We have agreed on some issues but I view this one somewhat differently. I have been amazed at the viciousness with which Miguna has been treated ever since he was sacked 11 months ago, while before that time he was a friend and a hero to many here. I am among those who have no fundamental problem with Miguna seeking to get even with Raila. I think his choice of weapon (including the media performances) for revenge is distasteful, but it's his choice. I recall a suggestion that the book has a biographical element; if that is so, then it would contain many other things. The book may indeed be quite different from what Miguna's public comments have led us to expect and on which we have based our comments regarding Mutunga's attendance. If that turns out to be the case, I will be among those who will publicly eat their words.

We will wait and see. God willing I will be there myself to have a chat with my good friend Miguna Miguna and many others including Dr. Willy Mutunga and Onyango Oloo.

Chief Justice Willy Mutunga being the Guest of Honor at this book launch is like Chief Justice John Roberts being Guest of Honor at a Sarah Palins book launch attacking President Barack Obama. The Chief Justice should know that he is no longer afforded the luxury of being his own person, everything he does, including his breakfast order, is viewed through the lens of his position as the Chief Justice. Justifying that he is attending it as a friend of Miguna Miguna wont just do. What's next? Attending a meeting of MRC coz he was in primary school with one of them? And no, there are no equivalencies to be made here...

I don't think this will be the Raila bashing party that many expected even though it has been sold as such. We will wait and see. God willing I will be there myself to have a chat with my good friend Miguna Miguna and many others including Dr. Willy Mutunga and Onyango Oloo. Adongo,I don't think this is going to be a Raila bashing party and am not even operating on that premise in my objections; in fact, even if it was, that would not be any more a reason to object to the CJ's attending as guest of honor than the basic one that we have articulated, namely, our country's Supreme Court Justice should not put himself in a situation where his judgment or impartiality is questioned and clearly this is one of those situations. Talking about Raila bashing, I don't even think anyone would want to bill this event as such for there cannot be more worse Raila bashing than what he has been subjected to but survived much to the surprise of his enemies and opponents who have retreated and are now busy scheming other plans to "stop" him from being reelected and becoming our next president. Put another way and as I have said elsewhere, my objection to the CJ attending the event as guest of honor would be the same if the author was peddling a book 100% in praise of Raila and I am not just saying that; I mean it because my focus is the integrity of the Supreme Court and by extension the rest of the judiciary. Again, the book may turn out to be an account of what Miguna learned while serving the PM as it relates to coalition affairs less ODM party strategy or without matters shared in confidence related to party strategy and, of course, one without rumors, lies or innuendo and were that to be the case, I, like others have said, will be first ones to commend him for it as we visit various hospitals to console those admitted there for the shock suffered in finding out this is what the book is all about, after all, instead of the "juicy stuff" they are salivating to savor. BTW, my objections and concerns about the CJ attending the book launch will also remain the same even if the book turns out to be 100% in support of Raila and for precisely the same reasons I have articulated for you know if that were to be the case former Miguna haters will return to hating him and condemning the CJ as being part of a conspiracy to recast Raila's image; after all, who would question a former friend turned enemy and in this scenario back to ally saying good things about him? I can even see them citing that recent TV clip at the late Saitoti's home where Miguna is seen whispering to the PM, "Don't worry," they'll say he said, "there is nothing but good stuff about you in the book; I am just hyping the book as I am for maximum effect." Anyway, the stage is set its now up-to whether the CJ shows up as planned and if he does, here is my prediction, or sneak preview, if you would: By attending Miguna's book launch as guest of honor, the CJ will make many reach the conclusion he has shown poor judgment and is no different from those with the "mta do" mindset as I saw someone put it and that will remain with him for the rest of the time he holds that position, which is not a good thing as it will therefore cast a shadow over him as to all his future judgments. On the other hand, if the CJ declines the invitation or does not attend the event, no one, even Miguna himself will question that that's a sign of someone who understands the significance of the office he holds and the need to hold himself at a higher standard than even expected for the office as a matter of principle. That does not mean by stating the disjunctive options this was I am saying that by attending as invited the CJ will show that he doesn't understand the significance of the office he holds and the need to hold himself to a higher standard; I am sure he does but where he will fall short is how high that standard should be. Attending an event where there is even an appearance of inappropriateness falls short of the highest standard our CJ should adhere to. BTW, had anyone noticed how everyone on the ground is mum on this issue, including the media? I do and know why as I am sure many of you do and may even pen something about this following the event--if necessary, that is, for it may not be necessary at all.

Mark Twain once remarked that before sitting down to write critical reviews and commentaries, on all sorts of subjects, he would first have his pen "warmed up in hell". I believe that quite a few pens, on both sides, are being warmed up for this book. Regardless of the contents, what brings joy to one side will inevitably bring curses from the other side. And one way or another, Mutunga too will get it, from one side or the other, which is why he should not be attending. But does the man have a "hard" head or what!

Furaha,
It is such a high-profile and public re-affirmation of his friendship to Miguna, that, wrongly or rightly, it sends powerful messages. It is an impressionable world you know.
Suppose --I know Oloo wants us to stop being hypothetical-- Caroli Omondi wuon Bando concludes he is mentioned adversely in the book and wants to sue. If you were his lawyer, would you not privately make a calculation of the fact that the CJ himself attended that launch as GoH? the launch of the book you want withdrawn from the market? and perhaps judges lower down the food-chain may want to please the friend of the boss?
I am using Caroli deliberately to add the complication that, if Raila becomes president, the lowly judge calculates who is the bigger boss!
NB: I actually think the CJ job comes with a lot of social restrictions. When the Kenya publishers and authors board have a ball, I do not mind the CJ as chief guest, giving them a speech. yes, Furaha, this is a tough job and I for one expect a lot from the holder. A curse I called it.

Omwenga:Heck, I am sure Miguna would like to hear what I think about his book--in person, with you in between ;D Really? You have already been able to get an advance copy and have read the entire book? Why not share it with us then! Furaha,From your handle name I must assume you have some sense of humor, ama? Read what I said in the context of what else I have been saying about this on this thread and you'll see it was not an assertion to be taken literally to mean I have an advance copy of the book or that I have read it; it was a joke. Trust me, if I were to run into Miguna, the book will be the last thing to talk about with him, if we talk at all other than asking him how the book is doing in sales to which he will respond great; couldn't do better! even when it's not and that's just fine. For a long time men asked why they read the Playboy magazine say it's because of its "well researched and informational articles" which is how the magazine was initially justified to miffed wives and girlfriends who quickly dismissed the reason as hogwash because as everyone now knows its all about the nude photos it contains. This Miguna book would have a similar reaction anyone asked why they are buying or reading it will say its for the "insights" it provides about the working of the coalition government but the real reason is they want to scour through every page in search of anything salacious or harmful to Raila that may be contained therein. Won't that be the day if there wasn't any

This is so true. In other words, he will have created a controversy where there need not be one and more so the reason he should not attend. BTW, the Star published a version of my blog at www.the-star.co.ke/weekend/siasa/82666-mutunga-should-not-attend-miguna-book-launch.

The Daily Nation is reporting that Chief Justice Mutunga has turned down the invitation to launch Miguna's book on grounds he has not read it. This is a welcome development and we should all commend the CJ for doing the right thing.

IMHO he should have picked a more complete statement (not requiring follow up statement) like saying that from the press releases, the book appears to be political and therefore may compromise his position as CJ

A few days ago, Miguna was rubbing his hands in gleeful delight having conned the CJ into launching his comic book. With eyes wide open, he quoted Ocampo, "I'm loving it!". Now what?
Well, knowing MM, expect a scorned vilified tirade against the CJ. Starting…. now.

Well thanks for all the buzz and priceless publicity Bwana Chief Justice which would otherwise have cost billions. At least the launch has not been cancelled and the book will still roll in town, right? Can't wait to buy a few copies before lynching anyone.

This was entirely unnecessary, and it was cheeky and insulting for Miguna to come here and crow that he's loving it. Anyway, tell Miguna that we wish him well with his launch and hope that it will be successful.

Those who wanted the CJ to decline the invite have won. Let the ululations begin. Onyango Oloo Oloo,I didn't know what to make of the whole story. I can't see it anywhere in the DN website so I thought folks are just making things up. Now that you have indicated the story may be true it is quite weird to be honest. Apparently the CJ has declined the offer because he has not read the book. One would assume that when the event was publicly announced with the CJ as the guest of honour, the CJ had by that time accepted the invitation. You don't announce a guest of honour before they accept an invitation. I am sure Miguna wouldn't do that. It now seems the CJ has changed his mind. Which is fine. If you have a mind you are free to change it. From what you say here it would appear Omwenga's relentless campaign has "won". We don't know what else is happening behind the scenes but this is a very strange set of events. Hopefully I will make it to the book launch myself and share a few laughs with friends and get a copy of the book. I think this matter is now over with. I hope the book launch is not going to be about the CJ but rather the book being launched. I think we need to give the CJ a break. He sure has his plate more than full.

Explain the detectable timbre in your voice bwana OO? Now that the CJ has seen the light, Tuju would be a good substitute, don't you think so? In every conceivable way, MM was going to herald CJ' gracing the book's launch as a tacit approval of his chosen path to denigrating Agwambo for gratuitous reasons. Now that it is gone, i will get the book ostensibly to read it and peel-off the veneer that covers a very disingenuous character that is MM.

Well the CJ has now spoken and he says Miguna announced him as the Chief Guest without confirmation from him. That doesn't sound very good. Let's hope this will not be the beginning of another controversy and accusations on the CJ. The Daily Nation and may be Miguna himself are still selling the whole thing as a book about Raila. We must have a country bigger than Raila and it still baffles me why this book is being sold as a Raila story. We will soon find out, won't we? You cannot be the perfect one always everyday.
