Muthaura was named a suspect by Ocampo many months ago, Muthaura has held that position and did not interfere with any witnesses....why would Ocampo now think he will? Does Muthaura even know who the witnesses are? My suspicion is that a government angry at Ocampo will ignore the letter! |

Henry Kosgey seems to play safe ball. Muthaura is playing a dangerous game. I shall advise him here for free. "Step aside to avoid a warrant or being detained while attending the summon hearing at the Hague on the 7th of April 2011. It is the only other option left. Take it or leave it." I would like to believe that the six are front runners for even bigger fish. Probably that is where Ocampo is heading and that is why these individuals are using state resources and state brand to buy themselves some time and hope. The prosecutor appears to have built a strong case for him to confidently state that he has collected sufficient evidence to support the cases and that any political debate around the Kenya cases may as well go on. But isn't the challenge you present the whole rationale behind the due process. My satisfaction is based on what appears to me to be Ocampo's confidence that he has what he needs to sustain the cases he has presented. The Ocampo six will be underestimating Ocampo at their own peril. So far he has done pretty well. It would be less re-assuring had he implied that he is still investigating the matter to buttress his cases(he may still have to do it at a later stage as the process shall dictate). |

Why someone would want to cling onto office under such circumstances is beyond me. The conflict of interest is so plainly obvious. Kibaki should persuade Muthaura and Uhuru to vacate office for their own good. If these gentlemen do not vacate office then we can expect arrest warrants. Who then will they want to blame?

...That is a one-two jab from Ocampo straight to the head of Muthaura; the naked emperor and his tailors at the corner are dazed by that fast direct blow, ladies and gentlemen. I see knees wobbling vibaya, Muthaura is still standing but leaning against the ropes, is he going down?
...Muthaura is saved by the bell for now; I swear it could have been an uppercut coming next, The naked emperor and his tailors have huddled around Muthaura, he will need all the moral support from the gang of tailors and the naked emperor because this looks like a one-sided fight.
The next round looks like someone will see stars and fireworks...or maybe Ocampo will toy around with him like Ali did with his opponents until the last round before finishing this off?

In any civilized system, Muthaura Uhuru and Ali should have resigned their positions by now and handle their cases. These people are not charged with stealing their neighbour's chicken. They have been charged with the most hideous crimes imaginable, namely organizing the murder, rape and mass displacement of Kenyans. We should be ashamed that such characters still occupy any position of leadership in the country as if there is nobody else who can take up their jobs.
I am glad Ocampo is calling them out on that. I am embarrassed for fellow Kenyans so skewed and perverted in their thinking that they see nothing wrong with this ugly picture. Muthaura is still running the nerve centre of the government. A man who has been accused or committing the worst possible crimes against Kenyans is still the president's chief of staff. It is scandalous.
Ocampo is making a very smart move at two levels. If Kibaki retains Muthaura as his main guy running the government Ocampo can opt for arrest warrants or ask for tougher conditions come April 7 when the suspects appear in court.
Secondly, Ocampo is showing the absurdity of the so called deferral by demonstrating that the key suspects actually run the same government which wants to be given the opportunity to try the suspects. Of course the blind mice cannot even see that. They are too busy chest thumping. More please. They are walking sweetly into Ocampo's net. Just great.

Attempts at coercion and to discredit the KNCHR were made. The suspects’ being in public office and at the heart of activities undermines the ICC process and is a conflict of interest. The two Principals asserted their willingness to co-operate with the ICC—including when the Prosecutor, finally, sought and received authorization to investigate. Are they out to prove that justice can only be—will in fact be—at the cost of peace? Like nalinali, I am beginning to listen very carefully to what Ocampo says. He has been silent since last December when he released those names – until now.
Before that he promised to take up the Kenyan case – he did.
He declared he would submit cases by the end of the year – he did
He said he would have two cases of 2 to 3 people – he did.
Now Ocampo is saying he has enough evidence for his case. Is this really the time for suspects and their online supporters to be arrogant and dismissive?
Muthaura was recently caught on tape discussing an ‘ICC interference’ strategy with a ‘youth leader’ at his office and dishing 'cash'. Purely as a Kenyan and a patriot who believes in constitutionality, I think there are many qualified Kenyans who can handle this office while Muthaura and co attempt to prove their innocence at the ICC.

What damms the gray haired rasputin and prince behind the throne muthaura even more, is that he was caught on tape, detailing what he thought about using the Police to supress ODM supporters!!
Now he is in a big dilemma.
He is giving Ocampo the ammunition to issue warrants direct, given that muthaura controls the security nerve center of the country, charged with witness protection, but at the same time, muthaura is the one coordinating the ICC deferral plot!!
But we know that muthaura's exit from that post makes him, and by extension the lame duck P.O.R.K very vulnerable!
Talk of being entangled in a self tightening knot, the more they move the tighter the knot!!
Boy are these guys screwed, or are they screwed!

That is what the International Crimes Act says. They would not be secret the most they are issued by the PTC! Let us use some facts even in our excitement! So in other word you are confirming that Kenyan courts can NOT and will NEVER be used to prosecute these guys even if they are as guilty as sin and the evidence is dangled right in-front of the presiding judge. |
