RAILA ODINGA PRESIDENTIAL CAMPAIGN SECRETARIAT
Press Release: Setting the ODM Nomination Debate Straight 1. We wish to put the record straight regarding the sponsored false perception that the Prime Minister, Rt. Hon. Raila A. Odinga, is frustrating Hon. Wycliffe Musalia Mudavadi’s ambition to run for the office of President of the Republic of Kenya on the ODM ticket. 2. Quite to the contrary, the Prime Minister is a democrat who recognizes everyone’s right to exercise and enjoy his or her democratic rights and freedoms as laid out by the law. To this end, Hon. Mudavadi is quite in order to seek to be the ODM Presidential flag bearer. 3. To accommodate Hon. Mudavadi’s Presidential ambitions, the Prime Minister has been supportive of the thought that the party’s Constitution and election regulations can be varied, to make room for a broad based nomination exercise for the Presidential flagship. This would open up space not just for Hon. Mudavadi to compete for this ticket, but for any other qualified party member, too. 4. Hon. Mudavadi has also been pushing for a county-based nomination exercise as opposed to nomination by a centralized Delegates’ Conference as is laid out in the Party’s regulations. Once again, the Prime Minister is open to such an arrangement, provided that this is the wish of the majority in the party. 5. While the Prime Minister remains open to the possibility of the Party’s Constitution and regulations being changed to make it easy for Hon. Mudavadi to realize his Presidential ambitions, he also remains awake to the fact that this needs to be done in orderly fashion and according to the law. 6. Article 20 of the Political Parties Act requires that notice be given to the Registrar of Political Parties for intent to amend the Constitution. ODM has done this, taking note too that to wait for amendment of the Constitution before presenting the registration of the documents to the Registrar of Political Parties would lead to its deregistration, owing to both constitutional processes and timelines within the party and those within the Parties’ Act. The registrar is supposed to cause a notice of intent to amend the constitution to be published in the Kenya Gazette within 14 days of receipt of the notice. Thereafter, a period of thirty days must lapse (Article 20. d of the Act), during which the party shall receive proposals from the public. The amendment process will then proceed, as laid out in Party instruments. Surely, those who initiated the amendment process that is now on going are not strangers to these legal requirements?7. We restate that amendment of a Party’s Constitution needs to be done in a sober, free and democratic manner. It should not be done under threats and intimidation. Intimidating people is itself of course the highest manifestation of dictatorship. Let Kenyans judge for themselves who is being high handed and dictatorial in this matter. It should not be done with a gun placed against people’s heads as is being done. 8. The Prime Minister has continued to exercise Stately restraint amidst orchestrated demonization of his person and that of the ODM. He will continue to comport himself with composure, even as the relevant Party organs continue to work towards placing before the National Delegates Conference for consideration, the prayers that Hon. Mudavadi has made. 9. Meanwhile, the Party has to comply with Political Party registration requirements as laid out in the Political Parties Act (2011). This exercise can only be delayed at the Party’s risk of deregistration, in which case there will be no party ticket to compete for. We are satisfied that ODM has issued notice to the Registrar of Political Parties, with regard to the anticipated alteration of the Party’s nomination rules. Nobody, therefore, has any cause for apprehension regarding his Presidential hopes within ODM. 10. We are aware of external forces that have been at work since sometime last year, seeking to infiltrate and rock the Party from within. These forces remain adamantly at work. We know about their recent activities and meetings in Nairobi and elsewhere. We would caution members of ODM not to fall victim to short-term attraction from these forces. ODM remains the only democratic political party in Kenya. It is the only party whose Presidential ticket is being contested for democratically. Signed: Barrack O. The Orange Democratic Party wishes to put the record straight regarding statements that have been issued to the press following the submission of the Party’s constitution to the Registrar of Political Parties in line with the Constitution of Kenya. The ODM held its National Executive Committee (NEC) on April 4, 2012 and after lengthy but fruitful deliberations, it was resolved that the party would prioritize its compliance with Section 51 (1) (a) of the Political Party’s Act which requires all parties to be compliant within 180 days with effect from 1st November, 2011, failure to which the party risked deregistration. It was on this understanding that the Party submitted its application for registration to the Registrar of Political Parties on April 10. Acting on the resolution of NEC, ODM also gave the Registrar of Political Parties notice of the party’s intention, as required by section 20 (1) of the Political Parties Act, to amend Article 6.2.1 of ODM constitution in accordance to which the Party Leader becomes the automatic Party's Presidential candidate. Section 20 of Political Party's Act requires parties to seek registration first before they become competent to amend their constitution or rules. This is so not only because the Party must issue a notice of proposed amendment, the substance of the proposed amendment must also be published in the daily newspapers for public consultations before the desired changes can be effected. Apart from the demands of the law, there is also the prescription of ODM constitution which lays the internal procedure of amending any provision of the constitution. Only the Party's NDC which is the apex organ of the Party has the authority to change the constitution. Article 7.3.3 of ODM constitution provides for a notice period of at least 21 days to hold a competent NDC. So, even assuming that a notice was sent by 10th April, it would take up to May 2012 to get it right with the constitution. Where then would there be the opportunity to comply with Party registration if the Party were to wait till May? One therefore must wonder how a section of ODM members entertained the idea that the Party could competently make amendments to its constitution without complying with sections 20 and 51 of the Act. There have been sustained and deliberate attempts to misrepresent the Party’s position on its nomination procedure, even when the Party has accommodated views of some of its members who would want nomination conducted through a county based electoral college. All efforts by those hell bent on destroying the party will be thwarted and their perpetrators rejected. As ODM we know who our real enemies are; and they are outside the party. I like the maturity, sincerity and honesty expressed in these statements. That is exactly what ODM needs. It is inconceivable that Mudavadi and Kabatesi, his Personal Secretary, who issues statements for him are unaware of the legal process of handling issues of amendments and registration deadlines.
So obviously they are making things up and pretending to be acting in the interests of ODM members. They are NOT. They are acting in the interests of Musalia Mudavadi and his "new" found friends. Let them go peacefully to the new bliss.
I don't want to say good riddance but it is close. When the light signs on everything Kenyans will see the truth and I doubt it will help Mudavadi much but that is for later. But I will say this much. No proxy will win the presidency of Kenya. It is too late for that trickery. You come in as a proxy for dubious characters you will be doomed. Take that to the nearest bank branch. You either come to in and hope to run Kenya for Kenyans but never ever think you can come to run Kenya for the benefit of a few individuals and get anywhere. Kenyans are not that stupid. Not this time. Not now.
Now if only someone can tell Jakoyo Midiwo and his friends to shut up about threats he issued yesterday about addressing the issue at the coming funeral of Mrs. Onyango, a NCIC commissioner who passed away recently. Raila and the ODM must keep away from Luo funeral politics that the likes of Midiwo thrive in.
Let the Raila Secretariat and the party organs address party issues in a mature sober way like we have seen here and let Jakoyo and his friends drink merrily and dance at funerals all they want without reducing ODM to a party of funerals.
Those Luo M.Ps need to be reigned on by Raila himself. Let them address issues in their constituencies and leave party affairs to officials of the party and also let Raila secretariat handle his campaign. I hope that is not too much to ask from them and from Raila himself.

If this secretariate is what was described as 'will mirror the Chicago machine', then we shall wait for along long time and will be disappointed in the long run.
As you will readily agree (if you can be honest), these statements make nonsense of the intelligence of Kenyans. I honestly did not expect such white lies from Raila's team. Such should be left to the likes of TIP, not ODM. I cant wait for Kabatesi to rip them apart. So far, he has shown that he is a very effective communicator and has the brains of a spokesperson that any presidential candidate would love to have.
ODM 'discovered' the offending clauses in their katiba through Orengo (so we have been told) more than one month ago and promised to work on it. What became of that promise almost two months down the line?
The last time the NEC met, Nyong'o told everyone that the legal committee would be meeting over the Easter weekend to deal with those issues. To the surprise of many, only Mudavadi's team showed up, all those allied to Raila never showed up. To make matters worse, the meeting venue was not even ready. What a coincidence?
While still mulling over this, Nyong'o rushed the papers to the registrar with the old constitution so as to give credence to their argument that, the political party's act will have to be adhered to. As we speak, KANU will be meeting in a day to change and ratify her katiba. Do the PPA rules only apply to ODM?
ODM is playing with fire. They should ask themselves why this Mudavadi issue has refused to go away. They have tried everything including threatening the life of their own party leader, but Mudavadi's issue keeps coming back at the center of our political discourse and right in their faces. This is an idea whose time has come, not even Raila's life is going to kill it. Interestingly, Mudavadi himself is not even talking that much, yet the party is on the defensive all the time.
The biggest mistake Raila did is to have people who have personal differences with Mudavadi at the heart of his campaign. We all know that Muluka has an axe to grind with Mudavadi since the fiasco that were the nominations of '07. Such people will do everything to drive Mudavadi away thinking that it is their payback time. Well, I have news for them, the way this thing is going, ODM is in a bind. Mudavadi will take a walk, and that will be the last nail in the ODM coffin.

Why not just do it yourself? Let's hear your arguments. We are all ears. I don't know which part of the process of amending party constitutions you do not understand including timelines and requirements of the Political Parties' Act. Why would ODM come up with rushed phony amendments that could end up getting the party deregistered just to appease one individual? Which party would Mudavadi be running for if ODM is deregistered? Were you guys not the ones screaming loudly for months that the issue for ODM was the demand by Mudavadi for county based nomination elections? Do you know how many posts you had on that issue? May be more than a hundred. That got resolved when ODM leadership indicated they would even go farther and have the nomination elections go to the ward level. All of a sudden since the county stuff was dead Mudavadi suddenly discovers that there are certain clauses in the ODM Katiba that could be harmful to his bid. Never mind that the same Mudavadi unless he was deaf and blind during ODM NEC deliberations was part of the team that ratified those amendments. Mudavadi was shocked to find out about these clauses! Really? How phony is that? The Secretariat has made it very clear that the process for amending the party constitutions is already underway including a formal request to do so filed with the Registrar of Parties. Within 14 days the party will have the mandate to go ahead and initiate the amendments which must be done legally. Once that process is complete the party will file the amendments with Political Parties Registrar as required by law. What is so difficult to comprehend about that? The nomination is not being done tomorrow for crying out loud. About Muluka being not friendly to Mudavadi, you may need to learn a little about internal party politics and nomination. I don't have the time to go through all that but let me give you a very simple example. In the last US Democratic Party nomination process between the current president Barack Obama and Hillary Clinton there were so many key strategists in the Hillary camp who thought Barack Obama was a joke and made no bones about it. In the Obama camp there also those who couldn't stand Ms Clinton. They thought she was a spoiled brat with a sense of entitlement. The most obvious example is Peter Carville who just hated Obama and thought he was a nuisance rather than a serious contender. Peter Carville is a legendary political strategist who also worked with Bill Clinton. He was a key member of the Hillary Clinton team. It was obvious that should Obama get the ticket Carville would not be in his team. That is fair enough. Did that stop Hillary Clinton from joining the Obama team after she lost the nomination? Of course not. That is mature politics not based on emotional tantrums. I could go on and on. Bottom line is that the ODM constitution will be amended if and if Mudavadi wants to contest for the presidential nomination as a member of ODM he is welcome. If he is not interested others will. I see no problem with that. Tuende kazi. At the beginning of this debate months ago I was clear that a fair contest for the ODM ticket was the best thing that could happen to ODM. I maintained that any tricks to muddy the waters and hinder Mudavadi would greatly harm the party. I still stand by those sentiments. What is now emerging is that Mudavadi has just been going through the motions and looking for excuses to play games with the party. That in my opinion will be very harmful to Mudavadi himself. Kenyans do not like politicians who get used like cleaning rags. Bad or good they like politicians who stand by their principles. Why do you think Kalonzo Musyoka is all but dead politically? Was he not supposed to be next best thing since sliced bread destined to State House? What happened to him?

Perhaps we should ask the IDPs who are still languishing in camps after all these years after being kicked out. Another rainy season is here and no one seems to care! Mudavadi is also a goner as a far as being in ODM is concerned while the likes of Joe Nyaga and others have been silenced. This once great party now risks being turned into yet another tribal outfit. Perhaps the noisy lot of Midiwo, Orengo, Nyong'o and Kajwang' should put as much energy in uplifting their people from poverty as they do in whining and scare mongering. Sadly the ODM juggernaut has outlived it's usefulness. The empty shell smoking in a corner seems to have been taken over by it's owners. A real shame I must say.

mwalimumkuuWhat's in these statements are things I already revealed to Jukwaa much earlier. I at the same gave my opinion which is that Mudavadi is not worthy of Raila's running mate position, let alone running for the presidency of this country. Mudavadi is a fraud and indecisive. The man does not have b*lls and I now think the DPM post handed to him was a notch or two higher than he deserved. It is pathetic that one Justus Kizito is the ally I keep hearing Roya Media harping about. Even Khaniri has now grown cold feet. At least your beloved Ruto is a fraud and decisive, fatally decisive. Ruto is also rich enough to keep hiring broke-tax-evading MPs to attend his rallies. Basically I have no business discussing ODM party matters with a URP sympathiser.

Mwalimumkuu, You are talking as if Mudavadi is the glue that holds ODM together. Please dream on. The fact of that matter is that Raila and ODMs popularity has nothing to do with his association with Mudavadi or any other person for that matter. Raila is a man of the people who has a way of communicating with the Kenyan masses like no other. You might even hate Raila but his ability to keep afloat and stay ahead of his competitors is well documented. Future generations will marvel when the read the history of the man. I’m afraid the same cannot be said of Mudavadi.
When you think that the man is down and out, he rises like a colossus and vanquishes his political enemies. If I were Mudavadi I would stick with Raila, at least there would be a chance of becoming a VP. As things stand the man is bound to lose it all. Take that to the National Bank of Kenya.
Last but not least, I don’t see any party that is even close to ODM in terms of popularity. To popularize a party takes ages. If Mudavadi thinks that he is going rejuvenate Ford Kenya and bring it to the level of ODM or even the pathetic PANU then he has another thing coming.
Personally, I always liked Mudavadi but now that he has quit my party of choice I must bid him good bye and wish him well
This guy is Moi like. He pretends to be humble but can turn out to be the worst dictator Kenya has ever known. The high handedness by which he is attempting to handle the party into accepting his unreasonable demands smacks of pure arrogance and dictatorial tendencies.
At the end of the day, it’s the people who will decide whom to elect as president and currently the opinion polls all point to Raila Amollo Odinga and not any other pretender to the throne. This must be sad news to you Mwalimumkuu.

I have already raised my own questions up there, which you have refused to address yourself to. Notably: i). How long has ODM known that it has their own section 2A that needs amending? Did they learn about it on Tuesday this week? Of course not, as much as I can remember, this is an issue that has been with us for close to 2 months now. Yet, nothing is being done about it. ii). The last time the committee was to meet to look at this, only Mudavadi group showed up. Raila group was nowhere to be seen. The supposed meeting venue was not even accessible by the Musalia group. How else can we interpret this? iii). As if not enough, they rushed to deposit the dictatorial constitution with the registrar knowing very well that once it becomes the property of the registrar, it becomes even harder to change these clauses. What does that tell you? iv). As you must be aware via the other thread on Uhuru's statement, KANU is meeting in a day to change her constitution and ratify it, before submitting those instruments to the registrar, is it in breach of the PPA rules as ODM wants us to believe or do these rules only apply to ODM? I don't know which part of the process of amending party constitutions you do not understand including timelines and requirements of the Political Parties' Act.

I thought they were genuine in their effort to align their retrogressive party constitution to the new way of doing things as per the political party's act Were you guys not the ones screaming loudly for months that the issue for ODM was the demand by Mudavadi for county based nomination elections? When was this resolved? I must have missed it. The last time I checked, this were some of the sticky issues that are still waiting addressing and were to form part of the amendments which Raila group keeps running away from. Mudavadi himself would be in a better position to address this. But from where I sit, such an argument is nonsensical and has been bypassed by time. Everyone agrees it was a grave mistake to have such a clause in a party like ODM's constitution in the first place. If anything, it has already served its purpose of kicking Ruto out. Not unless they are keen on using on Mudavadi too. The Secretariat has made it very clear that the process for amending the party constitutions is already underway including a formal request to do so filed with the Registrar of Parties. Within 14 days the party will have the mandate to go ahead and initiate the amendments which must be done legally. Once that process is complete the party will file the amendments with Political Parties Registrar as required by law. What is so difficult to comprehend about that? What is hard to understand is, why expose yourselves to such a long winded procedure when you can do this thing in one afternoon and get done over with if genuine in your course? About Muluka being not friendly to Mudavadi, you may need to learn a little about internal party politics and nomination. |
This should be addressed to Muluka, he must know that he is now running a party campaign and not 'a Mudavadi must learn a lesson' kind of thing. What is now emerging is that Mudavadi has just been going through the motions and looking for excuses to play games with the party. That in my opinion will be very harmful to Mudavadi himself. Kenyans do not like politicians who get used like cleaning rags. Bad or good they like politicians who stand by their principles. |
I am yet to see anything that demonstrates that Mudavadi is shifting goalposts. I have hard him articulate one thing, that the katiba needs to be changed to allow nominations at the grassroots and allow competition for presidential ticket. Whats new in this? Why do you think Kalonzo Musyoka is all but dead politically? Was he not supposed to be next best thing since sliced bread destined to State House? What happened to him? |
The last time I checked, Kalonzo was the vice-president of the republic. If that is what is meant by 'dead politically', I will take it any time.

Mwalimumkuu,You are talking as if Mudavadi is the glue that holds ODM together. Please dream on. The fact of that matter is that Raila and ODMs popularity has nothing to do with his association with Mudavadi or any other person for that matter. Raila is a man of the people who has a way of communicating with the Kenyan masses like no other. You might even hate Raila but his ability to keep afloat and stay ahead of his competitors is well documented. Future generations will marvel when the read the history of the man. I’m afraid the same cannot be said of Mudavadi. When you think that the man is down and out, he rises like a colossus and vanquishes his political enemies. If I were Mudavadi I would stick with Raila, at least there would be a chance of becoming a VP. As things stand the man is bound to lose it all. Take that to the National Bank of Kenya. Last but not least, I don’t see any party that is even close to ODM in terms of popularity. To popularize a party takes ages. If Mudavadi thinks that he is going rejuvenate Ford Kenya and bring it to the level of ODM or even the pathetic PANU then he has another thing coming. Personally, I always liked Mudavadi but now that he has quit my party of choice I must bid him good bye and wish him well This guy is Moi like. He pretends to be humble but can turn out to be the worst dictator Kenya has ever known. The high handedness by which he is attempting to handle the party into accepting his unreasonable demands smacks of pure arrogance and dictatorial tendencies. At the end of the day, it’s the people who will decide whom to elect as president and currently the opinion polls all point to Raila Amollo Odinga and not any other pretender to the throne. All I am saying is, if we must have a respectable campaign, then we must strive to remain truthful or at least be perceived to be truthful. As it is, Mudavadi has run away with this issue. The party is on the defensive and in the process, they are coming out worse. As they say, you can cheat some people some time but not all the people all the time. This is a moment of truth for ODM. Instead of addressing themselves to the issues at hand, the secreteriate has opted to lie to the people. And as you can see, the lies are so open that even my own form two here at mukibis can read through them. Tel them to be a little clever, this is not 2007. Mudavadi has been bold enough to remind them this.

Such should be left to the likes of TIP, not ODM. I cant wait for Kabatesi to rip them apart. But in as much as you raise the perception you will be happy to see ODM dead [or is it Raila finished politically], there are issues you raise that are highly relevant. The party secretariat under Nyong'o has been KANU-esq. And I speak from experience, like long ago when folks like me were busy in Nyanza trying to organize a local primary election so that truly popular candidates could emerge, only for some candidates to appear with signed certificates from Orange house! direct nomination!
All my eastlands-living folks in Nairobi are still ODM damu, but when I asked them how ODM lost Makadara, I recognized what had happened with me in Nyanza. The majority youth did not want Ndolo, but that is the man the party imposed. The ODM supporters refused, joined the protest candidate Sonko or just stayed at home. That is how ODM lost Makadara. Orange House thought they could impose Ndolo. the youth said No.
And these lessons have not been learnt well. And that is the achilles heel of ODM. There is a fear of democracy at the heart of the party. [or is it a lingering attachment to the politics of patronage and nepotism?]

Mudavadi's departure is probably a good thing for Raila. It will allow Raila to pick a significant running mate in terms of votes. Perhaps from eastern Kenya.
Mudavadi was putting a gun over everybody's head: in his incompetence, he started a campaign without reading the party's constitution. Now he is going nowhere.

I will be very interested in the grass-roots nomination process that will be used in electing presidential candidates in Mudavadi's new party.
In ODM Mudavadi was going to get his chance - but he clearly was not interested.

Phil, The biggest mistake Raila did is to have people who have personal differences with Mudavadi at the heart of his campaign. We all know that Muluka has an axe to grind with Mudavadi since the fiasco that were the nominations of '07. Such people will do everything to drive Mudavadi away thinking that it is their payback time. Well, I have news for them, the way this thing is going, ODM is in a bind. Mudavadi will take a walk, and that will be the last nail in the ODM coffin. Mwalimumkuu, It is true that Muluka has personal differences with Mudavadi. Not only does he have an axe to grind with Mudavadi but he also has some personal beef with kabatesi. That is why Muluka’s appointment to thIS high profile position in the PM’s campaign secretariat is not only a master stroke of GENIOUS but it is also REAL POLITIK.
