This discussion is just beginning. It is a discussion not limited to the judiciary and its place in the new republic. It is a discussion that also raises issues about the intellectual and patriotic part of our psyche as a nation. It is a timely discourse. Very true. I liked 'The jurisprudence that the courts produce cannot be entirely dependent on law. It must emanate from multi-disciplinary approaches, sources and expertise. Thus, experts in economics, science, politics, the arts, information technology and other disciplines will train judicial officers to give them a global outlook. ' That implies we all depend on each other once we have a progressive (reformist) or retrogressive (non reformist) out look. As much as it is nice to to say one is reformist or non reformist, the ultimate test and outlook is what one is doing. Action speak loudest. What are your plans on retirement, and again it was nice to listen in CJ say 'Friends, I have contemplated life when my term as Chief Justice ends. I have given thought to making a return to this university to teach.' Would it be nice to know President Kibakis' next plans after he is out! What of PM RAO if he does not make it to be PORK? At least Uhuruto their next carriers are well cut out. What of Wikileaf? What would they want to be if not PORK? Great piece Adongo. But let's be honest the CJ has just succeeded in drafting a good business plan (vision). This is a crucial step but the proof will be in his ability to implement the plan. More important than that, how he may have to amend his plan here & there as he encounters resistance to aspects of it. In short, we need him to go beyond the intellectual exercise of thinking up a strategy & actually acting on it...That is why like any good manager we need to keep checking to see if we are on track. If not we find out why and where we left off the correct path. Once we do we find our current status and re-adjust our bearings so as to be on the correct path. We then move on and again re-check repeating the cycle as many times but always keeping our eye on the ball

The commission was established within the framework of the African Nuclear Weapon Free Zone Treaty (NWFZT), also known as the Treaty of Pelindaba. Its charter includes: Monitoring of compliance with nonproliferation obligations by state parties Nuclear and radiation safety and security Nuclear sciences and technology Partnership and technical cooperation The NWFZT which came into effect on 15 Jul 2009 establishes Africa as a nuclear weapons free zone. It authorises AFCONE to monitor compliance by the state parties with their obligations under the Treaty, as well as to promote the peaceful use of nuclear technology in various fields. It is proposed that the AFCONE Executive Secretariat be established in Pretoria and the Government of South Africa has agreed to provide the required infrastructure for the office.

There is no way we can ignore solar energy anymore. It’s time a lobby comes out to fight this Nuke nonsense. no country on earth has nuclear power for electricity generation run by foreigners! So who are the foreigners who want to built, own and operate nuclear power plants in Kenya? In Germany it is the Germans, in Japan the Japanese, in China the Chinese, in USA the Americans, in South Africa the South Africans etc who are running their own nuclear power plants. System Stores Wind and Solar Power in the Form of Natural Gas, to Fit Neatly Into Existing Infrastructure It's abundantly clear that we need to get off fossil fuels for various reasons (try Googling "oil spill"), but our infrastructures are far better tuned for the hydrocarbon fuels of the past century than the renewables of the next. So why don't we just make fuels that work in our existing technology from renewable energy? A German-Austrian research collaboration has engineered a means to turn electricity from wind a solar resources into carbon-neutral natural gas that can be stored and deployed within existing natural gas infrastructure. The process hopes to create the storage capacity for renewable power sources that they so sorely lack. When the wind is blowing and the sun is shining, excess power is siphoned off and used to split water through electrolysis. But rather than storing the hydrogen gas for use in fuel cells -- technology that, while potentially game-changing, is not widely employed -- a simple chemical reaction between hydrogen and carbon dioxide is used to generate H4, or a synthetic version of methane. That methane can be stored in existing natural gas facilities for use when renewable fuel sources are having an off day. Those supplies could also be used as a heat source during cold winters or burn in natural gas powered car engines. The synthetic methane does release carbon emissions into the air, but since the CO2 used to make the synthetic methane is pulled from the atmosphere rather than the ground, the process only returns the carbon it initially pulled out. And keep in mind this is envisioned as a backup storage system rather than a shift to a natural gas economy. On breezy, sunny days the synthetic methane stays in its tanks and the world turns on carbon-free power. b6k, i am up for debate on this. in a kenya where moi's son is still scot-free after court orders his arrest, where kibaki is defying judiciary on county commissioners, yada yada.. nancy's case betrays selective persecution and hypocrisy at its best. animal farm re-visited. on Nancy B we had to start somewhere and best outcome is future state and public officers will be less brazen aka kenyatta, moi and kibaki style. She needs to do a Maina Njenga gig and she may come up again even the dynasties of kenyatta, moi and kibaki may not survive second and third generation when the fathers are off stage, hence the spirited fight Uhuru is putting up to skip ICC or be PORK against all odds. All we need do is keep the firewood coming to burn their attempts to prop up impunity

The one thing we should be talking with the Israelis is the reclaiming of the arid & semi arid lands to the north of KE. The Israelis can do wonders with the land that is otherwise under-utilized due to the harsh climate & desolate landscape. Kudos to the PM on this project... The Sudanese north of Khartoum, Egyptians, Libyans, Tunisian, Iraqis, Iranians, Indians, Europeans etc. all do not depend on rain fed agriculture. But wait a moment the technology applied in all those nations is not patented and we have our won success stories that we do not glorify. Remember Hon Mututho saying he will never again visit a foreign country to be shown agricultural success stories after touring Israel and being asked by a farmer 'how much acreage do you now have under irrigation in Kenya since from 1967 we have been receiving parliamentary delegations every 5 years and we show them this farm?'

A first I was puzzled by the second part of Podp’s statement; father cum brother. But I did some sleuthing and what an intriguing tale. Straight out of an Elechi Amadi novel. Priority challenges for the next governments 1. Kenya currently generates about 1,400 MW. Additional capacity in the pipeline could increase this by 500MW in the next 3 years if projects are implemented on time. But this is not enough. It is prudent therefore that any energy policies that are proposed must be aligned to the industrialization policies as well as Kenya’s Vision 2030 if we are ever to unlock our overdependence on imported goods. It is estimated that Flagship projects outlined in Vision 2030 will require an estimated 42,700 MW, meaning we need a lot of investment to be energy secure. Kenya needs to create new 41,300MW of energy by 2030. And we need to look at all new sources, Our recommendations therefore include: d) The government should also incentivize private sector investments in least cost energy sector geothermal and other renewable. Today the private sector accounts for 15 percent of the power supply. It can be increased. The country should enhance exploitation of geothermal, solar, wind and biomass resources to supply at least 5,200 MW for domestic and institutional energy requirements by 2030. My recommendation 47,000 MW = 10,000 MW (geothermal) + 5,000 MW (coal) + 10,000 MW (oil/gas) + 10,000 MW (nuclear) + 6,000 MW (wind) + 2,000 MW (solar) + 3,000 MW (hydro) + 1,000 MW (biomass) And that will only have Kenya a middle level economy i.e. where South Africa is now! With apartheid reloaded! Can't we aim higher? Above 50,000 MW?

furaha, otishotish we also have to remember that some perhaps 40% of the PEV atrocities/deaths are directly attributed to the police force, therefore a thorough investigation would have to finger many police officers, who strangely enough or should i say not surprisingly have since been promoted to higher office for their "excellent work" It is a crying shame that the ICC seems to have given up on the police violence. When they lost Ali's confirmation the OTP said that they would continue to investigate but so far nothing has come of it and they seem to have enough on their plate as it is. Police reforms will not work unless the police leadership and the political leadership are shown up for what they really are: an unholy alliance to keep power in the 'right' hands. And as we see more and more bills falter and with the constitution itself under increasing pressure, I fear we will see that unholy alliance strengthened. Kamale, First off, the PEV is a key piece of the integrity questions, Miguna has raised. If indeed Raila was part of those who master minded mass murder in Kenya, which is essentially what Miguna announced at his book launch then he (Raila) should be at The Hague with the others charged with mass murder and mayhem. Of course we know that it is not Miguna who prepares and executes charges at the ICC but rather the OTP. The trouble for Miguna here is that he claimed he is withholding the evidence he has as long as the suspects are busy kissing his feet. Today, as I arrive back from a one-month working holiday in Toronto, Canada, I wish to thank all Kenyans of good will and friends of Kenya, for their extraordinary support and fortitude in the face of increasing intolerance and emerging dictatorial tendencies, tendencies most Kenyans thought we had buried with the enactment of the new Constitution on August 4, 2010, but which have reared their ugly heads most recently in chilling scenes of barbarism exemplified by the burning of my effigy and the burial of my coffin in a mock funeral.
Ironically, those loudly shouting about their (tainted) reform credentials have neither censured nor condemned these acts of hooliganism and lawlessness. These fake and hypocritical ‘reformists’ use empty rhetoric to woo votes but do not care about the true state of our country. They drink wine but preach water to our country men and women.
Many Kenyans are asking, following the political tectonic shifts and volcanic eruptions precipitated by the publication of my book, Peeling Back the Mask: A Quest For Justice in Kenya: where do we go from here?
While I do not want to be prescriptive nor claim any authority in determining the “Way Forward”, it is my wish and desire that we start focusing our attention, as a people and a country, on the illusive but yet incomplete liberation struggle for our country; liberation from totalitarianism, intolerance, exploitation, inequalities, inequities, corruption, tribalism and nepotism. Yes, liberation from the poor and deceptive leaders; and from the criminally high rates of unemployment and poverty!
These are our main ailments as a people. They are the main issues that I address in my book, and that I would urge my fellow country men and women to focus on. Our unflinching focus on these issues will ensure that the Constitution remains a living and thriving organic product of our collective struggles. Let us work together to bring probity, transparency and accountability to all aspects of public life. It is our duty to hold all our so-called leaders to account. But even more important: we must carefully, consistently and thoroughly vet everyone who seeks elective position, especially at the apex of the political spectrum.
Nobody – absolutely nobody – should get a free pass. No one is entitled to be president. There is no free ticket to the Presidency of the Republic of Kenya!

Isnt it funny Miguna has all but abandoned his Nyando home and village folks where it may have been ideal to take a vacation and instead opts to go take fly thousands of miles for vacation whilst taking accomodation in a student dormitory somewhere in Canada, then coming back to lecture Kenyans on how to go about their lives? cannot blame MM for going off to Canada if the roads in his village are Roads of shame. The accolades showered on the government for building infrastructure, especially roads, do not mean much to the sugar cane farmers in western Kenya, especially the Nyando sugar belt, remarks Alan Majisu. Adongo Why would you want to meet Miguna and ask him the question on PEV? You already have declared that he was A LIAR on this one score and that is the case, I agree we should not only hang him, we should have him quartered! MM is nice sport it appears. The Constitution allows any one keen to know the truth from GoK to request for it. Remember the lawyer who wrote to CJ asking what was discussed with Secretary of State, Clinton when she was in town? For PEV answers Jakaswanga offers names and offices which have ready answers all that one needs to do is similar to what the lawyer in CJ issue did. Ask the right office paid for by tax payers funds. The Constitution allows you as a Kenyan a right to information. MM was blowing hot air and as Adongo says to sale Peeling Back the Mask. Its a clever sales gimmick. It worked but other than the 41 against 1 paragraph there is no PEV details in MMs book. Maybe those yet to be written but why wait if you really want PEV information? KNHRC, Waki Commission, etc. are juicy on PEV and so too are the offices Jakaswanga lists below. [Kenyans will stop asking Miguna WHY HE IS WITHHOLDING CRUCIAL INFORMATION REGARDING THE PEV.. you are in dream world I advise you stay right there.. For those really interested in PEV. And need real answers from people who know. You do not have to look far. (But those only interested in juicy side-shows, can continue pursuing Miguna. It is sport.) During the PEV, he chaired some of the inter-departmental intelligence committees! If you really want info, the truth and the whole truth, that is the guy you want. But given his job now, if he is the same fella, one could say he has reason to engage in a deep cover up. Let us re-read some of the stuff which came out during the questionings of folks like Ali, Nguyai etc at the ICC. Linked to the Gichangi situation reports. Then forgetting UK and Kibaki, there are three or so other very knowledgeable fellows. Big Guns. The then chief of intelligence Gichangi; the then chief of Military intelligence; the head of military transport, and to a lesser extent the then head of the GSU/AP. (head of Police CID just went missing!) Gichangi seems to have been running a professional force. Even if on routine. For instance on the route to Nakuru they noted, wrote and specified ARMY LORRIES passing by --and what they concluded the cargo was, given they were stopped at a road-check and given a look over! But it was the Americans who became the problem. The chief of military intelligence and his transport sidekick DENIED any military lorry transport of Mungiki to anywhere, at first. That meant Gichangi and his boys were LIARS, forgers etc! Gichangi could either underwrite the reputation of his intelligence organisation and their situation reports in this PEV period, or abandon his force to side with his old comrades in the army. And the americans pushed him. And he bit the bullet. {Good anecdote on how this pushing is done in what is called Edmund Muskie fashion. More about that later] So Who was lying? The army top brass of NISS situation reports? Sawa. The army changed their story. There could have been military lorries on routine duty anywhere in the country. Perhaps on the Nakuru road they were evacuating some Kenyans to safety --good samaritans and patriots that they are? And who can trace all army lorries in the republic at such a chaotic moment... huh!? Did Gichangi's boys really CERTIFY they were carrying mungiki hired murderers? Now ladies and gentlemen, if you care that much about the truth, follow this story. The main actors of PEV are all alive, and well in Kenya. I do not think there is really anything new Tobiko or the police investigators can glean out of Miguna --who a few minutes of serious questioning would reveal a bluff on bad poker. But you want real answers on PEV? you could start with Kimemia. Otherwise these your Miguna stalkings are just entertainment. On the ODM side then? Ach, b6k says phil of Jukwaa is the director of cyber communication for the orange party, let this be his territory. Reporter101, if you are serious about people you lost in PEV, and you seek the truth, Miguna is not really the person you want to be stalking. Take another look at those around you, if you are in Nairobi.All PEV info is available in Nairobi. Is there anybody here denying that?

Phil and Rais: G7 has never been about an individual or parties, but an idea of transformation, generational change and pushing the most critical agenda of the country forward, which has for a long time been stiffled by the retrogressive forces led by Raila. The faster these forces are consigned to the political dustbin the merrier, and that is how Mudavadi's argument begins to make sense. Great Teacher would love this. A perfect case of cultural invasion. Twisted logic. Manipulating people to conform. Educating the community, when in reality the community should educate itself. What is even more cruel is the negative classification. Great Teacher sees us as incapable of thought. This characteristic implies a single, inflexible view of reality.

For witnesses whose names have been redacted from public documents as well as not been disclosed, it would appear that Bensouda is a lot more worried about their credibility as opposed to prepping them and the claims of intimidation and changed stories are red herrings! My suspicion is that the coaching these witnesses had from the NGO's shopping for witnesses now make it difficult for Bensouda to make sense of her case. When he dared ODM leaders to 'kiss his feet' or he can take them to Hague, in my humble observation he was more of a possessed man. Anger. Its almost like in those evagelical summons when the preacher starts froothing in the mouth and the scared folk start confessing by talking in tongues. And the beauty is that it was all alive on TV stations. I have my doubts about the "beauty" in of "a possessed man ... frothing at the mouth", but I have been told that beauty is in the eye of the beholder. I do, however, agree with you that the man was probably just carried away. To that extent we should let the matter lie as long as Miguna doesn't come back to it.There are some things that people should not have to be told not to do and which should be ingrained in their brains--for example, taking off ones clothes in the middle of a busy street. References of the type Miguna made about the PEV are in the same category, and more so given that many people are still suffering bitterly from the effects of that sorry episode of our history. I really hope that Miguna Miguna will stay away from that topic. That reminds me of mama Lucy's famous question 'and who is your mother' implying that you should have been taught/brought up with 'good' manners. Otherwise your hope that MM will stay away from PEV topic may please Reporter111 who also frooths that MM should stay on it. Reminds me of adding parafin to wood fire
