How did this happen?
It’s bad for both MM and RAO.
How will they ever work together again in harmony after all the bad mouthing MM has carried out?
After all the hate campaign by MM?
Would it not have been better to give MM an equivalent job elsewhere?
I’m speechless
Some of Miguna`s friends told us that he would not seek back his job. What happened?

I wouldn't be surprised if Miguna Miguna refused to be re-instated back and instead resigns

I think the OPM did the right thing, coming into election year, would you rather have a MM out there on K24 calling RAO a conman?
It will not make any difference having him back, he does not work from OPM office, he is at NSIF building (I stand to be corrected) so for 8 months to election, I would give him enough duties to keep him silent.
A Reference letter from OPM, now that's another thing?

Having blasted the PM using any available microphone and megaphone thrust in his face and called him all sorts of ugly names under the sun, I think Miguna's position is untenable. He should do the honorable thing and decline this offer which is nothing but a trap.
Why is it being announced while the PM is thousands of miles in far away India? Does Miguna still think Raila is too old to lead, he's a non reformer, a dictator, liar and that theft is going on in PM's office? Miguna must clear this matter lest he's accused of bullying or blackmailing his way back into power.
We are yet to be told who had accused Miguna, who conducted the Kangaroo court that cleared him and how it's conclusion was reached. Was Miguna invited in that sham investigation to testify? When will he release his long awaited "explosive" book he's been penning and what are the contents therein as far as Raila is concerned or now that's he's "back" there will be lots of whitewashing various chapters?
Methinks this not not the end of the matter but just the beginning. Funny that all those die hard ODM fanatics who were kicking Miguna have suddenly gone mute.
The comedy continues!

There obviously have been diplomacy behind the scenes. This announcement should be good news to members of ODM.
I think Oloo will tell us exactly what happened but now it vindicates those of us who asked Miguna to be patient and avoid public spats with the OPM. The PM has kept his word but has Miguna done the same?
When he walks back to OPM tomorrow, Miguna will face those colleagues he called names while he was suspended. Let him do the honourable thing and apologise to them.
Meanwhile, we shall be watching and waiting. One false step and we move in with speed.

I think that MM is of no use to the PM after all the bad mouthing. In the election year (2012), clips will be pulled out of k24 archives and played in the air showing Miguna calling Raila a conman and many other ugly names.
From a pure political point of view, it would have been best to keep MM off the limits of the OPM.
We have all been wondering why MM went mute, kumbe he has been preparing to go back to his former office.
Will he have the guts to resign given the already contaminated working relations with R?
If he goes back, will he now play an enemy from inside, looking for means and ways of destroying RAO? Some have even said that he had started working for UK.
Could we say that MM lacks sense of judgment given the speed by which he moved to condemn RAO?
Would he come out insisting that he has been right all along?
Could this be a way of giving MM the chance to choose the highway by himself rather than being shown one?
Miguna Miguna has over the past few months shown that he is a vindictive and reckless person. Raila must be very careful about this person.
I will be keeping a steady eye on Miguna

Oh No. This is not good news for the beatiful girl, ODM. After all that badmouthing from MM. I am glad he will get his salary and all other benefits that he is entitled to, but he should be kept as far from the OPM's office as possible. A man who shares intimate e-mail messages to prove a point. We will be watching.

now that MM finds himself in this awkward situation what is his next move? i wouldn't be surprised if he declines the position - probably the most sensible thing to do considering all that has transpired.

Would it not have been better to give MM an equivalent job elsewhere? I’m speechless Some of Miguna`s friends told us that he would not seek back his job. What happened? Mzee & Others,I actually think this is the perfect outcome. First of all the PM has never made any public statement or responded to Miguna on the whole brouhaha or any other subsequent attacks on himself. He seems to have put the matter in perspective and did not see the roof falling as some thought. Secondly we made it very clear here in Jukwaa that the way Miguna was humiliated in the so called suspension was just simply uncalled for and unlawful. These are things in the public record. The problem we have with our wanasiasa and their herlings is that everything simplified beyond recognition and at some point to some people it was either you were with Miguna or with the PM. I suspect the reality is slightly more complicated than that. Third when Miguna launched a full scale assault on the person and the office of the PM with everything he could put his hands into, some of us took issue with that. I for one did not see how that was helping Miguna or the country. But it certainly wasn't the end of the ODM world that some people were waiting for and predicting. Fourth, Miguna took the matter to court and Judge Warsame ruled that the matter be resolved by December 30, 2011 one way or the other. Judge Warsame called on those carrying out the disciplinary process, whatever it was, to complete it and reach a decision by the said date. It would now appear that the disciplinary process has completed its cource and reached a decision that Miguna committed no offense for which he should be punished. The announcement is very simple. Miguna is free to resume his job tomorrow or the two parties can still reach any resolution(s) acceptable to both but based on the ruling that Miguna committed no offense. We also have to take into consideration that Miguna has appealed Judge Warsame's ruling. With this new development I don't know where that ends but given that Miguna's application was to get his job back or get compensated, I think that appeal becomes mute. Both parties have to reach a resolution and the announcement from the PM leaves that option open. At the political level I have always maintained that the whole event was blown out of proportion by some and made to appear as the biggest political even for ODM. It is NOT. If Miguna wants to resume work as the P.M's advisor on Coalition Affairs, he should be free to do so. Kivutha Kibwana is Miguna's opposite on Kibaki side. Not much fuss has been made about him. The truth of the matter is that Miguna was much more than an advisor to the PM on Coalition Affairs. Miguna was one of the PM's right hand strategist in everything to do with ODM and party politics. Can he still do that? May be but it has nothing to do with being an advisor on Coalition Affairs which is simply a technical position. That is a matter between the two of them and their political interests. That is my two cents. But we will see as things fold. We are still right here. adongo

I received the following text message sent to my phone from Miguna Miguna at 15:34 East African Time, Wednesday, December 28, 2011:
Limited comments to my relatives, friends & media today:
"Please I think it would be important that I express my gratefulness that I have been completely vindicated; that in the fullness of time, truth ultimately prevails over falsehoods and justice over evil. I've just received the news, though I was made aware of it yesterday. I'm going to take my time and analyse, digest and understand it fully before I can give any further comment."
I want that to go on the record!

This is the perfect outcome, I am now eagerly waiting to see what will come out of Miguna's 'potent' pen. The situation is awkward in the extreme for him. Is he going to continue badmouthing the PM while still working as his advisor? I don't think so. Will he trash Raila's real and perceived opponents like he used to before being suspended? I don't think so either.
This reinstatement gives him the opportunity to walk the talk. He called Raila all sorts of names after being suspended, if those were his convictions in the latter part of his initial stint then he has the chance of adding substance to his words.

Jukwaa Folks:
My position is very simple and straight forward:
Miguna Miguna was wrongfully suspended.
He was humiliated.
He followed due process and took the matter to court.
He has been reinstated.
It his decision whether to take the job or not.
As to his reactions and responses after he was suspended I think we have to remember that Miguna Miguna is a human being; his reactions were natural.
I will let the pundits ponder and pontificate over the other ramifications.

The decision to reinstate Miguna does not surprise me. It is a mere damage control exercise. The outcome was either to dismiss him or reinstate, and Raila chose the easier action, rather than face to lose in court and forced to reinstate under an order.
In my view, Miguna could have won a claim of dismissal on the industrial court. My general view is that he was employed on a contract, which entails his employer to suspend him on accusation of serious misconduct to conduct investigation. The investigation must be reasonable, allowing him an opportunity to defend himself. Miguna was not according any resemblance of fairness on the hullabaloo with which he was suspended and the aftermath of his suspension.
One of the tenets of natural justice is that the parties should hear the case that is being made against them. In this case Miguna was not allowed to hear the case against him. He had no opportunity to correct any statements, which might have been made, and with which he did not agree; he had no opportunity to question and interrogate the evidence against him, or about any of the views, which were being expressed; or express disagreement with the case.
If Miguna was sacked, based on the shambolic procedure leading to his suspension, he stood to win colossal compensation. His dismissal could have been unreasonable, thus unfair. And there was a serious chance Raila would be ordered to reinstate him. With his tail behind his legs, Raila call it quits and offers Miguna his job.
Where does Miguna stand, or rather where should he stand? In my opinion, he should take back his job, and continue working loyally to Raila, after receiving all what is due to him. His contract was only for a short duration which is coming to an end soon. He should complete it honourably and stand tall with his integrity intact. It would a waste to continue fighting when he has won. His ongoing cases should be curtailed, and appeal discontinued.
But, it should be a learning curve. As it has transpired, certainly in Jukwaa, the worst enemy are usually the friends who, on the face of it, claim to be dear and near. From the saga that was Miguna's suspension, it clearly emerged that ODM followers remain a ragtag group of adherents who sadistically demonise someone because they perceive him to be an enemy to Raila, the god, whether Raila is right or wrong!

Onyango Oloo Nairobi OO, I am happy MM has been reinstated and also note you have accurate information as I do from my own sources that MM has been "reinstated" (as you correctly put it) and not reinstated in the same position as DN and others are inaccurately reporting. I recently penned a blog omwenga.com/2011/12/20/is-miguna-miguna-the-newt-gingrich-of-kenya/, I suppose the question I posed has been answered, even though I still hold the view I suggested he would be a much needed addition in Parliament unlike the PM's office where his role will certainly not be as the highlight of what it was in the past, if anything, because he may be reinstated but the enemies he made there are still there and I doubt they are rolling the red carpet for him. One would obviously assume whatever role he is cast now, he must and cannot proceed as if the last few months have been erased from people's minds. I'll tactfully and carefully dance around all the sharks ready to take me down with any false move I may be as unfortunate to make. It's yes, sir, No, Maam until the waters clear of the sharks. Otherwise, the curtains must roll for Act III and the final scene which may be the most anticlimactic of all. The question of the hour is, we know MM is returning to at least the PM's office where he no doubt has the sharks I have alluded to above; what about out here and elsewhere? Is MM returning to the unprecedented state of being hated again by his former hater-cum-converts to admirers and now friends but immediately preceding enemies? Who needs Pepto Bismol with MM's reinstatement? I bet neither. He has neutralized himself as he has given fodder to both camps no matter what he does. In other words, this is more about containment than victory for whatever he went against wise counsel to keep mum and resurface at the appropriate time. On the other hand, this is what makes politics an exciting game for political junkies like your truly.

Should MM drink from this poisoned chalice, he would probably have to explain, preferably on K24, why his conscious led him back to working for an ungrateful dictator and conman. He will be going back with the knowledge that he is a political appointee… meaning he must prove his loyalty to a man he greatly despises.
Now, given his superiority complex, I do not see MM accepting the reinstatement. Not after his one way assault on the person of the PM and ODM. I think he will go home, celebrate the 'win' with his wife, then call a press conference tomorrow to reject the reinstatement in pretty much the same language and tone he used to ridicule the PM. His 'vindication' must in the end include his resignation.
After all, his only motivation at this point is a paycheck. I do not believe he can have the same pre-suspension passion to correctly advise the PM. The OPM is basically asking MM to fire himself. A pretty brilliant move if you ask me.

It was vintage Onyango Oloo who first mulled possibility that Miguna might actually assume a role in Raila’s 2012 Presidential campaign. I of course dismissed that likelihood, fretting possibility of vicious 20-second campaign TV ads featuring Miguna calling Odinga a political conman! Well - we're not there yet...we don't know whether that'll come.
I don’t know any details about these negotiations. Neither do I know whether Miguna will take the job back or not. In the world of politics, you can’t really say, never!
This could turn out into a teachable moment for both parties. On Miguna’s part, an important lesson to retain pertains to the twin skills of patience and mastering emotions. To the OPM staff – any of your actions could have unprecedented consequences. You can easily splash egg on the PM's face.
If the reconciliation train has indeed left the station, there’s no further need for Monday-morning quarterbacking (American colloquial for – revisiting the should-have, could-have, would-have done). Folks need to move on. I see a lot of trust-rebuilding work ahead – especially at the OPM. Will Miguna go for the next microphone? Maybe maybe not!
Over to you Jeff Koinange at K24TV. Sit baaaaaack!!!!!!!!

What a confused office we have in the name of OPM. In this era of accountability, one can only hope that the OPM will find it prudent to explain to Kenyans who sat in the disciplinary committee and what their findings were.
