NAIROBI, Kenya, Jan 11 - A local non-governmental organisation has written to the International Criminal Court (ICC), inviting it to investigate alleged executions and disappearances of over 8000 suspected Mungiki sect members.
DISAPPEARANCE OF OVER 8000 SUSPECTED MUNGIKI SECT MEMBERS(this is unacceptable it is worse than IDD Amin of Uganda killings in one year- this Ministers & MP's of then Narc government and now PNU should face ICC) ( disappearances of over 8000 suspected Mungiki sect members.
Oscar Foundation, a free legal aid clinic with networks in Kenya said it had documented numerous cases of mysterious deaths and disappearances on the banned sect members blamed on the police.
“We want the ICC to take up this matter and expeditiously investigate these atrocities,” the foundation’s Executive Director Kamau King’ara said.
In a the letter to the ICC dated January 1, 2009, Mr King’ara states that many of the youths were arrested, detained and tortured while in police custody before they were killed.
“Their bodies were found dumped in mortuaries or abandoned in forests in the outskirts of Nairobi,” he said.
“We therefore, ask the ICC to send international investigators to come and carry out independent investigations,” part of the letter in our possession states. It is addressed to the ICC Chief Prosecutor Luis Moreno Ocampo.
Many of the youths were killed since 2002 when the sect was declared an illegal grouping.
Tired of its massacre killings across the country, mainly in Central Kenya and Nairobi, the government launched an offensive operation in 2007 when the largest number of the sect members were arrested and others killed.
Police have blamed the Mungiki for dozens of killings, with several of the victims having been beheaded.
”The cycle of police brutality continues to be perpetuated with impunity and remains the most serious and divisive human rights violations in Kenya,’ the letter states.
“Excessive use of force by the law enforcement officers, including torture, extra-judicial executions, arbitrary arrests and intimidation, is rife in virtually all police stations in Kenya,” it adds.
Mr King’ara particularly takes issue with the conduct of the police force in failing to expeditiously investigate the killings, which Police commissioner Major General Mohammed Hussein Ali repeatedly denies.
“Police officers implicated in human rights violations should face due process of the law and be held accountable for their deeds,” Mr King’ara said and added that the “trend was rapidly precipitating a state of moral negligence and ineptness in the entire police force.”
Oscar Foundation said it wrote the letter on behalf of mothers, widows , friends and relatives of the slain victims of extra-judicial execution and enforced disappearances.
Mr King’ara said he had also forwarded evidence gathered by the foundation in the course of its investigations.

More killings feared as Kibaki vows new Mungiki war Posted on December 7, 2008 by nairobichronicle
President Mwai Kibaki has vowed to crack down on the Mungiki sect even as torture and disappearances undermine ongoing government efforts of eradicating the sect.
The President is enraged by the killings of at least 10 people in his parliamentary constituency. The dead are believed to have been executed by Mungiki adherents, who are known for demanding protection fees from retail business, land owners and transport operators across Central Kenya, Nairobi and parts of the Rift Valley.
Since June 2007, at least 600 youths have been killed for alleged involvement with Mungiki. Scores of others have simply vanished after they were arrested.
Survivors and civil society accuse the Kenya Police for the deaths and disappearances, a claim the police Commissioner has denied several times. However, former internal security minister, John Michuki, was quoted last year saying that funerals of Mungiki youth would become a common occurrence.
Mungiki is an underground movement among the Kikuyu ethnic group, drawing its membership from youths in squatter settlements and urban slums. The group advocates a return to Kikuyu traditional customs saying that modernity has failed to ease human suffering.
Mungiki leader, Maina Njenga, is serving a jail sentence for drugs and weapons possession but the sect describes the charges as a fabrication meant to curtail its activities.
Njenga began Mungiki in the mid 1980s in the Rift Valley province. His movement grew in numbers in the 1990s following clashes inflicted on the Kikuyu by forces loyal to President Daniel arap Moi.
The 1990s were a period of rapid economic liberalization in Kenya coupled with globalization, resulting in massive unemployment coupled with the loss of societal values. Rising crime and crumbling state authority added to the difficulties.
Within the shanties of the Kikuyu homeland and the capital city Nairobi, Mungiki restored order and provided basic social services in exchange for protection fees by households and businesses. By the early 2000s, Mungiki membership was estimated at over 1 million.
Since then, the Kenyan government has worried over the motives of Mungiki and sees the sect as a threat. Sections of the government are convinced that Mungiki’s goal is to capture power through its political wing, the Kenya National Youth Alliance.
Mungiki is not a movement of angels either. Dozens of people have been killed by the sect for either exposing the group’s secrets or refusing to pay protection fees. Mungiki does not allow revocation of membership and recruitment procedures are rather nasty.
Whereas President Moi kept the group in check through negotiation, his successor President Mwai Kibaki has pursued a hardline stance. Ironically, Kibaki is also a Kikuyu whereas Moi was not.
Being a phenomenon of the underclass, Mungiki does not enjoy the complete loyalty of the Kikuyu. Majority of upper and middle class Kikuyu support Kibaki’s crackdown against Mungiki, leading many social commentators to draw similarities with the Mau Mau war of the 1950s. Like Mungiki, Mau Mau drew its membership from the poor whereas the educated Kikuyu working for the colonial government opposed it.
Incidentally, John Michuki, the man who predicted Mungiki funerals in 2007 worked as a colonial administrator in the 1950s where he was tough against Mau Mau. Its worth noting that Mungiki draws its inspiration from the Mau Mau rebellion.
The rest of Kenya’s ethnic groups fear Mungiki and support the government’s campaign despite the violations of human rights. With Mungiki’s membership being exclusively Kikuyu, the rest of Kenya’s tribes see the group as an ethnic militia championing Kikuyu interests.
Consequently, there has been little condemnation of the government from the rest of the population. However, this apathy may change as the Kenyan government spreads its tactics to other parts of Kenya.
Security operations in Mount Elgon and the Somali border have been marred by similar allegations of torture, death and disappearances. It may seem as though the Kenyan government is adopting tactics last seen in Latin America back in the 1970s. Perhaps, Kenyan leaders and security chiefs should familiarize themselves with ongoing legal procedures in Latin America. More than 30 years after the era of leftist groups and right wing paramilitaries (usually backed by military governments), trials are currently underway for those responsible for the disappearances.

Security minister John Michuki has personally attested to the bizarre rituals administered on Mungiki adherents, to bind them and ensure they executed the outlawed sect’s reign of terror.
“It is evident that after they kill, they drink human blood as an element of oathing,” the Internal Security minister told a shocked congregation yesterday.
Speaking at Kiamara Catholic Church in his Kangema Constituency, the minister recounted how sect members drank the blood of beheaded victims ostensibly to bond them. Mungiki
Mungiki is an outlawed, quasi-political/religious cult in Kenya.
It is a criminal gang that has attacked women for wearing pants or mini-skirts, imposed female circumcision by force, murdered defectors, and raided police stations.
Mungiki attack matatu (public commuter vehicles) drivers by extorting money or taking over lucrative routes.
First Lady Lucy Kibaki joined in the Mungiki outrage on Sunday, reading a political agenda aimed to discredit the Government.
“When we near General Elections, there are always some people who incite our boys to win votes and victory. Daily, we hear reports of people being killed not only in Central Province, but all over,” the First Lady told a fundraising meeting at the Presbyterian Church of East Africa (PCEA), Kiambu. Seven years ago, self-confessed Mungiki leader Mr Ndura Waruinge, who has since renounced the proscribed sect, confessed that the movement practiced rituals that “blended Christian teachings with traditional African worship practice.”
Michuki’s revelation that Mungiki gangs drink human blood as a bonding ritual underlined the urgency with which the Government ought to tackle the menace.
One intriguing practice that Waruinge spoke about in an interview with The Sunday Standard in 2000 was a ritual called baptism by water and fire, which not only served to step up the spiritual fervour of adherents but also to initiate new members.
The recruit passes through a billow of incense, according to Waruinge, then is “blessed” with mixed olive, coconut and clove stem oil.
The President in his Madaraka Day speech, who warned mungiki sect that they would be dealt with firmly.
“There is no way, as a Kenyan, that you can have a right to kill another Kenyan; If you do so, we will get you no matter where you hide, and you will be killed,” he said in his address to the nation.
On Sunday, Michuki reiterated the Government’s hard stance on the outlawed sect, saying its strength could not match that of the State.
“Those who want to challenge the Government know that they are just a drop in the ocean compared to the country’s 33 million people,” Michuki said as he announced security had been beefed up in the affected areas.
The minister clarified that no rotting body was on Friday found near any of his property as reported in the Saturday papers.

FORMER Cabinet minister Ignati us Ngenye Kariuki yesterday took issue with the Government and the Minister for Internal Security John Michuki over the recent extra judicial killings of suspected members of the proscribed Mungiki sect.
The former Kiharu legislator pointed out that in the recent past a worrying trend of gunning down of alleged Mungiki operatives has been observed in the country.
He accused minister Michuki, of issuing dictatorial orders to the police who were exterminating innocent people.
He said every Kenyan has a right to be accorded fair trial in court of law but not to be subjected to extra judicial punishment.
Kariuki made the remarks while addressing bout 400 community leaders who had gathered at his Murang'a town home. During the meeting, he accepted to contest for the Kiharu parliamentary seat, which he lost in 2002 to the incumbent James Kembi Gitura.
Kariuki, one of the top stock brokers and investment consultant in the country, said he was prevailed upon to run for the seat by Kiharu residents.
He claimed that police and provincial administration in Murang'a region were harassing local young men in the guise of flushing out Mungiki adherents. The former minister further claimed that about 30 young men were massacred in cold blood a few months ago by the police when they were allegedly found in a hideout taking oath to abide to the sect.
The incident occurred at Gikui village in Iyego location, Kangema Constituency. Five school children were among those killed in the ill-fated Mungiki oathing ceremony.
Speaking to the' leaders, he claimed that the current political leadership had failed to champion the rights and interests of the residents. A member of the Constituency Development Fund (CDF) committee Edwin Matiba called for the auditing of the kitty.
He alleged that the fund was used in a suspicious way and that the area Member of Parliament Kembi Gitura had protected those embezzling the public fund.
At the same time, Kariuki observed that senior politicians from Mount Kenya region had failed to effectively campaign for the re-election of President Mwai Kibaki.
He said the leaders most of them in the Government have so far displayed arrogance which has thwarted efforts and plans to roll out campaign strategies for Kibaki re-election. He said proper plans should be put in place to manage Kibaki's campaign machinery without further infighting.

The Kenya National Commission on Human Rights (KNHCR), an independent body set up by an act of Parliament, says it has evidence that almost 500 suspects were shot and their bodies dumped during the past five months. Researchers have spent three months collecting the data from mortuaries as relatives came forward claiming that their loved ones had disappeared. A police spokesman dismissed the allegations as nothing more than "rumors." However, Maina Kiai, director of the KNHCR, said police had yet to explain how hundreds of bodies had been delivered by police vehicle to mortuaries, yet the force had denied any involvement in the deaths. "Killing about 500 people without due process is a crime against humanity," Kiai told reporters in Nairobi as he presented his organization's report on the killings. "We want police to tell us how those 500 people ended up in the mortuary between June and October. The burden of proof lies with the police." His report said the deaths were clinical killings. "Almost all the cadavers bear classic execution signs of a bullet behind the head exiting through the forehead," it said. The Mungiki (meaning multitude in the Kikuyu language) draw their inspiration from the Mau Mau guerrillas who rose against British colonial rule in the 1950s. They began in the 1980s as a quasi-religious movement to rid Kenya of cultural imperialism and return the country to its African traditions. Followers were believed to face Mount Kenya to pray and many grew their hair into dreadlocks. But in recent years, analysts say, it has fragmented into a network of distinct organizations. Some are little more than gangster outfits — running protection rackets in the slums and collecting "taxes" from buses — while others have political programs or continue as a shadowy religious order. They are bound together by a secret oath often taken under duress. One former adherent said it was designed to humiliate the recruit and ensure his silence. "You are forced to eat some meat — you don't know what, maybe it is human meat — and all the time they are beating you," he said. In recent years, the Mungiki have retreated into their slum strongholds of Nairobi. But they hit the headlines in April with a string of beheadings as they tussled for control of lucrative bus routes by executing drivers and conductors who refused to pay protection money. Analysts speculated that the Mungiki were also flexing their muscles ahead of elections due next month. Brutal police crackdowns began in June after officers were shot dead in a slum as they investigated Mungiki violence. Young men shaved off their dreadlocks or fled the city for fear of being caught up in the arrests. Thirty people died in shootouts with police in the Mathare slum in Nairobi during a two-day operation in early June that was later condemned by Amnesty International. In all, officers said they had rounded up 4,000 suspects. Kiai said he now had evidence that 454 bodies had been abandoned in Nairobi's mortuaries. Others, he said, were found in towns further afield or simply dumped in forests. Eric Kiraithe, spokesman for Kenya Police, denied the allegations. He claimed many of the bodies were victims of traffic accidents or gang warfare. "Who was there to say the victims were shot from behind and the bullets exited in front? If Kibaki falls out with the West he might face prosecution but for now he is in good books with them. The same applies to Museveni and Melez. The Bush administration and the U.K govt love Kibaki. Maybe things will change under the Obama Administration so lets wait and see what happens. But for now Kibaki is in the safe hands of the West, he knows it and he loves it.
It's got everything to do with Islam and the war on terror because thats what the US foreign policy is based on. Anyone who supports the US on this cause will never meet a judge at the ICC.
Charles Taylor was anti-west he was getting too close to Gaddafi, thats why they were after him. But had be committed those atrocities as a US ally he probably would still be president.

I totally disagree with you kibaki is safe or as you point out- I think you should read your politics more closely if indeed kibaki was in the best books of the west then why is their a coalition in kenya?? why did Bush withdraw his congratulations to kibaki for having won the 27th December 2007 where the whole world watched him rig and sworn in at night while he kibaki continued giving orders to his police force to shoot and kill innocent Kenyans... kingtut get out of your dreamland and face reality your argument about Kibaki being safe and knowing it does not wash, maybe the senile fool would like to believe that but the reality remains that Kibaki will face International Criminal court for his crimes against the citizens of Kenya.. In the short term Kibaki is safe and sound but it all depends on Obama. If the Obama administration supports Kibaki’s prosecution then so be it, I would support it too, but for now the old man is safe.
Kibaki is not senile, if he were senile how is it that he outsmarts Raila and ODM? He might give the illusion that he is senile but the man has a perfect grasp of what is happening around him. He knows his enemies and friends better than most Kenyan politicians. Right now everything is in Obama’s hand because only the US government has the ability to enforce an ICC case against Kibaki.

There is a coalition government in Kenya because the US could not afford to have civil war in Kenya and not because they cared about Raila’s election. Bush withdrew his congratulations after the mass killings and protests not because of the elections. In the short term Kibaki is safe and sound but it all depends on Obama. If the Obama administration supports Kibaki’s prosecution then so be it, I would support it too, but for now the old man is safe. Kibaki is not senile, if he were senile how is it that he outsmarts Raila and ODM? He might give the illusion that he is senile but the man has a perfect grasp of what is happening around him. Any intelligent kenyan can see where you are going with this- trying to excuse Kibaki's murderous madness -while connecting Obama to his prosecution meanwhile showing a hint of Raila & Obama connection at play..it doesn't wash!!!using it as the reason why Obama would be prosecuting Kibaki?? You proved my point by mentioning Saddam Hussein. Saddam was a close friend of the US when the US was using the Baath Party in Iraq to fight against the Iranian Islamists. Saddam commited mass murders against his people but he was only prosecuted when he became an enemy of the US. Kibaki will go down only when the West turns against him.

Kibaki knew that and that is why Martha Karua was on BBC saying that US was jealous of Kibaki's relationship with China( note that i mentioned kibaki not Kenya relationship- because Kenya has it's owners that is the people of kenya) Bush already signed off Kibaki for Prosecution in 2008- lets not try to cover that up like you are trying to on here.. Kibaki stopped being an asset to Bush and that means he is on his own.. KIBAKI WILL BE PROSECUTED FOR HIS CRIMES AGAINST THE CITIZENS OF KENYA... LOL @ you Tiskie, keep on dreaming. Kibaki and the US govt are in the best if terms. Don't be delusional and assume that the US wants a democratic and transparent Kenya. Raila is still viewed as risky for US plans for the region.
