Good essay. Uhuru did NOT win. He connived with the IEBC to steal the elections. He is a conniving election thief. Now, let us be clear, he is not president. But he is stealing taxpayers hard earned cash, posing as president anyway. He is spending our money campaigning for Jubilee for the second round. A round which he will loose because of his tribal basis for politics, his criminal ICC record and his general intellectual inadequacy to run a complex country. We need a president who will actually be in charge. Not one who will be manipulated and control by a faceless cabal of power-brokers. Raila Odinga won. Fair and square. But the forces of impunity who do NOT want to see a reformed working government have subverted democracy. The idea that taps of corruption and sleaze might be shut rankles some people so much. Let us be clear again, public resources should be sacrosanct. The people who are allowing Uhuru to use public resources for partisan political activity will be asked to refund that money when CORD takes over. This story has found a life of its own. Last week the story was, numbers were padded to give Uhuru the 50% +1. This week, we are told that Raila in fact won the polls and beat his closest rival by almost 1 million votes. But somehow the dark forces conspired again and stole victory from the anti-establishment ,progressive prime minnister of Kenya. The contradictions are mind boggling! On one hand, IEBC is deeply partisan but yet, as a whole, connived and stole elections, massively, for the jubilee candidate. I see the makings of 2007 post-election violence. Even if we hold fresh elections, the 'dark forces' will still be with us unless RAO wins. These wild claims are a smokescreen for a candidate who is not ready to accept defeat and is preparing his foot soldiers to cause anarchy. You will fail! Kenya must move on! Well said Dubois and Horth. Dubois, I agree with you that there does seem to be a "nusu mkate" end game at play by Raila. Raise the current and unfounded election thievery propaganda to a fever pitch level so that these unfounded claims all over the place become "truths". In the process completely obliterate IEBC's credibility so that should there be a run-off then IEBC can't be its overseer; a new referee has to be constituted. Moreover, the voter registration has to be redone, because this exercise too seems to be disputed by CORD. All of this requiring months and months to put in place with nusu mkate format between Jubilee and CORD in the meantime being the "only fit or just option for Kenya's governance". Election is about numbers and who gets the majority, not about the feelings of a certain group who believe that there is ONLY ONE human being in the whole country that can be Kenya's leader. Folks need to wake up and realize that it's possible that a majority of the voting populace don't share these same sentiments with them! We are tired of the ineffective system of a coalition government and also tired of politics. We wish and need to move on.

rr,I, unlike you, am beholden to no politician. I probably dislike Uhuruto more than you do and I did not vote for them. But the manner in which RAO has been running around leaves a lot to be desired, which I’m more than happy to point out. Let me try and explain; CORD has, since Uhuru was declared president, been constantly yelling that the elections were rigged, the voter register tampered with, RAO’s vote decreased while Uhuru’s increased. Even the articles OO linked to in his blog talk of “funny” numbers and everyone saying something probably went wrong at the IEBC. But the hard data is missing from all these allegations. Data which would be next to impossible to miss when one factors just how many thousands of people were involved in the elections. Taking the electronic voter tallying out of the equation (I mean, it was only to be used for provisional results ), leaves us with the manual tallying as the only way Uhruto could have rigged the elections. My confusion arises from this; if the manual tally was indeed manipulated, just how many people would have had to be involved or been in a position to notice? For example, if the numbers of one polling station were increased/decreased, for this change to make its way to Bomas would have meant that the numbers would have had to pass through many hands (polling station > constituency > county > Bomas). Each and every one of these stops a potential leak for any rigging attempt, exactly as we saw in 2007. On the other hand, if the numbers were increased/decreased only at Bomas, the same thing would happen except in reverse. All the hands through which the true numbers had passed would know that the numbers used in the final tally were incorrect, starting from the county tallying centers going down to the polling stations. Again, involving very many people. CORD agent in polling station A sees 100 being submitted upwards yet all CORD agents from the constituency through to Bomas sees 60 being tallied. Even if the CORD agents at Bomas didn’t see the wrong number being tallied (having been kicked out), they had their own rough sets of numbers to work from, based on their agents at almost each and every polling station outside of the IEBC control. Now this is where it get worse for RAO. You see, for the IEBC to have massively rigged the elections to the tune of 1.5m votes as stated by RAO (roughly 32’000 votes either being increased or decreased per county ….in reality, over 100’000 votes in major vote-rich counties), the differences would have had to have been in the order of hundreds of thousands between what left the county tallying center and what was declared at Bomas. A difference so huge it would be impossible to miss and petition. Yet it hasn’t. So it’s very curious that RAO’s petition only queries a couple of constituency figures totaling less than 6’000 votes. The probability of CORD (and indeed, everybody along the multiple chains) missing all that is astronomical. You can continue believing that RAO's 1.5m votes were stolen by UhuHoudini. We need to understand where Raila is coming from. He looks at his core support base and realizes how badly he has failed them (I am sure you've all read PODP's and Abdulmote's essays on this). The hope his core support base had in him and their dreams are all coming to nothing. The man is confused, he is at war with himself. He has no answers to the many questions that his people will soon start asking. That is why he would rather hung in there with the hope that something will come out of this confusion, maybe another power sharing offer? That is why new narratives such as 'we want our baby', 'I won the elections', 'did Uhuru win?' etc are being manufactured.
The man is trying too hard to run away from his own shadow, his failings as a leader. He promised too much, he delivered zero. That is a very bad situation to find oneself in. I fear for the man; at this rate, he could even contemplate suicide. It is never good to have a conscience that is at war with oneself, very dangerous.

The IEBC has now released its cleaned registration data but said that though it had forwarded names of registered voters to the Registration and Immigration Bureaus for verification of detected errors the two departments have not reported back.A cleaned data seen by the Nation now indicates that the total number of voters has gone up by 15,146 from 14,337,399 reported by the commission on December 18 when the voter registration closed to 14,352,545 according to official data released on Sunday.“We are going to have the principle register and an exceptional register listing voters who for one reason or the other registered but their biometrics were not well captured,” Mr Oswago said. He said that voters whose details are found in the principle register will be allowed to vote saying that blocking them from doing so would be punitive and uncalled for. “Those whose names are in the exceptional registers would be allowed to vote. If you are not appearing on the register for one reason or the other but you registered we cannot stop you because the mistake may have been ours,” Mr Oswago said. [/b] He said that those allowed to vote would still have their biometric details tracked because they are available but the immediate failure to identify them may be due to repairable errors. “We are also having another register containing names of individuals who double registered with their pictures indicating where they did it. This people will be handed over to the police as soon as they appear at the poling centres,” he said. But TNA Chairman Mr Johnson Sakaja said the party would not allow the use of black books or green books.
“If someone’s details cannot be found in the BVR data they should not be allowed to vote. We are not going to allow use of manual registers to by-pass the electronic records,” he noted.
He said that the manual entries can be used by electoral fraudsters to inflate numbers by playing with the available data and voting for absentee voters through conspiracies.
Said Mr Sakaja: “Matching of biometric data cannot happen manually. If someone’s details cannot be found the best thing is to send him or her away. "The European Union Election Observation Mission is closely following the petitions filed after the 4 March General Elections. Impartial and expeditious handling of petitions, in a peaceful atmosphere, is an important part of every democratic electoral process. To observe this important phase, EU election observers will stay in Kenya until the Supreme Court delivers its rulings," said an EU press release yesterday. The press release said that Chief Observer Alojz Peterle will publicly present the observer mission’s final assessment on the overall credibility of the elections after the tallying and the petitions are over. However the internal report indicates that grave reservations have now superseded the EU's initially positive public comments. The EU observers highlighted the failure of electronic voter identification "resulting in an inconsistent method of verifying voters' identity." They referred to the breakdown of the electronic transmission system and the multiplying by a factor of eight of rejected ballots. "Naturally this did nothing to enhance confidence in an already discredited results transmission system," wrote the observers. "Although there have been allegations of hacking and other sabotage, it is equally realistic that these systems could not be implemented because of the limited timeframe in which hardware was received, configured and deployed, alongside incomplete training for polling staff," says the report. The observers said "as was the case in 2007, there were numerous problems with the tallying of election results." "Neither election observers nor party agents had adequate access to the processes in the constituency, county and national tallying centres. Small but numerous mathematical inconsistencies could have had significant impact, given the small number of votes by which Kenyatta passed the 50 percent threshold. So far presidential results have only been disaggregated down to the constituency level," said the observers. "Processing of official election results, based on tallying the results on polling station forms,.... lacked transparency at every stage," said the observers. They said party agents and observers were not allowed to see how tallying was carried out, including in the National Tallying Centre at Bomas of Kenya. "Party agents were able to attend the tallying of 16 constituency results forms before being expelled from the NTC for disrupting the process." "EU EOM observers reported that tallied results at lower levels were often not signed by party agents, and in some instances observers noted mathematical inconsistencies," said the report. The observers pointed out that the Interim Election and Boundaries Commission progressively announced the numbers of valid votes, rejected votes, and all votes cast. "Throughout the four days in which these figures were announced, these figures did not add up," the report said. "The processing of official results was mired in obscurity, controversy and relatively small but numerous mathematical inconsistencies." The observers criticised the media for not broadcasting live press conferences saying this "restricted the access of the public to real and timely information about political developments." The observers commended the IEBC for having gender balance among its staff but observed that much less than the stipulated one-third of women were elected to office. "The performance of the police has been evaluated in general as good," said the EU observers and said "there were no major incidences of human rights violations during the election period." The Star reporting, www.the-star.co.ke/news/article-112920/election-not-transparent-eu-observers, which has been followed by other media is accurate and is based on having obtained an advance copy of the report which for obvious reasons is not being released by the EU yet. Unless one is clueless as to how these things are done, a report like this is leaked and thus provides a perfect opportunity to deny its accuracy or even existence as has been done here but the intent is there all along to have it out there. Very normal, especially in the West. In other words, it was the intention of the EU observers to have the content of the report made public before they make it public their denial is routine and expected.

Having nothing to do last night and TV being boring, I thought I could entertain my self with the two volumes of the Raila petition.
The Janet Ongera affidavit has seems to excite cord people apart from being a muddle in the attachment actually shows no wrong. I took a couple of constituencies where she claimed the figures in Form 36 and the summary do not tally and when I checked there actually was no problem as the figures for the constituency from form 34 to 36 and summary actually reconciled. Unfortunately she is stuck with an old electoral register and even with that she seems to read the figures wrong in the various columns!

Kamale, I have elected to reserve my judgement until the SC sifts through the case & separates the wheat from the chaff. As the old adage goes, Janet Ongera can't see the wood for the trees. Trusting anything a party apparatchik like Janet has to say would be premature at this stage of the game. Let's give the SC their space & see if they can give a fair & unbiased ruling. As is always my case, I'm already mentally prepared to be disappointed by the SC, so that it's not the end of the world if their judgment doesn't roll my way, as has been the case for many a Jukwaaist since the election results were announced by the IEBC. Life must go on & even election 2013 will end.....
