thejackalnews.com/media-news/news-media/1755-police-arrest-journalist-itumbi-over-clasiffied-documentsOle Itumbi is well known for leaking scoops well ahead of mainstream media and sometime publishing classified government information on his blog. www.dennisitumbi.com/, even before Official Government Spokesman Alfred Mutua has got wind of what is happening. Such has been the ways of the well connected Ole Itumbi. On social media, Ole Itumbi sometimes acts as propagandist for Team Uhuru and does not hide his contempt for Raila Odinga and ODM. Ole Itumbi is not known to be directly employed by anyone but lives decently as a freelance blogger. Since Yatta MP Charles Kilonzo tabled forged letters in parliament purportedly written by UK government functionaries, the social media has been awash with allegations that Ole itumbi was author of the letter that was tabled by dishonourable Charles Kilonzo, allegations that Ole Itumbi has strongly denied, even threatening to sue those who make such allegations. There is a clear fall out in the Charles Kilonzo dossier with allegations of huge amounts of money changing hands within the precints of parliament. The matter is sensitive given the contents of the letter tabled in parliament suggested that President Kibaki was target of ICC investigators in the Kenyan post election violence case currently underway in the Hague, and that the Prime Minister was being used as a pawn by foreign governments and being groomed to take over the presidency after Kibaki. It follows therefore that Ole Itumbi's arrest is bound to be of interest to Kenyan media and blogosphere. The reaction of PNU and Team Uhuru will also be closely watched. The fact that an unarmed blogger was arrested in a rural town by more than 40 armed CID officers underlines the gravity of Ole Itumbi's crimes (if any). @onyango Oloo, what have your sources confided? Is this arrest instigated by ODM, or is it an affront to free press? How safe are you/we here at Jukwaa? The electoral cycle is here with us and political temperatures are bound to rise.

Impeccable police sources indicate that blogger Dennis Ole Itumbi is being held for allegedly hacking into the ICC website and compromising the safety of ICC witnesses.
Other sources who have spoken to Ole Itumbi who is being held at Muthaiga police station say that Itumbi was told his his arrest "had something to do with the ICC and the allegations that PM Raila is threatening IEBC commissioners".
Ole Itumbi says he due to taken to record a statement at 0900 hours at the CID HQ - which is not far from the Muthaiga Police Station - but as at 10h40hours local time nothing had happened, the police appear to be consulting.
Some of Ole Itumbi's colleagues from the media, friends and relatives are camping outside the Muthaiga Police Station.

Now Police want to detain Ole Itumbi longer to facilitate additional investigations.
Director of CID Francis Muhoro Ndegwa confirms thay may request a court order to allow them to detain Ole Itumbi for longer than allowed by the law since his freedom before investigations are complete compromises national security.

The electoral cycle is here with us and political temperatures are bound to rise. Phil:Yawa. Chuckle. Last week, an expired member loudly speculated on this very forum who would take over the mantle of Administrator if Oloo died suddenly. Remember that spaced out posting? I do NOT think it was just some bad marijuana which caused that outburst. I ALWAYS ASSUME that I am under surveillance at all times-using all means.I feel SAFER that way. It always better to expect the knife, the pistol, the panga rather than to be ambushed by the same...From May to September 2009 I was forced to flee to Manzini, Swaziland because some people in certain circles did not take too kindly to the fact that I was doing a lot of stories for the Sunday Express where I was the Political Editor at the time, on extra-judicial killings. Of course I kept posting here on Jukwaa. I remember having to deny some Made in Canada rumours (which were actually true!) that I was no longer in Kenya. Onyango Oloo Nairobi, Kenya

Police arrest three over alleged hacking of ICC witnesses accounts By Joylene Sing'oei
Police have arrested and questioned three people including blogger Dennis Itumbi.
The blogger was arrested in his Embu rural home on Thursday by Criminal Investigation Department (CID) officers in a probe into claims of hacking of ICC witness email accounts.
He spent the night at Muthaiga Police Station and was later transferred to the CID Headquarters for questioning.
The other two people arrested have since been released.

Olooright on money! The old Jukwaa thread reveals a lot. I appreciate and admire your devotion to keeping real identities of Jukwaa members secret. So Denis Ole Itumbi has been running that website calling itself Wikileaks Kenya, right? Well, the guys asked for it. While he is cooling his heals at the cop station, Uhuru is at his minute being declared undespute GEMA preferred candidate by the GEMA Cultural Association.

IS THERE ANY MERIT TO OUTING ICC WITNESSES?
First recorded on September 9, 2011, this was an interview with Dennis Itumbi, a Kenyan journalist who had revealed the alleged identity of one witness in the case against 4 Kenyans at the International Criminal Court.
We argue about the legality of his actions, his motivations for them, and what will happen to him if he is arrested for this. On March 23, 2012, he was taken into custody for interrogation by the Police, facing accusations of hacking the ICC's website. [/i][/blockquote]

The fact that Itumbi is cooling his heels at a police station is not enough reason to believe that the Kenya police will begin and sustain a successful trial i.e if the guy is found guilty. My misgiving is motivated by the fact that Kenya Police have often been accused of being influenced by powerful individuals like Uhuru Kenyatta.

Folks,
We have been warning these people that fighting Raila can be a very expensive and thankless job and they never listen. When they came up with the forged expose about the UK working with ICC to fix Uhuru and Ruto so that Raila can be the president we told then it was a foolish act that only mad people can engage in. It was bound to backfire. Did they listen? No.
The uhuru herlings here in Jukwaa were screaming on top of their lungs about how Raila has been exposed and how this was all the work of UK security agents which has now been leaked. Utter nonsense.
This story is just beginning to really mess with the clumsily laid plans of kina Uhuru. The act first and think later mentality is a very dangerous way to do anything. The police now have no choice but to act or at least pretend to act. They dragged in the name of a foreign country complete with names. You got to be super stupid to do that kind of thing. It is hard to get away with things like that.
Keep the lies to the prayer hate festivals where even the Kenyan media will protect you and nobody cares how slanderous you are.
Secondly the bumbling baffoons paid by the Uhurus took the forged documents to parliament and thought they had a bombshell for Raila and a few nails for the ICC coffin. That is as dumb as it gets. They had a chance to withdraw after it emerged the forger was not that clever enough even to get his spellings right. But no, the battering rams had to continue, after all there was Raila to fight a few hides to be saved from ICC.
Now they have the matter destined to a parliamentary committee and both Gichangi and Iteere have been summoned to appear on Monday next week. They can't go there and lie to save Uhuru and his bumbling mob. The police therefore have panicked and are busy arresting people probably to enable them go to the committee and claim the matter is under investigation and they cannot talk about it now. That will not fool us.
This matter should be fully exposed for what it was. A shameless attempt to degrade the country, create conflicts with friendly nations and bismirch the work of the ICC for the sake of a few selfish individuals who think they own the country. That is an act of treason against the nation and I do not use that word lightly. The culprits have to be exposed, their motives examined and they have to be held accountable.
And make no mistake about it, the ICC is deeply interested in this matter and it will make life very difficult for some people. These acts of incitement against the ICC as tools of foreign governments undermining our country cannot be taken lightly and they won't.
When the dust settles I will not be surprised if these are the same characters interfering with ICC witnesses. This train is just leaving the station. There are a lot of passengers in the way waiting. They are welcome to hop in. Tuko pamoja in this. ama? Or now you are on your own? Ask Mungiki, they were pamoja and then they were not pamoja when some had to be eliminated to save the untouchables. This is dangerous business.

Oloo,Ole Itumbi will be charged in court next week. This weekend, he is a state guest at one of the police stations, most likely Kileleshwa Police Station. And the charge sheet will read that he has violated this law. Section 83 U of the Kenya Communications Act 2 of 1998 provides as follows:[/b] (1) subject to subsection (2), any person who causes a computer system to perform a function, knowing that the access s/he has secured is unauthorized, shall commit an offence and shall on conviction be liable to a fine not exceeding two hundred thousand shillings or imprisonment for a term not exceeding two years or both. Subsection 2 of the said section provides that a person shall not be liable under subsection (1) where s/he:
a. Is a person with a right to control the operation or use of the computer system and exercises such right in good faith. b. Has the expressed or implied consent of the person empowered to authorize him/her to have such access. c. Has reasonable grounds to believe that s/he has such consent as specified in (b) above; or d. Is acting in reliance of a statutory power for the purpose of obtaining information, or taking possession of any document or other property. Section 83 W criminalizes unauthorized access to and interception of computer service with a penalty of a fine of five hundred thousand or jail term of five years or both.

soundcloud.com/ramah-nyang/is-there-any-merit-to-outingDid anyone also hear Itumbi unequivocally threaten Martha Karua? “I have authentic documents (which I can provide in court & provide witnesses) that a key Minister in the Kibaki government who has since resigned (read Martha Karua) was one of the key architects of getting witnesses from the PNU side to testify at the Waki Commission."
“In fact the Waki Commission (was based on) highly non-credible evidence because PNU and ODM recruited witnesses to fix each other” It is easily discernible that Itumbi is accusing Karua of plotting to fix her political competitors (read Ruto and Uhuru) using her previous office. He claims Karua sat in her office, fished potential witnesses to testify against her targets (both Uhuru and Ruto), had them transported from their various abodes to her office, took their statements, then handed them over to another “key lawyer” (read Maina Kiai)…who “paid them” after “recording their statements”. Itumbi says he has the name of the lady who arranged for the transportation of the witnesses…and the registration of the buses that brought the witnesses.

Dennis ole Itumbi seems well covered politically. Sounds very confident even while under police custody. He just tweeted @oleitumbi: Thanks good people .its true im spending the weekend at keleleshwa. Keep the love
What is funny is that he had been screaming all over on twitter how he would take to court a fellow Tweep @robertalai who had claimed that Ole Itumbi penned the fake UK letter. Kumbe, after all Robert Alai wasnt lying

Did anyone notice the otherwise rural (Embu) based unattached journalist Dennis Itumbi strolling the sparkling sidewalk infront of the ICC Court building at the den Haag (the Hague)? At who's sponsorship could that have been been? Was he spending his own cash to 'cover' a story for his little known blog?

soundcloud.com/ramah-nyang/is-there-any-merit-to-outingDid I also hear Dennis Itumbi yell out the names of his fellow co-conspirators in the deadly witness-outing game? (towards the end of the audio clip)Itumbi actually admits to revealing (outing) the name of ONLY ONE witness – David Koros…the others he says were revealed by a blog pundit called RV pundit, who hacked into the emails of the witnesses then splashed retrieved correspondences in cyberspace. He claims he merely copied RV Pundit’s exposé (of such emails) to his twitter account for further dissemination, and thus he “can’t take responsibility for all the hacked emails”.Who the heck is this faceless RV Pundit; and have the cops arrested him too? Is he among the 12 being "questioned".All in all, at the outset, I must express reservations about this purported “arrest” of Itumbi by “over 40 cops and CID officers”. The best place Itumbi deserves prosecution is right at the ICC – where chances of him escaping the arms of justice are slim. Kenya’s bandia DPP and bandia Police will let this fellas go scot free – forget the theatrics. This propagandist has nevertheless been a good student of David Matsanga, and is doing the dirty job for Uhuru and Muthaura.Money and accompanying greed can really do wonders, even to an otherwise upcoming young journalist from Embu. This K.I.M.C. trained journalist, has thrown out of the window all the knowledge he acquired on ethics and professionalism. He has turned a blind eye to legal considerations in journalism. It’s now about impunity, reckless propaganda in exchange of the much sought muthendi. Itumbi admits to owning the catchy – Wikileaks Kenya. His propaganda seems to actually find way into mainstream media – if recent reporting is anything to go by. Itumbi recklessly admits publicly to outing David Koros with the specific intention of exposing him to harm. His twisted logic is that witnesses who lie (subjective term) “ deserve no privilege of witness protection!” That’s his (criminal) justification for outing and propagandizing ICC witnesses – thus endangering their lives. Even with this audio clip – the Kenyan Police and DPP may still eventually free Itumbi on technicalities, long after hoodwinking the ICC that they were pursuing the case. The army of cops sent to arrest Itumbi was one such circus show for the ICC. If ICC were to take up this case, with this audio evidence alone – Itumbi would definitely face severe punishment. He claims that the statement from Koros to PNU insiders was different from subsequent statements to the Waki Commission and the OTP (Ocampo) respectively; thus Koros deserves some form of extrajudicial retribution. That sums up the spiteful, wicked and criminal mind of Itumbi. He also publicly boasts to knowing the identities of OTP witnesses 11, 12 and 14 – and actually promises to “ out them if they lie”. Isn’t this surely the best evidence of witness intimidation for these OTP witnesses? These three witnesses are actually being explicitly forewarned about likely outing (& subsequent extrajudicial treatment) should they give ‘bad testimony’ against Uhuru and Muthaura. This is classic witness intimidation punishable by the Rome Statutes…including jail time. Since Itumbi even dared (in the same interview) to be a guinea-pig to test whether the ICC can actually bite – I suspect the man has actually been paid very dearly by Tea m Uhuru. This is a dare devil willing to do anything to scare away witnesses before the trials of Uhuru, Ruto and Muthaura start. Does Itumbi actually care about the lives of those he exposes (whether they end up dead)? When specifically asked that question, he brazenly rebuffs by claiming “ even the accused have families”. He seems more concerned with leakages such as purported “leaked e-mail conversations between Maina Kiai, Ocampo, David Koros, and former Swedish Ambassador to Kenya (now in Mexico)”.The worst – he brags that Ocampos Witness Protection Program (WPP) is weak “putting witnesses in even more danger than Kenyan NGO protection programs”. How did he know that? Is he admitting to tampering with the ICC witness protection program – a global governmental entity? Is he admitting to scaring potential ICC witnesses away from the OTP’s WPP? This is another admission of explicit intimidation of current and potential witnesses!

job & tnk,
You guys are right. The cops are picking low lying fruits which are probably rotten already. They want to fool Kenyans and the ICC that they are actually doing something about witness interference, intimidation and attemped briberies.
They are going after the low level scumbags in cyberspace who do low level hacking jobs either at the payroll of politicians or the NSIS itself or both and then leak them in the internet for the media and as part of the intimidation process.
But this is a fake operation. It is like trying to bring down the mafia down by arresting street level drug peddlers who probably don't even know where the stuff comes from. This is nonsense.
The police can play with the little boys they are grabbing but I doubt they will fool the ICC. What is now obvious is that the ICC is up against a criminal machine in Kenya ready to use all weapons.
The issue of witness safety has to be agenda number one when these cases start and if need be the OTP should file their own concerns with the ICC courts considering all the hoopla going around including David Matsanga's recent scandalous adventures and now these low level hackers.

They may get their asses in jail to cool things down but the ICC has bigger fish. The cops are cleaning trash already in the dumpsite. We need to deal with the real garbage and we need some serious garbage collectors. Leave the dumpsite for the scavengers. They eat that stuff for a living for crying out loud. Mr. Iteere will not fool us at all. Certainly he will not fool the ICC. The funny part is how the hackers are being hacked like in that interview thing. Itumbi would like to take that back. I am sure the cops played that to him at the station. That is called being busted. Is that your voice? That is what they ask you. If it is you are in shit even though you know the cops can't use that as evidence against you in court unless you consented to the recording or was speaking in a public event.

Friends: This is Kenya. Nothing will happen, so we might as well move on now. The fellow will be released within a week or so. The police will announce that investigations are continuing and that they will announce the results as soon as they are done. Stern warnings will be given about this and that. And that will be the end of the matter. By this time next week, both the media and the public will have moved on to something "juicier".

Its really unfortunate how 'Kijana wa Mkono' gets harassed while the "Boss" sits tight and comfortable.
Anyways, at least in this case, the bosses are facing a tougher and higher court.
But what happens, if ICC links Dennis Itumbi to one of the Ocampo4? Wouldn't that be trouble for the Ocampo 4 (Read Uhuru?). Judge Trendilova was very clear that in the case of the accused tampering or threatening the witnesses...then...arrest warrants could follow. Or is the case of Koros and the other witnesses not very important because even the Defence is already aware of the identity of the witnesses?

The way the "BOSS" and co use these little toys is the same way they used Mungiki youth to do the killing and the raping. Once the job was done they turned around and started killing the same Mungiki guys they worked with when they realized the tide had turned and now "commissions of inquiry" and "ICC investigations" had become the norm. When killers were at work they never thought about investigations. It was just kill people and be the hero of the moment and once Kibaki takes power all that would be buried. Nobody ever anticipated things would turn the other way and when they did they started getting rid of the evidence and taking out some of those who knew too much became part of the operations and that is probably one of the reasons some of the same Mungiki guys felt betrayed and endengered and started giving evidence. With these low lifes doing cyber spying and hacking for the big boys, their lives are worth less than zero to the big boys. They start to talk they will be found dead in some sleazy motel room. The police is not their biggest worry. The 'BOSS" is their worry. If things start getting too close, watch out. The ICC needs to keep a close eye on what is going on knowing very well the first duty of the police right now is to cover up for the Uhurus. The police has no interest helping the ICC and/or protecting witnesses. One thing we know is that nothing is working according to plan for the indicted suspects. Let them keep digging.
