On the contrary veri: remember the case is still young and the IEBC hasn't been weighed, measured and found wanting yet. Justice smokin wanjala- pronounced- wa--njala (the hungry one) did a smart move. Each petitioner will have ten representatives who will aid in tallying (unlike bomas where they were all kicked out) they will have to sign on an official document unlike bomas where cord says some forms were not signed by their agents, some had figures tampered with and some not on official IEBC forms. These figures will be compared to the registered voters provided by cord in the cd rom and also iebc who will be hard pressed to explain why they didn't use the gazzeted one which we all know is legally the official one irregardless of the noises to the contrary from some quarters here.
The "others" mank, as usual, always retreat back into the woodwork when explanations are needed most or things are thick. Lol. So far, quite a hostile bench to the petitioners and they are left with just the original petition and audit ordered. I guess then we will not know the whole truth thanks to technicalities. However I wouldn't blame the judges, their decisions are grounded in law. The petitioners can only blame themselves.

It sure sounds to me like a Solomonic unfolding we are setting ourselves to watch, thanks to those who have offered some interpretation however little. So far in my non legal opinion. IEBC and the other three respondents are trying to do what they sought out from the begining, that is damage control. They are trying to hold back on as much as they can to limit the damage on themselves and a few other people. They know we are probably headed for a re-run.
The only problem with that strategy is it has a high chance of backfiring because the trial proper is yet to start and what will they produce to counter whatever CORD produces as evidence ? they just cant continue shouting LIE LIE or quoting sections and subsections of the law to disprove whatever is laid out by the petitioners.
Nevertheless, lets wait and see...

On more serious matters, hii maneno ya 300 million for each judge (rumours as is) got me thinking... Kwani from MP's to IEBC etc getting all that money in bribes running into billions. Where does this money come from ? Kwani it is a bottomless pit ? Kweli some kenyans have cash if indeed the rumours are true. I am not an economist so someone answer me this: doesn't all that cash flying around do some damage to the inflation ?
That notwithstanding, I woke up early this sunday to catch our mboys in Hong Kong kicking some portuguese ass in sevens, (yeah, take that you colonialists!!! Lol). To stay awake, I had to load my system with copious quantities of coffee so allow me to indulge my caffeine induced overactive mind and add to the theory of bribing the judges and connecting it to the '2.7 billion shs edict' issued by Ruto recently.
I would love then (if above is true hehehe) to see how the judges explain their verdict irrespective of the evidence staring them eyeball to eyeball. Maybe, evidence notwithstanding, they will sleep peacefully knowing that at least they asked for a higher price (10 million times more) than Judas Iscariot. And for a lesser Sin. That cheap bastard... By the way, how do these bribes work ? Is it negotiable ? Couldn't they go for a higher price ? Does one judge get more than the other (thanks to his/her negotiating skills) or do they sit together and issue a blanket price ? You know!!! For the sake of FAIRNES and HONOUR amongst Judges ?

Omwenga, I guess the SC case will show whether the tyranny of numbers or rutos stronghold in kaleland is as tight as we all assume. I would suggest, if anyone has time, to look at cords petition and see the regions where numbers were subtracted from some candidates and added to others, where turnout was greatly inflated to suit a certain candidate. There are over 1.5 million extra presidential votes that don't add up with the downticket numbers. If you look carefully, most of those came from uhuruto strongholds.
Perhaps (and this assumption is pending what comes out of the case) ruto and uhuru may not even have the perceived grasp of their strongholds. CORD may in reality have bitten quite a chunk from them. But we shall see in time. People have been talking about a re-run but forgetting the elephant in the room: in case IEBC comes out irreparably discredited then who will manage the re-run which has to happen within sixty days of the ruling ? Apparently it is a very long process (constitutionally) removing the sitting commissioners and setting up a new body. We are all aware how long it took to disband the old one and set up this current one plus the political game play that is sure to happen. Some quarters have proposed the UN route, but isn't sixty days too short to notify them and all the technical requirements to be set up ? Besides I have a feeling jubilee may not like that idea for obvious reasons (don't worry, they will cry sovereignty).

Nereah, luokenya and mank. As you say, both being announced as president is a tad bit far fetched. I honestly think their game plan was very good until the court case. That's where CORD moved from being on the backfoot to ahead in the game. That's why we saw the confusion enamating from Jubilee and Hassan mara ati "please don't go to court" to trying to ignore it and going about their illegitimate business trying soo hard to show kenyans and the world kazi inaendelea, to them seeing that this is indeed a serious matter and using whatever excuse of law to respond, to now (after seeing that cord really has evidence) running like headless chicken trying to build alliances and campaigning for a run off or rerun. Kalonzo even tweets that they have been trying to reach him desperately.
They are doing this because they know they have been boxed into a corner. I was also afraid they may use other means to retain power (though remote still) but one thing left for them is to legitimise the power grab. Because of their last minute debacle at rigging, cord managed to (unexpectadly) collect vast amounts of evidence. Now how do you legitimise the power grab when the whole world including the AU awaits the court case before they endorse you ? They won't just grab it by force coz how will kenyans and the world at large react ? Don't forget for these people it eventually is about money and that's where the stick lays.
Forget about the whole jumping around kenya in planes, meeting other leaders, issuing roadside proclamations moi style. Those are just antics any PR agent will tell you is a 'trying to hard to convince you and me they are the kings' any psychologist will tell you if they were legitimate, they wouldn't need to overexert themselves with pictures in the press trying to convince kenyans ati 'look. We are working'. They all know their best route is the SC via threatening and bribing or whatever means they can use. But now the problem is that from their replies to the petition, they seek the case to be thrown out via a technicality. Now our beloved Mutunga oversaw a lot of play in this case thus said that it will be open to the media. Now irregardless of the threats and bribes from the other side, which judge will (in international media) try throw out the case on a technicality without hearing all evidence produced by cord ? Plus we all know with the new constitution, their jobs will be on line in future vettings.
What I am trying to say is the situation as it stands, kenyans have the upper hand. They have dug and dug themselves into a corner and are left with very few options and the options still don't look good for them. They are more scared than we are. They are not sure how the coockie will cramble and if the judges will go their way or if they use might, how kenyans and the world will react. Remember, mubarak was more valuable to the west geopolitically than our honchos are. We kenyans still have many options, if the case goes against us,we still have many battles to fight like the attempts at stiffling our media and civil society. We have the new constitution on our side. And we enter knowing that we may have to prepare for a long battle with impunity. We have dealt with Moi, who do they think they are ? They are in for a rude shock I dare say.

Oloo warns us in the pambazuka article that it may break our hearts leaving all our hopes for a better kenya in just the Supreme Court ruling forgeting the other potent arms of Government controlled by the "Lords" may be spending sleepless nights trying to find other dubious means to snatch (yet again) the coockie just as we are about to take a bite.
Obviously, even the merchants of impunity know that if it goes on, it inevitably leads to a clash of heads, it may take time but they know in that event, the people will win. They cannot kill each and every kenyan. who will they lord over ? but the poisoned chalice of power drowns any sort of reason inherent in humans. They will ignore any security briefings that show them what they dont want to hear or laugh off Mubarak or Gadaffi thinking they did not apply enough pressure on the people. Thats why history, my friend, will keep repeating itself.
We also are to blame as Wananchi. I understand that we as humans have the element of HOPE inbuilt in our psyche. It is what keeps us going in life. Heck, an election was won in America by a black man using HOPE as a slogan. But arent we using it without caution ? arent we drowning in it just like we drown in the faith of religion ? the faith that keeps people worshiping a God/Gods without any empirical evidence of their existence, the faith that makes believers strap themselves with bombs and 'matyr' themselves so long as they demise with a bunch of 'misbelievers'. We as wananchi have to start asking ourselves and our politicians serious questions.
I hate being cynical or defeatist but when i read a post by my dear jukwaaists; foresight, Omwenga and even dada Nereah saying "these people had to win this by hook or by crook coz a lot depended on it" then a line later he/she says "they have been caught stealing and we may go for a runoff which, judging by what is coming out, we will win"(ofcourse, not in those words) I wonder, if the riggers had a lot to lose and had to do it by hook or crook, what makes us think they still dont have a lot to lose now and will still win it by hook or crook in case of a run off ?
Why do we still expect them to behave with decorum yet we have seen many times that the word is non existant in their vocabularly ? what makes it different this time ? There is a lengthy post and discussion in deepcogitation started almost half a year pre election. The post is on IEBC and their lack of preparedness for the past election. almost everything that was predicted in the discussion came to pass. Why were we shocked when it happened ? most of us even took a sabbatical from forums because of the shock, yet we are back to preach the same message that the run off will be free and fair and the people shall win.
I ask myself sometimes whether the CORD leadership knew about the lack of preparedness by the IEBC before the elections. There is an article (i think in deepcogitation) about a report done by the west showing trouble with our just concluded elections. i am sure our leaders saw it. But what made them go ahead with it ? Hope that it will work out fine this time ? hope that because the cord leaders went to press saying there will be rigging, then the riggers will stop ? I ASK FORGIVNESS FOR MY CYNICISM BUT WHY SHOULD I NOT BE ?

I saw the conference on youtube. However i am not sure if the claims that the mainstream media is ignoring them are true. i am not in the country so i wouldnt know. However i wonder what the police will do with the evidence presented to them by my man Ababu. The IEBC is a gift that keeps on giving. Is the evidence admissible in court at this stage ?
On the police using live amunition and teargas on peaceful gatherings, well further proof of the much needed reforms in that sector. How can a force that is meant to uphold the constitution be the one that breaks it with abandon. Were they even provoked ? i am glad the CORD chaps held their peace and did not give the police the excuse they so crave. They want us to go to the streets and battle them there. That is what they understand and what they were prepared for: BRAWN. The Supreme Court and peaceful means is a variable that wasnt high on their list of expectations. It is really bothering them.

Nowayhaha. Any kenyan with average intelligence can visit any social media and sites such as daily nation to witness the matope being slung around between kenyans. Any intelligent kenyan with any grasp of world history knows that is an indication of the emotions bubbling inside that need a release. All they need is a trigger. What could be a trigger you ask; well, just one example could be our Attorney General who quiped before the elections that a senior judge could swear in the new president if the CJ is unavailable. What is he intimating ? Is he throwing that out so as to test the waters on kenyans reactions ? What about the meetings that took place before the elections with our CGS, Gichangi and kimemia ? Isn't that a variable that gives us a clue on how far this can go ? My question is this, will any right minded kenyan take it lying down ?

I spent the past two weeks trying to compile a perspective on how the masters of impunity managed to steal this election and use it to see what their end game is. I was trying to establish how far they are willing to go. I based the writ on the 'chaos theory'. Halfway through, i gave up writting and researching when i realised that no matter what variable i threw in the chaos theory, the outcome remains not easy. The mademoni are bent on getting it their way no matter what, based on their past and recent behaviours.
That said, people have been mistaking the current silence in the country for PEACE. I tell them never mistake CALM for PEACE. Justice breeds peace.
So one of my rare additions to this here Jukwaa will be a song by Labi Siffre - Something inside so strong. We wont give up.

That is theft in my limited legal world. I doubt its contents will be admissible in a court of law and thats a rookie mistake in my opinion.
I laugh sometimes when i see his antics and mudslinging. Like bullies, he is good at dishing out but can he handle being on the recieving end ? Whether the rape allegation is true or not, mudslinging is a game he has perfected against Raila and i am thoroughly enjoying favour being returned...

What had me knocking my head against the wall was the news that the rebels burned some ancient libraries and left with some priceless documents. Most of those documents are historic records found nowhere else in the world. The ancient manuscripts are a cherished heritage of the african (if not the world) people. They explain our rich history (including the Tuaregs themselves) some say that they even provide a Nubian link to the Pharaonic Egypt ruling class. All this while our African countries sit and await the legionaires to save our heritage. Like said earlier, these developements have ramifications beyond just Mali. Things are getting worse for Mitt (the lying Romney) His gaffes and audacity at 'in your face' lying amazes me. Nixon pales in comparison to what Mitt can do to get his way. His recent lie about Jeep moving production and jobs to china continues to air in his adverts despite the Jeep and Chrysler CEO's refuting the claims. I am happy that the MSM (mainstream media) is starting to catch up with the rest of us and calling him on his bullshit. As seen with recent battleground polls, his recent desperate "clutching at straws" antics are backfiring and starting to haunt him. By the way, i wonder why the MSM has taken this long to start calling him out. They have been peddling lies all through and were it not for alternative sources of info (blogs etc) where would the truth be (its actually not just a kenyan thing. As the race for 2012 in the states has shown, MSM is increasingly becoming a mouth piece for the moneyed worldwide. The various pollsters have underestimated the Latino turnout which, as nancy pelosi says, could be the key deciding factor that enables Dems to get a landslide and possibly get the extra 25 house seats that will see them retake congress and Nancy retaking the gravel as speaker (we all know how the repubs have used the House to curtail any legislation put foreward by Obamas team, also the fillibuster rule in the senate has been a thorn in the administrations flesh) This may just be a landslide people. But i have been wrong before.

Nereah. Its a phsychological game. The Republicans are reading from the Karl Rove book on using Media and Pundits to claim they are ahead. And to prove it they are pointing at National polls showing the race virtually tied. We know its the Electoral Collage that matters, a factor that brings the swing states into play. Romney has fewer paths to 270 than Obama. Romney cannot get to that number without Ohio. Obama is ahead by 5 pts in ohio polls yet the mainstream media paints it a a toss up. Romney is virtually tied with Obama in NC and florida or maybe a point or two up and they call it for Romney ?? New Hampshire is in Obamas bag amongst other swing states. One thing the Romney camp and the media will not tell you right now is if they had to pick which situation they would rather be in at this stage of the race, they would definitely pick Obamas situation. Another important thing to note is the outlier polls ( Gallup and Rasmussen) are republican leaning bodies that have to keep polls showing romney ahead for funding reasons and to play to the whole psychology thing. They have samples that lean heavily Republican some as much as five or more percent republican. They also poll heavily 65 + year old (who we know are mostly conservative) Data collection on most of these polling bodies use robo calls that call landlines as opposed to including a number of cellphone users who are predominantly democrats. When you look at all the Polls that the media shows us, they show us the Likely voter screen (LV). When you dig deeper into the details, they are taking the 2010 midterm sample when more republicans voted as opposed to Dems (this is a presidential race for heavens sakes) African Americans, Latinos and younger voters are heavily chopped from all the polls LV samples. But on the other hand, look at their Registered Voter polls and they all (well apart from Gallup) have Obama up 4+ % on average. There is a lot at play here. Early voting started in most swing states and so far Obama is ahead of Romney by over 20% in the votes cast. (you can just google it and find out) African American turnout has gone up even around 36% in early voting compared to 2008. Democratic numbers have gone up equally significantly in early voting, i forget the site where the figures are. Lets not forget the Heavy Latino turnout and polls have obama at 70 to 30 favotite amongst this group (Early voting favors democrats coz they reside in dense urban areas so it would be very hard getting them all to vote in one day, thus the attempts by repubs to do away with early voting). Looking at early voting trends, one tends to wonder why polls are still stuck on the "democrats have less enthusiasm this cycle" People will be shocked come November seventh i tell you. Thats if current trends in early voting continue. CNN is a gone case in my books. When you have the main political Editor (based in DC but i forget his name) tweeting pro conservative slogans and dissing Dems and insisting that the headline be changed from "Obama Wins debate" to " a tie" what does that tell you. Trump is just a fool. His antics show desperation in the GOP camp. Sometimes i wonder if that animal on his head has fused into his brain. Sources say that his "breaking news that will sink obamas campaign" is supposed divorce papers (Obama/Michelle) in his possesion.
