Currently at the high court is a case pitting Moi and a group of lawyers whom he accuses of 'stealing' from him.
Apparently, Moi started a company through nominees (the said lawyers) whose responsibility was to purchase shares in KCC. When the NARC government took over the assets of KCC, the owners of KCC 2000 limited were to be paid Kshs. 400 million for the assets of the company. It now transpires that Moi used the nominee company to buy out a dead company that had been run down by his son Raymond for a pittance, and now is suing these lawyers for not passing on the money to him.
Co-operative's minister has suggested that this amounted to 'insider trading' and fraud since Moi used inside information on the indebtedness of KCC to KCB to acquire a majority share holding in the company.
If this is the case, should the government refuse to hand over the money to him, or can he be sued for abuse of office?

There are two clear aspects here. Moi is suing his former lawyers. In my estimation the money belongs to Moi and not the lawyers who are changing their mind and playing him…the money must therefore be returned to him. This particular aspect of the case must be decided as such. The second aspect is this insider trading accusation levelled by Ndwiga (by the way: does he have the moral authority to make such accusations? – I am yet to meet a more corrupt and consummate thief than this man, from insurance to employment scams it has been a sleazy menu of Simon Makonde Ndwiga). Anyway this second aspect becomes a bit technical…Kenya does not/did not have any laws that would handle the kind of insider trading being suggesting. And more importantly KCC belonged to KCB and could be sold to anyone Importantly, Mwai Kibaki does not have the spine to prosecute Moi on anything. We've been waiting since 2002. The government knows – if Ndwiga does not – that if such were the case, then about 100,000 other insider trading cases should be filled in the high court immediately featuring many other people including Mwai Kibaki himself as defendant. They can’t open that can of worms, can they? Certainly not these people who make decisions based on what is political expedient. Is the insider trading because of his father-son relationship with the former CEO or because he was president? Can it be proven? And if it is argued and proven, this matter not being a criminal case, can Moi be jailed? In fact for whatever other reason can Daniel arap Moi be put into a jail without all hell breaking loose? Rest assured that Moi and his lawyers made all these calculations before they went to court.
