Congratulations to Miguna for winning the case!
But can someone clarify for me whether the "fines" imposed against the NLM are meant to compensate Miguna as a form of retribution as The Jackal News implied, or were they meant to be punitive sanctions against the respondent's behaviour as stated in the Orders and the money merely goes to the coffers of MCK?

If you read the judgment carefully, it is clear that the money is payable to the Media Council of Kenya-not to Miguna. Just when I thought that the Jackal News was part of what OO called the tabloid press spreading rumors and innuendos... For your information, Jackal News is run by a young Jukwaa member. The same news was carried in the print version of the March 22, 2012 edition of the Daily Nation. Onyango Oloo Nairobi, Kenya

i know i am always wrong but that my silly small mind tells me that miguna is getting out of this one bloody nosed. i am authoritatively informed that the publisher of nairobi law monthly is a man his type must avoid at all cost.
doubt me? ask yourself the source of his temerity to take down kengen's eddie njoroge, not just once but twice in devastating cover stories. of course you can determine between eddie and miguna who in kibaki's presidency wield more influence.
here is a man who has no regard for miguna's senior counsel and minister for constitutional affairs,an A student who was the first in this region to score a distinction in law,one mutula kilonzo.
i am saying that according to my informant, nairobi law monthly sits pretty for reasons that its owner who is a lawyer is not just that tall, brave and brilliant like miguna but more importantly have access to some of kenya's best kept secrets.
anyone reading this who has direct access to miguna and cares about should ask him to watch his back for nairobi law monthly has a notoriety for which definitely they have the last laugh irrespective of who pockets the million and above that the media council deem to have penalized nlm.

Puzzling comment Nereah. Unlike some of those people you mention, Miguna is NOT a crook. And you read the judgment. Rather clear cut- from people who may not care a whit for Miguna. I like the Nairobi Law Monthly for their insightful exposes. But they cannot be allowed to get away with gossip, rumour, libel and defamation. Onyango Oloo Nairobi, Kenya

Talking of 'inaccuracy. on media reporting, it is pretty obvious that The Jackal News had their header wrong, isn,t it? I mean how can any good editor not ponder on the relevance of their headers upon any article they may choose to publish? Sometimes you end up thinking either the publisher had made a stupid and reckless error or simply intended to mislead their readers, taking them for simple idiots some of us are not! I am not pleased about such prospects at all.
And OO, the reason why I had pointed this out and sought some sort of,clarification, is precisely because I had cared to "read the judgement carefully" and what the Orders had stated beforehand.
Shukran.

Nereah There is something I used to tell Miguna here in Jukwaa and that is "people carried away by their own importance rarely have far to walk back" Unfortunately Abdelnassir tends to arrogate a sense of importance on himself which is why he thinks he can defame anyone and then hide behind media freedom. In this case Miguna should go ahead and now sue for defamation after winning his complaint at the media council. I am all for media freedom, but this must for ever be exercised responsibly.

I think that Miguna Miguna and Abdelnassir are going to fight this out to the death. Both men are arrogant, proud and think they are the smartest people on earth. So, none is going to give ground. Im waiting for Abdelnassir counter punch.

these are both intellectually astute legal minds.... and in your own words arrogant and proud.one of them however can and most probably have unfettered access into the other's world in a way that makes this battle of wits and nerves asymmetrical.
