We need capable people in State posts, not sycophants I have some unsolicited advice for Uhuru Kenyatta, assuming that CORD loses election petition in the Supreme Court and the President-elect is sworn-in. Soon after officially taking reigns of power, Uhuru is expected to start nominating people to various State positions, including Cabinet secretaries, principal secretaries, parastatal heads, and ambassadors, among others. A lot has been said about the need for a national face in the Cabinet and entire civil service. And this is where the new Head of State’s first impression lies. President Kibaki scored poorly on this front. People who have been close to Uhuru and his deputy William Ruto are jostling for various positions for themselves, their kin, and sycophants. Some of these are basing their demands on issues that are of little or no substance. They do not care about the other Kenyans and could front names of people from his village with no regard to the rights and interests of Kenya. Uhuru should first be preparing on how to fend off such pressure and start by only going for people who merit the various positions they are seeking. For instance, I do not see why Uhuru should start by picking people who just lost in the elections and make them Cabinet secretaries, parastatal heads or ambassadors. The public rejected these people because they failed to perform and it would be disastrous for them to make their way back into the system through the backdoor just because they happened to have been in Jubilee Coalition. There are Kenyans, some very young, who have emerged out there and can breath fresh air into the public service. They may not be good orators or known public figures, but they have been contributing more towards a better Kenya compared to politicians angling for a slice of the Uhuru government. I just imagine what Dr James Mwangi can do in a ministry if accorded the chance. This is a man who transformed Equity Bank from a small housing co-operative society to the giant it is today. And what a noble “Wings to Fly” idea? Other people that Uhuru could consider is former Kenya Commercial Bank Chief Executive Martin Oduor-Otieno, Vimal Shah (Bidco Chief Executive), Co-Founder of AfricaOnline Ayisi Makatiani, Vision 2030 Board CEO Mugo Kibati, among many others. The point is, even if these are not among the personalities to be considered, there are many other Kenyans out there who are doing a splendid job and merit appointment as Cabinet and principal secretaries, among other top public positions. Deputy President-elect William Ruto attended the meeting where Mr Mudavadi, who came third in the polls, urged Mr Kenyatta to unite the country and “to take appropriate steps to ensure all Kenyans feel part of the new Government". "Mr Mudavadi added that there was need to bring leaders together without delay,” noted the PPS statement. Prof Kiyiapi “observed that the real challenge facing the country was not legal but political” because “electoral loss can lead to tensions dues to unfulfilled expectations”. “Consequently, Prof. Kiyapi emphasised the need to build bridges across the political divide in order to bring all Kenyans together,” the PPS statement read. “Safina leader Paul Muite urged the President-elect and his deputy reach out to all leaders, saying that legal battles will not secure the healing the country requires. For me the question is how Raila intends to be the leader of the reform process and what his strategies are for fighting the anti-reform process. He needs to show this yesterday. There are political risks of course,but in my view Kenyans are ready for such risks. Just as Raila took leadership of the YES brigade,why not tell the Nation his strategies for leading reformers starting with how he is going to appoint people to Kenyan institutions?As Kenyans start lobbying for posts he could tell them what his criteria for recomending appointments will be. Jim (James Orengo) observed that these appointments must give the impression that Raila is actually comfortable with business as usual. AND THAT MEANS WE HAVE LOST HIM TO CONSERVATIVE FORCES. This is instant grounds for recusal of Mutunga from the election petition case.
He may have changed his mind since he uttered these words, which was some years back. But then, justice must not only be done, it must be seen to be done.
If Mutunga sides with CORD in the petition, the Supreme Court will be permanently damaged as half the country will think Mutunga has politicised the court.
If Mutunga rules against CORD, perception will be he is simply going reverse so as to cover what he said in the past.
Either way, neutrality of the court is in question.
He should recuse himself - for the benefit of the court."

Mutunga has also been quoted saying Jaramogi was his political hero.Also CORD top lawyer is Oraro advocate...who is also Mutunga advocate. Also Mutunga is and was Nyongo tenant for many years.And most importantly Mutunga was NARC chief campaigner..a grouping which was against UHURUTO.
Unless Mutunga is .................he just has to step aside on this issue."

You’re serious, aren’t you? Isn’t it a fallacy for you to want us to believe you when you write the IEBC is heavily compromised without providing any proof whatsoever? Horth Three unnamed international media houses running anexit poll are more believable than the IEBC. That is the evidence these chaps have according to Raila. Kamale , And rather than report their exit polls results via their media houses or outlets they phone Raila and congratulate him .This is hilarious ))) Who sponsored the exit polls and what was the cost of commissioning the exit polls ? Which areas were they commissioned ? and what percentage of the population do they represent ? These are some of the questions which crop up in Kenyan minds . In 2007 the basis CORD/ODM used to refuse the election results and claim they were rigged was because of the Ambitho Polls and this time around after Kenyans detested the Opinion polls they now use exit polls - I pity CORD/ODM (((

I am afraid you are captive to illusions. Ori Jakaswanga,No; I am not and neither have I ever been captive to any illusion. All the evidence needed to nullify the bogus announcement by IEBC that Uhuru won will be presented in court and we expect nothing but a unanimous decision granting the petition. The evidence of rigging against Cord and Raila specifically is that overwhelming. Omwenga, What became of the confidence you had on IEBC ? Is it because you fairly lost that IEBC became a rigging institution ? I am getting sick and tired of Uhuru fanclub theatrics. Kenyan mustn't be taken for granted! The election is a process which only terminates when the procedure as defined by Law comes to end or by concession. Neither has yet taken place. So, why this unnecessary panyakukaring! Sadiq , Truth be told its CORD/ODM who are taking Kenyans for granted ,Kenyans want to move on with their lives after the elections .Minutes after Uhuru was declared President elect - Raila (CORD/ODMS) presidential candidate who was amongst the losers made a press conference indicating that they are going to petition the presidential election results as they have watertight evidence and guess what till this moment they have not filed in a petition but doing the opposite payukaring asking intelligence committee to stop briefing President elect and his deputy and going all the way doing campaigns in Kibera and making unestablished claims that Raila won by 55 % of the votes from exit polls(where were the exit polls by foreign media conducted ? did you witness any ? for me I didnt witness them and thats one of the reason Im wondering were they conducted in Kibera alone ?) To my knowledge, the role of the Judiciary is very crucial to the authenticity of the elections. Petitions must be allowed to be ventilated in Courts. Only then can people be declared victors. If only they had filed a petition then we would be scrutinizing and objectively discussing the merits and demerits of the petition and the likely or unlikely outcome . As we speak now they havent but they are yelling out loudly how they have won the case . So we are not rubbishing the role of the judiciary but asking CORD/ODM bring it on and they better make it quick, then from there we start the discussions .Untill then please let CORD/ODM supporters spare us the chest thumping and false bravado . For those casting aspersions on the person of the CJ, you are simply clutching proverbial straws. To my knowledge, the CJ has not indicated that he is against Uhuruto. Even if he was, so for example if he did not vote for Uhuruto, there is no legitimacy in questioning him. It is not his personal preference which is being sought, but his judicial acumen to decide on evidence whether the election process was fit for purpose. Sadiq as person with law background this is unfortunate coming from you .The CJ is on record saying the only person he believes once he becomes a president can push forward the reform agenda is only Raila Odinga not to add that is on record on Railas Biography .This clearly shows that if he becomes one of the bench members to hear the case he could be partisan -Suffice to say there is information that he has at one time been a member of Railas think tank - This can not be wished away - If the magistrates and "small" judges have had to withdraw from cases due conflict of interest as in Business ties etc what about in this case scenario where Chief Justice Mutunga has political ties(well documented and lots of people who can attest to the ties ) with CORD/ODM and Raila Odinga . Be rest assured that once the petition is filed these will be the calls from Kenyans and TNA/URP sections . From what I have heard, there were rampant irregularities from which one can deduce the election was flawed. The Court by way of the petition will be called to make a judgement on that matter. These are just that hearsay, rumors and propaganda calls and not unless they can be substantiated then they should be treated as such . Mind you in this age of information people can come up with all sorts of allegations but does this amount to the truth ,certainly no. Case in point is the Muthaura's case if you keenly followed the press briefing , Muthauras defence pointed out the shortcomings of basing cases on hearsay and rumors where Muthaura had to go through hell/nightmare only for his case to be dropped due to unreliable and a lying witness . What I know is that Uhuruto will not be allowed to grab power, if it is established that the election was stolen. That establisment can only be made by the Supreme Court. UhuRuto are not grabbing nor plan to grab any power - These are the President elect and his deputy and its the citizens of Kenyans albeit majority of them by 50.07% who bestowed the mantle to them to lead the country the nearest opponent was defeated by more than 800 000 votes a majority that is more than the voters of say a province like Coast who came out to vote - Can we respect the will of the Kenyan people - It is irresponsible to claim that by voting for UhuRuto is tantamount to grabbing power

The Intergovernmental Authority on Development (Igad) has said the Independent Electoral and Boundaries Commission (IEBC) was largely “transparent and professional” despite facing challenges during the elections. Igad, an eight-member regional bloc to which Kenya is party, said on Wednesday the manner in which the elections were conducted should be a model for adopting by other countries. “We laud the Chairman, the Commissioners and the entire staff of the IEBC for the transparent and professional manner in which they conducted the process despite some challenges. “The election day demonstrates to the region and the whole world the democratic maturity in Kenya,” said Igad secretary general Mahboub Maalim. Mr Maalim also praised the work of the media and congratulated President-elect Uhuru Kenyatta and his Deputy President-elect William Ruto for winning the elections and wished them well in fulfilling their pre-election pledges to Kenyans. The bloc thinks that Kenya’s conduct of the elections in turning out in large numbers and remaining peaceful throughout the period indicates a changing pattern on the continent which would eventually guarantee stability. “Peace and stability in this country will guarantee progress and prosperity of the entire region,” he told reporters in Nairobi. “Kenyans have shown high level of maturity. The people of Kenya carried the day.” Mr Kenyatta was declared the winner of the General Election after collecting 50.07 per cent of the votes cast. But that result is now the subject of a court challenge by his close opponent Raila Odinga. I do not recall previously any Kenya leader at the presidential level who has experienced such blatant strong worded rejection have you Kamalet? besides that I see a problem with this tag hanging our president elect and his deputy as an albatross. It will take a lot or PR work to clean up the image of the two... I am concerned that Bostwana stance may light up a fire that the two don't want as at this moment... The gist of the Botswana's Foreign Affairs Minister whose position is equivalent to our own Sam Ongeri is If President elect and his deputy stop co-operating with ICC . See below the excerpt. " Mr Skeleman said he expected Mr Kenyatta and deputy president- elect William Ruto, who is also facing similar charges, will cooperate with the ICC. " Similarly by hoping that Botswana will be a trend setter on " denouncing " Presidient elect Uhuru and his deputy is just wishful thinking point to note is that we are through with the campaign period where such statements would have "dented" the prospects of a UhuRuto win and coming to think of it If the so called US/UK warning of choice consequence's never did and infact majority of Kenyans went on and elected Uhuruto on Mar 04 as their president and deputy. Horth, Remember the saying not all popular "leaders" are great leaders oftenly used to describe Hitler . Prof Kaloki contested on a Wiper Democratic Movement ticket and garnered 79,513votes against Prof Kibwana’s 146,534. Among the close to 300 leaders were former MPs Kiema Kilonzo, Grace Mwewa, Agnes Ndetei, Jackson Mwalulu, Peter Kiilu and MP elect Rachael Nyamai, (Kitui South). We want a conducive environment for the new Government to thrive and that is why we are supporting the President-elect," said Prof Kaloki, who served as the secretary of the Wiper Parliamentary Group in the last Parliament. The group argued that there is always a winner and loser and that CORD can proceed with the court case if it has evidence. “So far we have not seen any evidence so we are here to congratulate the president elect rather than going out there to look for evidence that is not there,” said Prof Kaloki. The leaders said the decision was meant to show direction to their community. Omwange, in tonight's news I saw fake or paid for congratulatory messages coming from several envoys (I remember India but there were several nations represented). There were also meetings between the president elect, his deputy, & KE's security apparatus. These guys are gaining traction & legitimacy whilst Raila is busy preparing a doomed petition. It was even announced that the erstwhile office of the PM at former Shell & BP House will in future serve as the office of the Deputy President....Wa! b6k, A colleague of mine who is a diplomat and I working as private citizens with a deep love and desire for the best for our country spent the better part of 3 days beginning last Tuesday working our respective diplomatic contacts representing several countries. Those are the things that matter not some irrelevant and meaningless announcement as to where a Ruto or anyone else will have their offices. You have no basis whatsoever other than your own imagination to say Raila's petition is "doomed" and I say so authoritatively because I know what's in the petition and there is no way anyone with any sense of law and facts who reads and analyzes it cannot but conclude it will result in a unanimous ruling granting its prayers. That, you can take to the bank. Monday March 11, 2013 - After President elect Uhuru Kenyatta and his entire Jubilee team criss-crossed the country and made a lot of promises to various groups, some Muslim Clerics at the Coast feel it is now time for them to deliver on their promises. The Clerics have called on President elect Uhuru Kenyatta to put politics aside and embrace every corner of this country. They warned Uhuru from segregating the Coastal region in his development agenda by the fact that Coast was generally Raila Odinga’s CORD stronghold. She said some witnesses were refusing to testify before the court. “The witnesses that had conveyed evidence have been killed or died others refuse to speak to the prosecutor,” Bensouda said. “We do not feel there are reasonable chances of condemnation at the moment of the trial,” she said. However, Pre Trial Chamber V Presiding Judge Kuniko Ozaki told Bensouda that dropping Muthaura’s case will have major consequences on Uhuru Kenyatta’s case as well.
