Police reforms will never amount to anything if there is no thorough shakeup at the top. Concerns by IPOA, the PM and others need to be addressed with the seriousness they deserve. The business of whitewashing the concerns others raise remain in the domain of those who never accepted the overwhelming rejection by Kenyans of the old order when they voted in the new constitution: A desperate desire for a new order in order to preserve or rescue what could be rescued of the Kenyan dream. If police reforms fail to take off, then the rot that has led to issues like the failure to contain the Tana river and Baragoi massacres and rising insecurity will eventually begin chipping at any gains that may have been made in the judiciary so far.

Jakaswanga I am always appalled by institutions set up under the law that refuse to exercise their mandate properly. The Oversight Body was aware of the advertising for the various posts, the shortlisting and the interviewing of the applicants. It had this information that it claims makes the appointees ineligible for appointment. Me thinks they are are trying to lock the paddock after the horse has already bolted. The Police Service Commission is a creature of the constitution with a clear mandate for appointment and discipline of police officers. Based on the information that it had in its possession the Commission fulfilled its duty and passed on the names for appointment. Unless the oversight body wants to usurp the appointing role of the commission, I think they should shut up! What I expect them to do is exercise their functions as per Section 6 of the IPOA Act as well as the powers given in Section 7. None of these powers allow it to usurp the roles of the commission, but they are within their rights to receive complaints from the public alleging abuse of office by serving officers. The Law is very clear on how they go about this and that they do on conclusion of their investigations. I would like to say that I do not think IPOA investigated anything as that should have included interviewing both Muhoro and Kaindi who they seem to have issues with and if any crime had been committed, then the authority would have recommended to the DPP for their prosecution or reported to the Commission for disciplinary action to be taken as provided for in Section 29 of the IPOA act. Which brings me to the issue of Waiganjo and the confusion of the institutions that we set up. My reading of the Police Service Commission Act as well as the IPOA, makes me believe that it should have been the role of IPOA to conduct the investigation on Waiganjo.....but then when the left had has no idea what the right hand is doing shit happens as they say!

Both Raila and that body did not have good legal advice, to translate their reservations into a language which the CJ could understand! çase!
Apparently no 1 and 2 do not, in the eyes of CJ Mutunga, constitute a case or cases questioning the propriety of etc etc

My annoyance lies with the media whose intellectual laziness perpetuates the misunderstanding in this case. A simple quotation of the law would have quickly killed this story and allowed the swearing in of the 3.
