To be honest, I haven’t gone through the whole draft. Some of the chapters in the Kenya Gazette NO.063 of 2005, as drafted by the AG. have loopholes.Due to this I’m voting "NO". Reason: the document has defects.
For instance, Chapter 2-10.1, clearly states the separation of state and religion,yet when you move to Chapter 13-195(1),you find established, Christian courts, Hindu courts,Kadhis courts etc. Yet there is no provision for Free Mansonry & Atheism which we know exist side by side with other religions. Where are they represented in this draft?
Excessive powers bestowed on the Presidency, as indicated in Part 2 of that chapter are not the wishes of Wanjiku. These powers have been abused in the past and will certainly continued to be abused in the future.
What I disagree with is the attitude taken by some individuals to over personalize this issue, thus instead of reasoning out they have become emotional.
For instance you can not sell bananas in parts of Western
Kenya especially Kisumu. The same goes for Central Kenya where a total ban has been effected on the orange fruit.
Some personalities like the Chairman of ICJ,want the voting to be postponed until next year;the Election Commission want the campaign to be stopped immediately until June.Mr. Amolo, the ICJ Chairman stated that,"People are taking sides not on the basis of the content,but on the basis of perception".
Yet I have seen the voting patterns being influenced in most instances by political stances taken by the local leaders as well as tribal factors.
Just as President Mkapa put it earlier when commenting about AIDS,"Mule tia sumu kwa sukari".
So unless the anomalies are rectified I don't see what Kenyans are going to gain from the new constitution.
