Otishotish I just stopped short of celebrating these convictions after a more serious look at them. It is actually very good that the court have the courage to dish out jail sentences. My little concern about these sentences is that they could just be turned down on appeal as being excessive and reduced to just a fine by the high court in which these guys will quickly pay and move on. Now that is not what I call justice! A year in Jail for a Nabutola is perhaps equal to 6 years in jail for your kawaida criminal. It is the extent of the punishment and how it is felt that makes it worth it. So 3 years for Nabutola or 7 years for Muriuki could just end up being nothing but a 5 million shilling fine for the latter and 500k for the former on appeal. That is not justice in my eyes......

September 5th 2012 ruling...Nairobi Chief Magistrate Lucy Nyambura found the former PS guilty of charges arising from a contract of supply of equipment for making new passports. Mwaliko was facing abuse of office charges in connection with the tender that was awarded to Anglo-Leasing and Finance Limited. Mwaliko was put on defence in June by the magistrate who ruled that the prosecution had proved being the person in-charge of vice-president’s office and Ministry of Home Affairs, he facilitated the award of the contract to Anglo-Leasing arbitrarily without the knowledge of the Department of Immigration. The former PS, she further ruled, failed to comply with procurement procedures and guidelines. She said as the person in charge, he should have verified the status of Anglo-Leasing Limited before agreeing to enter into any contract with the company. Ms Nyambura ruled that despite not having the direct approval of the vice-president, Mwaliko disregarded the guidelines provided in the exchequer and audit regulations in awarding the tender. Nairobi Chief Magistrate Ms Nyambura is a Joke.. ati fining PS Mwaliko KES 3000,000 or time in Jail? what nonsense.. the guy will use the money he got in the corrupt Anglo leasing deal to pay the KES 3 Million and walk free..How about the Kenya tax payers who are left holding the debt ? why shouldn't this thieves made to return the stolen Loot $$$$$$ there something smelly with this ruling? how come the government is not up in arms protesting to this rubbish ruling by Magistrate Nyambura? Anglo leasing and Goldenberg scandals including other such government looting machines will never be resolved while the current government is in place.. Point 3. I support you by pointing out that the DPP should dare prosecute the top corruption suspects; the ones driving around in flashy cars, building shopping malls here and there. If he has the guts let him get the corrupt Ministers and Members of Parliament, the drug lords and other lords of impunity. the Courts have shown that they can deliver.

Thanks good insight.. what solutions or bills does the new Constitution have in place to make sure there is no repeat of misuse of government funds? if any? or else it is a waste of energy and time.. these thieves have becomes experts on how to get in and out with big loot since most seem to think they will pay their way out with the same stolen loot..

But there were two important things running for Morsi. Legitimacy by popular vote, an independent minded minister of Justice --that is Mutula Kilonzo for you then, and a brotherly head of the judiciary, in charge of prosecution. A judge with a work ethic, an efficient mind, technical competence, and an ego to protect.
On corruption, this Judge looked at the new president and told him in public. Now is the moment to fire me! because when I get to work, I wont be sparing anybody, not even you!
Morsi, a pious man whose vices have not included corruption, unleashed this boisterous man to prove his worth. --What are you waiting for, he asked him.
Mahmoud Makki, the Willy Mutunga of Egypt, immediately brought to him air-tight cases selected from the 30 or so rumoured cases of corruption mentioning the name of General Ahmed Shafiq. Arrest him now! And lets see how much law his lawyers know! We meet in court!
NB: General Ahmed Shafiq was the SCAF candidate for the Presidency. The deep state was at his beck and call. He had just nearly won the election! and had the personal assurance of all the heads of securities of Egypt.
But the warrant came. And Ahmed Shafiq fled with his family to UAE, where he was soon joined by Gen. Omar Suleiman, aka The Torturer, former head of Mukharabat and Mubarak's last deputy.
Now they are both on Interpol's wanted list.
1. Morsi in a swing of the pendulum of power, has now RECAPTURED THE POWER SCAF stole during their short-lived coup. Tantawi and 46 other Generals are gone. Some of them offered deals to rat on others. --The head of the Cairo military mission for instance: how did he allow camel-borne thugs (hired by Gamal Mubarak) to come in and try to kill unarmed demonstrators on Tahrir Square?
General in charge of airport security: he allowed his former bosses Gen. Suleiman and Shafiq to fly out knowing an arrest warrant was coming? And the once tough general was finding out, faced with the scorching Judge Makki, that he was facing his orals badly.
In the neighbouring village, I have been watching what a dedicated, competent, mentally astute legally, silently efficient Dr. Willy Mutunga can do within the auspices of his office, if he is serious. I am returning the verdict Dr. Mutunga has a lot of room for make up, so that he can have a chance in the beauty pageant in which the beauties from the neighbouring villages too, strut their stuff.
But there he was, My Dr. Willy, drinking coffee with 'Mubarak', even as the Ndung'u report has 'rumours' of land corruptions, a-la the ones that forced tough-guy Gen. Shafiq to flee the homeland he became a soldier to defend that long ago!

Public prosecutor refers Shafiq to Interpol

The former presidential candidate is accused of profiteering, forging official documents, and seizing public funds
Public prosecutor Mahmoud Abd El-Meguid asked Interpol to arrest former presidential candidate Ahmed Shafiq, Abd El-Meguidfs office said on Tuesday. Shafiq is facing corruption charges in a criminal court.
The former presidential candidate, who was also former President Hosni Mubarakfs last prime minister before, is currently residing in the United Arab Emirates where he moved two days after he lost the election to President Mohamed Morsy.
Shafiq has been placed on an arrivals watch list at all Egyptian airports.
gThe investigative judge decided to put General Ahmed Shafiqfs name on the watch and travel ban lists based on investigations over his illegal allocation of 40,000 square metres of land [c] to Alaa and Gamal Mubarak,h Judge Osama El-Seidy said in a statement.
He is accused of profiteering, helping Mubarakfs sons Alaa and Gamal seize over 40,000 square metres of public land in the Bohayrat Al-Murra region of Ismailia illegally, forging official documents, and seizing public funds.
The land Shafiq is accused of helping the Mubarak sons seize was originally owned by a housing association for air force pilots of which he was chairman. Shafiq is a career air force officer and eventually retired as an Air Marshal and Commander of the Egyptian Air Force.
Mubarak was also a career air force officer and one time Commander of the Air Force, reaching the rank of Air Chief Marshal, which Shafiq argued on the talk show Al-Ashera Masafan on Dream TV made the former president and his sons eligible for the land. He did not deny Gamal and Alaa acquired the land but said it was not illegal and that he was not the one who sanctioned the deal.
Sahfiqfs lawyer, Yehia Qadry, denied that he was wanted by Interpol and said his client would not return to Egypt gto be humiliated in prisonh until it is time for his trial. He insisted Shafiq would get acquitted in absentia.
Shafiq is currently in the Emirati capital Abu Dhabi. Egypt does not have an extradition agreement with the Gulf state.

The image of Ongonga in full zebra gear and still wearing designer glases is indeed refreshing and brings to surface the reality that it is not gonna easy to execute justice ,as a patriotic critic of corruption i must say that much is i celebrate, i also felt truly sorry for the guy and if i was in charge i would have probably discharged him because i think the humiliation is humbling enough and to boot this is the son of Achieng Oneko one of the heroes of the republic if i may add .The second shocking incident that proves that or country is changing fast is the unequovical apology from none other than Zipapa himself ,that was very humbling that all the Lords of impuniy should stand warned that things have changed and its not going to be business as usual.
