Not forgetting two of the biggest deals was the Safaricom IPO scam and the Orange/Telkom rip off that caused a diplomatic tiff between Kenya and France. The man was well rewarded. Kimunya is one of the rare African billionaires who is shedding the pounds while raking in the dollars. He claims he has a very good gym & exercise regimen but I suspect his health is going south fast & not even his accumulated billions can stop the trend. Makes you wonder why they even bother at all as one man (& his family) can only eat so much...

I'm completely perturbed after reading Parliament's PAC Report detailing Amos Kimunya's role in the De la Rue currency printing scandal where taxpayers lost more than Sh 1.8 billion (to pave way for Kimunya's legendary kick-backs). In this mafia operation, (as very typical of Kimunya's other looting scams), an innocent Kenyan (former acting CBK Governor Mrs. Jacinta Mwatela - a Taita) had to be ruthlessly hounded out of office and replaced by a pliant mafia insider - Njuguna Ndung'u. It's no wonder these mafias want to hang onto power at whatever cost. Read what Parliament thinks of Kimunya - not any different from their earlier recommendation regarding the looting of the Grand Regency Hotel. Parliament specifically recommends that Ndungu and Kimunya should not hold any public office; even asking that Ndung'u be kicked out from CBK. 177. Evidence received by way of own admission indicates that Hon. Amos Kimunya, then Minister for Finance was the architect of the joint venture deal between the Government of Kenya and De La Rue.
‘Article 226(1)(5) of the new constitution stipulates that:-
‘’If the holder of a public office, including a political office, directs or approves the use of public funds contrary to law or instructions, the person is liable for any loss arising from that use and shall make good the loss, whether the person remains the holder of the office or not’’.
As per the analysis of evidence, observations and conclusions under Chapter 5 of this report, the Committee was satisfied that the former Minister for Finance, Hon. Amos Kimunya and the incumbent Governor of Central Bank of Kenya, Professor Njuguna Ndung’u were responsible for the loss of Kshs.1,830,909,616.00 because:-
(a) Hon. Kimunya directed Central Bank of Kenya to cancel a cheaper contract with De La Rue even when his Ministry was not party to the contract and all the reasons he gave for the cancellation of the contract were invalid.
(b) Prof. Ndung’u did not make any effort to resist the orders from Hon Kimunya to cancel the contract. In so doing, he failed to protect the Bank and taxpayers’ interest.
Consequently, Hon. Kimunya and Prof. Ndung’u should be held accountable for the loss in accordance with Article 226(1)(5) of the constitution.
RECOMMENDATIONS
The Committee recommends as follows:-
(i) The Ethics and Anti-Corruption Commission should investigate the former Minister for Finance, Hon. Amos Kimunya over his conduct in the loss of Kshs.1,830,909,616.00 with a view to taking appropriate legal action against him and recovering lost funds;
(ii) The Ethics and Anti-Corruption Commission should investigate the incumbent Central Bank of Kenya Governor, Prof Njuguna Ndung’u over his conduct in the loss of Kshs.1,830,909,616.00 with a view to taking appropriate legal action against him and recovering lost funds;
(iii) Hon. Amos Kimunya and Prof. Njuguna Ndung’u having been responsible for the loss of Kshs.1,830,909,616.00 acted contrary to provisions of Chapter 6 of the Constitution of Kenya, the Public Officer Ethics Act and the Public Procurement and Disposal Act and in that respect and for this reason, they are not fit to hold public office
[/u][/b]; (iv) The appointment of Prof. Njuguna Ndung’u as Governor of Central Bank of Kenya should be terminated and towards this end, the President should appoint a tribunal pursuant to provisions of Section 14 (2)(f) and 14(3) of the Central Bank of Kenya Act, Cap 491. In the meantime, Prof. Njuguna Ndung’u must step aside from the Office with immediate effect;(vii) In the light of Article 231(3) of the new constitution, Central Bank of Kenya (CBK) should competitively procure banknotes as and when required without any direction or control by any person or body. The situation can clearly be foreseen and the delay in finalization of the joint venture should not be a reason for direct procurement of banknotes from De La Rue at a price which is not competitive. We do not need to belabor the point; the House was very magnanimous in terms of granting for all the others and I would wish that they do the same on this one.

Back to the multi-billion-shilling Airport rip-off.From last Thurday's Hansard: Belgut MP Charles Keter and others challenging the corrupt Transport Minister, Amos Kimunya. Mr. Keter: Mr. Speaker, Sir, there is an opinion from the Attorney-General,dated 22nd February, 2012, which, partly, reads:-
“---By seeking to terminate the procurement process after notification and acceptance of award of contract, the Authority will not only be contravening the provision of Clause 327(3) of the Request for Proposal but also acting in bad faith, thereby undermining the integrity and fairness of the procurement process---“
Mr. Speaker, Sir, this is a letter written by the Attorney-General, who is the legal advisor to the Government. I will table the document. Also, the Minister has said that it is a “purported” cancellation. There are Minutes to that effect, which are dated 26th July, 2012. Whereas the Cabinet Sub-Committee on Infrastructure is dealing with the case, after some of the Directors of the Board were retired---
Out of the nine Directors of the KAA Board, seven come from one region of this country. After some of them were retired, the Board was forced to cancel the tender. I have with me here, Minutes of the Board meeting that cancelled the tender. The Managing Director did not sign the Minutes. He said that the Attorney-General had given an opinion he did not want to go against.

Mr. Speaker, Sir, tender procurements are run by Tender Boards Committees. The Board has no say in the process, unless some rules have been flouted in the process. So, I want him to come out clearly and say whether he has any interest in a company called “China Construction Engineering State Corporation”. I want him to indicate clearly whether he has any interest in that company, declare what relationship he has with one Janice Gachoka, the Chairperson of the Procurement Appeals Board, and state whether he has talked to her concerning this case.
Mr. Speaker: Very well. Yes, Member for Kinangop.
Mr. Ngugi: Mr. Speaker, Sir, I want to thank the Minister for the Ministerial Statement. I would like to seek clarification because it appears that the KAA Management hurried the processes of this tender of a very large amount, which is improper. I would like him to tell the House whether, as the Minister in charge, he has taken any action against the management of KAA or has investigated any other malpractices that the management of the Authority may have engaged in. Thank you, Mr. Speaker, Sir.
Mr. C. Kilonzo: Mr. Speaker, Sir, I want to know something from the Minister. He has been given advice from six different offices. There is the Office of the Attorney- General which has given him three letters which are very clear. You cannot terminate when you have awarded according to the law on procurement and he has quoted the relevant section. He has rejected the advice also from the Permanent Secretary (PS), Office of the Prime Minister on the same. He has rejected advice from Ethics and Anti- Corruption Commission that this process should not be stopped. He has rejected advice from the Public Procurement and Oversight Authority (PPOA). He has rejected advice even from Mr. Kimemia, the Permanent Secretary and Secretary to the Cabinet. I wish to quote as follows: There is a Committee where the Minister sits. It is the Sub-Committee on Infrastructure in the Office of the Prime Minister where he sits. This is what the committee said:-
“It was agreed that even when the Committee wanted to think differently, the legal opinion of the Attorney-General as the Constitutional Chief Legal Advisor is material to making a decision on the way forward, hence could not be ignored. Even though the Minister for Transport insisted on the tender award being cancelled against the advice of the Attorney-General, the Committee advised that going against the legal opinion of the Attorney-General, who is the Government Chief Legal Advisor is, in itself, unconstitutional under the new constitutional order.”
Mr. Speaker, Sir, for the benefit of this House, I want to refer to Article 156 of the new Constitution which is very clear. It states:-
“The Attorney-General is the Principal Legal Advisor to the Government; and,
(ii) Shall represent the national Government in court or in any other legal proceedings on which the national Government is a party, other than the criminal proceedings.
Most important, it says that the Attorney-General shall promote, protect and uphold the rule of law and defend the public interest.”
Could the Minister clarify the following? Is he of a better legal position than the person who this House and this nation has bestowed those powers?
Mr. Duale: Mr. Speaker, Sir, I want to be very categorical. I want to table the following documents. I want to start with the legal opinion by the Attorney-General of the Republic of Kenya concerning this contract and his position. I want to table the opinion of PPOA over that contract, which the Minister has disregarded, dated June 2012. Mr. Speaker, Sir, I want to table the acceptance letter by the Chinese company after an award was given to them by the Kenya Airports Authority. I want to table both the award and the acceptance. Mr. Speaker, Sir, finally, I want to table the report of the Infrastructure Subcommittee led by the Minister for Public Works, hon. Chris Obure, in which the Minister sits. Among the Ministers who were there was hon. James Orengo, where the Minister was told – and it is in the minutes - that the Constitution does not allow what he purports to do. This Minister must come out very clearly and tell this nation his interest in the said Kshs55 billion project. I table the document.

Mr. Linturi: Mr. Speaker, Sir, I really sympathise with the Minister because he is always stuck in circles of controversy.
(Laughter)
Mr. Speaker: Order, hon. Linturi! Move to the clarification that you want.
Mr. Linturi: Mr. Speaker, Sir, the clarification is this: Why is the Minister always finding himself in those kind of scenarios wherever he is executing his duties as a Minister?
(Laughter)
Secondly, is he prepared to foot all the costs of legal suits that are likely to arise out of this particular contract which he has decided not to honour?
Mr. Linturi: Mr. Speaker, Sir, the last clarification is this: Is the Minister preparing himself now to refund the Kenyan public any costs that arise out of the mistakes that he has done while in the Government? That is because the burdened taxpayer will not continue meeting those expenses because of his negligence and recklessness in the performance of the duties of his office.
Mr. Baiya: Mr. Speaker, Sir, I would want the Minister particularly to clarify what prompted the Prime Minister to write the letter that he wrote, and which apparently triggered the apparent fast-tracking of the process. Why, indeed, he has actually deemed it wrong merely because the process was fast-tracked? Why did he deem that to be a basis for stopping that contract and, more so, when actually all the due process and all the representatives of the due process appeared to have actually given the whole process a clean bill of health? It is particularly important for the Minister to also clarify the following: Development is actually an entitlement for the country. Why does the Minister deem it necessary to delay and deny the Kenyan people their entitlement to have a modern airport?

The parties have not disagreed about what is good for the country. It is a fratricidal power struggle between different very well-connected siblings.
We must remember that large projects with massive procurement needs open huge opportunities for kickbacks and backhanders.
I could go on and on with a list of projects that are being rushed so that they can be committed before the elections.
In future, we should insist that all projects funded by levies paid by the public be subjected to some form of public debate.
Early this year, the minister for Finance, Mr Njeru Githae, increased airport tax by 100 per cent to make it possible for KAA to collect revenue to finance this project. What this means is that anybody who buys an air ticket out of Nairobi pays Sh3,400 for the airport expansion project.
I have seen a copy of the agreement which the China Development Bank has offered KAA and keep wondering whether it is competitive.Included in the terms are all manner of fees: front-end fees, advance payments, arrangement fees, and so on. Are these terms competitive?

The chairman of the Public Accounts Committee, Dr Boni Khalwale, said the two ought to be kicked out of office “together”, because they were like “siamese twins”. The MP got his day in the House after weeks of waiting for debate on the committee report that seeks to have the two fired over the scandal. Mr Kimunya was the minister in charge of Finance. The Ikolomani MP –amid many interruptions—rallied his colleagues to adopt the committee report. He said Mr Kimunya, who was not even party to the contract, had connived with the CBK Governor, to cancel a cheaper contract, and take short-term contracts, which turned out to be inefficient and expensive. “This is corruption. If corruption is not wrong, then nothing is wrong in Kenya,” said Dr Khalwale. Reject expert advice“It is this defiance; it is this impunity by Prof Ndung’u, who deliberately refused expert advice that convinced the committee that he lacks the chemistry and the responsibility to protect public good,” the PAC chairman said. Two of those technocrats whose advice was rejected –Jacinta Mwatela and Macharia Gikonyo— were subsequently fired from Central Bank. They had to give their evidence in camera, and they had to get special security just to appear before the Public Accounts Committee, Dr Khalwale disclosed in Parliament Thursday. The tension in the House was palpable. The silence, when the interruptions subsided, was so loud. But that did not stop MPs from raising Points of Order –seeking the attention of the Speaker to signal a breach of procedure. The temporary Deputy Speaker Gitobu Imanyara, who presided over the meeting had to ask MPs to listen to Dr Khalwale instead of interrupting him. The MPs heeded. Voluminous storage“We were shocked when Amos Kimunya came and misled the committee. He said that he feared for the voluminous storage of 1.7 billion pieces of banknotes. That was not true. The above is sweet musik to SafCom who are minting billions and stiffling growth of small players like AirTel, Yu etc. plus of course the mwananchi who has to pay up! Imagine AirTel climbed up from shs 1 a minute call to shs 3 because of MTR status quo being maintained! Prime Minister Raila Odinga, jumped into the CCK’s regulatory mandate with a similar directive on behalf of yet another big business – Royal Media Services. When they post about the coalition government the blame it is about all inclusive... But when it comes to talking about the parties and party platforms you would agree everyone has a right to support their party of choice and their parties mandate.. Jobs & Phil post here loads of information in regards what is wrong with our Government & parliamentarians and why they parliamentarians are passing watered down bills.. he faults the individuals that are behind the scenes or openly seeking majority votes in order to pass watered down bills... Kenyans should thank him for being vigilant to the happenings in Government/parliament..
