But what happens, if ICC links Dennis Itumbi to one of the Ocampo4? Wouldn't that be trouble for the Ocampo 4 (Read Uhuru?). quite right, that would be a major disaster. if this thing filters upwards its curtains for the O4

If Itumbi is in the coolers for the David Koros emails, then that would be a travesty of justice as these things were in the public domain in September 2011 when the confirmation hearings were starting.
In fact as Oloo says, he did write to the ICC about the same when Jukwaa was linked to the emails and I said that it just did not add up. Ocampo had redacted the names of all his witness and the most that could have happened is speculation that certain people were ICC witnesses!
What I think has happened is that the leaked David Koros and Wafula email exchanges that included the outgoing Dutch Ambassador was the embarrassment of how witnesses were being obtained by the Wafula outfit in Eldoret. Anyone that read the emails would see now how embarrassing the emails would be to some of the witnesses and the ICC prosecutor in a main hearing.
So for those that cheered Assange of wikileaks fame.....just what is the difference between him and Dennis Itumbi? Those condemning him on the basis that he is an Uhuru or Ruto supporter but ignore the public interest in the leaking of the emails are nothing more than hypocrites.
My view is that Itumbi is being investigated for the leaked British papers rather than ICC otherwise as I asked above why wait since last year?

I for one haven't used the misleading Ole prefix. It is often her Dutch government that enforces ICC court warrants and such. Her commitment to Justice and safety of victims was not based on a personal zeal; but rather on her government's policy. Lastly, this needs to be made very clear. Get it over your head Sir, Dennis Itumbi is no William Assange! One is a whistle-blowing journalist of international repute; another a cheap propagandist hireling. Assange does not doctor forgeries then post them on Wikileaks; he actually retrieves authentic documents, vets them for safety; tries to protect his secret sources; and posts them for the public. On the other hand, Itumbi is paid by Uhuru Kenyatta to doctor forgeries; hack emails for malicious and reckless endangerment of perceived opponents (like Koros, Wafula, Karua, Kiai, Omar Hassan et al) . Daylight is so contrasted from the night!

So far as I am aware he came across the emails and blew the whistle on the shameless recruitment of witness by Wafula and company! In fact you should read about David Koros and his role in the emails to see the injustice...but then you believe that he is credible before some ICC prosecutor...he is not in my opinion (which does not matter anyway!). Whether Itumbi hacked into Wafula's email exchanges with his financiers regarding recruitment of witnesses or accessed them via the RV Pundit character is neither here nor there. The question is whether he should have read them and kept quiet or in the alternative blow the whistle on the Eldoret NGO and Wafula. And this is where the parallel with Assange comes in - both had access to information and made it public! You cheered Assange for the leaks but then what Itumbi does is complicate a little matter that jeopardises your expectations for a conviction so that like Kalonzo and Pastor Muiru.....someone pitias kati kati yao! I am surprised you were never that quick to condemn Assange when the US Ambassador initially denied the emails he sent back home reporting the stupidity of our leaders! Job Reading elsewhere about this saga, it would appear that even that recording has been doctored but then he still does not admit to hacking but to revealing the information he had on David Koros! The dramatized 40 cops arrest was all meant to hoodwink the ICC - that something serious was being done to 'get to the bottom' of this. Remember the "No Stone will be left Unturned" promise by Moi after Ouko's death....that's the game. I noticed: - (a) Itumbi's cockiness in the audio recording - not afraid of being arrested or arraigned in courts
- (b) calmness during the arrest
- (c) casual address of the Press in the midst of his "arrest"; with cops pretending to rush him yet in essence allowing for a complete press statement {this was likely meant to publicize the arrest for ICC's eyes and ears - contrast that with the secret, silent 'release' from custody}
- (d) and the new spin from the likes of Kamale that the audio recording of his confession was doctored....This guy could well be an NSIS operative.

Friends: This is Kenya. Nothing will happen, so we might as well move on now. The fellow will be released within a week or so. The police will announce that investigations are continuing and that they will announce the results as soon as they are done. Stern warnings will be given about this and that. And that will be the end of the matter. By this time next week, both the media and the public will have moved on to something "juicier". What I wrote last week.

The NSIS director one Maj Gen Gichangi has totally snubbed summons by the parliamentary committee on foreign relations and defence currently probing the fake UK dossier that was tabled in parliament by Yatta MP Charles Kilonzo. Gichangi has twice failed to show up at the committee's sittings while his own boss Prof. George Saitoti was at the sitting yesterday. March 29, 2012, Nairobi, KENYA: The despicable refusal by the Director of National Security Intelligence Service (NSIS) of Kenya Mr. Michael Gichangi to honour summons to appear before the Kenya Parliament Committee on Defence and Foreign Relations amounts to insubordination of Parliament. It is a direct affront on the sovereign will of the People of Kenya expressed by the Parliament; International Center for Policy and Conflict said today.
According to the Constitution of Kenya security organs including NSIS are subordinate to civilian authority (Article 239[5]); and are subject to the authority of the Constitution and Parliament (Article 238[2]{a}). Additionally the constitutional values and principles governing public service (Article 232) equally bind all personnel serving in the NSIS.
This contemptuous disregard of the Parliamentary summons is a blatant violation of the provisions and principles enshrined in the Constitution. It is constitutionally mandatory that security duty be conducted and “pursued in compliance with law and with the utmost respect for the rule of law, democracy, human rights and fundamental freedoms”.
The NSIS Director and the entire institution of NSIS are bound by the Constitution of Kenya. Both would be committing a grave offence of undermining the Constitution and acting ultra vires. According to Article 3 (1) of the Constitution every person (natural or legal) is obliged to uphold, respect and defend the Constitution.
NSIS is NOT a parallel government. It is subject to public scrutiny and accountability. NSIS conduct stinks of an institution living in the past and further provide watertight evidence for expeditious democratization of security organs.
Parliament as well as it Committees has constitutional powers according to Article 125(1) (2) [a, b, and c] to call for evidence, cause production of documents and summon witnesses including enforcing the same. These powers are equal to those of High Court of Kenya. In this regard fail to honour Parliament’s summons amounts to contempt of Court. The constitution as read with the National Assembly Powers and Privileges Act, Cap 6 Laws of Kenya, imposes sanctions for failure to appear before a committee of Parliament.
The documents which Mr. Gichangi is required to validate their authenticity goes to the heart of administration of justice, and the honour and reputation of the country.
