KPODP First I think you overrate the Kenyan MP that they can intimidate Bensouda. They do not need to deal with her and all they needed do was make their case to the ASP. Bensouda is not ASP! As to the witnesses being intimidated, threatened and not being coached, that is a position you are entitled to just as the Ruto team is entitled to conclude they were coached and being forced to appear in court and recanting their statements on oath is an indication of truth. I keep hearing that African politicians and even Kenyan MPs do not represent the wishes of Kenyans. SO what is the point of electing them if you do not want them to represent your wishes. You get what you pay for! JUST HOW have the issue of more than 1300 dead not been addressed? The matter is being actively canvassed in the ICC hearing and those hearings must be for the victims!No one wants the court not to hear the matter that would bring justice for the victims. But can you honestly answer if they get justice when the wrong people are convicted (Note the Ruto defence argue his is innocent) or even when the accused is acquitted for a sloppy job by the prosecution? The way the case has gone, it is increasingly clear that OTP has the wrong people on the dock and victims actually told Bensouda as much when she was last in Kenya. A misconception has been created that Kenya wants rule 68 reversed and there is a belief that this will kill the Ruto case. Kenyan politicians flocked to the chief prosecutor’s door last week to try to intimidate her as they did the witnesses. This should be an indication to ASP of the truth about the so-called recanted testimony. The witnesses, who have now been termed hostile, were clearly intimidated and threatened, not coached. They withdrew their testimony for fear of being victimised because their evidence was against those who are now in the seat of power. African politicians at The Hague meeting do not represent the people of Africa. The Kenyan politicians who attended the ASP meeting did not represent the wishes of Kenyans. The African Union has not addressed the issues of the more than 1,300 innocent Kenyans who were killed in cold blood during the post-election violence and the more than 6,500 who were uprooted from their homes and are now living in camps in Kenya and neighbouring Uganda. Most governments do this to terrorists and people they perceive as enemies of the state. This email hack (for that is what I think it is) was intended to open up a conversation on how these 'hactivists' behave, and lends credence to the usual accusations made on the likes of Kiai on their role of witness procurement for financial gain. What is really sad is that these guys will readily "sell their country" (as a mzee told me last night) for 7 pieces of silver and they are actually worse than the Kanyaris of this world who fleece people for monetary gain! my concern primarily is people died, we are told above 1,000 and the saddest thing is our own police, public prosecution etc. have not done anything to bring to book even the petty offenders i.e. looters followed by felons i.e. rapists and lastly killers of those 1,000+ Kenyans. it is mainly when rule of law is seen to work that the NGO activists will be out of work as they will have nothing to report. back to the red high light which to me is of tertiary importance. history has many lessons for those who may not wish to repeat the follies of tester year. Exactly Kamale. Anyone following the noise raised about Waiguru, will tell you, it has nothing to do with corruption in her docket and/or her involvement in the said corruption. Waiguru's sins have everything to do with the NYS projects mainly and other programs such as Huduma within the ministry, and all that they intended to achieve (either by design or default) heading into 2017. In my own view, Waiguru's major undoing was her effort to be seen as the face of the programs. You will remember that as soon as NYS took shape and made major changes in Kibera and later Mathare, and Kisumu, Raila sounded very uneasy. He started by visiting Kibera and attempting to take credit for the work that was going on by claiming that it was a continuation of the coalition government's plan. He soon realized that this kind of line was not selling. Meanwhile, the project was becoming bigger and very attractive, moreso to MPs in opposition strongholds. He decided to fight the program by labeling it a Jubilee militia to be used at rigging 2017 elections. This line, like the earlier one did not sale either. The possibility that junior staff had taken advantage of procurement system to steal money in the ministry was thus godsend for Raila. He immediately made it an Ann Waiguru issue. With media firmly in his pocket after having the much publicized breakfast meeting with them, he went on the offensive. Looking at the latest documents regarding stuff allegedly bought by Waiguru's ministry, you can easily tell, there was a motive behind that list. What would for instance, a CS need a piano and a condom dispenser in their office for? Raila had all along wanted to make corruption the major part of his narrative heading into the next election. I see Jakaswanga looking at the unacceptable remarks by Aladwa from the hata nyinyi Kenyan way of excusing wrong doing. Why go for Aladwa if you did not do anything to Kuria? The fact that the authorities appear to do nothing on Kuria (which actually is not true!!) does not excuse the utterances of Aladwa. We miss the point when we look at the reaction of the police rather than the danger that the utterances of Aladwa brings to society especially when we all recall that it was similar utterances in 2007 that brought Kenya to the brink of civil war in 2007. Let us first condemn as unacceptable the utterances by Aladwa and then deal with the fairness or the lack of it in how the authorities deal with the matter. B6K and Jakaswanga:No one is stopping ICC from doing what it should do. We are only asking questions, and very valid ones at that. The argument has been made from the get go, that these cases were framed by multiple players (including Waki himself, given his backers for the job and what interest they had in the Kibaki succession). None other than the witnesses themselves have come out and categorically stated that they were bought and coached to frame Ruto and others, and that none of the events they narrate in their 'evidence' took place, and even if they did, they ('witnesses') were never in attendance and could have not known who attended and what they said. The court in her own 'wisdom' has developed a narrative that the recantations are because the witnesses were bribed by the defense and their sympathizers. Which begs the question, if the court believes that their own witnesses, under a protection program can be compromised by defense, what would have made it hard for the same fellows to sale their souls to the highest bidder in the process of developing these cases? Instead the court has gone ahead and admitted recanted evidence. We now have a situation where both PNU operatives and part of the civil society that prepared the witnesses are coming out to say, indeed, these witnesses were bogus, and that the evidence they adduced to the court was cooked ( read here). At this point, one would expect a court of such standing to halt the case and investigate these claims. But no, the judge comes out and attempts to cajole and bully Kenyans into silence. He insists that, the court will only be guided by evidence before it. Which evidence? We ask. The truth is, ICC is really hurting itself. Even though we may argue that, one can be incarcerated over evidence by only one credible witness, I don't see any such witness in this case, show me one and I show a liar. ICC must do itself and Kenyans a favor; drop these cases pronto and open investigations into its own operations and possibilities of its participation in miscarriage of justice. Otherwise this intransigence is not helpful to them, it is not helpful to Kenya and the world that funds this court. ~~ Mwalimumkuu @nyumbakubwa ~~ one side in this article is good points for you and the one I quote is good for me. We cannot leave it up to the public gallery or worse yet a group of mercenary MPigs in Suswa to give WSR & Sang a verdict of innocence or guilt. Let the court process continue to its logical conclusion. Justice Osuji's recent warnings to Kenyans (like Moses Kuria) and the media specifically seem to point at possible action by the court against a few Kenyans in the near future. Whether some of the witnesses were procured will soon come to light. in the beginning ther was the waki-report. I like to go back to this document, to have an idea where the train left the rails. It was a home-grown report. THE WAKI REPORT: The idea that the ICC is a clear and present danger to Kenyan society is balderdash. Why do I like the Waki report: it reveals a level of penetrative thinking which is not usual within Kenyan public discourse. Such depths become scary.
