Githongo was a hero when he ran to London, except to the now PNU diehards. Miguna is a hero when he runs to Canada, except to the ODM diehards. This is very interesting. horth githongo was running away from the inner circle that wanted to kill him miguna is running away from rebuttals and law suits

tnk, Very right. The caroli move will hit Miguna right in the pocket. If I were Miguna, I would remain is exile for good. In a way one can say that Caroli has driven Miguna both out of the PM´s office and Kenya. What a last laugh Caroli is having. But how long will Miguna run from the law???

In fact I have also heard that the those Kenyan immigrants who had a rape case against Miguna in Canada will be appealing the ruling. Remember ODM or FORA is also in Canada. Then where next will Miguna run too....run baby run!!! This is more nonsense out of the 24/7 Kenyan rumour-mill. The cases against Miguna were criminal cases and so would have been brough by the Crown. Only the Crown, and not those "immigrants", can decide to appeal the case. And on the basis on which the charges were dismissed, there is not the slightest chance of that happening. otishotishThis are the developments am continuing to hear from Canada. Are you sure there is no other way around that Rape case? Anyways, am not a lawyer and if the case is as you suggest, then Miguna is one lucky man.

Mbuta, Today is the day for administrators to go on a road not less traveled. Seen Oloo and now Kathuure? I hope none of them flees away from JUKWAA. Actually am getting worried...I hope they manage to stay calm despite the unceasing bombardment directed towards their dear friend Miguna, otherwise the possibility of shutting down Jukwaa, or locking Miguna threads may be threatening. Miguna ran away into exile summer holidays, you know!

Anyways, am not a lawyer and if the case is as you suggest, then Miguna is one lucky man. Friend gemagema: This is "Miguna Time", and I expect we'll be hearing a lot, and of all sorts, about him. "Do you remember when he ...?". "I also heard that he ...". "And wasn't he the one who ...?" "This is a secret, so don't tell anyone; but I have it from impeccable sources that ...". "A friend of my cousin who knows someone who knows Miguna's domestic servants ...". "Wait till you hear this!" There are four things Kenyans love more than anything else: beer, nyama choma, music+dancing, rumour-mongering. They especially love the last because they can indulge in it even when it is far from pay-day and they can't afford the others. The criminal case is done and dusted. Perhaps they could bring some sort of civil case, but that would not be "re-opening" or "appealing" the criminal case. And even there, all they would be doing is putting money into a lawyer's pocket: the same issues that killed the criminal case would kill the civil one. If the people involved want to make something out of it, the best would be to find a way to "eat" from it----write a "True Story" for some well-paying magazine.

Been watching KISSTV on Miguna. They just showed copies of a number of letters written at the PMs office by various officers complaining about MM management style and "loose cannon" tactics. These are the revelations that wuod KANO was running away from. What are the intergovernmental jurisdiction agreements between Kenya and Canada in respect of criminals/potential criminals who cross boarders to evade justice. There must be away of committing Miguna to a return date to clarify his role in concealing evidence on PEV?

How about fresh charges? eeh? rumors on the ground are that those are not the only women in Canada claiming rape.. if indeed the rumors are true are you saying that their cases are non-starter? I may not be a lawyer but your argument doesn't add up.. As for the previous victims coining a book about their rape experience, that is a good route to take at least they will remove the devil that has been haunting them to date.. if indeed their allegations were true all along and a rapist got away my question is aren't rapist known to be repeat offenders? they don't seem to be able to stop themselves.. all said and done.. the only individuals that know the truth are the Victims & the rapist if indeed the allegations or the current rumors of others coming forward to file cases are true! ivyo tu.

Really ;D ;D so you have heard rumours that they are paying women in Toronto to claim that they were raped by Miguna? and they will have some vivid imagination on how the rapes happened? I would like to see such women exposing themselves to the whole world narrating a painful experience because they want to get back at Miguna? or the previous victims must have pretended infront of the Toronto judges that Miguna raped them, going through the ordeal of being questioned on how it exactly happened... Kweli you must have some serious info most people don't have..., A lawyer who was helping these same Rape victims with their immigration cases.. I guess you must be having some inside information that most Kenyans don't know.. hey do tell us.. you seem to be a lawyer? do you practice immigration law? just curious.. I wonder why you seem to be so adamant in regards to the previous victims, do you have information that most Kenyans don't? you seem to insinuate that these previous victims were lairs ? how so do tell?? Rumors are rumors so let the rumor run it's cause if indeed there are women out there claiming rape? why does it bother you? alah!

Really ;D ;D so you have heard rumours that they are paying women in Toronto to claim that they were raped by Miguna? Either you can't read, or you still haven't sobered up from Sunday afternoon. The people who are being paid are the people spreading the rumours you have been hearing about old issues and so-called fresh cases. That's according to the rumours I have heard. Yes, I definitely have information that Kenyans like you don't. It's called The Law. The complainants in that dismissed case cannot "appeal" or "re-open" those cases, as you imagine---for the very simple reason that it's not up to them. If people want to beat up Miguna, he has given them plenty of material, with his book and numerous media performances. Going on and on about these rape stories is going beyond silly. Whether or not the women in the case were telling the truth or lying is something I don't know and I am not in a position to comment on. What I do know and can comment on is the fact Miguna was charged in a court of law, and the charges were dismissed. They were dismissed on the basis that the evidence was weak and contradictory, not, as several have claimed here, on some mere technicality. So, people should let that one go. By all means attack Miguna, if you wish, but don't get so carried away.

I bet you most Kenyans just want to know the information Miguna is withholding in regards to PEV. The rape case that he won on technicalities? did the victims withdraw their case against him? if not why not? Rumors are rumors let just say you will never stop world rumors just because you feel they are silly.. Many rumors around the world have solved cases even cold case mysteries.. if indeed there are women out there coming forward alleging rape then time will tell if indeed these rumors are true, silly or not.. the person getting carried defending Miguna is you.. did he engage you as his Jukwaa defense lawyer? wonders never cease on Jukwaa.. ama Yup!! and rumours or court cases are going round and round.. I guess the book sales will cover his expenses.. why can't this Kenyans hire lawyers in Canada and Sue him $$$$$$$ for defamation or whatever.. Bett to sue Miguna over death claimRoads Minister Franklin Bett says he will institute a private criminal prosecution against Prime Minister Raila Odinga’s former aide Miguna Miguna. Bett said police have taken long to investigate claims by Miguna in January that he (Bett), Higher Education Minister Margret Kamar and Energy Assistant minister Magerer Langat had plotted to have him killed. He, at the same time, said it was sad Miguna had opted to ‘flee’ the country when the police were looking for him to record statements over claims he had evidence on Kenya’s post-election violence of 2008. Speaking to the press in Kericho, the minister said he had been waiting for the police to conclude their investigation for the last six months since he recorded a statement over Miguna’s claims. Coward and liar“But before that, a systematic scheme to malign and slander him in the media claiming that he suffers from personality disorder should be unleashed. One of the participants, whose conscience refused to go along with the scheme has disclosed the information to me,” the sms claimed. On Tuesday, Bett said Miguna was a coward and a liar, saying he fled the country after he knew he could not substantiate his wild allegations over Raila as contained in his sensational book “Peeling Back The Mask”. www.standardmedia.co.ke/?articleID=2000062092&story_title=Bett-to-sue-Miguna-over-death-claim

Here is a free professional development for you and thank JUKWAA for it. In criminal and civil realms you can actually apply to a supreme court for a rehearing of an already dismissied matter and where judgement has been entered, even if its done out of time. Appeal on a matter by a primary court to a secondary court usually have time limits. But on a matter that has already been appealed ( closed ) there are circumstances where the court will hear the complainant if its a matter of public importance, injustice that cannot be remedied elsewhere and loss caused to complainant has curtailed his/her human rights, if judgement was obtained by fraud and if there is NEW EVIDENCE that was never heard by the court before. Please do your research before making such a statement that is not entirely TRUE. So the information that you have that kenyans dont like is null. Pity the poor lad reporter let you get away with it but not too quick! The victims have a right to claim for a rehearing if they so seek omera! REHEARING 101!

Perhaps you can answer a specific question: Please explain to me how the women in question (the case against Miguna) can "appeal", or "re-open", or whatever (in the Ontario Superior Court or Supreme Court of Canada) this criminal case that was brought by the crown and dismissed, on fairly solid grounds, by a judge. As appropriate, please cite the relevant parts of the Rules of that Supreme/Superior Courts, the Criminal Code of Canada, and (as you see fit) relevant cases. To avoid abstract generalities, please argue in relation to this specific case, of which the records are publicly available. That will help both my understanding as well as that of those seeking to "appeal", "re-open", or whatever these cases. Once you have done that, I will have had my professional development" and will definitely thank you and Jukwaa for it. OK, off you go to get started! Regardless of your answer to the above question and regardless of reporter's rumours and hectoring, here's one thing I can state with 100% certainty: There will be no "appealing", or "re-opening" or whatever in the cases against Miguna that were dismissed. Wake me up if and when I am shown to be wrong. But first, complete my education, as requested above.

Perhaps you can answer a specific question: Please explain to me how the women in question (the case against Miguna) can "appeal", or "re-open", or whatever (in the Ontario Superior Court or Supreme Court of Canada) this criminal case that was brought by the crown and dismissed by a judge. Wacha tu! Double jeopardy from From Wikipedia, the free encyclopedia we all know where jama got the information.. but the rumors of new victims won't go away will they ;D so lets watch wait and see.. jama can't stop the rumours.. defend !! defend!! defend!! I hope the said victims are reading Jukwaa. My question still remains.. did the victims withdraw their case or was it won on technicalities as stated? mambo ni ivyo ivyo..

reporter911: Miguna was acquitted, by a judge, on solid grounds. The crown could, if they wish, re-open the case, but if you actually read the case material, as opposed to just rumour-mongering, you would know that that won't happen. And it won't be enough for the women to merely say that they want the cases re-opened.
I suggest that you now try to sober up while your new friend works on his homework assignment. Once you are sober carefully read the last line of my previous comment.

reporter911: Double-jeopardy has nothing to do with it, as there was neither complete trial nor verdict. The charges were dismissed, by a judge, on solid grounds. The crown could, if they wish, re-open the case, but if you actually read the case material, as opposed to just rumour-mongering, you would know that that won't happen. I think ye protest too much since when have rumors been silenced or abolished on Jukwaa? or is it just rumors about Miguna that you find distasteful? I guess I will repeat it again maybe you should go wash your ears properly next time.. ahem!! rumors on the ground in Kenya and Toronto are circulating that there are new victims claiming having been raped by Miguna I guess this in the layman's language means new cases if indeed the rumors are true? remember they are just rumors and rumors are all over the world... no human being can stop rumors around the globe.. so are you trying to shut down rumors on jukwaa when they touch anything to do with Miguna? then please say so.. or else allow members to speculate and post news from wanaichi on the ground TERMED AS "RUMORS"

And I note that you've moved on from the old complainants (and appealing and re-hearing and re-opening) that you were previously yelling about. That's good. I don't know Oloo's stance on rumour-mongering on Jukwaa, but, until he clarifies his policies, I have to agree that you are within to rights to engage to your heart's content. Proceed.

I thought the world policing was the job of the American? or are you also a Jukwaa moderator.. esh!move on! back to Miguna.. Kenyans are waiting for the PEV important crucial information he is withholding maybe you can whisper in his ears next time you get a chance ama!

Huh!!! Not in Jukwaa mate, are you a lawyer practising in the profession? Well done, Mr. Clever. Wake me up if and when I am shown to be wrong. But first, complete my education, as requested above. DECLINED! Mate am suddened by your level of understanding on this matter especially if you profess to be in the know how then you would be well aware of my clear indication at a law about rehearings. I find your understanding wanting. Somewhat mediocre and Junior level litigant!!! For me to table in specifics on how to approach the legality in a rehearing is a kin to branding me a probono lawyer for these women. What you are asking me generally is between a client and lawyer contractuals. Comical as it is i dedduce you are either lame or your understanding is of the same on the matter. You sure need to revisit this urgently for your own good if this is how you butter your loaf. I have come accross legal minds with little understands of the rehearing process and the case law that supports it, so your retort doesnt suprise me?!!. I am not here to school lame minds. Its expensive to be lame and more so costly to unlame your thinking! For where in God's green earth does the learner orders the teacher to go do him research? I disagree! There is a lot of material available freely on the issue i will advice you humanely to go figure and "unclog". One last piece stop writing with AUTHORITY on every matter and specifically on the matter of the faculty of rehearings.Perhaps start using the word " am alleging" ok. And i will not wake you up, i will let you enjoy your slumber! To the matter at hand : YES THE WOMEN upon "new evidence" can lodge and seek to reopen the matter at the supreme court. They will however need a lawyer and a counsel with my kind of "thinking" not "yours" ...its all about the fight in a dog matey and the expertise: a lethal combination in legal battles.

Lol! Twitter for KTN & Standard (same source, really) seems to confirm this. Miguna is a riot! Come baby come has morphed to catch me if you can! You can't make this stuff up... Ooops! Folks, if you watch the Capital Talk video recorded the day after the launch that is posted by Joblesscorner in his video only thread you will hear MM clearly confirm that he will be leaving the country "next week" to do his book tour. The guy therefore did not flee the country. As for those stressing that he left with a lot of luggage, any family man would know that if you are moving with your family for a trip you know will last a month, you will move with quite a lot of suitcases. It comes with the territory. Apologies to MM for getting carried away with the "mob" on this one
