Mutahi Ngunyi on The Bench - 23/01/2012
I wrote the above yesterday and to my own surprise Mutahi Ngunyi went ahead to repeat his earlier view on Jeff Koinange's 'The Bench' on the 23rd of January, 2012.

Let us recap what Mutahi Ngunyi said on Jeff Koinange's 'The Bench' on the 9th of Januray,2012: In essence, Judge Ekaterina Trendafilova has just handed Deputy Prime Minister and Minister for Finance, Uhuru Muigai Kenyatta and Eldoret North MP, William Samoei Ruto, enough lemons to open a lemonade factory; and let me assure you, they'll be smiling all the way to the Bank or rather to the State House by the time they are declared innocent. My friend just make sure you do not choke on the lemonade and ask what else has been added into the mix. Yes the earth may not be flat but people are still free to imagine it is particularly if they are running in a soccer field. It looks so flat. Trust me, the denials have limits. You will soon find out.

I argee with Mutahi Ngunyi, Uhuru just need to address the wazee, he has the backing of Michuki, he will be sitting pretty.

Im inclined to believe and agree with Mutahi that ICC is a political court due to the following reasons. - Muthaura’s case was pegged on General Ali and was supposed to collapse without it. ICC argued that Mathaura gave Ali orders to withdraw police protection giving Mungiki access and authority to go on the rampage. But since no evidence was found on General Ali, why was Muthaura’s case confirmed?
- Like Mutahi the balancing act is hard to understand; two from each party confirmed.

The funny thing in this whole agenda is that many have told us before that political games are being played in the shadows. The first thing I've noticed is that whenever anything related to the ICC is going on our Premier seems to somehow do a disappearing act on us. Every time there seems to be something burning outside the country but I dare to speculate he's not usually on the agenda the press tell us he's on. I have this feeling that he might be meeting people he would rather not be seen meeting in the country.
Secondly, there is this interview that shows Kosgey giving his statement over the whole ICC issue and something quite remarkable is that Midiwo is seated behind him. Someone made the speculation that Kosgey's inclusion in the list was political and was intended for the purpose that will unfold in the coming days. When it happens I will make sure to shout it out that, "I TOLD YOU SO!", but for now let me hold my peace on the Kosgey angle.

Classic escapism from the real matter at hand.
Kenya has made no serious effort to investigate let alone try PEV cases......those with power to do so would rather wish it away. Like they do the IDP's. Lip service is their staple.
I shudder at the prospect that suspicion for crimes against humanity could garnering anyone some votes, even peddling such an idea is a sign of serious failing in our moral fabric. How would one then despise a criminal state or a Narco state? are we selective in condemning criminal enterprise?
Why do we see politics in every event, crimes seem ok if its the other side at loss.
Instead of making time to remember those burnt in churches, pulled out of Matatu's and hacked by rusty panga's and those who have been probably forever separated from their land and property we see them as pawns in the political chessboard. Conveniently used and tossed.
And the Mutahi's are there to feed this psychosis and cheer the party on. Why cant they and we be bigger and ask.......What we should be asking!
Did the crimes happen?, did anyone among us commit them? are we addressing it?
Could we be shouting hoarse for Barnabas to be let go.
Before the politics, lets demand accountability......from all sides of the divide.....let the suspects prove their case and the victims have their closure.
WE NEED TO WAKE UP.

Nairobi Slums
Burnt Forest
Molo
Not just Ruto, Raila, Uhuru, Kalonzo........
Then we shall see how sickening such armchair analysts can be......Would you be discussing the menu in a sinking ship.

You're so idealistic and misinformed or rather misdirected, that it hurts just reading what you've written above. Idealistic because you think that Kenyans vote with equity and justice in their minds and misinformed because the intended misdirection in the whole ICC saga has worked in your particular case. Let me be frugal with my words - the ICC cases have nothing to do with justice or equity! It's all politically motivated (locally and internationally). I don't have the time to give you all the details and facts but what I will do is dangle a bone, that if you're hungry, you'll be able to satisfy your intellectual needs. Do a research on all the possible meanings of FPS. Once you find it you'll know what I'm referring to. Another pointer - it will be related to the acronym GELB. NB: Both are acronyms.

I could add some more politically motivated ideas:
Ignored plight of IDP's.
Lack of local trial of PEV or gecaca like process 5 years on.
Stay in office of suspects against the constitution, as Baraza is suspended.
Use of public funds for crimes committed in 'individual capacity'.
What is politically motivated or not is beside my point which is- why do we want to sweep accountability for the tragic events of 2007 under the carpet.
Why are we hell bent in one direction only that is -- DO NOTHING.
I am not the biggest fan of parading our dirty linen in foreign lands but we ascribed to the court willingly and had ample time to set up local processes and since we obviously do not want to hold anyone to account.
We need the bitter reminder that some crimes cannot be considered sovereign national affairs . Let them be tried and be free if found not culpable. That is the minimum. And may future generations take a lesson from this process.

...Of course these two clowns on the bench "shredding" the OTPs evidence and prophesying what doomsday scenario is in store for Raila as they have done before...
Not a mention of dead or alive victims, not a mention of the pillage and plunder, the mass murder, the mass rape, the mass evictions, the terror against innocent citizens...
Not a mention that Uhuru, Muthaura and Kibaki had meetings with mungiki at State House Nairobi to plan chaos and violence...!
Trying to sway and lead public discussion away from the real to the imaginary...

Cogency, While you rightly point out that to some extent Muthaura's case was pegged on Gen. Ali's case due to the alleged order to give mungiki protection, you conveniently omit the fact that Muthaura was confirmed mainly based on the meeting he had at State House with Uhuru, Kibaki and the mungiki gang. That was the basis of Muthaura's confirmation and the Judge said as much. Please forget about your selective amnesia.

Man, There is no selective amnesia; meeting the youth or what ICC is calling mungiki at statehouse was not a crime. Planning with the police to create Mungiki free zones to cause havoc was the crime. According to the prosecution Muthaura had the power to give orders to General Ali with directions on what to do to ensure violence was successful. Remember the connection between Muthaura and General Ali was the phone call. It is disconcerting to see General Ali off the hook and no other evidence introduced to show that Muthaura contributed to the violence and anarchy that resulted. It is puzzling to see ICC ignoring such glaring exculpatory evidence that could have exonerated Muthaura.
