What is this man's obsession with gestapo Ali? ,is it because they share the same ethnic and religous back ground? there are many kenyans who are qualified and can deliver 20 times better than Ali did,the police is an instituition that once reformed it will not matter who is at the top.

Mukwasi, Stick to the issues, and make good inputs, Keep in mind Farah Maalim is the Deputy Speaker, the 3rd arm of the government. He has observed that the executive are not working. Name anyone who is qualified more than Major General Ali? The Prosecutor in ICC cases, once he or she has additional evidence, has the freedom to renew charges against anyone who has escaped during Confirmation. It is important to keep this in mind, given that the OTP's Updated Document Containing Charges still has Ali very much in the mix. As long as Ali continues to feature prominently in such proceedings, and no doubt we shall learn more during the trials, he should be treated like an Ebola virus.

Are you arguing that the failure to confirm the charges against Ali was an acquittal for purposes of 'double jeopardy'?
I struggle to agree on the basis that as no trial and acquittal happened, the OTP is at liberty on new evidence able to revive the charges. All that happened, in my opinion, is that the charges were simply dropped as evidence available was insufficient to warrant a trial - whilst in an acquittal the evidence is insufficient to sustain guilt.

Rome Statute, Article 61(8):
Where the Pre-Trial Chamber declines to confirm a charge, the Prosecutor shall not be precluded from subsequently requesting its confirmation if the request is supported by additional evidence.
