Now that Kibaki has assented to the draconian Media Bill and thereby turned it into law, ODM has no business staying in a GCG which does not guarantee it equal partnership. The president through this action among others, has literally slapped ODM and more so the PM in the face especially after Raila had publicly assured Kenyans that the President would not append his signature to the controversial Bill. The president cannot keep on backstabbing Raila and still expect the GCG to function. The president never won the legitimacy to rule Kenya single handedly. Instead the ever patient Kenyans handed him a lifeline after he brazenly stole the elections and sworn himself into office by use of force! Time and again, Kibaki has used Muthaura to frustrate the PM's efforts to fulfill ODM's election pledges to the electorate. Oh! we have a GCG in kenya? from the look of things going on, Kibaki is the president of Kenya.Raila has been a disappointment from the time that he mentioned a Grand coalition. Kibaki does not respect the coalition,as far as he is concerned, he is the president.I still blame Raila for giving in to the grand coalition thing. Am however happy that i know Raila's true colors now, he is not worth being a president. The guy is too soft and he has been going along with anything that Kibaki wants. Watch this space,this issue like all others before, will end without a challenge from Raila. Am throwing my odm shirt out.

It is time for ODM to make a stand now.. no need for courts options on the media bill.. they ODM should recall they refused to use the courts and preferred Kofi Annan mediation because the Kenya courts are stacked with Kibaki's Judges under the control of Martha Karua.. ODM Must get out of the Coalition period!

Facts are Kibaki did not win the 27th December 2008 elections let me remind you.. secondly just like he has muzzled the Media by signing that bill, he has his operators like Muthurua and Michuki using the government machinery to oppress and harrass the ODM MP's when they try to do their job, the PM is a peaceful individual that does not mean he is a weak person.. at least he is not a murderer like your guy Kibaki who you seem to admire. Kibaki must be forced out ! he is in office illegally and kenyans must wake up and march him out.. take an example from Thailand they did it and yes we can too.

tiskie, i think you misunderstood judy. all she's saying is that she is disappointed at raila for hanging onto the gcg and putting up with the irritating nonsense from muthaura, even having the audacity to trust kibaki after all that kenya went through. i too think raila is too soft for accepting and tolerating a terribly flawed nara which doesnt change kibaki's powers. whatever happened to him i am clueless, maybe i'll know some day.

Tiskie, i did support ODM, i almost died for ODM, i was in kisumu when all the violence broke out, and they thought i was from the wrong tribe, so everything that you are talking about i lived it, i didn't watch it. My point is, like most Kenyans i had very high expectations for ODM,i knew they were gonna win,and they did.Now we have this GCG thing, which i know makes some people very happy but most of us kenyans are suffering and we want change, if Raila doesn't get it, then to me, he is not fit to be a president. Am really frustrated by the people that we call our gvt. It's time for us to hold them accountable, we did elect Raila for president,we are gonna hold him accountable.If anyone of those politicians want to be the next president then they better read the sign of the times and wake up really fast!

Regarding Raila, he was ALWAYS a tough politician who sent several chills down the spines of many a politician. But after joining the GCG he somewhat became spineless. At first I understood him. He wanted and may be still wants from the bottom of his heart the GCG thing to succeed. But now that he has been betrayed, back-stabbed and has to keep on fighting his juniours day in day out, I strongly believe he would do us ALL ODMers a favour by simply quiting the coalition!! According to NARA which Raila signed, and if my memory serves me well, if any one of the coalition partners pulls out, this triggers automatically a new general election!! Raila has this tool and he should use it instead of fighting and trying to put off fires ALLOVER the place!! For how long does he want to play second fiddle to Kibaki when in actual fact the NARA gives him the same powers like Kibaki?? Raila must reenergise his old self and show some spine RIGHT NOW!!! I agree with you 100%. Now is the time for Raila & ODM MP's to show is that they can deliver services to the people. This is the time for PM Raila to stand his ground and flex his clout in government. ODM has enough cabinet positions to implement change in Kenya and they should not give us this excuse of Kibaki backstabbing them. If Raila cannot stand his ground then he should step aside for Ruto/Balala or quit the Coalition altogether.

King, Quiting the coalition is not an option for this is what Kibaki might be aiming at. As Kamale has mentioned above there is nothing in the NARA that will bring down the government in case ODM quits. If they did that, they would be playing into Kibaki and cronies hands, for the issue at hand (the media bill) is small in comparison to stuff like making the constitution and delivering services which are yet to come. What Raila should do is to take a stand on issues even it it means antagonizing PANU. He should let it be known that they have two different missions. While ODM is for change PANU is for status quo. They should vote as ODM on issues that they feel are at the heart of their manifesto. If they are beaten in parliament so be it. Nobody would blame Raila/ODM. I know that Kibaki would have stopped this bill if he wished but we must remmember that some ODMers eg Jakoyo Midiwo voted for the very bill. We must not forget that it was a suprise bill, all parliamentarians knew it was going to be tabled. Why did they not rush to the parliament to vote against it? My gut feeling is that this is something most MP´s wanted to protect their "dirty" images. See the below Karua and wamagunda court ex. An all out war between the two is the best option in my humble opinion. Raila must drop the good guy approach and be who he actually is ie a shaker and mover in the political domain. Kenyans let us hand the blame to where it all began! rigged elections!!! thousands dead and wounded!!!! - for what?? so that a particular individual namely Kibaki and his cronies could hold on to power by shear force?? ODM joined the coalition to stop Kibaki sending out his police force to slaughter innocent kenyans- the whole world watched on national and international media police shooting dead innocent Kenyans whose only crime was to demonstrate against the rigged election.. Raila did the right thing then to stop the massacre of innocent kenyans and I agree to the fact that now he has to re-evaluate his parties position - which all kenyans can now see that the coalition is not working. Things in Kenya are getting worse- hunger, unemployment, more corruption( distribution of Unga e.t.c) Now gagging the media?? Kibaki has taken Kenya back to the times of Kenyatta and Moi " control and prosecute anyone who says anything against the government?? what horseshit.
Judy I agree with your point at length but my only beef on that is How does Raila work with Kibaki ? when Kibaki is undermining every step he takes to work with the kenya society(the media bill and other matters of interest ?? fact is ODM should walk out of the coalition and as for they not being able to I disagree with the individual that states here that PNU can then ran the country - that clause was especially put in place after the fiasco with Kibaki's Narc government in 2002 when he decided to throw out the opposition parties that helped him gain power.. if there is no coalition government then an interim government is put in place by the speaker of the house to finalize the new constitution and pave way for immediate election(that is from one of the lawyers involved in the final details of the agreement. With this in place I believe strongly ODM is justified to walk out of the coalition it is not working and ordinary kenyans are suffering.
ODM MUST WALK OUT OF THE COALITION IMMEDIATELY- MAJORITY OF KENYANS WHO HAVE WATCHED KIBAKI IN ACTION WILL DEFINITELY SUPPORT THIS MOVE FROM THE ODM PARTY PERIOD!!

Kamale, I just went through the Jukwaa archives. You are right and thanks for the correction. NARA does not provide for a general election should the coalition fail. But that not withstanding, I still insist that Raila explains to the ODM base why they should still support a GCG that does NOT treat them as equal partners! It is the ODM base that created the GCG and they deserve an explanation. Something is not right with the GCG as it is currently!! AND BY THE WAY, MOST OF THE ODM MPs ARE A TOTAL LET DOWN! THEY TOO ARE UNDERMINING THE PM!! THEY SHOULD WAKE UP AND STOP THEIR TRUANCY IN PARLIAMENT!!

That is the same reckless stupidity that led Kibaki to think that he could steal the election order the killing of Kenyans and life would just go on. You know what happened. Yes, the NARA legislation does not provide for new elections should the GCG be dissolved. Practically it doesn't have to. If either Raila or Kibaki (the two principals) were to trigger the dissolution of the GCG by one of them withdrawing from the GCG the country will go back to where it was exactly one year ago today. I am sure you know where Kenya was on January 4, 2008. If that is what you folks want, keep praying, your wishes may be answered. Once the GCG is dissolved, Kibaki can appoint all the 222 M.Ps into the cabinet and it wouldn't make a difference. The nation would go to war again and this time not even Kofi Annan would save the country. So be careful what you wish for. OkhunyanyeIt is not the business of Raila to put ugali on anybody's table. Kenyans put ugali on their tables and even floors whenever they can despite the best efforts of the present government to make their lives impossible. So don't worry about ugali for the citizens. They will survive. The most basic responsibility of any government is to protect the fundamental freedoms of its citizens and provide them with security. In a democratic country, which Kenya claims to be, the government has a duty to safeguard the democratic rights of the citizens. In terms of development, the government has a duty to create an atmosphere where citizens can engage in fruitful economic activities, enjoy the benefits of good infrastructure and engage in trade, industrial enterprise, commerce and all forms of human advancement, primary among which is the provisional of educational facilities and institutions. This idea that the government should just give us some ugali and then they can do anything they want is pretty backward if you ask me. It begs the question; why did Kenyans remove Moi from power then. He (Moi) promised us "development" and a lot of ugali. May be he is your man if I were to go with your ugali theory. Now lets address some substantive issues. One. Should Raila and the ODM quit the GCG right now? The answer is YES. As a person who has supported the GCG right from its onset, what I am saying is that some bridges have been crossed which cannot be crossed back. I wouldn't waste my time explaining that. Two. Can Raila and the ODM quit the GCG right now? The answer is NO. Why? This is why. Raila despite what his enemies and some fools say about him actually truly loves his country. Raila Amolo Odinga is an outstanding Kenyan patriot. He has damn near lost his life defending his country, something most of these cowards including Kibaki would never even imagine of. Raila knows if he were to trigger the collapse of the GCG today the country would break into pieces. Kenya would become the next Somali and not even the political thugs at State House can stop that. In fact most of them would pack up and leave. Besides there wouldn't be much to rob from the citizens. Kenya is at the first anniversary of the disaster of the 2007 General Elections. If anybody was to revive that nightmare then they can forget about Kenya. I remember this time last year Kamale posted right here on Jukwaa how beer was flowing in Westlands and how the Kenyan middle class was just laughing at a few primitives killing each other and better still for the alleged middle class, how those who dared the government were getting a deserved good whipping, including their heads crushed by the police and the army. A month later the same Kamale posted a drenching account of how he had to save his beloved mom from the bushes in the Molo area. The mess came into the city and into people's homes and lives one way or the other. In reality nobody can be safe from a political disaster in the country. Those who are begging for this madness to be resumed because they think Kibaki is now out of the woods are making a big mistake. If they dare the country to confront them, they will get what they want, but it will not be triggered by Raila as an individual or as ODM leader and Kenya's PM. That is what history tells us. Leaders emerge in the battlefield, they don't create the battlefield. If things get outrageous then of course the PM can resign to defend the dignity and integrity of the nation. That is part of his duty to the people of Kenya. Now what should Raila and the ODM do?1. Raila should stay in GCG and publicly declare it as hostile territory. This garbage that Kibaki respects Raila and the two work very well yada yada is sickening. Kibaki is running the country according to his wishes, or the wishes of his chosen successors, and Raila is really just their spanner boy. If Raila can't figure that out that is his problem. 2. Raila should call a press conference after the Wednesday ODM meeting and apologize to Kenyans for misleading them that he was talking to Kibaki to ensure that the ICT bill would be brought back to parliament. There is nothing wrong with a honest apology and Raila owes Kenyans a big one. Just do it. In that apology Raila should make it clear to Kenyans that he genuinely thought that he and Kibaki would be honest partners in governing the country after the 2008 mayhem. He (Raila) has to confess to Kenyans that his hopes and dreams of that principled partnership has been brought to zero by the reality on the ground. Raila knows that reality and he has to explain it to Kenyans. For example can you imagine that almost three months after the ODM and Kibaki agreed on new cabinet appointments to fill vacant positions, diplomatic rearrangements etc, which was vetoed by Muthaura and the MKM madmen nothing has happened? This is unacceptable and Raila should not walk around like he doesn't know what is happening. Kenyans know what is going on. Raila has to level with them. He (Raila) is a lame duck Prime Minister. Kenyans know that. Raila has to accept that fact. Kenyans are waiting to hear his explanation for the facts leading to that sad reality. If the circumstances merit the dissolution of the GCG, Kenyans will tell him to walk. Right now Raila is telling Kenyans that he actually has influence on the affairs of the state as the PM and as the principal partner in the GCG. Events tell us that is not true. Kenyans will believe what they see, not what they are told. Raila has to deal with that. 3. Raila and the ODM have to draw the line on the Waki report. According to media reports Kibaki and Muthaura have come with this bizarre formula where the OP and the Ministry of Justice and Constitutional Affairs will appoint cabinet minsters and PSs to then appoint politically correct persons to be nick named the "Police Reform Group". The same murderers and killers who brutalized Kenyans after the stolen elections want to take charge of police reforms. If Raila and the ODM accommodates this kind of shit they will hear from Kenyans and will pay dearly. Add to that Muthaura allegedly is appointing the electoral reform team and possibly the constitutional reform "experts". To me these are the key issues for which Raila should finally pull the trigger, get out of GCG and let the chips fall wherever they may. There is a lot more I would want to say, but you know what, I would keep quiet for now. I am beginning to enjoy silence in terms of Kenyan politics. I will keep it that way, unless crazy stuff like some of the things I have seen on this thread comes up. adongo

But I can't stop due to the events in Kenya. Honestly, I'm tired too and I wish I could stop but every day I think of my beloved mama at home and I imagine her eating ugali with salted water. Now that makes me hit the roof every single f...king day and because of my mama I cannot help but log onto Jukwaa and scream!!

Adongo, Thanks for the candid talk, a gem as usual!! But please Adongo, you cannot afford to be silent on the Kenyan state of affairs now! How I wish I did not have to log onto Jukwaa every f...king day to scream my frustration out!!?? But I can't stop due to the events in Kenya. Honestly, I'm tired too and I wish I could stop but every day I think of my beloved mama at home and I imagine her eating ugali with salted water. Now that makes me hit the roof every single f...king day and because of my mama I cannot help but log onto Jukwaa and scream!! I believe you also have your loved ones back home. adongo, I agree with a lot that you’ve written. nara has revealed its deep flaws which put the pm in a terrible position. despite the defined official role of pm, raila hardly has any clout in supervising ministries, primarily due to the kibaki-planted impediment called muthaura. neither raila nor odm will be accorded any room, support or finances (treasury) to conspicuously and singularly deliver service to kenyans as some are theoretically suggesting. things moving in government are all kibaki proposals like selling tana river land to his friends in qatar. which service are people talking about when some idps still remain in camps. donors refused to fund kibaki’s sh 31 billion reconstruction and resettlement request as they know better.
raila hardly has any grip on coordinating the reform agenda, a job solely under martha karua whom raila has tried to appease, sometimes with embarrassment. karua will simply not let raila (even via an odm proxy in the psc) any chance to steer the reform process, just look at the selection of the psc committee chairman. my brother keeps reminding me that no matter what, raila has to persevere and wither the current stormy gcg until agenda 4 item is completed with a new constitution in place. until then, i'm told, odm cannot make any serious political move. that is not far from your postulation above. and that is where we begin to have divergent opinion.
i concluded a while back that the new constitution as desired by majority kenyans, will not be delivered with kibaki at the steering wheel. i postulated without fear of contradiction that this kibaki-led gcg will not bring long term reforms in kenya’s constitution, judiciary, police and land tenure system for the very reason that kibaki has too much vested and conflicting interests with the rest of kenyans. cosmetic changes to hoodwink some? maybe he will try hard to do that.
my feel is that raila assumed that as prime minister and leader of the biggest party in parliament, and with additional goodwill from across the country, he would have enough clout to steer long sought constitutional, legal and institutional reforms in the country which would eventually open a path for tackling poverty, land problems, historical injustices, grand corruption, and combating regional inequity. he also probably thought that the irritating muthaura would be a small surmountable problem. the office of the pm cannot co-exit with this head of civil service/cabinet secretary office as previously constituted. its like having a principal and headmaster in a school at the same time.
Wuo’nyar Alego must have also assumed that trusting kibaki through regular assurances and even warming to people like mutula kilonzo (kalonzo musyoka’s brain and waki’s lawyer) would make the implementation of the kriegler and waki commission findings as easy as a walk in the park. agwambo and very many kenyans appear too generous in dishing out tonnes of ‘benefits of doubt’. you don’t need to be a straight ‘A’ nerd to see that the recipients of agwambos benefits of doubt all have high stakes in shaping electoral reforms. muthaura has in fact let the cat out of the bag to remind everyone that kibaki will still be in charge of this so called reform process. the same people who participated in rigging the last election like that nefarious computer meddling character called suleiman chege (something like that) are being planted at the centre of the electoral ‘reform’ process by kibaki’s de facto prime minister, mr. muthaura. what kind of a stupid nation can we be to swallow such classless impunity and abuse? but then, what is expected from a kibaki led ‘reform’ process.
this is what i vehemently dismiss as a joke, any process with the word reform in it that is supposedly led by the electoral thief called kibaki. where kenyans have failed to make nara work for them, kibaki has succeeded in accomodating all his interests. he is comfortably back as an imperial president sitting above the law and using various gcg agents to steer the country away and further away from real reforms. the truth of the matter is that the teeth of real reforms cannot spare kibaki and his cronies.
agwambo needs to ask himself where the law and institutional reform roadmap is really heading. Even the stk process is problematic for the very reason that the electoral thief, kibaki himself, is the one conferred authority of appointing judges and a prosecutor to conduct the tribunal. instead of facing the dock, he’s appointing the managers of the dock. there’s plenty of loopholes to handpick his own stooges, even from among the pool of foreign expatriates presented by his friends like benjamin mkapa. then the cleverly inserted time deadlines that purportedly give the tribunal an operational time frame between april 2009, to dec 31st 2012 (after the next general election), mischievously give the president hidden ‘carrot and stick’ powers to determine its actual date of commencement, depending on the right political climate. the president will politically arm-twist potential suspects to be indicted. if recent reports sighting ruto and others like uhuru at state house are anything to go by, then anyone expecting justice from this so called stk will be extending the joke too far, it’s just a matter of time.
worse is this. most pev victims know how badly police reforms are needed. it is the height of insensitivity and cruelty to place that vital mantle again under kibaki’s acolytes like saitoti. waki has wrested too much authority to the minister for internal security and justice minister karua in the process of reorganizing the police force. waki recommended that the police reform group (PRG) begin its work immediately with a mandated duration of 6 months, reporting directly to the minister of justice and producing progress reports. we already know what to expect with these one-person ‘radical surgeries’. waki’s commission did not call for the resignation or dismissal of any police officials including the bosses. all these fake 'reforms' will be happening with raila and odm in government. just like the media bill fiasco, the blame is being shared between all these odm, odm-k and pnu and the optics dont look any good for raila. therefore what makes these good odm people think that when the fake kibaki-led reforms come, only muthaura and kibaki will be blamed. its time to evaluate the cost benefits of nara and this gcg thing.

You always gave Raila the benefit of doubt. From his tiff with Wamalwa, to his marriage to KANU to try and kill the giant from its stable, then his flirtation with Kibaki and rejection of the project, then his referendum partnership with Moi, then his stint in opposition against Kibaki. You always waited for the day he would be in a position of power. Now he is PM and you still give him the benefit of the doubt, you hope that the good game he has always talked will become a grand walk. You just hope that one day he will be president, then all will be happy ever after. I wonder whether you will still give him the benefit of the doubt after he has served a disastrous term as the PORK. Carry on hoping my Kenyan compatriots........I will always respect your right to hope for the best from a basket of rotten apples.

R has to do something surely The first thing is to continue speaking with one voice as a party as shown in those two article linked by AO The second thing is for him to NOW come out WITH ODMs OWN VISION.
I can remember sometime back R was smiling around, talking of "marrying" the manifestos of PNU with ODM. Is the media bill amongst the progeny of this illicit marriage.
Can R tell us just which segments of ODM vision has been implemented? To me it seems like everythin that has transpired since the ugly animal the GCG was born, is actually PNU vision.
R cant even appoint his slate of Ambassodors, eti the Ambasadors have refused to be recalled?
R is instead given assignements pre-rigged with booby traps, eti its Rs business to settle the IDPs and Mau summit sh!t, sh!t that the sloth and his MKM henchmen and woman are responsible for!
