I think the deal as structured now is unworkable. I can see that government collapsing as soon as the talks for constitutional reforms take shape, where both sides will take opposite directions. The PM has inbuilt executive powers, even though they want to avoid those words to make some people happy. The PM supervises and coordinates the cabinet meaning every ministry will plan its activities working in conjuction with the PM's office. At the same time the ministers are only answerable to the president. Rude and uncouth ministers like Martha Karua and Kimunya are going to tell the PM to go to hell and only report to the president. Can you imagine Michuki handing over the plans and operations of his ministry to the PM when he knows he can get away with not doing so? The result could be a very frustrated PM who only controls half the cabinet. At the same time the ministers from ODM can revenge by not bothering to deal with the president after all it is very hard for the president to fire them. They can decide to simply work with the PM and run their own side of the government. They are goin gto run some big ministries and if they cut loose the president because the president's own ministers have cut off their man, there is little Kibaki can do about that. In other words the way the deal is structured we could end up with two governments in all but name. I think people got tired and wanted a deal by all means. They got a deal which is bad for Kibaki and the PNU, bad for Raila and the ODM but most of all terrible for Kenyans. It also seems the clincher of the deal was based on the fact that this situation will prevail for 12 months after which time a new constitution will be enacted and instead of fresh elections, the PM will then be appointed according that new constitution. That is a recipe for PNU types to fight tooth and nail to ensure that the PM's position in the new constitution remains as is and for the ODM to fight for the Bomas model. In other words we will be right back where we were in 2003. I think this government will collapse even before the end of the year. It may just be a breather for both sides to plan for the inivitable showdown. It looks like we are going to be in for a very unstable few years. I will examine the situation later, but that is my gut feeling. adongo Adongo, Arguing for arguments sake is quite counter-productive. How different is what you wrote above and what I posted earlier (see below)?? You've got me confused too. Question, will ODM's inclusion in the government, even with the 50% executive power, necessarily make it easier to pass reforms or get a new constitution? Absolutely not!! Kenyans were treated to the same theatrics for over two years when Narc came into power. This power sharing issue is a very recent development and frankly it is of no benefit to the Kenyans you are talking about, Adongo. My point is that we first have to settle the election issue before anything else otherwise the country will continue pulling in two different directions.
The most reasonable route for ODM is to demand fresh polls but only after wide ranging reforms. ODM can actually do this quite well even in opposition. The mediation team should bring the two side together and make them agree on the reforms needed and also set a timeframe for Kibaki's government. Otherwise if this power-sharing nonsense goes through (and I doubt it will) we will witness the biblical tower of babel. Power sharing can work but not where, two people believe they are the legitimate president; the government and civil service is split along two warring blocks; a power sharing arrangement is hurriedly crafted to appease ethnic cleansers and foreign governments and so on. It just wont work!!!!

DUBOIS, Your proposals are only workable in a situation where you are dealing with people who have a conscience and do not go back on their word. If PANU was genuine we could not have needed Annan to settle this thing. Kibaki could have refused to take up the illegal position he is holding now and demanded a new elections. But as we all know, he is hell bent on ruling by force, even if means being a president of only two provinces.
PANU is very opposed to those very reforms you are talking about which is one of the reasons they rigged the elections. To expect PANU to somehow turn and support reforms which ODM proposes is a joke. Amending the constitution as we know requires 2/3 majority.

Could Dr. Annan have finally seen the sense in meeting the principle players? The reasons rightly put here by Job may have finally rang true. But, will this also be a chance for Annan to know/see first hand that 'the duly elected' Kibaki has some concerning mental health issues?
It is a guarded government secret, but a real concern that Kibaki ' is a mentally ailing man and the steroids used on him during the campaign period could only go so far and are medically not advisable for long term use. ..hence, he will be getting back to his sedated state of being... God help,us
Ask yourself why the people so close to the man are ever so protective of the man and his over exposure to the public and media?
This truth will soon come out.
I hope Annan will later whisper out this concern ....

From the looks of it Kibaki is not going to be meeting Annan one on one...looks like the saboteurs will be part and parcel of the " 1 on 1 " discussions.

They will definately not let him do the negotiations alone... the old man might throw in the towel and say " To hell, let them have it" now that will not be acceptable to the goons who funded the "kibaki tena" campaign. As we all know, this whole defiance by the PANU lot is all about holding on to power till they recover all the campaign expenses. The One Million Dinner fund-raisers were not for nothing. When you look at Martha Karua, her defiance, her steely ugly eyes and attitude just know that she is not defending the mental case at state house but rather the goons who paid for all those larger than life blue billboards you saw in every part of the country with the massive portrait of the Mt Kenya Mafia Mascot* [ *Mascot is defined as "A person, animal, or object believed to bring a desired outcome, especially one kept as the symbol of an organization such as a gang of looters] So Denno, Annan will not get the chance to hold direct talks with Kibaki as that excess baggage (Read Karua and co., plus what they are in defense of ) will hang on like a bad smell.

And yet creditors still await millions of dollars for services such as transport and advertising. Where did the money go? ODM paid promptly (I can attest to this), but PNU is still dragging its feet. You would imagine that one would want to clean up after the shameful antics.
