This Miguna thing has become comical as far as i am concerned. Now that he has declined the job why are we even discussing this and waiting for updates? Are we doing this for the entertainment value or does Miguna still hope he can galvanize some sympathy which he helped chase away by his past public spats? Is there a point in posting Migunas actual correspondence with the OPM office on this board over this issue? As far as I can tell Miguna has not rejected the outcome of the discussions between himself and the PM. He has rejected a letter that purports to spell out what the agreement with the PM was. And the high court ruling had set a short deadline of 30 December after taking more than three months to deliver a ruling. Something needed to be done before that deadline. I am not saying that I am for or against Miguna in this. that is not the issue here. But there needs to be proper process. As it stands that process is still ongoing. Whether it is wise to have all this play out in public is another question.

This indeed is a scenario on what a president Raila is going to make. A Spineless one that is what he is proving to be. The man isn’t a leader as we can see who has the say in his office.
What is, since years obvious to many is that there is a power fight going on in his office and he seems to be ignoring it or he is powerless to bring it to an end.
No thank you Mr Raila, you are a very charming man but not a leader. For the goodness of our country, I hope he will see that and let Mudavadi take the ODM Presidential ticket.
And to Mr Miguna Miguna, you are indeed a tough chap and thank you for opening many people’s eyes to see the real Raila. Keep the pressure on.

While we await your promised update on the situation, may I, humbly, request that now that MM has decided to make public his correspondences and agreements with the PM, he (or you on his behalf), should also publish the M.O.U between him and the PM talking about his reinstatement and which has been dishonoured in this case, so that we should comment or discuss the situation while possessing all the facts?

If Miguna's effort is all about being termed "tough", then well done. Unfortunately he comes out a political idiot in this.
If indeed there was an agreement between him and the other one, then he needed to seek a check-up meeting rather than this self-wasting emotional hunch. He should have met the one in privacy, once more, and sought to understand why the private agreement was not being kept. That's not just politics, but social ethics as well.
Miguna is not the only one in Raila's politics, so other people could have made Raila word the reinstatement different from what he and Raila had agreed ... but in Miguna's world there is non other, but he alone, Miguna. If I had a chance to advise Miguna I would be simple and succinct ... "Grow up!"

in this rather unfortunate saga, there is considerable confusion
the person desirous of the services of miguna is of course one raila agwambo, and therefore it is correct for the two to meet and discuss mutually agreeable agenda
however the employment terms are set by the technocrats in the office, it is these guys that miguna should have held discussion number two after meeting with the PM (formally or informally) to obtain the nitty gritty. thats why all firms have an HR department on which sit HR professionals and accountants/finance so that all legal requirements are met. to expect the PM to draw your terms of employment is a little unrealistic, i beleive citizen is facing a similar issue with an employee shipped direct from south africa by its CEO.
if miguna has issues with the contract terms, he should take this up with the technocrats armed with the mutual understanding agreement. those technocrats are the ones who take the heat if something goes wrong somewhere down the road. the technocrats are charged with responsibility of converting the desires of employer and potential employee into a workable contract that protects both the organisation and the staff. this will be in accordance with state, corporate and other legal, social and financial requirements.
now if he is being payed out of RAO's pocket then thats a different ball game and he would simply have to fold up and take it or leave it.

How Miguna expects to be employed "on condition that the following demands are met" by the same person he has called all sorts of unpalatable names beats me...
Why was Miguna engaged in a very public duel in both print and broadcast media for monies and powers accorded to other political appointees of the other principal authority and then call a press conference to reject the job offer...? For a moment I thought that all he wanted was a well paying job with all the perks and benefits kumbe it is mere politics...
And about the book that he is writing as an expose to the underhand, irregular, illegal, dirty deals at the PMs office, report to the nearest police station and record your evidence there... Citizen, K 24 will use and dump you like some sh*# paper....
This Miguna ish is beginning to sound like the saga of Erick Masika leaving Gor for AFC... I am tired, can we move on...

It is common knowledge that the PMO is a divisive place where some individuals do not want to get along. and let me add that I know Miguna himself is not easy to get along with. But that is not the point. The point is that in a divisive and politically charged situation the PM himself should make sure that clear instructions are issued to those charged with implementing the agreement. It is not merely a matter of Miguna negotiating with 'technicians'. Like it or not the agreement reached is policial in nature. Can technicians who report to Isahakia be expected to act in good faith? Isahakia's dislike of MM is well known. So did the PM leave proper instructions before he left? I don't know but it is quite possible that he did not. And those who claim that MM should have talked to the technicians: from the letter and the statement I get the impression that he did try to contact the PM's office but that his efforts were unsuccesful. Granted, it is difficult to reach people over Xmas and the court did set a tight deadline for 30 December. And finally, let's not be too quick to state that the PM does not need Miguna. In many ways he probably does not, but then again he does. Every senior politician needs people around him who does his or her dirty work and says and writes things that the politician cannot and will not say. Politicians excell in the art of the possible, not in the art of the necessary. If you look at the history of the present constitution you will find Miguna's imprint in very many places. He made himself a nuisance to many of the water melons and others who were keen to maintain as much 'business as usual' as possible. But Miguna's weaker side is that he believes that standing firm and defending rights and values is an end in itself. It is of course, but it requires strategic thinking and action to achieve them, including close collaboration with others. Alienating people who have similar objectives does not help, no matter how right one may be.

That MM sat down with the PM to negotiate his terms of service is a slap in the face to all those who thought he was a beacon of principle. How is he selfless? Yes, I that guy from Manyatta who used to be your Youth and fought many battles for you on the streets of Kisumu City. I remember in Narok as you campaigned for Kibaki in 2002 how not even the Maasai Morans brought by KANU could dare come close to your meeting. We were ready to lay down our lives for you. We believed in you. We would jump in a bullet's way to save you. I still regret what some of the youths did to the late Dr Oki Ooko Ombaka when he came with Prof Ghai to Kisumu. All I remember is that a NCCK Landrover was burned and the blind professor (may his soul rest in peace) was humiliated. When my late brother (name withheld) captured a headline in the EA STANDARD about your inability to unite with Ghai Commission, youths went looking for him to kill him. I had to tell him to hide after some of the youths told me to protect him. That is how zealous your followers were/are. They can KILL over a headline that does not depict your interests in good light. Well, let me quickly add that my brother's later death is in no way related to your youths. I do not want any INSINUATIONS made.
To cut the long story short, a lot of water has gone under the bridge. You have continued to help transform Kenya. What worries me a lot is the increasing accusations against you bordering on TRUSTWORTHINESS. All are crying that you are not keeping your part of the bargain. I see a pattern consistent with what most of your political detractors accuse you off namely, you cannot be trusted. Is it that you are just too MACHIAVELLIAN? How will we make a difference between you and say others that you constantly accuse of being anti-reformists?? Why are you always opposed to anything that does not serve your interests?? Right now the GATEWAY is closed. Anyway, Miguna Miguna, yes, I say it was in your best interest to find a reason/excuse to turn down the job. You had said too much in your anger that you going back there would just be LAUGHABLE. I know you were angry and that made you call him conman among other things. Yes, Anger can make us say things we do not believe. So i will assume you were not lying about Raila because you were ANGRY. May be you were which again would be LAUGHABLE. But if were telling the truth, it would be hard for you to go back to that office and downplay such issues. So your best bet is to find a way to continue fighting for change. You do not have to be in Raila's bus. You can start your own party or as someone suggested you can lead COTU. i think you can do a good job there. I would probably join your party as ADVISER on condition that you do not fire me the way you were fired by Agwambo.
Keep writing. Start a radio talk show and invite HArd core democrats. Start a youth party and do an OBAMA in KENYA in the next elections. I am just saying. Just leave Raila alone. His MISTAKES will one day catch up with him and it will be a big shame to most of us who have believed in HIM. We do not know where we will start. Happy New Year Guys!

But I hope you take a quick read of my fill-ups below, even if some will be repetitions of the lady. In the main, in regular employment, where structure is running efficiently and process observed, what you outline above is the modus operandi. Noting also that most of the jobs, advertised, will in the rule come with a standard contract, or advisories on what to expect in basic renumerations and secondary benefits... But this saga [that is the word you used] is neither regular nor ordinary/normal as Furaha so accurately intimates. This is a job apparently where you hear you are suspended through the media! and, on talks about resumption, even before you get to the technicalities with the technical staff to iron out the material contract agreed in principle with the top boss, there are already media communiques that you are re-instated. (There is a media war too!) There is also the fact that a judge's sword was hunging over the OPM, as Furaha notes. And given that Raila has never contacted MM all these [suspension] months, nor acknowledged his smss in a hint at reconcilliation, conclusion is it must be the legal sword of damocles that has spurred him [Raila] to eat humble pie [with this irritant fly hovering about his soup!] Then there is the truly horrendous claim by MM that all this time he has never been officially presented with neither the copy of his transgressions as investigated, nor an opportunity to rebuff them officially. That is malicious laxity. I am also curious as to whether the official who signed the re-instatement letter, has the legal validity. In government hierarchy Muthaura's juniors would not sign a letter of his appointment I think! NB: 1. Normally things would be done far from the glare of publicity, and only once the final agreement mutually okayed by the contestants is reached, would the press be called to take the obligatory stagemanaged smiles and handshakes [as if the parties were long lost brothers refound, or, as this one would play, the prodigal son returning to the fold! And a beaming father happy!] TNK, you must also have seen alot of people get fired. Straightfoward and with minimal fuss. Don't you think the firing of MM, and his junior staff, had the hallmarks of a deeper rot? I was amazed about the clause reporting directly to Raila. Hearing second hand from ones legal advisor, can anybody do that? It is mumbo jumbo enough understanding a lawyer on one on one! to imagine a third party in between, reveals the new working relationship was a mere paper tiger. 2. So perhaps MM is stretching it when he says the meeting was in good faith. Maybe he needs his money and arrears to move on, and Raila can do without a heckler the caliber of MM in his die or do election year. Therefore it could have been meant as a truce which was like drinking a cup of poison [ If you remember the phrase of Ruhollah Khomeini signing peace with Saddam Hussein to end the Iran-Iraq war]. Only there are other actors on the stage, and they have their game plan too! And it is these shadowy actors --we all know and don't say-- who are actually directing the Raila-Miguna show. In other words the two gladiators are being manipulated.

It takes courage to stand up for what he believes in and never to cow to submission. The public must be told the truth at all times. Raila must explain what is taking place in his office. Without explanation, these incidences of injustice against Miguna will stick with him and soil his reputation, if he has any still.

It takes courage to stand up for what you believe in and never to be cowed to submission. The public must be told the truth at all times. Raila must explain what is taking place in his office. Without explanation, these incidences of injustice against Miguna will stick with him and soil his reputation, if he has any still. Miguna only believes in his stomach as several of us have stated here numerously. How else do you reconcile the fact he was willing and ready to go back and work for a man he has variously described as a "political conman" This is just pure common sense!

Your arguments are not sustainable.
1. Everyone seeks employment and so forth because of stomach. One hardly works for free! Employement is rewarded with remuneration.
2. The fact the Miguna called Raila a 'conman' ( not sure if it was political) does not negate the fact Raila was the one who called him for a meeting to discuss his reinstatement. If Raila wanted to reinstate Miguna despite what he said about Raila, where the two were to work together, I see no reason why it should bother a non-entity who will not work with either of them.
3. Common sense may not be that common, after all, as you seem to have missed it by a mile!
