B6k/NowayhahaThis misstatement my Issack is causing quite some confusion. Some help from the constitution: (4) A candidate shall be declared elected as President if the candidate receives— (a) more than half of all the votes cast in the election; and (b) at least twenty-five per cent of the votes cast in each of more than half of the counties. Votes must first be cast, then counted to arrive at the number where they are more than half of all votes cast in that election. Spoilt (or rejected)votes are not counted as they cannot be assigned any specific candidate. So if 10,561,612 votes are cast and counted, the winner shall be the one with 5,280,807 votes which are more than half of the 10,561,612 votes. I hope this is helpful! Kamale, Hope he will come out again and clarify once and for all to avoid creating room for misconception, mind you this question was asked twice and the second time by Lenard Mambo Mbotela in swahili and he reiterated the same thing as he did the first time only in swahili this time around -what came out is that once a vote has been CAST it will count in the final tallying of 50 +1 and by being termed as a rejected vote it has been counted already.

Based on clarifications from IEBC press conference the rejected votes count in the calculation of the 50% +1 votes which will determine an outright winner or a run off. He insisted this is what the law entails Nowayhaha, that means the figures the IEBC are posting on the screen at Bomas are off somewhat. UK will be at 51% while Raila drops to 38% of votes cast (& counted) including the rejected ones.... B6k, You are correct nowonder Kamale was saying its early days.....from calculations of what is being relayed the rejected votes amount to 6.3 %

Sister Malkia,There is no difference between a spoilt and rejected vote! NONE counts!! I know neither counts. However, the legal distinction is extremely important. Most immediately, do either rejected or spoiled votes count in the calculation of the 50% + 1, also in the event of recounts the standard for spoiled votes is clear intention of the voter (think Florida 2000). It may help if I clarified that at this juncture I am more interested in the legalities and not the political ramifications, if any, of the distinction. IEBC was 6 1/2 hours offline. Enuff time to cook meth and anything else you want. Looking forward to the 3rd revolution. Roundi hii tumehata. Lincoln, do you really want to go down that "cooking" (figures?) lane? It seems to me after taking a wee nap is that the trend we saw emerging from the first 10% of counted votes has marginally held at the 20% mark. Other than RAO finally crossing the 40% mark & UK sliding 3 points or so, it looks like CORD still has a lot to do to catch up. What's still disturbing is the high number of rejected votes. It is edging toward 6% of the vote so far. What on earth were people doing at the voting booths? A joke trending in the social networks is that ..... People were told to vote "wisely" only to discover his name wasnt in the ballot papers thus they scribbled his name, they wish they had been asked to vote "rejected" as he never campaigned and is performing relatively well .

I think he is doing his Job. earlier on today... Secretary General Anyang’ Nyong’o challenged IEBC to explain why it reverted to manual voting after the electronic machines faileFd in parts of the country, despite ODM having written to the electoral body asking it to confirm the status of the kits. “We assumed IEBC heeded our advice but it seems they were lazy and did not, leading to a 95 per cent failure of the kit forcing voters to use the manual system,” said Nyong’o. The machines were bought at Sh7 billion. He said it was risky to use the manual voting system since it is easier for someone to masquerade as another person especially in cases where the computer cannot show faces of voters. Peruse throught Tweeter and Facebook and see the outcry from fellow Kenyans after the Betts press-conference -Kenyans are asking the media to give the politicians a complete blackout. On the malfunctioning of the BVR kits or the so called technical hitch earlier in the day this was across the board and it affected the other side of the divide as it affected CORD/ODM but do you see the other political players using it as a basis to discredit the elections?

ODM National Election Board chairman Franklin Bett has faulted the authenticity of provisional results being issued by IEBC. “Where are these figures coming from? In Ongata Rongai there are people who are still voting. These are just figures floating on a screen,” said Mr Bett at a press conference held at the Bomas of Kenya tallying centre. “March 05 is not designated as a voting day. We have heard of continued voting in Kimilili, Kitale, Uasin Gishu and Kitale. Betts speech is as incoherent as it comes what has provisional results got to do with unverified reports that elections are ongoing in one polling station Ongata Rongai. This is a dangerous precedence they are setting and of-course the next course of action will be to call for the so called mass action with claims the elections have been bungled . Well we have repeatedly said before If Cord/Odm calls for violence this time around then ICC should come in handy and save the situation in the early stages rather than wait for it to escalate to the magnitude it did in 2008. Advice to CORD/ODM let IEBC do their work, resist from making baseless and alarmist calls which might bring tension in the country which in-turn might result to post election violence Kenyans voted peacefully, If you have grievances for heavens sake we have a reformed court which can be trusted and in addition to that your leader said he will seek redress in the courts in case of any dispute or was this the known case of double speak ? Kenyans will be patiently waiting to see and confirm.
