to go ahead with the court case and I know through God's grace and mercy he will win.Ma vote 4 Raila sio lazima let him treat our friend with courtesy n respect that comrade Miguna deserves.I will continue to support Miguna n his belief 4 democratic ideals n fight for a better society in Kenya.Long live Miguna x2 n God protect u from political prostitutes.

MM my brother,
Please, you've already gone to court! Please let the courts give you your rights back! This public spat with the PM is not helping your case at all!!
If the PM chooses to lie through the press, let him do so. Just wait for the courts to mediate your case and prove you right. You might just have the last laugh with the PM ending up with egg all over his face!!
Tone down my brother. The whole country has heard you!!
Cheers and all the best.

KENYANS MUST ALWAYS DEMAND JUSTICE, and not shy away when confronted with misuse of the law!

Folks MM is losing the plot here. He has already taken this matter to court. A reasonable person would have left it at that. He can't go lauding his rights under the new constitution, which apply to even Canadian citizens (they are human after all) & then keep on fighting wars by proxy through blogs & the press.
Sadly, his friends are doing him no favours here by assisting him in his "going postal " over his suspension. Little wonder he was suspended via remote control. There would've been a hostage situation in the PM's office requiring body bags if anyone had dared sack him in person.

What is this insult about Canadian Citizenship? the last i checked every Kenyan as a right of having Dual citizenship! so lets not go there, it was tried and it failed.. why is it that when a Kenyans insists on due process according to the law of the land, it termed that he is losing the plot? which plot? does the NEW CONSTITUTION have a plot or it is there to protect the interests of all Kenyans? wake up the law has to be followed to the T Leaders must not be allowed to abuse and misuse the law ever! I pity those individuals that follow such leaders blindly, such people have no right advising Miguna to do the same.. KEEP SILENT AND FOLLOW BLINDLY WHEN DUE PROCESS OF THE LAW IS NOT FOLLOWED BY GOVERNMENT EMPLOYERS PAID BY KENYANS TAX PAYERS.. THOSE LOUD MP'S SUPPORTING IMPUNITY SHOULD MAN UP AND START PAYING THEIR TAXES- KENYANS LOOK FORWARD SEEING THEM IN COURT TOO..

This Miguna issue has stirred me awake from my stupor in the Midwest. And i think this is my first post on Jukwaa. I am really angry at Raila but there is no other better option to run to? Can progressive guys like Miguna Miguna, Onyango Oloo, Lumumba etc start a powerful alternative force in Kenya and in Luo Nyanza to make luos start entertaining another leader who is not from the Odinga family? Agwambo is too comfortable lately. he talks Luos down in funerals and stuff like that. I can now understand why people like Ruto are simply interested in stopping him from being president. They may wanna maintain the status quo by knocking Raila out but what is Raila doing by firing Miguna like a gunia? To be honest, I am radically minded and I am afraid to say what I wanted to say. Anyway, Raila respect the people who have helped you reach where you are. I was one of your Kisumu youths and we risked our lives for you. We lost comrades to. Now looking back at that thuggery, I guess we were mis-used. We thought we were helping you fight the status quo. Now what do people like Midiwo have to help you with?? The guy is always in bars more than even parliament. Are those the people you wanna rule us with come next year?? Why would we find your presidency attractive if it will be business as usual?? Do you care how Miguna is feeding his family??? Do you remember how Moi fired your wife Ida from that high school and ordered her to vacate the house within a day?? Why are you forgetting where you came from?? Do you remember when your life was in danger after you had rubbed the then Moi establishment the wrong way?? Do you remember guys like Archbishop Okoth who gave you priest clothing to help you evade to Uganda?? Do you remember the foreign embassies that aided you during your time of peril?? Why do you toss out a person like Miguna Miguna without warning him?? After all his scathing attacks (whether right or wrong), do you even care about his safety?? And if his writings were that bad to you, why didn't you just have told him to tone down?? He is not an idiot. i am sure Miguna would have at least known that his job could be on the line and prepare. And now the same INCOMPETENT Luo Mps who have done nothing to your cause or of their constituents are joining in the lynching. YOU are QUIET, because you think such matters are BELOW you. I am not a prophet, but sooner or later your boat is gonna capsize. Miguna, take heart. Go back to Canada, i fear for your life.

AMEN.. it is about who one steps on to climb the ladder, some lift the people at the bottom up with them, with respect but others spit down on them after they reach the top of the leader, we have seen it happen over and over again in Kenya... my sentiments, are there no Kenyans intelligent and smart enough to stand for the top offices in the land? what is all this about recycling material, when one looks at the line up of next years wannabbe's, Even Obama come from nowhere - "young senator" there were more powerful people ahead of him and with determination and strong backing and grassroots campaigning he won... Kenyans must wake up... look around them and ask themselves some serious questions ARE THE FACES IN CURRENT PARLIAMENT THE SAME FACES THEY WANT TO SEE IN 2012 UNDER THE NEW CONSTITUTION? I SINCERELY HOPE NOT!! one can not change a LEOPARDS SPOTS, OLD HABITS DIE HARD/OR NEVER.. SIGNS ARE THERE LOOK AT THEM TRYING TO GET OUT OF PAYING TAXES WHEN EVERY KENYANS IS MANDATED TO PAY BY LAW!

THOSE WHO LIVE BY The RIVERBANK SHOULD NEVER WASH THEIR FACES WITH SALIVA. KENYANS LET US WAKE UP. We are all equal. I will make a YouTube video questioning Raila on this. He needs to RESPECT people. For Now if he reads all this, i will dedicate two delicate video links to him and to his family.

I am already playing war songs. Agwambo listen to each line of the song below. JAH will never give POWER to a BALD HEAD. i saw you are BALDING and your hairline is doing it chaotically lol. Apologize to your supporters. We have VOTES too. I do not even know Miguna Miguna and i am sure i would not stand his heady proud nature, but RAILA keeps exposing himself. To me the whole issue is about RAILA,and his tendency to USE, MIS-USE, Refuse and ABUSE people. The LUO have a proverb that says, A BOAT capsizes when it is just about to hit the shores. AGWAMBO, listen to us. We are not IDIOTS. Some of us have done more to you than OBURU and JAKOYO will ever do. We did not do it for any PAY. We loved you. Do not BETRAY us.

hey guys
from what i read of reporter911 and gateway and a few others
evidently all that true ODMers want in this miguna saga is fairness and am not going to try to mix this up with heckling.
there has been some very shabby treatment of miguna by the PMs office, that is not in doubt.
what is however rearing its ugly head is intolerance which can sometimes be confused with standing firm on principle
lets revisit history a little bit circa 2007/8 and we find that intolerance mixed with rigid positions aka intransigence and we found ourselves in a quagmire of epic proportions
i'd like to believe that a significant number of us learnt from this experience and are willing to demonstrate a little more flexibility in terms of accommodating even those views we deem to be extremist and perhaps toxic.
my point is that yes its true miguna has been treated very shabbily by the PMs office, but the dream of a better kenya is much bigger and still remains a far reach. from what i know of miguna he is a very capable individual, and even this disagreement is not enough to sway him. some bitterness and resentment as is expected of humans will be there, but we need to focus on the bigger picture. as kenyans we have to move away from the kamikaze style of "do and/or die". we need to embrace tactical errors and learn NOT to live with but to anticipate them, but also to find reasonable avenue to handle the subsequent crisis, but even more importantly devise methods to avoid recurrence, otherwise we fall into the trap of history repeating itself every cycle.
at this moment in time am asking what went wrong really between miguna, PM and the office
what should we have seen that we didnt
what needs to be fixed to avoid a future recurrence

This Miguna guy is surely going Loco. As Kamale has said earlier, this would be a good time for Miguna's friends to really hold his hand and tell him to either go silent or tone down major.
On a separate note, I have been scratching my head trying to find out or figure out what great or major thing that Miguna has done for Kenya/Raila/ODM such that the mere plan to sack him is all of a sudden treasonable.
The only difference or contribution this guy has made to Kenyan politics is to re-define the meaning of confrontational politics.
Another thing, assuming Miguna has his way in court, what kind of working relationship is he going to have with the PM and how is he going to advise the PM? I have never seen or heard of someone trying to be an advisor by force.

Rather than wait for Miguna to go to court and engage in the one-sided spat with the PM, Dennis Onyango should already have released a press statement answering these issues you raise in your comments. On the other hand, there is a political angle that I think ODM as a party should also have addressed. It is cowardly to sit and watch as your own party leader is ridiculed in national press and do nothing about it. People like Jakoyo Midiwo need to shut up. Jakoyo is just adding fuel to the fire and you can be sure ODM is losing support each time Jakoyo opens his stupid mouth. Meanwhile, I urge Miguna not to give up the fight. No one is above being accountable to the law and that goes for Prime Minister Odinga too.

How about putting your neck out there for all to strike at... getting yourself very much disliked and hit from all corners because you fearlessly defend someone you trust with your soul and mind to take our country out of the rules of the Impunity. How about putting your own life and that of your Family behind you for the sole purpose of wanting to help another profit for the sake of a Nation needing a hero…. How about waking up one day and finding that person you have sacrificed your life for with a knife ready to stub you on the back. If you were a true to yourself person, would you not be overcome with a truly raw anger that makes you want to destroy that traitor in a hero’s suit? Miguna is a fearless Man, but now he is also something else, he is a damn angry man. But he wants to spit that bile out before it gives him cancer and go on with his honest life. That’s his right.

RAILA, some of us still LIKE you, but "IDHI MARACH" (you are on a wrong tangent). Our EXODUS from BABYLON will happen without you if you refuse to listen to your people. I think you should come out and APOLOGIZE.
The MOVEMENT of JAH PEOPLE (KENYANS) will not be CURTAILED. We gonna kick all the OLD MEN out of TOWN. SET the captives FREE.
